Former US President Donald Trump's legal troubles and controversies surrounding his involvement in attempts to overturn the 2020 election have spurred a spirited debate among legal experts.

This debate revolves around whether Trump is disqualified from seeking the presidency again under the 14th Amendment to the United States Constitution.

As the 2024 election cycle draws near, this issue is expected to play out in the courts, adding another layer of complexity to the ever-evolving political landscape, as reported by Forbes.

The 14th Amendment

Section three of the 14th Amendment, which was enacted in the aftermath of the American Civil War, contains a pivotal clause that is central to this debate.

It states that no person shall "hold any [state or federal] office" if they've previously taken an oath of office and then "engaged in insurrection or rebellion against the [US], or given aid or comfort to the enemies thereof."

A preprint article sparks the debate

Conservative legal scholars William Baude and Michael Stokes Paulson ignited this debate with a forthcoming law review article. In their article, now published as a preprint, they assert that Trump's actions during the January 6, 2021, insurrection qualify as insurrection under the 14th Amendment. They argue that this section of the amendment is still in effect and "ready for use," allowing state officials to bar Trump from the ballot without requiring additional legislation or court rulings.

Support for disqualification under the 14th amendment

Baude and Paulson's view is echoed by several legal experts, including those on the conservative side of the political spectrum. Northwestern University law professor Steven Calabrisi, a founder of the conservative Federalist Society, argues that Trump's exhortations to his supporters to "fight like hell" in the lead-up to January 6, combined with his failure to intervene once the insurrection began, constitute aiding and abetting the insurrection. This, in Calabrisi's view, merits disqualification, even in the absence of a conviction for incitement.

Interestingly, a joint article by conservative legal scholar J. Michael Luttig and left-leaning legal expert Laurence Tribe, published in The Atlantic, also supports Trump's disqualification under the 14th Amendment. They contend that any person who attempted to subvert the Constitution, declared that it should be "terminated," and sought an immediate return to the presidency cannot, in good faith, take the oath required of presidents.

Opposition to disqualification

Despite the growing support for disqualifying Trump under the 14th Amendment, dissenting voices remain within the legal community. Stanford Law professor Michael McConnell, while expressing his low regard for Trump, cautions against allowing secretaries of state to disqualify political opponents from the ballot. He argues that such a practice would be profoundly anti-democratic and questions whether the events of January 6 rise to the level of an insurrection. McConnell also raises concerns that disqualifying Trump could empower partisans to seek disqualification whenever a politician supports or speaks in favour of the objectives of a political riot.

Harvard University law professor Noah Feldman opposes the 14th Amendment strategy in a Bloomberg op-ed. Feldman notes that a 1869 circuit court ruling held that Section Three of the 14th Amendment could only go into effect if Congress passed legislation directing its implementation. This view challenges Baude and Paulson's argument that the section is already operational.

Baude and Paulson's case for disqualification

Baude and Paulson assert that Trump undeniably "engaged in" and provided "aid or comfort" to individuals involved in the insurrection. In their assessment, Trump's actions and statements during this period are unequivocal and disqualify him from seeking the presidency or any other state or federal office governed by the Constitution.

Differing legal opinions and the potential for a supreme court decision

Legal experts are deeply divided over whether Trump's conduct meets the criteria for disqualification set forth in the 14th Amendment. Although some have already filed requests with officials in various states to disqualify Trump from the ballot, there is no indication that these efforts will succeed. However, this dispute is likely to make its way to the highest legal authority in the land—the Supreme Court—as the 2024 election approaches.

Background on previous uses of the 14th amendment

The discussion surrounding Trump's eligibility under the 14th Amendment follows previous attempts to employ this constitutional provision during the 2022 midterms.

Critics sought to bar Rep. Marjorie Taylor Greene and former Rep. Madison Cawthorn from the ballot over their ties to the events of January 6.

