The Delhi High Court on Wednesday (December 24) expressed its frustration with the government's failure to reduce the Goods and Services Tax (GST) on air purifiers, despite the severe air pollution crisis in the city. The court sharply questioned why air purifiers continue to be taxed at the highest slab of 18%, even as the air quality in Delhi reaches hazardous levels, endangering the health of its residents. The bench, comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela, was hearing a public interest litigation (PIL) filed by advocate Kapil Madan. The petition calls for the reclassification of air purifiers as medical devices, which would bring them under the lower 5% GST rate. The PIL argues that air purifiers, which are essential for breathing clean air, should not be considered luxury items. The petition says that access to air purifiers has become indispensable for health and survival, especially for people with respiratory conditions, children, and the elderly. According to the petition, the 18% GST is placing an unnecessary financial burden on the public, making it harder for people to afford devices that are crucial for mitigating the life-threatening effects of air pollution. Also Read: Jamia suspends professor over 'atrocities against Muslims' question in semester exam In a sharp rebuke, the Delhi High Court questioned the government’s request for more time to respond to the issue. The bench remarked, “What is ‘in due time’? When thousands of people die?” highlighting the urgency of the matter. The judges emphasised that the government had failed to provide citizens with clean air, despite the ongoing pollution crisis. “The least you can do is give them access to air purifiers,” they added. The court further suggested that the government consider exempting air purifiers from GST temporarily, under the National Security Act, to address the current air emergency. The judges made it clear that the government could not continue to delay action on this pressing issue. They asked the government counsel to seek instructions from the authorities and present a concrete proposal on the matter by 2:30 pm on the same day. In its ruling, the court has urged the government to consider the health implications of continuing to tax essential air purifiers at a high rate, especially in light of the ongoing pollution emergency in Delhi. The judges pointed out that the imposition of high taxes on these life-saving devices was a clear violation of the principle of fairness and justice, particularly when the government has failed to ensure adequate air quality.

Delhi's Environment Minister, Manjinder Singh Sirsa, accused the Aam Aadmi Party (AAP) of intentionally burning garbage to escalate pollution levels in the national capital. Speaking at a press conference, Sirsa claimed, “It pains me to say this, but AAP is purposely setting waste on fire to worsen the air quality. They seem to be hoping the AQI rises. They are indifferent to the people of Delhi and should stop engaging in such dirty politics.” The minister’s accusations came as part of his announcement about new measures to combat the worsening air pollution. He pointed to a particular incident in the Trilokpuri area, where local MLA informed him that an AAP councillor had set fire to a pile of garbage in the area. Sirsa referenced a video shared by AAP councillor Vijay Kumar that showed a heap of burning waste surrounded by smoke amid the already toxic air. “I appeal to Arvind Kejriwal with folded hands, please stop this politics. Your children also live in Delhi. Don’t harm your own people like this,” Sirsa urged. The minister outlined several steps to address the city’s air quality, which had plummeted to dangerous levels. Also Read: PM Narendra Modi arrives in Oman to strengthen strategic and defence ties These measures included a 50% work-from-home mandate, a strict requirement for Pollution Under Control (PUC) certificates, and a ban on vehicles that do not meet Bharat Stage 6 (BS6) emission standards from entering the city. The Supreme Court orally observed on Wednesday that the measures taken by the authorities to curb the rising levels of air pollution in the Delhi-NCR region have been a ‘total failure’ so far and are merely temporary policy decisions aimed at mitigating the health risks. A bench led by Chief Justice of India Surya Kant remarked on Wednesday that any meaningful reduction in air pollution would require broader and long-term planning. While hearing various petitions highlighting the inadequacy of recent measures aimed at protecting children, like the Delhi government’s directives to shut schools or allow them to function in hybrid mode, the top court noted that these were merely temporary policy decisions aimed at mitigating the health risks of severe air pollution. An order issued in this regard read, "keeping in view the prevailing trend of air quality, in an effort to prevent further deterioration of the air quality, the Sub Committee on GRAP hereby decide to invoke all actions under Stage-III ('Severe' Air Quality of Delhi, ranging 401-450) of extant schedule of GRAP, with immediate effect in right earnest by all the agencies concerned in Delhi-NCR, in addition to the Stage-I and II actions already in force." What's causing pollution The change in the wind pattern and winds blowing easterly has further worsened the situation for the PM 2.5 concentrations, which is the predominant pollutant during the winter season and is on increasing trend. Residents of Delhi and the National Capital region are noticing something unusual this December. The expected winter chill has yet to arrive, temperatures remain higher than normal and fog combined with pollution is making the air hazardous for many.

