<p>A New York appeals court on Thursday refused to delay Donald Trump's scheduled Oct&nbsp;2 civil fraud trial, after the former US president accused the trial judge of wrongly refusing to throw out most of the case.</p>

<p>In a brief order, a five-judge panel of the Appellate Division, a mid-level appeals court in Manhattan, denied Trump's motion to postpone the trial.</p>

<p>It also lifted a Sept. 14 order by Justice David Friedman to put the trial on hold while it considered Trump's motion. Friedman was part of Thursday's panel.</p>

<p>The panel ruled two days after state court Justice Arthur Engoron found that Trump and his family business persistently and fraudulently overvalued his assets and net worth in order to obtain better terms on loans and insurance.</p>

<p>Trump had been sued in September 2022 by state Attorney General Letitia James, who accused him, his adult sons, the Trump Organisation and others of "staggering fraud" in how they valued properties.</p>

<p>James is seeking at least $250 million in penalties, a ban against Trump and his sons Donald Jr and Eric from running businesses in New York, and a five-year commercial real estate ban against Trump and the Trump Organisation.</p>

<p>Lawyers for Trump and the other defendants were not immediately available for comment. James' office had no immediate comment.</p>

<p>The case is unrelated to the four criminal indictments that Trump faces, including for trying to overturn the 2020 presidential election.</p>

<p>Trump has pleaded not guilty to all, and cast litigation against him as part of a politically-motivated, Democratic witch hunt as he seeks a return to the White House. James is a Democrat.</p>

<p>Despite his legal woes, Trump holds a commanding lead for the 2024 Republican presidential nomination.</p>

<h2><strong>Witness lists</strong></h2>

<p>Trump sued Engoron on Sept. 14, seeking to delay the trial and accusing him of ignoring a June ruling from the appeals court that, according to Trump, required gutting James' case because many of her claims were too old.</p>

<p>Engoron's decision on Tuesday showed that he believed the appeals court ruling had little effect on James' case.</p>

<p>The judge said the defendants were living in "a fantasy world, not the real world," as they made up valuations for properties including Trump's Mar-a-Lago compound in Florida and Trump Tower penthouse in Manhattan.</p>

<p>Engoron found "conclusive evidence" that Trump had overstated his fortune by as much as $2.2 billion.</p>

<p>He also ordered the cancellation of certificates that let some of Trump's businesses operate.</p>

<h2><strong>The accusations</strong></h2>

<p>James accused the trio (Trump and his sons) and other Trump Organization executives of lying to tax collectors, lenders, and insurers for years in a scheme that routinely exaggerated the value of their properties.</p>

<p>AFP reported that she asked for a summary judgment, however, seeking that the former president be found liable ahead of the trial and the judge sided with the attorney general.</p>

<p>James is seeking $250 million in penalties and the removal of Trump and his sons from management of the Trump Organization. The New York State attorney general claims that Trump and his associates submitted "grossly inflated" numbers to banks and insurers each year between 2011 and 2021 "to secure and maintain loans and insurance on more favourable terms."&nbsp;</p>

<p>They allegedly fraudulently overvalued the net worth of Trump company assets by billions of dollars, which resulted in hundreds of millions of dollars in ill-gotten savings and profits.&nbsp;</p>

<p>James also alleged that the overvaluation of Trump's assets was between $1.9 billion and $3.6 billion per year.</p>

<h2><strong>'This is a fantasy world'</strong></h2>

<p>New York judge Arthur Engoron ruled on Tuesday that Trump and his lawyers relied on bogus arguments. "In defendants' world: rent-regulated apartments are worth the same as unregulated apartments; restricted land is worth the same as unrestricted land," Engoron said, adding, "This is a fantasy world, not the real world."</p>

<p>Among the properties overvalued -- by between $114 million to $207 million -- was the 77-year-old's apartment in Manhattan's Trump Tower, whose square footage was given as 30,000 square feet when it is 10,996 square feet.</p>

