Indian Supreme Court Justice Sanjay Kishan Kaul called for an impartial investigation into human rights abuses in Jammu and Kashmir since the 1980s, carried out by both state and non-state actors, in a separate but concurrent ruling on the validity of abrogation of Article 370 that gave special status to the erstwhile state.

Kaul&nbsp;recommended setting up a&nbsp;"Truth and Reconciliation Commission" to look into the matter.&nbsp;

"I recommend the setting up of an impartial Truth and Reconciliation committee to investigate and report on the violations of human rights both by the state and non-state actors at least since the 1980s and recommend measures for reconciliation," Justice Kaul said.

Justice Kaul, who hails from a Kashmiri Pandit family in the valley, said that "maybe some sentiments are involved," while reading the ruling.

He added that an entire generation of youth had grown with a feeling of distrust and that the findings of the truth and reconciliation committee were owed to them.&nbsp;

Kashmiri Pandits were forced out in a mass&nbsp;exodus due to the rise in Islamic terrorism in the late 1980s. One of the primary motives of abrogation of Article 370 was to allow the Kashmiri Pandits to return to their roots apart from assimilating the state into the mainstream.&nbsp;&nbsp;

Without referring to Islamic extremists, Justice Kaul said the second round of insurgency holds origins in the later parts of the 1980s. Failing to address the troubled situations at the ground level culminated with the migration of a major part of the state's population.&nbsp;

"It is a bit sentimental as well -- insurgencies led to the migration of one part of the population and the situation was such that army had to be called and nation faced dangers. People of the state paid a heavy price and intergenerational trauma the people have gone through, the state needs healing," Justice Kaul said in the epilogue of the ruling.&nbsp;

He added the situation became so aggravated that the very sovereignty and integrity of the country was in danger and the army had to be called in.

"Army is meant to fight battles with enemies of the State and not really to control the law and order situation within the State. But then, these were peculiar times. The entry of the Army created its own ground realities and in their endeavour to preserve the integrity of the State and the nation against foreign incursions, the men, women and the children of the State paid a heavy price," Justice Kaul said.

Army's deployment in the state came with its fair share of controversies and the truth committee is expected to find instances when the power was misused. On the whole, Justice Kaul's recommendation is expected to be the fitting epilogue to the troubled history of Jammu &amp; Kashmir, one that will perhaps mend the relationship amongst the communities as well as with the State, legal experts said.&nbsp;

Teams of NIA cracked down on eight locations in the seven districts of Poonch, Shopian, Pulwama, Baramulla, Ganderbal, Kupwara and Srinagar in J&amp;K.

According to NIA, "The locations raided today were residential premises of hybrid terrorists and Overground Workers (OGWs) associated with the newly formed affiliates and offshoots of the banned terrorist outfits."

"Extensive searches were also conducted at the premises of the cadres and sympathisers of these newly floated organisations, which included The Resistance Front (TRF), United Liberation Front Jammu &amp; Kashmir (ULFJ&amp;K), Mujahideen Gazwat-ul-Hind (MGH), Jammu &amp; Kashmir Freedom Fighters (JKFF), Kashmir Tigers, PAAF, among others," NIA added.&nbsp;

NIA said that the searches led to the seizure of several digital devices containing large volumes of incriminating data and documents. The conspiracy of the recently launched offshoots of the banned terror outfits to destabilize J&amp;K through violent terrorist attacks and activities.

NIA had registered the case (RC-05/2022/NIA/JMU) suo moto on June 21, 2022, to probe the involvement of the cadres, OGWs and other suspects of the new outfits in the collection and distribution of sticky bombs/magnetic bombs, IEDs, funds, narcotic substances and arms/ammunition to spread terror, violence and subversion in J&amp;K.

The conspiracy also involved the radicalisation of local youth and the mobilisation of OGWs to carry out violent and disruptive activities in J&amp;K.&nbsp;

According to the Jammu and Kashmir government, around 4,200 terrorists who are living in Pakistan and Pakistan-occupied Kashmir (PoK) have been listed among the “proclaimed offenders” by the government of India and their properties are being attached.&nbsp;

The inspector-general of registrations and revenue has already received a list of around 4,200 terrorists living in PoK from the last three decades. The revenue department most likely would be seizing the properties and making sure that these properties are neither sold nor bought by anyone.&nbsp;

Jammu and Kashmir Police recently also attached properties of those found guilty of wilfully providing shelter to the terrorists.

