<p>"President Trump summoned the mob, assembled the mob and lit the flame of this attack," the Republican vice chairwoman of the panel, Liz Cheney, said in her opening remarks at the first in a series of hotly anticipated summer hearings.</p>

In that tweet, Trump criticised former vice president Mike Pence for announcing that he would not overturn the results of the 2020 election while presiding over the joint session of Congress to certify Joe Biden's win.</p>

<p>A former top adviser to ex-US president has been charged with contempt of Congress. Peter Navarro, faces a charge of refusing to cooperate with the House of Representatives committee investigating the Jan. 6, 2021, attack on the U.S. Capitol. Announcement about the contempt charges was made by the Justice Department on Friday.</p>

<p>A federal grand jury charged Navarro with one count involving his refusal to appear for a deposition before the Jan. 6 Select Committee and another for his refusal to produce documents in response to a subpoena, justice&nbsp;department said.</p>

<p>During his 72-minute hearing before magistrate, Navarro did not enter a plea. The hearing was in the US District Court for the District of Columbia. Navarro accused the US Justice Department of "prosecutorial misconduct" for arresting him at a local airport</p>

<p>Navarro said authorities ignored his request for them to contact an attorney and refused to allow him to make a phone call during his arrest. "I am … disappointed in our republic," he told the judge. His next court appearance was set for June 17.</p>

<p>"The existence of evil is one of the very best reasons to arm law-abiding citizens," he said during an event in Houston attended by almost two thousand people.</p>

<p>Suggesting ways to improve security in schools, Trump said that every school should have a single point of entry, strong fencing, and metal detectors, adding there should also be a police official or an armed guard at all times in every school.</p>

<p>Although NRA's influence has waned as it has become mired in legal battles linked to a corruption scandal, it is still considered the most powerful gun rights organisation in the country that has rejected most initiatives to prevent mass shootings, including expanded background checks on gun purchases.</p>

<p>The Texas shooting has reignited the tinderbox debate about US gun control with Democrats calling for harsh control laws to prevent such incidents.</p>

<p>Instead of passing laws to tighten gun control, Republicans in Washington have suggested "hardening" schools with beefed up security.</p>

<p>According to the Gun Violence Archive, there have been 214 mass shootings this year in just five months in the United States, with a racist massacre at a supermarket in a Black neighborhood of Buffalo just 10 days before the Texas killings.</p>

<p>A state appeals court in New York on Thursday asked former US president Donald Trump and two of his adult children to testify under oath by the New York attorney general’s civil investigators who are probing fraud business practices by his firm, Trump Organization.</p>

<p>The appeals court rejected Trump’s plea that sought relief from being compelled to answer.</p>

<p>The decision is a major blow to Trump who has been trying to avoid the probe by New York Attorney General Letitia James into the Trump Organization’s “fraudulent or misleading” valuations of assets like golf courses and skyscrapers to get loans and tax benefits.</p>

<p>A four-judge panel also upheld Manhattan Judge Arthur Engoron’s February 17 ruling, which enforced subpoenas requiring that Trump and his two eldest children — Ivanka and Donald Jr. — give deposition testimony in Attorney General Letitia James’ probe.</p>

<p>“The existence of a criminal investigation does not preclude civil discovery of related facts, at which a party may exercise the privilege against self-incrimination,” the appellate panel wrote, citing the Fifth Amendment to the US Constitution and other legal protections for witnesses, AP news agency reports.</p>

<p>Meanwhile, James welcomed the ruling, saying that her investigation “will continue undeterred because no one is above the law.”</p>

<p>New York state's Supreme Court on April 25 had ordered Trump to pay $10,000 a day for as long as he refused to provide accounting and tax documents.&nbsp;</p>

<p>It was part of a civil investigation, which was led by the Attorney General of the state, Letitia James, against the Trump Organization family business.&nbsp;</p>

<p>A spokesperson for James's office stated: "On May 19, Donald Trump paid the attorney general's office $110,000." According to James' spokesperson, the Trump camp also had until Friday to submit sworn statements relating to the Trump Organization's request for accounting and tax records.&nbsp;</p>

