A jury found Friday that celebrity tattoo artist Kat Von D did not violate a photographer’s copyright when she used his portrait of Miles Davis as the basis for a tattoo she put on the arm of a friend.

The Los Angeles jury deliberated for just over two hours before deciding that the tattoo by the former star of the reality shows Miami Ink and LA Ink was not similar enough to photographer Jeffrey Sedlik’s 1989 portrait of the jazz legend that she needed to have paid permission.

“I’m obviously very happy for this to be over,” Von D, who inked her friend’s arm with Davis as a gift about seven years ago, said outside the courtroom. “It’s been two years of a nightmare worrying about this, not just for myself but for my fellow tattoo artists.”

The eight jurors made the same decision about a drawing Von D made from the portrait to base the tattoo on, and several social media posts she made about the process, which were also part of Sedlik’s lawsuit. They found that the tattoo, drawing and posts also all fell within the legal doctrine of fair use of a copyrighted work, giving Von D and other tattoo artists who supported her and followed the trial a resounding across-the-board victory.

“We’ve said all along that this case never should have been brought,” Von D’s attorney Allen B. Grodsky said after the verdict. “The jury recognised that this was just ridiculous.”

Sedlik’s attorney Robert Edward Allen said they plan to appeal. He said the images, which both featured a close-up of Davis gazing toward the viewer and making a “shh” gesture, were so similar he didn’t know how the jury could reach the conclusion they did.

“If those two things are not substantially similar, then no one’s art is safe,” Allen said.

He told jurors during closing arguments earlier Friday that the case has “nothing to do with tattoos.”

“It’s about copying others’ protected works,” Allen said. “It’s not going to hurt the tattoo industry. The tattoo police are not going to come after anyone.”

Allen emphasized the meticulous work Sedlik did to set up the shoot, to create the lighting and mood, and to put Davis in the pose that would make for an iconic photo that was first published on the cover of JAZZIZ magazine in 1989. Sedlik registered the copyright in 1994.

And he said that subsequently, licensing the image to others including tattoo artists was a major part of how he made his living.

Von D said during the three-day trial that she never licenses the images she recreates, and she considers work like the Davis tattoo a form of “fan art.”

“I made zero money off it,” she testified. “I’m not mass-producing anything. I think there is a big difference.”

Her attorney Grodsky emphasized for jurors that that lack of an attempt to cash in on the image was essential to the tattoo being a form of fair use, an exception in copyright law used for works including commentary, criticism and parody.

Allen argued in his closing that the social media posts about the tattoo were a promotion of her and her studio, and thus a form of monetizing the image.

If jurors had sided with Sedlik, they could have awarded him as little as a few hundred dollars or as much as $150,000.

Von D was among the stars of the reality series Miami Ink then was the featured artist on its spinoff LA Ink, which ran on TLC from 2007 to 2011.

The 41-year-old Von D, whose legal name is Katherine von Drachenberg, was already a prominent young tattoo artist when she became a TV personality through her appearances on TLC’s Miami Ink starting in 2005 on TLC. She was the central star of its spinoff, LA Ink, which ran from 2007 to 2011 and made her possibly the most famous tattoo artist in the country.

Von D said that despite the victory, she’s not enthused about getting back to work.

“I think I don’t want to ever tattoo again, my heart has been crushed through this in different ways,” she said. “We’ll see with time.”

Both the divas, who are often considered rivals in the hip-hop scene, have new offerings for their fans. While Nicki is launching Pink Friday-inspired press-on nails in January, Carbi has teamed up with Starco to launch new limited-edition strawberry-flavoured Whipshots. The announcements for both products were recently made on social media by the two rappers.

Taking to social media on Sunday, Cardi B and Starco announced the arrival of a much-anticipated limited-edition flavour—Strawberry Whipshots, just in time for Valentine's Day. Starco shared the news highlighting the significant demand from fans for this particular flavour.

This release marks the brand's fourth limited-edition offering, following the success of Peppermint, Pumpkin Spice, and Lime flavours introduced since the brand's inception in December 2021. Strawberry Whipshots is now available both online and at select retail locations nationwide.

