Delhi excise policy case: Supreme Court refuses to entertain BRS leader K Kavitha's bail plea

The Indian Supreme Court on Friday (Mar 22) refused to entertain the bail plea of Bharat Rashtra Samithi (BRS) leader K Kavitha who was arrested in the money laundering case linked to the Delhi excise policy irregularities matter, the news agency ANI reported. Kavitha, through her lawyer P Mohith Rao, had moved the Supreme Court on March 18 challenging her arrest by the Enforcement Directorate (ED) in the case.
On Friday, the apex court remarked that it has to follow a uniform policy for all and can't allow people to approach the top court directly for bail as they are a political person, the news agency ANI reported. The court added that Kavitha, 46, can move a trial court or invoke any other remedy for the grant of bail and bail application, if any is filed, be decided expeditiously.

Kavitha was arrested by the ED on March 15 and she is in the central agency's custodial interrogation for seven days till Saturday. The 46-year-old BRS leader was arrested following a search operation at her residence in Hyderabad.
Earlier this week, the ED claimed that Kavitha allegedly conspired with the top leaders of the Aam Aadmi Party (AAP), including Delhi Chief Minister Arvind Kejriwal and jailed former deputy chief minister Manish Sisodia to get favours in the Delhi excise policy formulation and implementation.

The agency said that Kavitha was involved in paying $11.99 million (around Rs 100 crores) to AAP leaders in exchange for these favours.
In her petition, the BRS leader challenged her remand saying the remand order doesn't adhere to Article 141 which states that the law declared by the Supreme Court shall be binding on all courts within the territory of India. Kavitha also challenged Section 19 (1) of the Prevention of Money Laundering Act (PMLA).
Meanwhile, on Thursday (Mar 21) night, Kejriwal was arrested by the ED in connection with the excise policy case. The Supreme Court will soon hear Kejriwal's petition against his arrest.