<p>"A discrepancy of this order of magnitude, by a real estate developer sizing up his own living space of decades, can only be considered fraud," the judge said.</p>

<p>In mid-September, Mitt Romney, the Republican Party’s 2012 presidential nominee and a towering figure in the party for decades until he fell out with Trump, echoed Haley’s call for generational change by announcing he would not run for re-election as Utah’s senator.</p>

<p>“At the end of another term, I’d be in my mid-80s,” said Romney, who is 76. “Frankly, it’s time for a new generation of leaders. They’re the ones that need to make the decisions that will shape the world they will be living in.”</p>

<p>Roughly three-quarters of American voters say Biden would be too old to be effective if he won re-election next year. About half of US&nbsp;adults think Trump would be too old for the office. While the age difference is only three years, Biden is widely seen as less vigorous than Trump.</p>

<p>Surveys show that most Americans are uncomfortable with the idea of a re-match between Trump and Biden next year. But barring a political miracle, this is what they will get.</p>

<p>Concern over the age of elected officials in key positions deepened in August when Mitch McConnell, leader of the Republican minority in the Senate, froze for more than 30 seconds, unable to respond to a question. McConnell, who is 81, had a similar episode in July when he froze mid-speech. But after medical exams, the Capitol physician declared him fit to continue working.</p>

<p>The incidents have put a spotlight on the relative age of US&nbsp;lawmakers compared with the median age of all Americans, which, according to recent census data, is 38. In contrast, the median age of senators is 65, the second highest on record, and the median age&nbsp;of members of the House of Representatives is 58, also one of the highest on record.</p>

<p>Which is what prompted Haley, a former governor of South Carolina and Trump’s ambassador to the United Nations, to describe Congress as “the most privileged nursing home in the country.”</p>

<p>The sharp-tongued Haley, one of the country’s most prominent politicians of Indian descent, added: “We need to have mental competency tests for anyone over the age of 75.”</p>

<p>The remarks raised eyebrows but brought into the open what is often termed “Washington whispers” about the age and mental acuity of the country’s lawmakers. The idea of cognitive testing really boils down to the question of how long someone should be allowed to work.</p>

<p>A 1986 law banned mandatory retirement for reasons of age for most professions. There are few exceptions where it is legal to force employees to leave by a specific age. They include commercial airline pilots whose retirement age is 65, though there are efforts to raise it to 67.</p>

<p>In lengthy debates involving pilot unions, airlines and legislators over the implications of the move, one question has never come up in public: would passengers be comfortable flying with a pilot aged 80?</p>

<p>The likely answer – no, thank you – explains the discomfort with the idea that an octogenarian will almost certainly hold one of the world’s most stressful jobs, the US&nbsp;presidency.</p>

<p>To put the aged US&nbsp;leadership in global perspective: as gerontocracies go, it is not in the lead. Iran and the Vatican, for example, are run by men much older than the American leadership. But there was one US&nbsp;senator, Republican Strom Thurmond, who set a record by reaching the age of 100 while in office, a month before retiring in 2003.</p>

<p>Staying with the aviation comparison, I wonder what the passenger’s view would be if told that the senior citizen in the pilot’s seat had an experienced co-pilot 30 years younger. In this scenario, imagine pilot Biden and co-pilot Kamala Harris, now his vice president.</p>

<p>US President Joe Biden Wednesday (Sept 20) said Donald Trump had the best chance to be nominated as the Republic Party’s 2024 candidate. He said this during a fundraiser campaign in New York, further fueling speculations of a possible rematch between the pair.</p>

<p>“He may be the nominee again. It looks like he is destined to be the nominee again,” Biden said.</p>

<p>“I need you. I need every American who loves democracy to join together in 2024. If we do that we have done something few of us have ever done, that is save American democracy,” Biden added.&nbsp;</p>

<p>However, the delay meant that Smith got access to only 32 DMs and the prosecutors let the court know about it.</p>