Sharing a campaign picture on Instagram featuring Cardi B, the brand wrote, "Sweet meets sexy meets your creamiest cravings. Looking for your new favourite flavour? The answer is right in your hands... (or Cardi’s, for that matter!)." Check it out below!

Taking to Twitter to share her excitement, Minaj teased fans with the promise of more to come, saying, “Wait ‘til y’all see the rest. Like, they are the ACTUAL nails I wear designed by my ACTUAL nail tech, and I made my partner do them over three times! I said if I don’t want to wear them, I’m not going to even ATTEMPT to sell them to my fans [because] they’re not stupid. (sic)”

Addressing a fan's concern about nail beds, Minaj responded emphatically, “That s**t triggers me [SO] BAD! Ugh! Babe, when I say down to the tiniest nail beds, that’s what I mean. The biggest to the smallest. We don’t segregate in [Gag City].”

Minaj also shared the inspiration behind the launch, revealing that her experience with motherhood influenced the decision. “I experienced [being too busy to go to the salon], and it got so much more hectic once I became a mom. I can’t sit there for as long as I used to when I only had me to worry about, so it became almost a necessity for me to create some fly, quality press-on nails.”

Fans can expect not only stylish and quality nails but also more from Nicki Minaj in the coming months. The rapper is set to embark on her “Pink Friday 2 World Tour” in March, commencing in Oakland, California, and including stops in Baltimore, Charlotte, Philadelphia, Boston, and Chicago. American rapper Cardi B and Trinidadian rapper Nicki Minaj are having a great start to 2024 as entrepreneurs.
In addition to his work on Good Fortune, Reeves announced a collaboration with author China Miéville on a novel titled The Book of Elsewhere earlier this month. The novel, expected to be published in July, draws inspiration from BRZRKR, a comic book series co-created by Reeves in 2021 with co-writer Matt Kindt and artist Ron Garney.

Renowned actor Keanu Reeves, 59, was seen on the set of his latest film, Good Fortune, walking with crutches and wearing an ice pack around his knee during a break. The actor, known for his roles in The Matrix and John Wick series, was photographed in Los Angeles alongside co-star Seth Rogen, 41. Reeves was dressed in a beige trench coat, grey trousers, a white button-down, and a green tie when he was seen walking at the movie set with crutches while his co-star Rogen seemed focused on his phone. The viral photos have raised questions about Reeves' condition, prompting inquiries that remain unanswered as neither Reeves nor Lionsgate, the studio behind the film, has responded to requests for more information. Concerned fans have been taking to social media to inquire about the actor's health, with one writing, "Why is he walking like that? Is he injured?" Another wrote, "Did he inure himself during an action scene? Or is it for a scene? Anyways, I am worried." A third user commented, "Are you okay? What's happening?" The comedy film's premise has been kept under wraps, adding an air of anticipation to the project. Lionsgate Motion Picture Group Chair Joe Drake expressed enthusiasm about the film when it was announced in April 2023, stating, “We have indeed found good fortune with this film.” Despite the promising start, production faced a hurdle in May due to a writers' strike, leading to a temporary suspension. Palmer, 30, gave fans a behind-the-scenes glimpse of the film on Tuesday, sharing selfies with Reeves, Ansari, and Rogen. The Emmy winner's Instagram post revealed some spontaneous fun on set during a pool scene that turned into an impromptu pool party. "Having so much fun with these amazing guys on the set of our film 'Good Fortune' — we had a pool scene today that lowkey turned into a real pool party hahaha! Working with Aziz something spontaneous always happens," captioned Palmer. The collection aimed to challenge societal perceptions towards insects and encourage a deeper appreciation for their beauty.

For her show-stopping moment, Ananya dazzled in a butterfly-inspired black mini-dress that effortlessly blended sophistication with avant-garde flair. The statement piece included a giant sieve adorned with delicate butterfly motifs, creating a whimsical yet elegant ensemble. Complementing her attire, Ananya opted for a sleek hair bun and donned stylish black high heels.

Taking to her Instagram Stories, Ananya shared a video snippet from the show with a caption that read, "Walking for @rahulmishra_7 at Paris Couture week."

