Delhi HC agrees to hear Neha Bora's plea against 'maintain peace' directive on 'urgent basis'

The bail petition of 15 accused in Darya Ganj violence case will be heard at 4 pm today after medical reports, footages, and evidence in the matter are submitted before a Delhi court.

The Delhi Police had arrested 15 people and detained 40 on December 20 last year after police and protestors clashed in the area over the Citizenship (Amendment) Act.

All the 15 accused were then sent to judicial custody. Advocate Rebecca John, appearing on the behalf of the accused, told the court that Section 436 (Mischief by fire or explosive substance with intent to destroy house) of the Indian Penal Code (IPC) should not be imposed in the case.

"The allegations in the FIR only make out a case under Section 435 (Mischief by fire or explosive substance with intent to cause damage to the amount of one hundred or (in case of agricultural produce) ten rupees), which is a bailable offence," she said.

Additional Public Prosecutor (APP), however, opposed the bail petition and called the incident a criminal conspiracy. Judge Kamini Lau retorted and said that it cannot be called criminal but civil at best.

"The people were walking from Seelampur and as they moved on others kept joining. That is how protests are. And everyone has a right to protest," Kamini said.

She added, "We as courts sitting here to safeguard the rights. I am worried about the vandalism. How can anyone damage public property and block roads? It is condemnable."

Yesterday, Tis Hazari Additional Sessions Judge Satish Kumar transferred the bail plea matter to District Judge (Central) as the violence case was transferred to the crime branch.

Delhi deputy chief minister Manish Sisodia on Tuesday took a jibe at Home Minister Amit Shah over the installation of CCTVs in the national capital, reported news agency ANI.

Delhi deputy chief minister Manish Sisodia on Tuesday took a jibe at Home Minister Amit Shah over the installation of CCTVs in the national capital, reported news agency ANI. "Amit Shah is questioning where the CCTVs we promised. Well, I would like to assure you that you don`t have to look through `durbeen` (binocular) just raise your eyes and find it on every lane. You are also being recorded while doing door to door campaigns don`t worry," Sisodia was quoted as saying to reporters in Delhi. After the Election Commission announced the poll schedule for Delhi, Shah accused the AAP government of making empty promises. "In the last 60 months, the Aam Aadmi Party government made only promises and now in the last 3 months, the public development money was spent on advertisements for its announcements. People of Delhi are still looking for free wifi, 1.5 million CCTV cameras, new colleges and hospitals," Shah tweeted. Delhi, where 70 seats are at stake will go to polls on February 8 while the counting of votes will take place on February 11. In 2015 assembly polls, the AAP won 67 of 70 seats while the BJP could win only three seats. The Congress, which was in power for 15 years in between the years 1998 and 2013, failed to get any seat.

Just look up, you will find CCTVs on every lane: Sisodia to Shah

Envoys from a diverse set of groupings and regions such as European Union, ASEAN, Latin America will tour Kashmir and assess the ground situation after scrapping of J&K’s special status. Sources have also told WION that the envoys will meet civil society members, journalists and some other delegation. It’s very highly unlikely that these envoys will speak to media during their stay. × In October last year, European union Parliamentarians were taken to Kashmir which was the first such visit by any international delegation post abrogation of the Article 370. Before that visit, Indian Prime Minister Narendra Modi and National Security Advisor Ajit Doval met the visiting members of the European Parliament and spoke about the developments in Jammu and Kashmir and the issue of cross border terrorism. The visit by foreign envoys comes even as Modi-government has come under severe criticism for keeping the region cut off from the rest of the country.

YSRCP senior leader Dharmana Prasada Rao had written a letter to President Ram Nath Kovind, saying that declaration of "Amaravathi" as the capital was unconstitutional and violates the fundamental constitutional principles.

"The then Government of Andhra Pradesh declared "Amaravathi" as new capital without considering the recommendations of the report by the expert committee," the letter said.

"An expert committee headed by Sivaramakristna was appointed by the Government of India only to study various alternatives regarding new capital under the Andhra Pradesh Reorganization Act 2014. The leader further claimed the declaration of Amaravati as the capital was unconstitutional and violates the fundamental constitutional principles," the letter said.

"This action of declaring "Amaravathi" as capital is unconstitutional as it violated the fundamental constitutional principle of "Justice" and "Equality of Opportunity" enshrined in our Constitution. It is also illegal as it violated the provisions of the AP Reorganization Act 2014 and did not follow the recommendations of the expert committee," it added.

The expert committee in its report has clearly stated that "the committee does not consider a single large capital city as a feasible option available to Andhra Pradesh as of now.

Now, the Government of Andhra Pradesh following the recommendation of the expert committee is seriously thinking about revisiting the decision and appointed high-level committee to study reports of "GN Rao Committee" and "Boston Consulting Group" and considering to implement recommendations of the expert committee " Distribution of various Capital Functions" to all three regions of the State.

Citing the reason behind the three capital proposals, the leader said the proposal will boost the economic development of this backward region.

The Supreme Court on Tuesday asked the Centre to look into public interest litigation (PIL) against Reserve Bank of India's (RBI) decision to exchange Rs 30 crores worth of banknotes which were defaced by separatist groups in Kashmir in 2013. A Bench headed by Chief Justice of India, Sharad Arvind Bobde, has asked the Solicitor General Tushar Mehta, to reply within two weeks as "it is a matter of national importance." The plea filed by one Satish Bhardwaj has called for the Central Bureau of Investigation (CBI) investigation against RBI for allowing notes to be exchanged. Bhardwaj has alleged that he had moved RBI and CBI for action into the matter in 2013 itself but did not get any response.