<p>As reported by news agency AFP, these documents were indeed collected and produced by a third-party firm on Thursday, according to the same source.&nbsp;</p>

<p>“I strongly supported Obama for President,” Elon Musk tweeted late last month, part of the spree of ideological comments accompanying his continuing takeover of Twitter, “but today’s Democratic Party has been hijacked by extremists.” Around the same time, he set the social-media platform ablaze by reposting a cartoon showing a stick figure comfortably on the center-left in 2008 redefined as a right-wing bigot by 2021 because the left-wing stick figure had raced way off to the left. Then this week, he expressed the same kind of thought in the abbreviated style for which the site is famous: “Twitter obv has a strong left wing bias.”</p>

<p>And now, at last, we have the news that he’s likely to allow Donald Trump to tweet freely once again.</p>

<p>All of these comments and promises align the country’s richest man with the rightward side in our culture war. But though I don’t know Musk — I’ve never interviewed him or hung out with him in any secret billionaire lair — I think I know enough about him, and I know enough Silicon Valley people like him, to suggest that neither his tweeted self-descriptions nor the criticisms being lobbed his way capture what’s distinctive about his position and worldview.</p>

<p>A term like “conservative” doesn’t fit the Tesla tycoon. Even “libertarian,” while closer to the mark, associates Musk with a lot of ideas that I don’t think he particularly cares about. A better label comes from Virginia Postrel, in her 1998 book “The Future and Its Enemies”: Musk is what she calls a “dynamist,” meaning someone whose primary commitments are to exploration and discovery, someone who believes that the best society is one that’s always inventing, transforming, doing something new.</p>

<p>If you think this sounds uncontroversial, think again. First, the dynamist may not care where novelty and invention spring from. Unlike the purist libertarian, he might be indifferent to questions of public versus private spending, happy to embrace government help if that’s what it takes to get the new thing off the ground — and happy to take that help from regimes like Communist China no less than from our own. And he may be willing to risk much more than either the typical progressive or the typical conservative for the sake of innovation. Political principle, social stability and moral order are all potentially negotiable when discovery alone is your North Star.</p>

(I am personally a dynamist about Musk’s Mars colony but not Mark Zuckerberg’s metaverse; flying cars, yes, sex robots, not so much.) Even in the tech world, your appetite for dynamism depends on where you stand: If you’re lucky enough to work for one of Silicon Valley’s near-monopolies, the new powers of the age, you may not be that interested in further churn or change.</p>

<p>Musk himself may yet evolve into that kind of comfortable monopolist, but for now, pending the IPO for MarsCorp in 2047, he remains a dynamist in full. And seen in this light, his recent transformation from Obama Democrat to progressive foil makes perfect sense in light of the transformations that liberalism itself has undergone of late.</p>

<p>Liberalism in the Obama era was an essentially dynamist enterprise not because liberals were absolutely committed to capital-S Science but because those years encouraged a confidence that the major technological changes of the 21st century were making the world a more liberal place. Whether it was social media shaking Middle Eastern autocrats, the Obama campaign running circles around its Republican opponents with online organizing or just the general drift leftward on social issues that seemed to accompany the internet revolution, progressives around 2010 felt a general confidence that technological and political progress were conjoined.</p>

<p>Ever since Trump bent history’s arc his way, however, that confidence has diminished or collapsed. Now liberals increasingly regard the internet as the zone of monsters and misinformation, awash in illiberalism, easily manipulated by demagogues, a breeding ground for insurrectionists. And if digital technology has become particularly suspect, via the transitive property, so has the larger idea of innovating your way out of social or environmental problems — empowering the part of the environmental movement that wants to tame capitalism to save the planet, for instance, at the expense of the part that imagines taming climate change with fleets of Teslas and nuclear power plants.</p>

<p>Meanwhile, the values underlying dynamism — above all, the special pedestal given to free thinking and free speech — are also more suspect within liberalism today. In their place is a new regulatory spirit around culture as well as economics, a how-much-is-too-much attitude toward the circulation of potentially dangerous ideas, a belief in institutions of scientific and intellectual authority but not necessarily institutions devoted to wide-open inquiry.</p>