Bollywood's rising star, Ananya Panday, took centre stage as she graced the runway as the showstopper for designer Rahul Mishra at the ongoing Paris Haute Couture Week 2024. The 24-year-old actress not only turned heads but also made history as the youngest Bollywood actress to walk the prestigious ramp in the City of Lights. Ananya Panday showcased Rahul Mishra's latest collection, titled "Superheroes," which drew inspiration from the intricate world of insects, featuring elements inspired by butterflies, beetles, snakes, and more.
Norman Jewison, the acclaimed and versatile Canadian-born director whose Hollywood films ranged from Doris Day comedies and Moonstruck to such social dramas as the Oscar-winning In the Heat of the Night, has died at age 97.

Jewison, a three-time Oscar nominee who in 1999 received an Academy Award for lifetime achievement, died “peacefully” Saturday, according to publicist Jeff Sanderson. Additional details were not immediately available.

Throughout his long career, Jewison combined light entertainment with topical films that appealed to him on a deeply personal level. As Jewison was ending his military service in the Canadian Navy during World War II, he hitchhiked through the American South and had a close-up view of Jim Crow segregation. In his autobiography “This Terrible Business Has Been Good to Me,” he noted that racism and injustice became his most common themes.

“Every time a film deals with racism, many Americans feel uncomfortable,” he wrote. “Yet it has to be confronted. We have to deal with prejudice and injustice or we will never understand what is good and evil, right and wrong; we need to feel how ‘the other’ feels.”

He drew upon his experiences for 1967’s In the Heat of the Night, starring Rod Steiger as a white racist small-town sheriff and Sidney Poitier as a Black detective from Philadelphia trying to help solve a murder and eventually forming a working relationship with the hostile local lawman.

James Baldwin condemned the film’s “appalling distance from reality,” and thought the director was trapped in a fantasy of racial harmony that would only heighten “Black rage and despair.” But The New York Times’ Bosley Crowther was among the critics who found the movie powerful and inspiring and in a year featuring such landmarks as The Graduate and Bonnie and Clyde, Jewison’s production won the Academy Award for Best Picture while Steiger took home the best actor Oscar. (Jewison lost out for best director to Mike Nichols of “The Graduate”).

Among those who encouraged Jewison while making In the Heat of the Night: Robert F. Kennedy, whom the director met during a ski trip in Sun Valley, Idaho.

“I told him I made films and he asked what kind I make,” he recalled in a 2011 interview with The Hollywood Reporter. “So I told him that I was working on ‘In the Heat of the Night’ and that it’s about two cops: one a white sheriff from Mississippi and the other a black detective from Philadelphia. I told him it was a film about tolerance. So he listened and nodded and said ‘You know, Norman, timing is everything. In politics, in art, in life itself.’ I never forgot that.”

He received two other Oscar nominations: For Moonstruck, the beloved romantic comedy for which Cher won an Academy Award, and Fiddler on the Roof, the classic musical about a Jewish village in Russia that Jewison has said was offered to him under the mistaken belief he was Jewish.

His other notable films included the Cold War spoof The Russians Are Coming, The Russians Are Coming the Steve McQueen thriller The Thomas Crown Affair and a pair of movies featuring Denzel Washington: the racial drama A Soldier’s Story and The Hurricane, starring Washington as wrongly imprisoned boxer Rubin “Hurricane” Carter.

A third project with Washington never made it to production. In the early 1990s, Jewison was set to direct a biography of Malcolm X, but backed out amid protests from Spike Lee and others that a white director shouldn’t make the film. Lee ended up directing.

Five Jewison films received the best Oscar nominations: In the Heat of the Night, The Russians Are Coming, The Russians Are Coming, Fiddler On the Roof, Moonstruck and A Soldier’s Story.

Jewison and his wife Margaret Ann Dixon (nicknamed Dixie) had three children, sons Kevin and Michael and daughter Jennifer Ann, who became an actress and appeared in the Jewison films “Agnes of God” and “Best Friends.” The Jewisons were married for 51 years, until her death in 2004. He married Lynne St. David in 2010.