These efforts yielded mixed results, with an administrative law judge ruling against disqualifying Greene but a federal appeals court ruling in favour of the possibility of disqualification under the 14th Amendment. In an unprecedented move, local commissioner Couy Griffin in New Mexico was removed from office and barred from holding office again due to his involvement in the January 6 riot, marking the first use of the 14th Amendment for such a purpose since 1869.

US: South Carolina lawyer Alex Murdaugh appeals murder conviction, alleges jury tampering

The United Nations Environment Programme (UNEP) has sounded the alarm on the extensive and unsustainable extraction of approximately six billion tonnes of sand from the world's oceans annually, posing severe threats to marine life and coastal communities, as reported by Reuters.

Sand, the world's second-most exploited natural resource following water, serves as a fundamental component in the production of concrete and glass.

Destructive dredging practices

According to the UNEP, certain vessels engaged in sand extraction are akin to "vacuum cleaners," indiscriminately dredging both sand and micro-organisms crucial to the marine food chain. This destructive activity has profound and long-lasting consequences for marine ecosystems, jeopardising the potential for recovery in some regions.

The unveiling of "Marine Sand Watch," a cutting-edge analysis tool that employs marine tracking and artificial intelligence to monitor dredging activities, coincides with this revelation. This innovative platform offers critical insights into the scale and impact of shallow sea mining and dredging.

Alarming environmental consequences

Pascal Peduzzi, who leads UNEP's analytics centre GRID-Geneva, underscored the alarming scope of the environmental repercussions stemming from these activities. Out of the approximately 50 billion tonnes of sand and gravel utilised worldwide each year, an estimated six billion tonnes is extracted from the world's oceans and seas. This equates to the daily use of "more than one million dump trucks," highlighting the staggering volume of sand removal.

Sterilising the marine environment

Large vessels involved in this industry are, in essence, sterilising the seabed by extracting sand and inadvertently obliterating microorganisms vital to fish sustenance. In some instances, dredging reaches the bedrock, rendering any hopes of marine life recovery futile.

The UNEP has called for a comprehensive ban on sand dredging from beaches to safeguard coastal resilience and economies. While sand remains indispensable for construction purposes, such as buildings, roads, hydroelectric dams, and solar panels, its significance extends to environmental protection, providing a crucial buffer against rising sea levels.

Hotspots of extraction

The report identifies several regions as hotspots for extensive dredging, including the South China Sea, the North Sea, and the US East Coast. These areas have witnessed substantial sand extraction activities, intensifying the threats to their marine ecosystems and coastal communities.

Also watch | Food we eat responsible for 1/3rd of human-made emissions

The UNEP's warning underscores the urgency of adopting sustainable practices and regulations to curb the rampant exploitation of this invaluable resource. Failure to do so not only endangers marine biodiversity but also imperils the livelihoods of communities dependent on healthy coastal ecosystems. It is imperative to balance the demand for sand with the need to protect our oceans and safeguard our future.

The United Nations Environment Programme (UNEP) has sounded the alarm on the extensive and unsustainable extraction of approximately six billion tonnes of sand from the world's oceans annually, posing severe threats to marine life and coastal communities, as reported by Reuters.