<p>Just as a dynamist might, at the extreme of the orientation, prefer a monarchy that protects innovation over a democracy that discourages it, some of today’s progressives are making the same move in reverse: If democracy is endangered by technological change and unfettered free speech, then so much the worse for free speech. The important thing is to save democratic self-government, even if you have to temporarily take the “liberties” out of the American Civil Liberties Union or put away your John Stuart Mill.</p>

<p>Whatever else Musk wants with Twitter — and obviously you should assume that he wants to make a lot of money — this seems like the ideological trend he hopes to resist or halt: the liberal retreat from dynamism, the progressive turn toward ideological regulation, the pervasive left-wing fear that the First Amendment and free speech are being weaponized by authoritarians and need some kind of check.</p>

<p>So now the question: If this was your ambition — setting aside whether you think it’s admirable or dangerous — would buying Twitter make sense?</p>

<p>The affirmative theory holds that because Twitter is both an essential digital town square and a place particularly populated by well-educated liberals, if Musk can make it succeed with a lighter-footprint approach to content moderation, from a dynamist perspective he might hope to accomplish two goals at once. First, he would be simply sustaining an important space in which free debate can happen. Second — assuming that he could come up with a light footprint that left-leaning users would accept — he would be gently training Twitter’s liberals back into their Obama-era belief that openness and dynamism are good things, that a marketplace of ideas can work without constant ideological supervision and constraint.</p>

<p>The more skeptical theory, on the other hand, suggests that Musk may be making a mistake somewhat characteristic of the Silicon Valley mentality and overestimating the importance of novel virtual spaces compared with the legacy institutions — East Coast, brick and mortar, academic and bureaucratic — that still give contemporary liberalism its actual shape and direction. That is to say, what you see on Twitter, the fads and mobs and performativity, may accelerate certain ideological transformations, but social media isn’t actually the place where these shifts are taking shape; it’s just the space in which the change becomes visible and legible to people on the outside.</p>

<p>So, for instance, if important media institutions are more doubtful about free speech than in the past, or if important academic fields are more likely to impose ideological loyalty oaths, or if important foundations and funders are creating a climate of intellectual conformity, a social media town platform is too far downstream of those changes to really help reverse them.</p>

<p>A free-speech-oriented Twitter can certainly surface individuals or even small-scale factions offering diversity and dissent. But institutions of employment and ambition will always matter most — there’s no app-based solution or simple blockchain fix if you think the Ivy League and the mainstream media have gone terribly astray. At some point you need to make change within those institutions themselves, start new ones — the Musk Schools! the Musk Herald-Tribune! the Musk Foundation! — or do both.</p>

<p>Since a big part of Musk’s success and wealth comes from looking for tech’s applications in the real world — meaning cars, rockets and tunnels, not just apps and tweets — it’s quite possible that he’s already considered all of this and that he has an ultimate vision for a Twitter as a virtual network that links reformed or revitalized institutions in the real world.</p>

<p>Or alternatively, maybe he believes that very soon the virtual will fully displace the world of bricks and bodies and that in buying Twitter he’s literally buying the digital real estate where his fellow dynamists will build the great institutions of tomorrow.</p>

<p>It’s one of dynamism’s strengths as a guiding ideology that it can inspire those kinds of leaps. But its weakness is usually the same one that doomed Icarus. Sometimes you leap and have a bird’s wings to bear you upward. Sometimes, though, all you have is their disintegrating feathers — or, still worse, not their plumage but their tweets.</p>