<p>“Indeed, the materials Twitter produced to the Government included only 32 direct-message items, constituting a minuscule proportion of the total production,” the prosecutors wrote in the newly unsealed brief.&nbsp;</p>

<p>The Elon Musk-owned company put up resistance, arguing that some of Trump’s direct messages might be covered by&nbsp;executive privilege if he was communicating about state business with other administration officials.</p>

<p>In an interview with CBS News, DeSantis said: "I think the chance of getting elected president after being convicted of a felony is as close to zero as you can get."&nbsp;</p>

<p>Republican Senator from Utah Mitt Romney has said that he will not be running for re-election after his Senate term ends in January 2025.</p>

<p>In a video posted on social media platform X, the 76-year-old said that it is time to focus on the new generation of leaders as he will be in his mid-80s if he is elected to a second term.</p>

<p>"They are the ones who need to make the decisions that will shape the world they will be living in," he said on Wednesday (Sept 13).</p>

<p>Later, in an interview with the Washington Post, Romney recalled his young leaders remark as he condemned the party for relying on “populist demagogue” Donald Trump.</p>

<p>“It’s pretty clear that the party is inclined to a populist demagogue message,” he said.</p>

<p>The 2024 elections would be seeing a fierce battle between 80-year-old Joe Biden and 77-year-old Donald Trump.</p>

<h2><strong>Want young leaders to take up reign&nbsp;</strong></h2>

<p>Romney, who ran for president in 2012 against Barack Obama, said that neither leader&nbsp;has&nbsp;led their parties to confront issues facing the country.</p>

<p>"Political motivations too often impede the solutions that these challenges demand," he said in the video.</p>

<p>"The next generation of leaders must take America to the next stage of global leadership."</p>

<p>“We’re probably going to have either Trump or Biden as our next president. And Biden is unable to lead on important matters and Trump is unwilling to lead on important matters,” he told the Washington Post.</p>

<p>Romney, an outspoken critic of Donald Trump, is the only Republican who voted against the former president in his 2020 impeachment trial. He was also one of several Republican senators who voted in favour of impeachment during the second trial following the Jan&nbsp;6 attack on the US Capitol.</p>

Asked to explain his own words about Donald Trump's "abhorrent" behaviour that made him a "danger to democracy", Ramaswamy tip-toed around the question, only to be called out on national TV by the host.&nbsp;</p>

<p>Hasan referred to Ramswamy's January 12, 2021 post on X (formerly known as Twitter), six days after the events of the US Capitol Hill riots where the GOP leader attacked Trump and&nbsp;wrote:&nbsp;“What Trump did last week was wrong. Downright abhorrent. Plain and simple."</p>

<p>Using Ramswamy's words as the departure point, Hasan asked, “Is Donald Trump, as you say now, the best president of the 21st century...Or is Trump, as you’ve said in the past, in your books, on Twitter, a ‘sore loser’, who is a ‘danger to democracy’, and who did ‘downright abhorrent’ and egregious things on January 6’? Which one is he, Vivek?”</p>

<p>Hasan was referring to Ramaswamy's statement from the debate last month wherein he&nbsp;dubbed Trump as the best president of the 21st century.&nbsp;</p>

<p>Replying to Hasan's question, a visibly agitated Ramswamy said Trump was the best president of the 21st century, and that he “would have made the same judgments that he has made every step of the way”.</p>

<p>A Georgia grand jury recommended criminal charges against Republican U.S. Senator Lindsey Graham and other allies of Donald Trump as part of its investigation into efforts to overturn Trump's 2020 presidential defeat, said a report released on Friday.</p>

<p>None were ultimately charged when Georgia prosecutors filed a sweeping criminal case against Trump and 18 alleged co-conspirators.</p>

<p>The special grand jury recommended charges against Graham as well as Georgia's two U.S. senators at the time, Kelly Loeffler and David Perdue, the report said. Like Trump, all are Republicans.</p>