Destructive dredging practices According to the UNEP, certain vessels engaged in sand extraction are akin to "vacuum cleaners," indiscriminately dredging both sand and micro-organisms crucial to the marine food chain. Alarming environmental consequences Pascal Peduzzi, who leads UNEP's analytics centre GRID-Geneva, underscored the alarming scope of the environmental repercussions stemming from these activities. Out of the approximately 50 billion tonnes of sand and gravel utilised worldwide each year, an estimated six billion tonnes is extracted from the world's oceans and seas. This equates to the daily use of "more than one million dump trucks," highlighting the staggering volume of sand removal. Also read | Deforestation declines in Brazil's Amazon as govt approves more indigenous reserves Sterilising the marine environment Large vessels involved in this industry are, in essence, sterilising the seabed by extracting sand and inadvertently obliterating microorganisms vital to fish sustenance. Hotspots of extraction The report identifies several regions as hotspots for extensive dredging, including the South China Sea, the North Sea, and the US East Coast. These areas have witnessed substantial sand extraction activities, intensifying the threats to their marine ecosystems and coastal communities. Also watch | Food we eat responsible for 1/3rd of human-made emissions The UNEP's warning underscores the urgency of adopting sustainable practices and regulations to curb the rampant exploitation of this invaluable resource. Failure to do so not only endangers marine biodiversity but also imperils the livelihoods of communities dependent on healthy coastal ecosystems. It is imperative to balance the demand for sand with the need to protect our oceans and safeguard our future. (With inputs from agencies) WATCH WION LIVE HERE:

McConnell shrugs off health worries in Senate return after August recess

A cargo ship that had vanished beneath the waters of Lake Michigan over a century ago has been located, remarkably intact. This remarkable find was made by maritime historians Brendon Baillod and Bob Jaeck, who stumbled upon the sunken vessel named Trinidad, lying approximately 270 feet below the lake's surface, just a few miles off the coast of Wisconsin, reported USA Today. The remarkable state of preservation of Trinidad sets it apart from other shipwrecks discovered in the Great Lakes, making it a significant find.

Trinidad's intriguing artefacts

Trinidad still harbours an array of intriguing artefacts within its watery grave. The ship's deck houses intact dishes, anchors, a wheel, and even a bell, along with various other deck equipment. Perhaps most notably, the ship's rigging, typically composed of rope prone to deterioration, was constructed using wire, offering marine archaeologists a rare opportunity to directly study how a 19th-century cargo ship's rigging was configured.

A time capsule of history

Brendon Baillod, President of the Wisconsin Underwater Archaeological Association, who spoke to USA Today, aptly described the Trinidad as "one of the most intact shipwrecks ever found in Wisconsin waters." Although not a renowned vessel, its extraordinary state of preservation renders it a significant historical artefact, akin to a time capsule preserving the maritime history of the era.

The hunt for Trinidad

Brendon Baillod embarked on a meticulous search for Trinidad's resting place, relying on historical documents to approximate its location within a 25-square-mile grid, roughly 10 miles from the shoreline. With this critical information in hand, Baillod and Jaeck employed sonar technology in their quest to locate the sunken ship.

A stunning discovery

Their exhaustive search paid off when they chanced upon an initial image of the wreck. Initially resembling little more than a faint smudge, they nearly overlooked this historic find. However, a second pass at a slower speed revealed the shipwreck in greater detail, almost precisely where historical records indicated it had sunk. The moment of discovery left them stunned by the extraordinary preservation of Trinidad.

Trinidad, a 140-foot-long schooner, was constructed in 1867 by William Keefe in Grand Island, New York. The vessel primarily served the purpose of transporting grain, and shuttling coal from Oswego, New York, through the Great Lakes to ports in Milwaukee and Chicago, before returning to New York laden with Wisconsin grain.

Despite Trinidad's profitability, its owners maintained it inadequately, leading to its gradual decay and hull leaks within a decade. By 1879, it was deemed unfit for grain transportation.

In May 1880, while carrying coal, Trinidad struck a reef in Lake Superior, tearing out ten feet from her bottom. This damage was hastily repaired. Nevertheless, the ship embarked on one final journey, transporting coal to Milwaukee in May 1881, before its planned winter retirement in Port Huron, Michigan.

During the voyage, Trinidad encountered excessive leakage, despite the installation of additional pumps. At 4:45 am on May 11, 1881, the ship suddenly lurched and rapidly descended into Lake Michigan's depths. The crew had little time to salvage their belongings or even the ship's mascot, a Newfoundland dog, which tragically perished in the ship's swift descent.