But though I don’t know Musk — I’ve never interviewed him or hung out with him in any secret billionaire lair — I think I know enough about him, and I know enough Silicon Valley people like him, to suggest that neither his tweeted self-descriptions nor the criticisms being lobbed his way capture what’s distinctive about his position and worldview. A term like “conservative” doesn’t fit the Tesla tycoon. Even “libertarian,” while closer to the mark, associates Musk with a lot of ideas that I don’t think he particularly cares about. A better label comes from Virginia Postrel, in her 1998 book “The Future and Its Enemies”: Musk is what she calls a “dynamist,” meaning someone whose primary commitments are to exploration and discovery, someone who believes that the best society is one that’s always inventing, transforming, doing something new. If you think this sounds uncontroversial, think again. First, the dynamist may not care where novelty and invention spring from. Unlike the purist libertarian, he might be indifferent to questions of public versus private spending, happy to embrace government help if that’s what it takes to get the new thing off the ground — and happy to take that help from regimes like Communist China no less than from our own. And he may be willing to risk much more than either the typical progressive or the typical conservative for the sake of innovation. Fauci made it clear on Sunday that he will resign from his position if Trump is re-elected as President in 2024.</p>

<p>Fauci, who has served under seven US Presidents till date and was a vocal critic of the former president’s handling of COVID-19, said during his CNN interview that he will leave as the director of the National Institute of Allergies and Infectious Diseases if Trump wins the elections in 2024.</p>

'Never say never', says Melania Trump when asked if she wants to be US first lady again

<p>The House committee probing the January 6 attack on the US Capitol has subpoenaed five Republican members of the Congress who refused to cooperate when the panel asked them to meet.</p>

<p>This is the first time that a bipartisan investigating committee has issued subpoenas to the sitting members of Congress.</p>

<p>The subpoenas have been issued to House minority leader, Kevin McCarthy, Jim Jordan of Ohio, Scott Perry of Pennsylvania, Andy Biggs of Arizona and Mo Brooks of Alabama.</p>

<p>The committee is seeking to compel the Republican members of Congress to share some of the most sensitive information about former president Donald Trump’s efforts to overturn the 2020 election, The Guardian reported quoting sources.</p>

<p>In letters sent on Thursday to the subpoenaed lawmakers, the committee said, “You declined voluntary cooperation, and we are left with no choice but to issue you a subpoena.”</p>

<p>“The Select Committee has learned that several of our colleagues have information relevant to our investigation into the attack on January 6th and the events leading up to it,” said the committee’s chairman, Bennie Thompson, serving as the US representative&nbsp;for Mississippi, in a press release.</p>

'Can't you just shoot them': New book makes explosive claim about Donald Trump's handling of protests

<p>A New York Police Department (NYPD) veteran, Thomas Webster, has been convicted of assault during the infamous United States Capitol Hill riot.</p>

<p>The 20-year NYPD veteran was convicted of assaulting a police officer during the riots by a federal jury, on Monday.</p>

<p>Webster, 56 has been found guilty on all six counts in his indictment, including that of assaulting Metropolitan Police Department officer Noah Rathbun with a metal flagpole.&nbsp;</p>

<p>Webster's self-defence argument as per an AP report was rejected on the basis of two videos of his assault on Rathbun.</p>

<p>Even before any physical contact was made, Rathbun's body camera video recorded the NYPD veteran yelling profanities at him. According to Webster, he was exercising his right to free speech by yelling at officers.</p>

But in the weeks since the Manhattan district attorney, Alvin Bragg, stopped presenting evidence to the jurors about Trump, new signs have emerged that the former president will not be indicted in Manhattan in the foreseeable future — if at all.</p>

<p>At least three of the witnesses once central to the case have either not heard from the district attorney’s office in months or have not been asked to testify, according to people with knowledge of the matter.</p>

<p>In recent weeks, a prosecutor at the Manhattan District Attorney’s Office who played a key role in the investigation has stopped focusing on a potential case against Trump, other people with knowledge of the inquiry said — a move that followed the resignation earlier this year of the two senior prosecutors leading the investigation.</p>

<p>And the remaining prosecutors working on the Trump investigation have abandoned the “war room” they used to prepare for their grand jury presentation early this year, the people said, leaving behind an expansive office suite and conference room on the 15th floor of the district attorney’s office in Lower Manhattan.</p>

<p>The grand jury’s expiration at the end of the month does not preclude prosecutors from impaneling another jury, but the developments underscore the reduced possibility that Trump will face charges under Bragg, who along with several other prosecutors had concerns about proving the case. Some people close to the inquiry believe that it will not result in an indictment of the former president unless a witness cooperates unexpectedly — a long shot in an investigation that has been running for more than three years.</p>