''The Youth of Jammu and Kashmir has understood the plans of Pakistan. In 2022, around 110 local youths had joined terror outfits, but the number this year fell drastically, with just 10 youths joining the terror ranks. Out of these 10, six have already been killed. I appeal to the youth to shun the path of violence and those four local active terrorists should also come to mainstream,'' said DGP JK Police Dilbagh Singh.&nbsp;

The Jammu and Kashmir Police has repeatedly&nbsp;appealed to the local youth to shun the path of violence and return to the mainstream. Police says that Pakistan is still trying to derail the peace process in the Kashmir Valley, but Jammu and Kashmir Police is making sure that those attempts are unsuccessful.&nbsp;

However, while the recruitments have come down drastically in the Valley, the police say that many terror camps across the border are still active in areas like Sialkot and near LoC across the Gurez sector. The Jammu and Kashmir Police say that Pakistan tries to push the terrorists into Kashmir, but they have managed to foil more than 90 per cent of these bids and security forces posted along the LoC are always on high alert. &nbsp;

Jammu and Kashmir Police have also said they will soon make Kashmir terror-free, and Kashmir will be a peaceful place soon.

Six of just 10 local terror recruits in J&K in 2023 killed

A joint operation by Indian Army and Jammu and Kashmir Police was launched on the intervening night of 09/10 October 23 after security forces had a tip off about the presence of terrorists in the area.

Two terrorists belonging to the Lashkar e Toiba terror outfit were killed by security forces in a joint operation in South Kashmir’s Shopian district. A joint operation by Indian Army and Jammu and Kashmir Police was launched on the intervening night of 09/10 October 23 after security forces had a tip off about the presence of terrorists in the area. According to security forces, a cordon and search operation was started in the area and during the night hours at around 01:00 AM, the terrorists opened fire on the security forces resulting in a gunbattle. Two terrorists were neutralised during the operations. The slain terrorists have been identified as Morifat Maqbool and Jazim Farooq, both from LET. It has also been learned from police sources that Jazim Farooq alias Abrar was involved in the killing of Late Mr Sanjay Sharma a Kashmiri Pandit in Pulwama on 26 February this year,'' said Defence PRO, Indian Army. Jammu and Kashmir Police earlier had said that both the terrorist bodies have been recovered from the operation site. They had identified them as locals affiliated with the Lasher e Toiba terror outfit. ''Two (02) terrorists killed. Killed terrorists have been identified as Morifat Maqbool & Jazim Farooq @ Abrar of terror outfit LeT. Terrorist Abrar was involved in killing of Kashmiri Pandit late Sanjay Sharma, '' said Vijay Kumar, ADGP Kashmir Police. The security forces also said that Two AK Series rifles, one pistol and other war like stores were recovered from the operation site. Indian Army said that '' This has once again brought to fore the nefarious designs of Pakistan in supporting terrorists and trying to disrupt peace and development in Kashmir. Jammu and Kashmir administration, on Friday (September 22) took a decision to release Farooq after four years of house arrest that had started on August 4, 2019. &nbsp;He was placed under house arrest when the Government of India revoked Articles 370 and 35A and the state was bifurcated into two Union Territories of Jammu and Kashmir, and Ladakh.

“After 4 years I am here with you. I was kept under house arrest since 4 August 2019. It was despite the fact that authorities had approved my release but nothing was done. At last, I had to go to the court and get my release order. To stay away from you all for years was very difficult for me. This was the toughest time but your prayers and love helped me and I found you all with me always. I know what has happened with you after August 2019 it was not easy; the article was abrogated, and the state was divided. Despite being under house arrest, I always kept an eye on the situation. Today’s situation is no different, we should have patience and believe in god. Islam teaches us to trust in God as after every tough situation, there is bound to be a good time,” said Farooq.