Delhi's former chief minister, Arvind Kejriwal, took a dig at the current CM, Rekha Gupta, over the pollution in the national capital. Gupta remarked that the government was using mist sprayers to contain pollution at hotspots. Kejriwal said in a social media post that Gupta's comments made it clear that the government is working to "hide" the pollution data. 'AQI is temperature'? Kejriwal takes dig at Rekha Gupta over Delhi's pollution row

Despite a slight improvement in the air quality, Delhi's air continued to be in the 'very poor' category on Saturday morning, with the national capital region recording an average AQI of 341, according to the air quality early warning system for Delhi. Air quality improved slightly by 28 points on Friday, with an average AQI of 369. Delhiites have spent around half of November in a toxic smog in the 'very poor' or 'severe' category, with no end to breathing difficulties following the lifting of curbs under the Graded Action Respect Plan-3 (GRAP 3). While people still came out for their daily early morning walks, India Gate and Kartavya Path continued to be blanketed in a layer of toxic smog, recording an AQI of 346. Anand Vihar and Dhaula Kuan also had a layer of smog, while vehicles continued to ply on the roads. According to data from the Central Pollution Control Board (CPCB), Alipur, Anand Vihar, and Aya Nagar recorded AQIs of 319, 354, and 324, respectively, in the 'very poor' category, with PM 2.5 as the predominant pollutant across the National Capital Region (NCR). Industrial areas in the national capital region had a slightly increased AQI than today's average, with Bawana recording 'very poor' air quality at 364 AQI, Narela recording 387 AQI and Okhla Phase 2 having 340 AQI. Meanwhile, the area of Indira Gandhi International Airport (IGI Airport) recorded slightly better Air quality, managing to be in the 'poor' category at 295 AQI. Locals have expressed concern about their health, saying they are experiencing breathing difficulties and eye itching due to deteriorating air quality. Some even expressed concern about volcanic ash that might come from Ethiopia after the volcanic eruption. "Nothing can be seen around here. Today I didn't wear the mask, thinking I could do it, but as soon as I came out, I felt it: my eyes were getting irritated, so I put the mask back on and got out. It is very difficult to live here," Atul, who came to cycle around the Kartavya Path area, told ANI. On the government's response to curbing pollution, the cyclist said, "You can see their efforts on social media, but can't see much on the ground." However, another local, Bhavya Bansal, said he feels the government is working to curb pollution rather than expressing concern over the volcanic eruption. "Pollution is there, but if we see that the government is also working, we could see the work being done. But it seems that from the volcano which has erupted, its ashes could make (air quality) worse," he told ANI. Comparing AQI of other cities, Bansal said that he feels he needs to "stretch his breathing more" here in Delhi, as he told ANI, "Compared to other cities I travel to it seems I have to stretch a lot more to breathe properly here. But right now I am not feeling any health issues." Four days ago, the Commission for Air Quality lifted GRAP 3 measures across Delhi due to the improving air quality, and GRAP 2 measures were implemented across NCR. However, Delhi's air has continued to be in the 'very poor' category. Delhi Chief Minister Rekha Gupta earlier on Friday reaffirmed the government's efforts to curb pollution, saying they are regularly monitoring the situation and taking appropriate steps daily. Speaking to reporters, CM Rekha Gupta said, "The government is monitoring the situation daily and taking appropriate steps regularly to curb pollution. The steps we take today will give results in the future." As for the ash clouds from Ethiopia's Hayli Gubbi Volcano reaching India, environmentalist Vimlendu Jha had said earlier that it will not "immediately impact" Delhi's AQI. "The impact of these clouds might be seen in the Himalayas, the Tarai region (a lowland region of flat, alluvial soil that forms a belt along the Nepal-India border) and even parts of China.", he said. Meanwhile, the problem of air pollution seems to have reached Parliament yet again, with the winter session set to commence on December 1, with the Leader of the Opposition in the Lok Sabha demanding a debate on the air pollution crisis in the house. In an X post, Rahul Gandhi questioned the Centre, alleging "no urgency, plan, or accountability" for the air pollution problem. He wrote, "Every mother I meet tells me the same thing: her child is growing up breathing toxic air. They are exhausted, scared and angry. Modi ji, India's children are choking in front of us. How can you stay silent? Why does your government show no urgency, no plan, no accountability?"Disclaimer: This story has been published from a news agency feed with minimal edits for grammar and punctuation. Delhi has emerged as the most polluted state and Union territory in India, based on a new satellite-based assessment data released by the Centre for Research on Energy and Clean Air (CREA). The national capital registered an annual population-weighted PM2.5 level of 101 micrograms per cubic meter (µg/m 3 ), nearly 2.5 times higher than the national ambient air quality standard of the nation and 20 times higher than the recommended level of the World Health Organisation (WHO). The assessment also shows that the Indo-Gangetic Plains remain the country’s most polluted region. The report also indicated that Delhi remains the worst-affected state in three of the four seasons, with a yearly population-weighted PM2.5 average of 101 µg/m³, 2.5 times the national standard and 20 times the WHO benchmark. Annual satellite analysis discovered that 60 per cent of districts (447 out of 749) cross the NAAQS for the annual PM2.5 level of India, out of which none of these cities fulfil the World Health Organisation (WHO) guideline of 5 µg/m³. In addition, 11 districts of Assam and 11 districts of Delhi collectively account for nearly 50 per cent of the top 50 most polluted districts, followed by Haryana and Bihar with seven each.
Rise in pollution levels during winter
Delhi, Haryana, Himachal Pradesh, Punjab, Tripura, Meghalaya, and Chandigarh showed 100 per cent district-level violations of air-quality limits in every season except the monsoon. PM2.5 breaches are most severe in winter, when 616 out of 749 districts (82 per cent) exceed the national standard. The exceedance remains high in summer with 405 districts (54 per cent), falls sharply during the monsoon to 74 districts (10 per cent), and rises again post-monsoon with 566 districts (75 per cent) recording levels above the norm. Southern states, which maintain annual PM2.5 concentrations below the national limit, have an opportunity to adopt tougher, region-specific standards and move closer to the WHO’s interim air-quality targets.