<p>In an interview this month, Bragg said that his prosecutors were interviewing new witnesses and looking at additional evidence. He declined to provide details, citing grand jury secrecy law, but said that the inquiry must be allowed to run its course.</p>

<p>“It’s a work in progress,” Bragg said, adding later, “We’ve got seasoned prosecutors working every day. It’s not going to be on a timeline.”</p>

<p>But impaneling a new grand jury could create challenges for any potential case. Trump’s lawyers could argue — and a judge might agree — that prosecutors were inappropriately hunting for a more favorable group of jurors.</p>

<p>Just weeks after their departure, Solomon Shinerock, one of the key prosecutors on the team, stopped investigating Trump. Shinerock, who for years was the lead assistant district attorney in the investigation, pulled back in part because it appeared to be winding down, two of the people familiar with the inquiry said.</p>

<p>The Daily Beast first reported that Shinerock was no longer actively involved in the investigation.</p>

<p>While Shinerock is not investigating Trump, he is still working on a Trump-related case. In July, Manhattan prosecutors indicted the Trump Organization and its longtime chief financial officer, Allen Weisselberg, accusing them of a yearslong tax evasion scheme.</p>

<p>Shinerock is playing a central role in preparing for that trial, and, given that role, is participating in meetings in which the investigation into Trump is discussed, a person with knowledge of the meetings said.</p>

<p>In the interview this month, Bragg said that no one had left the Trump team since Dunne and Pomerantz. Asked this week to clarify his remarks, Bragg’s spokesperson stood by them, saying that there was one “dedicated team working on the indicted tax case and the Trump investigation.”</p>

<p>The team is led by Susan Hoffinger, an experienced prosecutor whom Bragg appointed to lead the office’s investigations division.</p>

<p>The spokesperson, Danielle Filson, said in a statement that the team included “lawyers who have worked on the case for years and skilled new prosecutors with decades of experience and fresh eyes.”</p>

<p>She declined to say how many prosecutors and other staff are assigned to the team investigating Trump, but said it was “actively probing unexplored avenues.”</p>

Likelihood of Trump indictment in Manhattan fades as grand jury wraps up

<p>Democratic lawmakers on Wednesday released a report alleging that top Trump administration officials awarded a $700 million pandemic relief loan to a struggling trucking company in 2020 over the objections of career officials at the Defense Department.</p>

<p>The report, released by the Democratic staff of the House Select Subcommittee on the Coronavirus Crisis, describes the role of corporate lobbyists during the early months of the pandemic in helping to secure government funds as trillions of dollars of relief money were being pumped into the economy. It also suggests that senior officials such as Steven Mnuchin, the former Treasury secretary, and Mark Esper, the former defense secretary, intervened to ensure that the trucking company, Yellow Corp., received special treatment despite concerns about its eligibility to receive relief funds.</p>

<p>“Today’s select subcommittee staff report reveals yet another example of the Trump administration disregarding their obligation to be responsible stewards of taxpayer dollars,” Rep. James Clyburn, D-S.C., the chairman of the subcommittee, said in a statement. “Political appointees risked hundreds of millions of dollars in public funds against the recommendations of career DOD officials and in clear disregard of provisions of the CARES Act intended to protect national security and American taxpayers.”</p>

<p>The $2.2 trillion pandemic relief package Congress passed in 2020 included a $17 billion pot of money set up by Congress and controlled by the Treasury Department to assist companies that were considered critical to national security. In July 2020, the Treasury Department announced it was giving a $700 million loan to the trucking company YRC Worldwide, which has since changed its name to Yellow.</p>

<p>Lobbyists for Yellow had been in close touch with White House officials throughout the loan process and had discussed how the company employs teamsters as its drivers, according to the report.</p>

<p>Mark Meadows, the White House chief of staff, was a “key actor” coordinating with Yellow’s lobbyists, according to correspondences that the committee obtained. The report also noted that the White House’s political operation was “almost giddy” in its effort to assist with the application.</p>