Theories surrounding the sinking

While Captain John Higgins initially attributed the sinking to hull damage from ice in the Straits of Mackinac several days prior, Baillod's research suggests that Trinidad's lack of maintenance played a pivotal role. Reviewing the vessel's history, Baillod noted that it had received minimal upkeep and essentially met its demise due to neglect.

Miraculous rescue: A truck fell into a 100-foot ravine & the driver survived for 5 days

A drought in the US state of Texas has unveiled a remarkable discovery of more than 70 dinosaur tracks previously concealed beneath the dried-out Paluxy Riverbed. The Paluxy River, typically coursing through Dinosaur Valley State Park, located roughly 90 minutes south of Dallas, is renowned for its dinosaur-related attractions, media reports said. The recently exposed tracks belong to two distinct dinosaur species. The first is a carnivorous theropod closely related to the iconic T. rex, identified as the Acrocanthosaurus. The second is a herbivorous, long-necked sauropod akin to the Brontosaurus, known as the Sauroposeidon. Sauroposeidon also happens to be the state dinosaur of Texas.

According to media reports, the Acrocanthosaurus stood at approximately 15 feet in height and weighed about seven tonnes, while the towering Sauroposeidon reached over 100 feet in height and weighed around 44 tonnes.

Distinguishing features of tracks

Palaeontologists studying these tracks have noted that theropod tracks typically exhibit three toes, whereas sauropod tracks appear more bulbous, resembling the imprints left by elephants.

At the Ball Room dinosaur track site within the park, the limestone bed holding the fossilised imprints reached scorching temperatures of up to 126 degrees.
A clarification from experts

Experts emphasised the importance of clarifying that the drought did not reveal perfectly preserved tracks.

Instead, volunteers had to painstakingly remove sediment, sand, and gravel that covered and filled the tracks.

Paleontologist Glen Kuban, with over four decades of experience working in the park and the surrounding area, reportedly told CNN, “It’s important to clarify that the drought does not magically unveil tracks in pristine condition. … It takes many volunteers many days — in this case weeks — to remove the sediment covering and filling the tracks."

While the drought has provided a temporary window to study these remarkable footprints, the return of rains will inevitably bury the tracks beneath sediment once again. This natural process helps preserve the tracks in the geological short term.

To make the most of the current arid conditions, casts have been created of the exposed footprints, ensuring their preservation for future study.

Paleontologist Glen Kuban, with over four decades of experience working in the park and the surrounding area, reportedly told CNN, “It’s important to clarify that the drought does not magically unveil tracks in pristine condition. … It takes many volunteers many days — in this case weeks — to remove the sediment covering and filling the tracks." Watch | Labour reshuffle: Sir Keir Starmer to shake up shadow cabinet × While the drought has provided a temporary window to study these remarkable footprints, the return of rains will inevitably bury the tracks beneath sediment once again. This natural process helps preserve the tracks in the geological short term. To make the most of the current arid conditions, casts have been created of the exposed footprints, ensuring their preservation for future study. Inflight 'biohazard': US plane makes U-turn as passenger suffers major diarrhoea

Late last week, a devastating incident sent shockwaves through the community of Worcester, Massachusetts when a 14-year-old boy named Harris Wolobah tragically lost his life after participating in a viral social media trend known as the 'One Chip Challenge.'

Harris, a sophomore at Doherty Memorial High School, consumed an extremely spicy Paqui chip, which ultimately led to his demise, reported the Mirror.

This challenge was initially devised as a marketing campaign by Paqui, a chip company.

Participants purchase a chip flavoured with the Carolina Reaper pepper, renowned as one of the world's hottest peppers, and film themselves attempting to endure the intense spiciness without consuming any relief, such as water or other food.

What's the viral 'One Chip Challenge' trend that killed a teenager in the US?

As the nation’s confidence declines, China is no longer expected to overtake the US as the largest economy anytime soon, and it may never overtake the US to claim the top spot, according to a report by Bloomberg.

