<p>"The Court’s concern is less that the State has failed to allege sufficient conduct of the Defendants – in fact, it has alleged an abundance. However, the lack of detail concerning an essential legal element is, in the undersigned’s opinion, fatal," McAfee wrote in Wednesday’s order.</p>

<p>"As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited," McAfee added. "They do not give the Defendants enough information to prepare their defenses intelligently, as the Defendants could have violated the Constitutions and thus the statute in dozens, if not hundreds, of distinct ways."</p>

<p>The attack, which took place in the United States city of Lithonia, was caught on camera where the assailant later identified as 53-year-old Julian Faulkner was seen beating Saini to death with a hammer.&nbsp;</p>

<p>Prior to the attack, employees at the Chevron Food Mart told police that for nearly two days, they had been allowing a homeless man to come in and out of their store.&nbsp;</p>

<p>One of the employees, who wished to be unidentified, told WSB-TV that Faulkner would ask for coke and chips and they would give him “everything including the water".</p>

<p>They added, “He asked if I could get a blanket. I said we don’t have blankets so I gave him a jacket. He was walking in and out asking him for cigarettes, water and everything.”&nbsp;</p>

<p>The employee also told the media outlet that the 53-year-old would sit in the store “all the time” and they never asked him to leave since it was so cold. &nbsp;&nbsp; &nbsp;</p>

<p>However, after a couple of days, Saini, who reportedly worked part-time at the store as a clerk, on Tuesday (Jan 16), just after midnight, asked Faulkner to leave, or he would call the police. As the Indian student was preparing to leave, police said he was attacked by the 53-year-old.&nbsp;</p>

<p>“He hit him from the back then he kept on hitting for almost 50 times on the face on the head,” the employee told the news channel. The police found Faulkner standing over Saini’s lifeless body. He was pronounced dead at the scene.</p>

<p>“Can’t even describe what I’m feeling. We were always trying to be helpful and we never expected this sort of thing would happen,” the employee told WSB-TV.</p>

<p>So far, the investigators have found that Faulkner reportedly beat the victim with a hammer, causing his death. Another store clerk who witnessed the attack helped the investigators by providing them with the camera footage.&nbsp;</p>

<p>Vivek Saini, a 25-year-old whose family hails from the Indian state of Haryana had gone to the US two years ago and had recently earned an MBA degree.</p>

<p>Faulkner was arrested on the spot and remains in DeKalb County Jail. He has since been charged with felony murder and interference with government property.</p>

<p>Amid the ongoing investigation, it was also revealed that the officers who arrested the 53-year-old also found two knives and another hammer on him.</p>

<p>After the incident&nbsp;made headlines across India, the Consulate General of India in Atlanta, released a statement condemning the attack in the "strongest terms" and said it is in touch with the victim's family.&nbsp;</p>

<p>"We are deeply anguished by the terrifying, brutal, &amp; heinous incident that led to the death of (Indian)&nbsp;National/student Mr Vivek Saini &amp; condemns attack in the strongest terms. It is understood that the US authorities have arrested the accused &amp; are investigating the case," said the Indian&nbsp;consulate in Atlanta, in a post on X.&nbsp;</p>

<p>The department contacted Greene's private security detail to assure her safety and that there was no emergency at her apartment.&nbsp;</p>

<p>Russia has signed a deal with the breakaway Georgian region of Abkhazia to set up a naval base on the Black Sea coast, its leader announced Thursday (Oct 5). The move comes as Moscow pulls out its Black Sea fleet from Crimea, likely because of increased missile and drone attacks from Ukraine.</p>

<p>Aslan Bzhania, the leader of the separatist region, said that an agreement had been signed for a permanent naval base in the Ochamchira region. "We have signed an agreement, and in the near future there will be a permanent base of the Russian Navy in the Ochamchira district," Bzhania was quoted as saying by Izvestiya newspaper.</p>

<p>"This is all aimed at increasing the level of defence capability of both Russia and Abkhazia, and this kind of interaction will continue," he said, adding, "There are also things I can't talk about."</p>

<p>Telegraph newspaper reported, citing British intelligence, that the Russian Black Sea Fleet is “struggling to deal with concurrent threats on the southern flank of the Ukraine war” and “fleet activities are likely relocating to Novorossiysk in the face of threats to Sevastopol”.</p>

<p>Georgian security services said the deputy chief of Ukraine's military counterintelligence and Georgia's former deputy interior minister, Giorgi Lortkipanidze, were plotting "destabilisation aimed at a violent overthrow of the government."</p>

<p>It said Georgians fighting Russian forces in Ukraine, including a bodyguard of Georgia's jailed ex-president Mikhail Saakashvili, were among the conspirators being trained near Ukraine's border with Poland.</p>