Sources said that the LG administration took the decision of Farooq’s release after due consultation with different law enforcement agencies.

“Part of J&amp;K is with India, one with Pakistan and one with China which forms J&amp;K. We have to seek a solution. We have always worked for peace and non-violence suffered for that, sad that we were called separatists, enemies of people but we had no personal ambitions. We were representing the aspirations of people,” said Farooq.

The Downtown Heroes Football Club which was formed a few years ago has not only remained but become a mission, and is helping the youngsters to stay away from drugs and give a new shape to their future.

The old city of Srinagar was known for producing top-class footballers&nbsp;who even went on to represent Jammu and&nbsp;Kashmir and India at the national and international level. The downtown area of Srinagar was known as the hub of football in Kashmir, but with the beginning of insurgency, the downtown lost touch with the most popular sport in Kashmir.

Downtown Heroes FC was started with an aim to revive the lost glory of football in the old city. It was launched in 2020 and the club has already made a name for itself. The club is not only changing the image of the downtown, but it also has helped in curbing the drug menace in the Srinagar city. Not only are they including addicts in the club to play but also running campaigns for a drug-free Kashmir.

''See we started this club in 2020. We started this for a reason that was that downtown earlier was known for good things but over the period of time it lost its glory. It was now known for bad things, the aim to start this club was to show the world that we are not bad people and if given a chance we can excel anywhere. One of the biggest challenges Kashmir is facing now is drug addiction because we lack basic avenues of entertainment, so we want to give this alternative to people to&nbsp;come and&nbsp;play football and shun violence and drugs. We are successful till now. We have people who have left drugs and are playing with us. The target is to get youth away from this all,'' said Hanan Bashir, co founder, Downtown Heroes FC.

In its inaugural season, Downtown Heroes FC went to play in the Premier League, Real Kashmir Cup and also went on to win the Doon Knockout football tournament title. This year Downtown Heroes FC played the Durand Cup which is the oldest football competition in India and Asia.

''In 2020, we created this Downtown Club. It took us three years to become successful in our goal. This year we went for the Durand Cup, which is the oldest tournament in Asia. The top teams of India played there and this year Downtown Club was also one of those teams, which is a big success for us. Many of our boys are playing in foreign clubs and are constantly getting offers,'' said Mushtaq Bashir, co-founder, Downtown Heroes FC.

The club includes youth in the age group of 15 years to 25 years. The club began playing at the Islamia College ground in Downtown and quickly rose to prominence on the domestic football map of the country. The Downtown Heroes have been promoted to the 2022–23 I-League Division 2. Downtown Heroes Football Club is showing a new direction to the youth of Valley.

The more private clubs come to our Kashmir, the better it is. The future is being made. In recent times, drug addiction has been on the rise and if the youth go into the sports, they will save themselves from these bad habits. The change is coming slowly, the downtown club has a lot of local youngsters playing in it and we have got a great platform like the Durand Cup to play in,'' said Salah Shafi, a player.

Downtown Football Club has also now joined the J&amp;K Sports Council's campaign to bring more youth into the sports field. Next week the club will be selecting football players at sub-junior, junior levels. This is part of the club's expansion plan to involve more youth in sports and keep them away from drugs and violence.

''This has provided us with great help. There is a huge drug addiction here and when they saw us footballers on TV&nbsp;to play football for the club, they got inspired. The people from our area are extremely proud and inspired when they see us playing on TV. Football has played a big role in downtown to save youngsters from addiction.

The bigger the platform you get, the better your profile becomes,'' said Momin Khalid, another player.

More than 200 youngsters are right now associated with the Downtown Heroes FC.

While shielding its handler, it laid down its life in the best traditions of the Indian Army," a defence spokesperson said. There have been three operations in the Union Territory of Jammu and Kashmir in the last three days. In total, eight terrorists have been killed in these three operations.&nbsp;

Yesterday, four terrorists were killed in an operation in the Surankote area of Poonch district in Jammu and Kashmir. The Indian army had said that Four AK-47 rifles, two pistols, and other war-like stores were recovered from the operation site.&nbsp;

And on Monday, in a joint operation, Indian Army and J&amp;K police killed two infiltrators while foiling an infiltration attempt on the Line of Control (LoC) in the Poonch sector of J&amp;K.&nbsp;

An unidentified terrorist was killed and a policeman was wounded in an encounter in Jammu and Kashmir's Kulgam district in the early hours of Tuesday, said the police.