The report said that China’s gross domestic output would not surpass that of the US until the middle of the 2040s, and even then, it won’t be by much before “falling behind” at that point. Prior to the pandemic, they predicted that China would seize and maintain the top spot by the beginning of the following decade.

In a research note brought out on Tuesday, Bloomberg Economists said, “China is down-shifting onto a slower growth path sooner than we expected. The post-Covid rebound has run out of steam, reflecting a deepening property slump and fading confidence in Beijing’s management of the economy. Weak confidence risks becoming entrenched — resulting in an enduring drag on growth potential.”

The second-largest economy in the world, China, is now expected to develop at a slower rate, to 3.5 per cent in 2030 and 1 per cent or less by 2050, according to experts. In comparison to earlier estimates of 4.3 per cent and 1.6 per cent, respectively, this is less.

China’s economy grew by 3 per cent last year, which was one of the country’s slowest rates of growth in recent memory due to economic restrictions and a real estate crisis. Its final reopening gave rise to optimism that the economy will improve this year. However, as exports plummet and the real estate downturn worsens, the recovery has lost momentum. Additionally, economists surveyed by Bloomberg have lowered their growth projections for 2024 even further, to below 5 per cent.

The updated prognosis comes as the international community re-evaluates how to deal with a China that may be nearing a power peak.

The US and the Group of Seven countries are increasingly examining signs of deep-seated structural issues in China, spotting possibilities that could ultimately boost the West’s position against a collapsing geopolitical rival, while also taking the slowdown’s wider implications into account. Commodities and stocks are already in disorder due to this year’s setbacks.

Additionally, China is coping with more serious, long-term issues. The country had its first population decline since the 1960s in 2017, which has stoked fears about declining productivity. Confidence has also been impacted by regulatory crackdowns and geopolitical conflicts with the US and other Western governments.

The US, however, seems to be doing better than many economists had anticipated just a few months ago. The ability of the economy to avoid a recession for the time being has been boosted by a strong labour market, robust consumer spending, and moderate inflation.

According to Bloomberg Economics, prospective US growth will be 1.7 per cent in 2022–2023, with long-term projections indicating a gradual decline to 1.5 per cent by 2050.

Forecast: China’s slowdown means it may not surpass US economy

Major retailers across the United States have begun placing everyday products like toothpaste, chocolate, washing powder and deodorant under lock and key amid a reported rise in petty theft and organised shoplifting as the country grapples with the cost of living. Meanwhile, some shoppers said they are fearful during shopping amid the rise in organised retail theft.

US retailers justify placing products under lock and key

According to a report by AFP, major American retailers like Walmart and Target, drugstore chains CVS and Walgreens as well as home improvement firm Home Depot and Dick’s Sporting Goods are among some of the growing number of companies who have voiced concerns about the thefts, including some violent incidents.

They have also spoken about how it has affected their recent earnings. “Organised retail crime, and theft in general, is an increasingly serious issue impacting many retailers,” said Lauren Hobart, chief executive at Dick’s during a conference call, as quoted by AFP. She also called the impact of stealing on the company’s inventory “meaningful”.

In a separate briefing, Target chief executive Brian Cornell said, “During the first five months of this year, our stores saw a 120 per cent increase in theft incidents involving violence or threats of violence.” He also noted how this loss of inventory due to theft is well above what is sustainable over the long term.

According to the National Retail Federation’s Retail Security Survey 2022, American retailers lost some $94.5 billion nationwide to the so-called “shrink” in 2021. In this context, shrink refers to the loss of inventory from factors including staff theft, shoplifting or administrative errors.

The survey also noted that retailers on average saw a 26.5 per cent rise in organised retail crime in 2021 and a majority of respondents said that the pandemic has led to an increase in risks.

The US Federal Reserve has announced consecutive interest rate hikes taking the number once close to zero to around 5.5 per cent over 18 months, which is the highest in 22 years.