<p>Graham, a Trump rival turned golf buddy, denied wrongdoing and said he was fulfilling his oversight duties as the top lawmaker on the Senate Judiciary Committee when he asked Georgia officials to examine absentee ballots after Trump's defeat.</p>

<p>"We can't criminalize senators doing their job," he said at a news conference in South Carolina on Friday. "The next election, if I have questions I'll do the same thing."</p>

<p>The panel also recommended charges against Trump's former national security adviser Michael Flynn, adviser Boris Epshteyn and lawyers Lin Wood and Cleta Mitchell, the report showed.</p>

<p>It was unclear why Fulton County District Attorney Fani Willis opted not to bring charges against the six people, and her office did not immediately respond to a request for comment.</p>

<p>The six were among 39 people the special grand jury recommended charging in its Dec. 15 report, which had been sealed for nine months. Unlike the final criminal indictment, it did not detail specific allegations.</p>

<p>"This baseless witch hunt isn't based on the facts, or the law, or reality," Flynn's lawyer Jesse Binnall said in a statement. Flynn, a prominent figure on the far right, had urged Trump to use the military to overturn the 2020 election.</p>

<p>A longtime Trump political adviser, Epshteyn was involved in efforts to overturn Trump's loss and has since been advising the former president on the legal threats he now faces. An attorney, Epshteyn declined to comment.</p>

<p>Wood, a conservative lawyer who promoted conspiracy efforts about the election, denied wrongdoing and said he was surprised to learn the special grand jury recommended charges against him. "I'm not quite sure why my name is in it," he told Reuters. He has since retired in the face of disciplinary bar proceedings.</p>

<p>Mitchell, another conservative lawyer who worked to reverse Trump's defeat, did not immediately respond to a request for comment.</p>

<p>The special grand jury convened in 2021 at the request of Willis to aid her investigation. Over several months, the jurors subpoenaed testimony from 75 witnesses, including Trump allies such as his former attorney Rudy Giuliani, Graham and top Georgia officials such as Governor Brian Kemp.</p>

<p>The special grand jury did not act unanimously.</p>

<p>It voted 13-7, 14-6 and 17-4 in favor of indicting Graham, Loeffler and Perdue, respectively. There was one abstention in each of the votes for Graham and Loeffler. The grand jury voted 20-1 in favour of indicting Trump with respect to the national effort to overturn the election.</p>

<p>The indictment listed 30 unindicted co-conspirators, who have not been charged but allegedly played a role in the scheme.</p>

<p>Despite his legal troubles, Trump remains the front-runner for the Republican presidential nomination next year against Democratic President Joe Biden, the incumbent.</p>

<p>The special grand jury report remained secret at Willis's request while she determined what charges to bring. With the indictments issued, Fulton County Superior Court Judge Robert McBurney ruled there was no longer any reason to keep it from the public.</p>

Navarro’s attorney Stanley Woodward argued that the subpoena was not simple and stated that it failed to specify where in the Capitol complex the accused had to show up for his deposition.</p>

<h2><strong>Navarro's non-compliance was an accident or mistake?</strong></h2>

<p>He added that the prosecutors were not able to prove that Navarro was willful in failure to follow the subpoena, adding that his non-compliance with the testimony's demand was a result of an accident or mistake that was not established by the prosecutors.<br />

“Do we know that his failure to comply beyond reasonable doubt wasn’t the result of accident, inadvertence or mistake?” he stated.<br />

“Why didn’t the government present evidence to you about where Dr. Navarro was or what he was doing&nbsp;on the day when the deposition was scheduled deposition,” asked Woodward to the jury. “Something stinks,” he added.<br />

<p>US former president Donald Trump is likely to appeal for moving the Georgia criminal case, in which he faced accusation of conspiring to overturn his loss in US election 2020, from state to federal court, stated his lawyer in a court filing on Thursday (September 7). <p>The craze for MS Dhoni - the cricketer, and more so for the person that he is, goes beyond the cricketing world, with the former US President inviting him over for a golf game in his country.&nbsp;</p>