Police further added that the terrorist's identity and affiliation were being ascertained and that incriminating materials like arms and ammunition were recovered from him.

The encounter began in the early hours of Tuesday at Hoowra village in Kulgam district.

Kashmir Police Zone tweeted: “Encounter has started at Hoowra village of #Kulgam district. Police &amp; Security Forces are on the job. One JKP personnel got injured. Operation in progress. Further details shall follow.”

Providing an update on the encounter, it said, “01 local terrorists neutralised. Identification &amp; affiliation are being ascertained. Incriminating materials including arms &amp; ammunition recovered. Search going on.”

On Friday, police gunned down four terrorists in the Kala Jungle of the Machhal sector of Jammu and Kashmir in a joint operation by the Indian Army and Jammu Kashmir police.&nbsp;

"In a joint operation, Army and Police have killed four #terrorists in Kala Jungle of Machhal sector in #Kupwara who were trying to infiltrate to our side from POJK," Jammu and Kashmir police said in a tweet.

The police in an official statement, said that huge quantities of drugs and ammunition were recovered from the slain terrorists.

As per the statement, the recovered items included 9 AK series rifles, 14 AK magazines, 228 rounds of assorted ammunition, 3 pistols, and 55 suspected narcotic packets.

"During the intervening night of 22/23 June, alert troops of the Indian Army detected suspicious movement in the general area Kala Jungle along the Line of Control in Machhal Sector. Ambushes were sited and tracking of the terrorist movement was carried out during the night. At around 0430 hours, four terrorists were observed crossing the line of control from Pakistan. They were engaged upon coming in effective range by the Ambush parties", the statement read.

The officials said that on Thursday Anantnag Police arrested two Lashkar-e-Taiba (LeT)-associated terrorists and recovered arms and ammunition in the Bijbhera area of Jammu and Kashmir.

According to NIA, they cracked down once again on the newly floated terrorist outfits in Jammu and Kashmir and seized incriminating literature and several digital devices.&nbsp;

“The searches were conducted at three locations in the Kashmir valley, in the residential premises of sympathisers/cadres, hybrid terrorists and Over Ground Workers (OGWs) linked with the newly-formed offshoots and affiliates of several proscribed Pakistan-backed terror outfits, such as Laskhar-e-Toiba (LeT), Jaish-e-Mohammed (JeM), Hizb-ul-Mujahideen (HM), AI-Badr, AI-Qaeda, etc,” said NIA.&nbsp;

The day-long raids and searches were conducted at locations in Srinagar and Budgam districts as part of the ongoing NIA investigations into the activities of the recently formed terrorist groups, including The Resistance Front (TRF), United Liberation Front Jammu &amp; Kashmir (ULFJ&amp;K), Mujahideen Gazwat-ul-Hind (MGH), Jammu &amp; Kashmir Freedom Fighters (JKFF), Kashmir Tigers and PAAF.&nbsp;

“A total of 51 locations have been searched in recent days in connection with the terror conspiracy case (RC-05/2022/NIA/JMU), which was registered suo moto by NIA on 21st June 2022. The case relates to the hatching of a conspiracy, both physical and in cyberspace, and plans by the proscribed terrorist organisations to unleash violent terrorist attacks in Jammu and Kashmir with sticky bombs, IEDs and small arms etc. The plans are part of a larger conspiracy to carry out acts of terror and violence, by radicalising local youth and mobilising overground workers, to disturb the peace and communal harmony of Jammu and Kashmir,” said the Indian anti-terrorism agency.

