Following his arrest last night in connection to the money laundering case linked to the Delhi excise policy scam, a Delhi court on Friday remanded Delhi Chief Minister (CM) and Aam Aadmi Party (AAP) leader Arvind Kejriwal into the custody of the Enforcement Directorate (ED) until March 28. Special Judge Kaveri Baweja at the Rouse Avenue court issued the remand order after considering arguments from both the ED and Kejriwal's legal representatives. The ED had requested a ten-day custody of Kejriwal.

Shashi Panja, a leader from the Trinamool Congress, denounced the Bharatiya Janata Party (BJP) for detaining Arvind Kejriwal, stating it violated the model code of conduct. Panja suggested that BJP's actions, like arresting the Delhi Chief Minister, reflected their frustration over not achieving the 400-seat goal in the Lok Sabha elections.

Samajwadi Party chief Akhilesh Yadav said, "These are govt institutions, they'll do what the govt wants. This is the question that in a democracy the institutions work as the instrument and they're working as an instrument to please the BJP... Whoever holds the power uses these institutions. Previously also, whoever was in power used these institutions and now the BJP is doing it ten times more. What remains the credibility of these institutions?..."

Singhvi said that Kejriwal's name is not even mentioned in 50 percent of the statements and 80 percent people did not mention any of Kejriwal's dealings in this case.
He questioned what was the need for the ED to arrest Kejriwal in March 2024 and said that the entire remand application is a copy-paste of the written grounds of arrest.
"ED says that further money trail has to be found, how did this become the basis for arrest. This can at best be a basis for questioning, not arrest," the lawyer added.
"ED now has a new method. First arrest them, then make them government witnesses and get desired statements. In return they get compensation. Democracy is the foundation of the Constitution. Today, an attempt is being made to deliberately make the party inferior to other parties by arresting it before the elections. ED does not have any solid basis to explain why the arrest is necessary."

Now as the ED side has already made its arguments, senior lawyer Abhishek Manu Singhvi, representing the Delhi CM in the case, is presenting his arguments.
He said that remand is not given just like that and the court has to be convinced. "ED will have to prove how a case is being made here under PMLA," he added.
Singhvi argued that ED should prove why there is a need to arrest Kejriwal. He argued that if ED has the power to arrest, it does not mean that they will use this power in the same manner.
"It is the first and only time that a sitting chief minister has been arrested... Four senior leaders of his party are arrested... This means before even the first vote is cast, the results are there," the lawyer said added.

ASG representing ED said that Aam Aadmi Party benefited from this scam and CM Kejriwal is the beneficiary in the same.
He also argued that Kejriwal is not only an accused in this case in his personal capacity, but due to his big role in AAP, he also has responsibility in this case.
"But the party has no personal status of its own. According to law it will be treated like a company. Whoever is the executive of this company is involved in its functioning.. the blame lies on him in this case too," he said.
He lamented that Kejriwal has willfully disobeyed the summons. "The conduct of disobeying the summons... At the times of search he did not give correct facts. We need remand so that interrogation can be done," he added.

Senior advocate Abhishek Manu Singhvi mentioned Delhi CM Arvind Kejriwal's plea for an urgent hearing. He said to the Supreme Court that "if this process goes on, before the first vote is cast, a lot of senior leaders will be behind bars. Please take it up.”