<p>Dhoni, who earlier this year, won the IPL 2023 title with Chennai Super Kings - joint-most in the tournament's history, didn't hang his boots from cricket, saying the love and appreciation he received from the fans motivates him to push for another year.</p>

<p>"You do get emotional; in the first game at CSK, everyone was chanting my name. My eyes were full of water. I needed to take some time off in the dugout. I realised I need to enjoy this. I think they love me for what I am; they love that I am so grounded. I don't try to portray something I'm not. Just keep it simple," Dhoni told broadcasters during the IPL 2023 final post-match presentation.</p>

The easy thing would be to walk away from here, but the harder thing would be working hard for 9 months and try to play another IPL. It would be a gift from me, won't be easy on the body," Dhoni added.</p>

<p>Meanwhile, nursing a knee injury throughout the tournament, MS Dhoni didn't bat much, scoring just 104 runs in limited outings, with the best of 32*. He kept wickets in every game, displaying his commitment towards his team.&nbsp;</p>

<p>Following the tournament, Dhoni underwent knee surgery and was said to be taking proper care, given what is at stake.</p>

<p>Republican presidential hopeful Vivek Ramaswamy, in an&nbsp;interview&nbsp;on Wednesday (September 6), declined to answer MSNBC host Mehdi Hasan on being asked to elucidate his 'danger to democracy' remark about former United States President Donald Trump.</p>

<p>Ramaswamy started off his interview on a cordial note with host Hasan, saying, “You and I both grew up as kids of Indian immigrants who love to debate, super confident, perhaps overconfident in our views.”</p>

<p>“But here’s the difference. I kind of know my limits … what have you done that even qualifies you to be president of the United States?”&nbsp;</p>

<p>Citing his business career, Ramaswamy said that he was “an outsider who deeply understands the law and the constitution in this country”.</p>

<p>The conversation took a turn when Hasan asked Ramaswamy specifically about an Alzheimer’s drug that was pushed by the Republican presidential candidate but failed clinical trials.</p>

<p>Both of them then argued over remarks made by Ramaswamy to the Atlantic, in which he expressed collusions about 9/11 and the January 6 foray on Congress, which Trump stirred, after which Ramaswamy took to X (formerly known as Twitter) and on 12 January 2021 wrote, “What Trump did last week was wrong. Downright abhorrent. Plain and simple.”</p>

<p>To which Ramaswamy responded saying that Trump was the best president indeed that the country had in the 21st century, and said he “would have made the same judgments that he has made every step of the way”.</p>

<p>Hasan said, “You say he behaved in downright abhorrent behaviour that makes him a danger to democracy. Downright.”</p>

<p>Ramaswamy then referred to a Wall Street Journal column from 11 January 2021 in which he said, “Censorship was the real cause of what happened on January 6.”</p>

<p>“What did Donald Trump do that in your view was downright abhorrent? Second time I’ve asked that,” said Hasan.</p>

<p>Ramaswamy said, “The thing that I would have done differently if I were in his shoes, I would have declared re-election on January 7.”</p>

<p>Hasan said, “That’s not what I asked, Vivek. What did Trump do that was egregious, quote, ‘downright abhorrent’ and a danger to democracy? Can you just explain to our viewers your words?”</p>

<p>Ramaswamy then said that what happened on January 6 was “reprehensible” and “a true leader should have handled that situation” differently.</p>

<p>Hasan said: “I want to hear from your mouth. You’re scared of him. Why won’t you say what he did that was downright abhorrent?”</p>

<p>Ramaswamy said, “You are stitching together three things.”</p>

<p>Hasan said, “I want you to answer my question, Vivek. Three times I’ve asked it. What did Trump do that was downright abhorrent? It’s a simple question. It’s your words, it’s onscreen, what did he do that was downright abhorrent?”</p>

<p>Ramaswamy said, “I believe that failing to unite this country falls short of what a true leader ought to do. That is why I am in this race, to do things differently than any prior president has done them.”</p>