<p>The loan raised immediate questions from watchdog groups because of the company’s close ties to the Trump administration and because it had faced years of financial and legal turmoil. The firm had lost more than $100 million in 2019 and was being sued by the Justice Department over claims that it had defrauded the federal government for a seven-year period. It recently agreed to pay $6.85 million to resolve allegations “that they knowingly presented false claims to the U.S. Department of Defense by systematically overcharging for freight carrier services and making false statements to hide their misconduct.”</p>

<p>To qualify for a national security loan, a company needed certification by the Defense Department.</p>

<p>According to the report, defense officials had recommended against certification because of the accusations that the company had overcharged the government. They also noted that the work that the company had been doing for the federal government — which included shipping meal kits, protective equipment and other supplies to military bases — could be replaced by other trucking firms.</p>

<p>But the day after a defense official notified a Treasury official that the company would not be certified, one of Mnuchin’s aides set up a telephone call between him and Esper.</p>

<p>Following the call, Esper certified that the company was critical to national security and a week later the approval of the loan was announced.</p>

<p>Mnuchin then sent an email to Meadows that included news reports praising the loan. He highlighted positive comments from James Hoffa, the longtime president of the Teamsters union, who according to documents in the report made a direct plea to President Donald Trump about the loan.</p>

<p>Mnuchin and Esper declined to comment.</p>

<p>At a congressional oversight hearing before leaving office in late 2020, Mnuchin said the loan was appropriate and necessary for saving jobs and maintaining trucking services to the Defense Department. Lawmakers from both parties, such as Sen. Ron Wyden, D-Ore., and Pat Roberts, the Republican former senator from Kansas, had sent letters to Mnuchin urging him to consider the loan application.</p>

<p>Yellow had many connections to the Trump administration. The company had financial backing from Apollo Global Management, a private equity firm with close ties to administration officials. The report, released by the Democratic staff of the House Select Subcommittee on the Coronavirus Crisis, describes the role of corporate lobbyists during the early months of the pandemic in helping to secure government funds as trillions of dollars of relief money were being pumped into the economy. It also suggests that senior officials such as Steven Mnuchin, the former Treasury secretary, and Mark Esper, the former defense secretary, intervened to ensure that the trucking company, Yellow Corp., received special treatment despite concerns about its eligibility to receive relief funds. “Today’s select subcommittee staff report reveals yet another example of the Trump administration disregarding their obligation to be responsible stewards of taxpayer dollars,” Rep. James Clyburn, D-S.C., the chairman of the subcommittee, said in a statement. “Political appointees risked hundreds of millions of dollars in public funds against the recommendations of career DOD officials and in clear disregard of provisions of the CARES Act intended to protect national security and American taxpayers.” The $2.2 trillion pandemic relief package Congress passed in 2020 included a $17 billion pot of money set up by Congress and controlled by the Treasury Department to assist companies that were considered critical to national security. In July 2020, the Treasury Department announced it was giving a $700 million loan to the trucking company YRC Worldwide, which has since changed its name to Yellow. Lobbyists for Yellow had been in close touch with White House officials throughout the loan process and had discussed how the company employs teamsters as its drivers, according to the report. Mark Meadows, the White House chief of staff, was a “key actor” coordinating with Yellow’s lobbyists, according to correspondences that the committee obtained. The report also noted that the White House’s political operation was “almost giddy” in its effort to assist with the application. The loan raised immediate questions from watchdog groups because of the company’s close ties to the Trump administration and because it had faced years of financial and legal turmoil. The firm had lost more than $100 million in 2019 and was being sued by the Justice Department over claims that it had defrauded the federal government for a seven-year period. It recently agreed to pay $6.85 million to resolve allegations “that they knowingly presented false claims to the U.S. Department of Defense by systematically overcharging for freight carrier services and making false statements to hide their misconduct.” To qualify for a national security loan, a company needed certification by the Defense Department. According to the report, defense officials had recommended against certification because of the accusations that the company had overcharged the government. They also noted that the work that the company had been doing for the federal government — which included shipping meal kits, protective equipment and other supplies to military bases — could be replaced by other trucking firms. But the day after a defense official notified a Treasury official that the company would not be certified, one of Mnuchin’s aides set up a telephone call between him and Esper. Following the call, Esper certified that the company was critical to national security and a week later the approval of the loan was announced. Mnuchin then sent an email to Meadows that included news reports praising the loan. He highlighted positive comments from James Hoffa, the longtime president of the Teamsters union, who according to documents in the report made a direct plea to President Donald Trump about the loan. Mnuchin and Esper declined to comment. At a congressional oversight hearing before leaving office in late 2020, Mnuchin said the loan was appropriate and necessary for saving jobs and maintaining trucking services to the Defense Department. As Elon Musk buys Twitter, netizens have something to say about Donald Trump