Jewison, honoured by Canada in 2003 with a Governor General’s Performing Arts Award, remained close to his home country. When he wasn’t working, he lived on a 200-acre farm near Toronto, where he raised horses and cattle and produced maple syrup. He founded the Canadian Film Centre in 1988 and for years hosted barbecues during the Toronto Film Festival.

The Toronto-born Jewison began acting at age 6, appearing before Masonic lodge gatherings. After graduating from Victoria College, he went to work for the BBC in London, then returned to Canada and directed programs for the CBC. His work there brought offers from Hollywood and he quickly earned a reputation as a director of TV musicals, with stars including Judy Garland, Danny Kaye and Harry Belafonte. Jewison shifted to feature films in 1963 with the comedy 40 Pounds of Trouble, starring Tony Curtis and Suzanne Pleshette.

The director’s light touch prompted Universal to assign him to a series of comedies, including The Thrill of It All, which paired Day with James Garner, and Send Me No Flowers, starring Day and Rock Hudson. Wearying of such scripts, Jewison used a loophole in his contract to move to MGM for 1965’s The Cincinnati Kid, a drama of the gambling world starring McQueen and Edward G. Robinson. He followed with The Russians Are Coming, The Russians Are Coming, which starred Carl Reiner and Eva Marie Saint and was the breakthrough film for Alan Arkin.

His other films included F.I.S.T., a flop with Sylvester Stallone as a Jimmy Hoffa-style labour leader; ...And Justice for All (1979), with Al Pacino fighting a crooked judicial system; and In Country, featuring Bruce Willis as a Vietnam War veteran. His most recent work, the 2003 thriller The Statement, starred Michael Caine and Tilda Swinton and flopped at the box office.

“I never really became as much a part of the establishment as I wanted to be,” he told The Hollywood Reporter in 2011. “I wanted to be accepted. I wanted people to say ‘that was a great picture.’ I mean I have a big ego like anyone else. I’m no shrinking violet. But I never felt totally accepted — but maybe that’s good.”

Marlena Shaw, the jazz and R&B vocalist whose “California Soul” was one of the defining soul songs of the late 1960s, has died. She was 81.

Shaw’s daughter, Marla Bradshaw, announced the singer’s death Friday in a video posted on Facebook. A cause of death was not given.

“It’s with a very heavy heart for myself and my family I announce that our beloved mother, your beloved icon and artist Marlena Shaw has passed away today at 12:03,” Bradshaw said in the video. “She went very peacefully, and she went listening to some of her favourite songs.”

Shaw, a charismatic and wide-ranging vocalist, was best known for 1969’s “California Soul,” which has endured as a widely popular and often sampled song. Gang Starr, Stereo MC and Diplo (who remixed it) are just a handful of the artists who have sampled it.

A man was arrested on Saturday for allegedly attempting to break into Taylor Swift's Tribeca apartment in New York City. According to a report, the New York Police Department responded to a call about a "disorderly person" on Franklin Street, where officers were informed that the individual had attempted to open a door to a building at the location, as confirmed by a NYPD spokesperson.

While police did not confirm the suspect's identity or explicitly state that he was trying to enter Swift's residence, eyewitnesses claimed otherwise. One witness recounted seeing the individual around 1 p.m., going up to Taylor Swift's door. The witness was unsure if the man had knocked or rang the doorbell. This eyewitness also revealed that the suspect had been seen in the neighbourhood, particularly around Swift's residence, for several weeks.

A second source, residing nearby, shared exclusively with Page Six that they had observed the same man "lurking here for a month," engaging in disruptive behaviour such as sleeping on the stoop, chain-smoking, shouting, and making everyone uncomfortable. The neighbour claimed to have called the police multiple times, with no significant action taken until the suspect attempted to break into the building.

Upon police arrival at approximately 1:45 p.m. ET, officers engaged in a civil conversation with the alleged stalker before taking him into custody. The bearded individual, with shaggy brown hair, was photographed during the booking process wearing a tan hoodie, khaki pants, a navy blue jacket, and tan gloves.

The Indian and Pakistani sports communities were left in shock as cricketer Shoaib Malik announced his marriage to Pakistani actress Sana Javed on Saturday on social media. The revelation confirmed longstanding rumours about trouble in Shoaib's marriage to Indian tennis star Sania Mirza.

