French luxury powerhouse Hermes finds itself embroiled in legal turmoil as it faces an antitrust class action lawsuit in California, centring on allegations of restricting the sale of its coveted Birkin handbags to customers deemed to have "sufficient purchase history" with the brand.
The lawsuit, filed in San Francisco federal court by two California residents, accuses Hermes of engaging in anticompetitive practices by tying the sale of Birkin bags to the purchase of other merchandise.
According to the plaintiffs, Hermes's sales associates are instrumental in perpetuating this scheme, pressuring customers to buy additional items such as shoes, scarves, and jewellery to qualify for the opportunity to purchase a Birkin bag.
The lawsuit highlights the Birkin handbag's esteemed status as an "icon of fashion," symbolising prestige and exclusivity within the luxury sphere.
Despite its renown, Birkin bags are not available for online purchase, and Hermes retail stores refrain from openly displaying them for sale.
The lawsuit sheds light on the secretive nature of Birkin bag sales, alleging that only customers deemed worthy are granted access to view these coveted items, often in private settings.

Hermes sales associates, the complaint asserts, are not incentivised by commissions on Birkin bag sales but are instead instructed to leverage these sought-after handbags as a means to coax consumers into purchasing ancillary products.
The proposed class action lawsuit seeks to represent thousands of US consumers who have either purchased Hermes goods or have been coerced into buying them in pursuit of acquiring a Birkin bag.
Hermes, renowned for its commitment to craftsmanship and exclusivity, has yet to issue a response to the allegations levelled against it in the lawsuit.
With approximately 43 stores across the United States, including eight in California, the luxury brand faces mounting pressure to address the accusations of anticompetitive behaviour.
The plaintiffs seek unspecified monetary damages and a court injunction to halt Hermes's purportedly unfair practices, signalling their intent to challenge the luxury giant's grip on the distribution of its iconic Birkin bags.
