WhatsApp messages are playing a growing role in employment tribunals, with a sharp rise in cases referencing the messaging app, from 150 in 2019 to 427 in 2023, according to HM Courts and Tribunals Service data. Law firm Nockolds warns that companies could face significant financial penalties if they fail to monitor misuse of the platform, as it increasingly serves as evidence in workplace disputes.