While divorce speculations circulated for months, Shoaib's post ended the ambiguity surrounding their relationship. Later, in a conversation with PTI, Sania Mirza's father, Imran Mirza, confirmed that his daughter had opted for a 'Khula' from the cricketer. "It was a 'Khula.' I do not wish to comment beyond this," he stated.

What is a Khula?

Khula is a Muslim woman's right to unilaterally seek a divorce. In Islam, it grants women the option to terminate a marriage. After separation, the husband remains responsible for the education and financial support of the children, who typically reside with the mother until reaching a certain age.

Wives may seek Khula for various reasons, such as abuse, neglect, irreconcilable differences, financial neglect, prolonged absence of the husband, emotional dissatisfaction, or differing life goals.

In a Khula, the wife typically makes a formal request to the husband for the dissolution of the marriage. The husband has the right to agree to the Khula or negotiate terms, which may include financial arrangements, return of dowry, or other conditions. Once an agreement is reached, the marriage is considered dissolved.

Similar to Talaaq, there is a waiting period, known as 'iddah, in the case of Khula. The 'iddah period serves various purposes, including determining if the wife is pregnant and providing time for reflection and potential reconciliation. During the 'iddah period, the wife cannot remarry.

Khula is rooted in Islamic jurisprudence and is considered a right granted to women to protect their well-being and provide them with the means to seek a divorce when necessary. The process aims to ensure fairness and equity in the dissolution of the marital contract. The specifics of Khula may vary based on cultural practices and interpretations within different schools of Islamic thought.

How is it different from Talaaq?

Talaaq, also spelt as Talaq or Talaqah, is an Arabic term that refers to divorce in Islamic law. It is a legal and religious procedure by which a Muslim man can unilaterally end his marriage by pronouncing the word "Talaaq" three times. This is known as the Triple Talaaq.

In Islamic jurisprudence, the husband initiates the divorce by verbally stating "Talaaq" three times, either in a single sitting or over an extended period, adhering to certain rules and waiting periods. After the pronouncement of each Talaq, there is an obligatory waiting period known as 'iddah, during which the wife cannot remarry. The purpose of 'iddah is to ascertain if the wife is pregnant and to allow time for reconciliation.

It's important to note that while talaaq is permissible in Islam, the process and conditions surrounding it are subject to interpretations and vary among different schools of Islamic jurisprudence. Additionally, there are ongoing discussions and reforms in various Muslim-majority countries regarding the legal procedures and implications of talaaq, especially in cases of triple talaaq, to ensure fairness and protection of the rights of women.

In a recent legal move, actor Charlie Sheen, 58, has taken steps to reinforce the safety and well-being of his 14-year-old twin sons, Max and Bob, whom he shares with ex-wife Brooke Mueller. Documents filed in an ex parte motion on Thursday detail new stipulations surrounding child custody, specifically addressing concerns related to Mueller's sobriety.

Obtained by PEOPLE, the court documents reveal Sheen's request for the court to sign and enter two previously agreed-upon documents without a legal response from Mueller, 46. The agreement, first signed in November 2022 and later reinforced in August 2023, outlines conditions for child custody in the event of Mueller's relapse.

The documents state that in the case of Mueller's relapse, there would be an "immediate reversion of sole custody and sole physical custody to [Sheen]." The agreement further states that the two will "continue to enjoy joint legal custody" unless Mueller tests positive for drugs and alcohol or otherwise relapses. At that point, Sheen would have sole custody "until further court order or written agreement of the Parties," and this could happen on as little as 48 hours' notice.

The documents outline the terms for physical custody, stating that Mueller is entitled to "reasonable and flexible periods of custody and visitation," ensuring frequent contact between the minors and both parents.

To monitor Mueller's sobriety, the agreement mandates weekly drug and alcohol testing, as well as additional testing as required by her probation officer or upon Sheen's request. Termination of custody for Mueller is immediate in the event of a positive test, and a missed test is considered equivalent to a positive result.

Sheen, who recently celebrated six years of sobriety after his own struggles, is currently financially supporting Mueller, including paying her rent.