<p>A New York judge on Monday held Donald Trump in contempt of court for failing to turn over documents to the state’s attorney general, an extraordinary rebuke of the former president.</p>

<p>The judge, Arthur F. Engoron, ordered Trump to comply with a subpoena seeking records and assessed a fine of $10,000 per day until he satisfies the court’s requirements. In essence, the judge concluded that Trump had failed to cooperate with the attorney general, Letitia James, and follow the court’s orders.</p>

<p>“Mr. Trump: I know you take your business seriously, and I take mine seriously,” Engoron remarked, before holding Trump in contempt and banging his gavel.</p>

<p>The ruling represents a significant victory for James, whose office is conducting a civil investigation into whether Trump falsely inflated the value of his assets in annual financial statements.</p>

<p>In January, James, a Democrat, said her office had concluded that the Trump Organization had engaged in “fraudulent or misleading” practices involving the statements. But she said she would continue to investigate before deciding whether to sue Trump or his company.</p>

<p>Although James does not have the authority to file criminal charges, her civil inquiry is running parallel to a criminal investigation led by the Manhattan district attorney, Alvin Bragg, who is examining some of the same conduct.</p>

<p>James’ office is participating in that separate investigation, which had appeared to be nearing an indictment of Trump earlier this year, before Bragg raised concerns about prosecutors’ ability to prove their case. Bragg, also a Democrat, inherited the inquiry from his predecessor after taking office Jan. 1.</p>

<p>The ruling Monday presents a roadblock for Trump as he continues to battle the attorney general’s investigation. James has sought to question the former president and two of his children, Ivanka Trump and Donald Trump Jr., as part of her inquiry and attorneys for the Trump family are seeking to block the questioning. (In the fall of 2020, James questioned another of Trump’s children, Eric Trump, as part of her investigation.)</p>

<p>In March, Engoron sided with James, ordering Trump and his children to be deposed. The Trumps have appealed that ruling.</p>

<p>This month, lawyers from James’ office called for Trump to be held in contempt and assessed a daily fine of $10,000 as long as he continued to not cooperate. They said Trump had declined to turn over documents in response to eight separate requests. Trump’s attorneys had said the requests were “grossly overbroad,” and did not “adequately” describe the requested materials.</p>

<p>Last week, one of Trump’s attorneys, Alina Habba, said in a document filed with the court that Trump did not have any of the documents that James had requested. Any such documents, if they existed, would be in the possession of the Trump Organization, she said.</p>

<p>She added that James had filed the motion for contempt without warning, “seemingly in an effort to turn this matter into a public spectacle.”</p>

<p>But James has said that at least some of Trump’s documents have yet to be turned over. In one filing, her lawyers mentioned a file cabinet that had been held at the company and contained the former president’s files, and noted that he used Post-it notes to pass messages to employees.</p>

<p>According to James, Trump’s attorney said that a file of Trump’s correspondence had not been searched, in part because the business had determined that Trump was not involved in preparing his own financial statements.</p>

<p>James called that assertion improbable, and referred to a statement affixed to the financial statements that says: “Donald J. Trump is responsible for the preparation and fair presentation” of the valuations.</p>

<p>In a separate case in federal court, Trump sued James, seeking to halt her civil inquiry and have her removed from the Manhattan district attorney’s criminal investigation. That case is ongoing.</p>