<p>Kobakhidze said the government had sent a letter denying her permission to hold the meetings. Zourabichvili did not immediately respond directly, but posted a photo of herself on Instagram, holding a smartphone and smiling.</p>

<p>Kobakhidze accepted that impeachment would be unlikely to succeed as Georgian Dream, which only has a simple majority in parliament, would need to attract votes from opposition parties.</p>

<p>A former French diplomat of Georgian descent, Zourabichvili was elected to Georgia's mostly ceremonial presidency in 2018 with Georgian Dream's backing.</p>

<p>She has since broken with the party, which she has repeatedly accused of being pro-Russian and insufficiently committed to Georgia joining the European Union and the U.S.-led NATO defence alliance. Georgian Dream says it wants Georgia to join both blocs.</p>

<p>In March, Zourabichvili said she would veto a controversial bill to require non-government organisations (NGOs) receiving more than 20% of their funding from abroad to register as "foreign agents". Critics said the bill was inspired by Russian laws used to crush dissent and in the end it was withdrawn.</p>

<p>The European Union, which last year declined to give Georgia candidate status alongside Ukraine and Moldova, has repeatedly warned that a deepening of authoritarianism could derail Georgia's EU application.</p>

The officials called Idalia and its dangerously high-surging waters 'a once-in-a-lifetime event' for the area around northwest Florida. No deaths were reported in Florida due to the hurricane and Florida Governor Ron DeSantis emphasised "that very well may change," given the storm's magnitude.</p>

The National Hurricane Centre (NHC) said that the water levels were more than six feet above normal in Cedar Key, as a number of Florida islands jutted into the Gulf of Mexico, and said that the coastal waters were increasing rapidly.</p>

<p>Few Floridians also suggested that they had dodged a bullet as the projected ferocity of Idalia diminished. <p>Donald Trump's former lawyer Rudy Giuliani has been issued a default judgment and ordered to pay sanctions of nearly $133,000 in a defamation and civil conspiracy lawsuit brought by two Georgia election workers.&nbsp;</p>

<p>The workers, Ruby Freeman and Wandrea'&nbsp;ArShaye Moss, claimed that Giuliani had defamed them by alleging the mishandling of ballots in the 2020 presidential election.</p>

<h2><strong>Penalty for 'wilful misconduct'</strong></h2>

<p>US District Judge Beryl Howell imposed the 'default' judgment and monetary penalty after Giuliani repeatedly failed to comply with orders to turn over electronically stored documents and evidence sought by the two election workers' lawyers.</p>

<p>CNBC reports that Judge Howell criticised Giuliani for "wilful... misconduct" and "slippery" statements, failing to fulfil his obligations under the legal proceedings known as discovery.&nbsp;</p>

<p>In her 57-page opinion, the Judge said: "The bottom line is that Giuliani has refused to comply with his discovery obligations and thwarted plaintiffs Ruby Freeman and Wandrea' ArShaye Moss’s procedural rights to obtain any meaningful discovery in this case."</p>

<p>The judge's ruling emphasised Giuliani's failure to comply with discovery requests and ordered him to personally pay the plaintiffs $89,172.50 as reimbursement for their attorneys' fees and costs associated with their motion to compel evidence. Additionally, two of Giuliani's companies were ordered to pay the plaintiffs $43,684 for the same conduct.</p>

<p>She has also ordered Giuliani and the plaintiffs' lawyers to propose three trial dates in the US District Court in Washington, DC, to determine the amount of compensatory and punitive damages he should pay due to the&nbsp;judgment.</p>

<p>Howell's ruling also referred to Giuliani's recent criminal indictment in Georgia related to alleged attempts to overturn the 2020 election results.</p>

<p>Raffensperger said in his testimony that Meadows facilitated the call, which occurred after the Secretary of State's office had conclusively found there was no widespread fraud in Georgia. The federal government has no role in administering state elections, Raffensperger said.</p>

<p>Meadows lawyer George Terwilliger said during closing arguments that the bar is “extremely low” for federal officers to move their cases to federal court. “The tie doesn’t go to the state,” Terwilliger said.</p>

<p>Jones said he would issue a written order as soon as possible but noted that the case raised novel legal questions. "Some of the things I rule on might set precedent for future cases," he said.</p>

<p>Trump's arraignment is set for September 6 at 9:30 am ET, making him the first among the defendants to face proceedings in a comprehensive racketeering case. This case alleges that they participated in a criminal enterprise aimed at maintaining Trump's hold on power.</p>

<p>Fulton County Superior Court Judge Scott McAfee has staggered the arraignment times for all the defendants, with each given a 15-minute interval.</p>

<p>During these arraignment hearings, the defendants will formally hear the charges brought against them and enter their pleas. In Trump's previous three criminal cases, he has pleaded not guilty to all charges.</p>