Delhi remains the worst-affected state in three of the four seasons, with a yearly population-weighted PM2.5 average of 101 µg/m³, nearly 2.5 times the national standard and 20 times the WHO benchmark.

Top 7 Delhi areas with the worst AQI

Delhi woke up to another morning of thick, toxic smog, with air quality showing no significant improvement on Friday (Nov 14). The 24-hour average Air Quality Index (AQI) in the national capital was recorded at 399, one point below the “severe” category after three consecutive days of AQI above the 400 mark. Out of 38 monitoring stations, the Delhi Technological University (DTU) station recorded the best air quality with an AQI of 270 at 7 am, according to the real-time data from the Central Pollution Control Board (CPCB). A total of 25 monitoring stations in the city recorded “severe” air quality, while 11 observed “very poor” AQI.Wazirpur and Chandni Chowk were among the worst-polluted areas with AQI of 447 and 445, respectively. Meteorologists have attributed the bad air quality in Delhi to low wind speeds and unfavourable atmospheric conditions that have trapped pollutants close to the land.Neighbouring regions around Delhi, including Gurugram and Faridabad also recorded an AQI in the “poor” category. While AQI remained in the “very poor category” in Ghaziabad, Noida and Greater Noida on Friday (Nov 14).According to data from the Decision Support System (DSS), stubble burning has remained one of the significant contributors to air pollution in Delhi by increasing the PM2.5 concentration in the city. The city recorded its highest PM2.5 level on November 12, recording 22.4 per cent. However, on Thursday (Nov 13), the levels in the national capital dropped to 12 per cent.
GRAP-3 restrictions in place
Delhi authorities on Tuesday (Nov 11) imposed Stage 3 of the Graded Response Action Plan (GRAP) after the AQI dropped to “very poor”. Under the restrictions, construction and industrial activities are banned, along with restrictions on vehicular emissions.
SC urges lawyers to attend hearings virtually
A day earlier, on Thursday (Nov 13), the Supreme Court expressed concerns over the rising air pollution in the national capital, calling the situation “very, very serious”.“Why are you all appearing here? We have the virtual hearing facility. Please avail it. This pollution... this will cause permanent damage,” Justice Narasimha said during a hearing. He added, “The quality of air in Delhi had reached a point when masks may no longer be enough to protect citizens. The situation is very, very serious.”

Toxic smog continues to blanket Delhi, AQI misses ‘severe’ mark by 1 point

The Central Government on Tuesday initiated the third phase of the Graded Response Action Plan (GRAP). Air Quality in Delhi NCR have deteriorated from 'very poor' to 'severe'. In a statement on Tuesday morning Commission for Air Quality Management (CAQM) said that the sharp increasing trend in AQI of the Delhi NCR region has prompted them to take stricter actions across the city. Delhi's AQI was recorded at 425 on November 11 at 9 am. This is particularly due to the temperature inversion hot air moves up and acts as a lid for the air pollutants. Due to low and stable wind flow, these pollutants get trapped, "…the Sub-Committee today has taken the call to invoke all actions as envisaged under Stage-III of extant GRAP – ‘Severe’ Air Quality (Delhi AQI ranging between 401-450), with immediate effect, in the entire NCR,” said CAQM in a statement. On November 9, activists from various social organisations gathered near India Gate to protest against the Government's inefficiency in tackling the rising pollution level across Delhi NRC.
What are the restrictions under GRAP III?
GRAP puts restrictions on all non-essential construction activity, demolition, stone crusher, mining or transportation of construction or demolition material, all BS III petrol and BS IV diesel LMVs (4-wheelers) in Delhi and in the districts of Gurugram, Faridabad, Ghaziabad and GautamBuddha Nagar. All state governments and the GNCTD are advised to switch to online teaching for classes up to Grade V. Inter-state buses from NCR states other than EVs/CNG/BS-VI diesel are barred from entering Delhi, and initiate intensified mechanised sweeping. There are certain exceptions, such as essential public-funded projects, such as railways, metro construction, airports, defence, sanitation, and healthcare facilities, which are allowed to continue under strict dust and waste management norms.