Cadres and workers of the newly formed organisations have been found to be involved in the collection and distribution of sticky bombs/magnetic bombs, IEDs, funds, narcotic substances and arms/ammunition, etc. They are spreading activities related&nbsp;to terror, violence and subversion in Jammu and Kashmir, as per NIA investigations.&nbsp;

NIA also said that investigations have further revealed that Pakistan-based operatives are using drones to deliver arms/ammunition, explosives, narcotics, and so on, to their operatives and cadres in the Kashmir valley. These operatives are using social media to connect with the cadres and workers in India.

A bus carrying 75 pilgrims to Katra from Amritsar fell into a deep gorge on the Jammu-Srinagar national highway near Jhajjar Kotli on Tuesday. At least 10 people were killed, while 57 were reported injured, as of the last update.

Initial reports suggest that CRPF, police and emergency services have arrived at the spot. The dead bodies and injured have been taken to Jammu's&nbsp;Government Medical College&nbsp;hospital. A rescue operation is currently underway.&nbsp;

"Those critically injured have been brought to GMC Jammu. 12 others have been admitted at local public health centre," Deputy Commissioner (DC) Jammu Avny Lavasa was quoted as saying by ANI.&nbsp;

Chandan Kohli, SSP Jammu updated the death and injured toll saying eight had died while the rescue operation was underway.&nbsp;

"The bus was going from Amritsar to Katra, towards Mata Vaishno Devi and rolled down the Jhajjar Kotli bridge. The injured people have been shifted to a hospital. All other teams - paramilitary teams and SDRF - are helping the Police. Locals are helping too so that people can be evacuated and rescued," said Kohli.

Bihar Chief Minister Nitish Kumar expressed condolences over the death as the majority of the pilgrims hailed from the eastern state. He announced an ex-gratia of $2400 (Rs 2 lakh) each to the next of the kin.&nbsp;

In North Kashmir’s District Kupwara, property worth over 30 million&nbsp;rupees or around USD 363,123&nbsp;was notified by DM Kupwara on the recommendation of the SIA of J&amp;K Police. The property has been barred with restrictions on usage and entry.

“To choke the availability of funds for secessionist activities and to dismantle the ecosystem of anti-national elements and&nbsp;terror networks hostile to India's national security, sovereignty, integrity and unity, property belonging to and held by banned JeI at Kupwara has been notified by concerned District Magistrates in the exercise of the powers conferred under section 8 of the Unlawful Activities (Prevention) Act, 1967 &amp; Notification No. 14017/7/2019, dated 28- February- 2019 of Union Ministry of Home Affairs,” said the special investigative agency.&nbsp;

The property is a shopping complex comprising 20 shops along with land falling under survey number 2990/2666/270 and survey number 3551/2979/263. All the property has been sealed. People have been blocked from entry and usage.&nbsp;

“Additionally, 'Red entry'&nbsp;to this effect has been made in the relevant revenue records. With this, SIA Kashmir has got 57 properties of JeI notified to date,” said Special Investigative Agency.&nbsp;

SIA says that action taken is expected to dent terror funding in J&amp;K besides being another major step in restoring the rule of law and&nbsp;a society without fear.

Pertinently, SIA has identified as many as 188 JeI properties across the UT of J&amp;K, which have either been notified or are under the process of being notified for further legal action.

They are hopeful the event would eventually mean more tourist arrivals at the ski resort.&nbsp;

''Since the announcements have been made about G20, the development work has been fast-tracked, the roads, and maintenance has been done. I have not seen such development in my seven years of career. Tourism in Gulmarg would be boosted, while the locals will also get a positive mindset, and the image that we have outside can change as well. The developments are very good and will help the tourism sector a lot,'' said Waseem Hassan, a hotelier.&nbsp;

Gulmarg hotels and resorts are fully packed all through the year, and now with the visit of G20 delegates, the stakeholders are expecting it to become the favourite destination of foreigners as well. The event would be a start for Kashmir Valley's promotion as a tourist destination across the world.&nbsp;

''Development is happening very fast and nicely and whatever work was pending has also been finished due to the G20. The development has happened on a great scale, and we are extremely happy about it. We hope they don't shut Gulmarg that day, but we are hopeful that G20 will get us more tourists from international countries. This will be a great promotion for Gulmarg,'' said Mir Fayaz, a local travel agent.&nbsp;
