<p>The Supreme Court decides actual disputes, not abstract propositions, and then only after lower courts have made their own rulings. While there have been countless election cases filed around the nation, it is not clear which of them might reach the court in the coming days.</p>

<p>But one candidate is already on the court’s docket. Last month, the court refused to put a case from Pennsylvania on a fast track, but three justices indicated that the court might return to it later if need be.</p>

<p>On Wednesday afternoon, the Trump campaign asked the Supreme Court for permission to participate in the case alongside Republican state lawmakers and the Republican Party of Pennsylvania. In a statement issued when the court refused to speed the Pennsylvania case, Alito, joined by Thomas and Gorsuch, criticized his court’s treatment of the matter, which he said had “needlessly created conditions that could lead to serious postelection problems.”</p>

<p>“The Supreme Court of Pennsylvania has issued a decree that squarely alters an important statutory provision enacted by the Pennsylvania Legislature pursuant to its authority under the Constitution of the United States to make rules governing the conduct of elections for federal office,” he wrote, adding that he regretted that the election would be “conducted under a cloud.”</p>

<p>“It would be highly desirable to issue a ruling on the constitutionality of the state Supreme Court’s decision before the election,” Alito wrote. “That question has national importance, and there is a strong likelihood that the state Supreme Court decision violates the federal Constitution.”</p>

<p>But there was not enough time, he wrote. Still, Alito left little doubt about where he stood on the question in the case.</p>

<p>“The provisions of the federal Constitution conferring on state legislatures, not state courts, the authority to make rules governing federal elections would be meaningless,” he wrote, “if a state court could override the rules adopted by the legislature simply by claiming that a state constitutional provision gave the courts the authority to make whatever rules it thought appropriate for the conduct of a fair election.”</p>

<p>Pennsylvania officials have instructed county election officials to segregate ballots arriving after 8 p.m. on Election Day through 5 p.m. three days later. That would as a practical matter allow a ruling from the Supreme Court to determine whether they were ultimately counted.</p>

<p>Alito’s statement in the Pennsylvania case echoed an earlier concurring opinion by Kavanaugh in a voting case from Wisconsin. Kavanaugh also said that state legislatures, rather than state courts, have the last word in setting state election procedures.</p>

<p>Fearing crowded polling places amid the coronavirus pandemic, a record number of Americans, particularly Democrats, cast mail-in ballots this year, and counting them could take days. As a result, initial results on Election Day may show Republicans, indicated by red on election maps, holding large leads in battleground states such as Pennsylvania, which counts mail-in ballots received three days after Nov. 3. As ballots are tallied in the ensuing days, that "red mirage" could fade, giving way to a "blue shift." Experts see a possible "blue mirage" and "red shift" in Florida and North Carolina, which process mailed-in ballots before Election Day.</p>

<p>Two candidates, one declaring victory. The second, just short of it. Voting officials scrambled to count votes. News channels had all hands on deck. Analysts converted their years of experience into predictions. And protesters rallied on the streets.</p>

<p>This presidential election is going down the history of American as the most chaotic. And its counting night is perhaps the most dramatic. It was dictated by uncertainty, highs and lows.</p>

<p>Trends started trickling in around 7 pm Eastern Time. Kentucky was called for President Donald Trump while Joe Biden bagged Vermont. Half an hour later, Trump bagged West Virginia. Biden won Virginia.</p>

<p>8 pm was Trump's golden hour. He secured 42 electoral college seats. South Carolina, Alabama, Mississippi, Tenessee, Oklahoma turned Red. But the happiness was shortlived.</p>

<p>Soon, Connecticut, Delaware, Illinois, Maryland, Massachusetts, New Jersey and Rhode Island turned blue.</p>

<p>Then the tide turned, Donald Trump won Arkansas. Indiana followed next. North Dakota, South Dakota, Wyoming, Louisiana, Nebraska turned red.</p>

<p>Biden picked New York and New Mexico.</p>

15 past midnight, Biden made history. He won the first swing state, Minnesota. 5 minutes later Trump secured second swing state of Ohio.</p>

<p>The tally at 12:20 am ET was Biden 233 and Trump 145. At 12:47 am, Joe Biden spoke to his supporters from Delaware.</p>

<p>"Good evening, your patience is commendable. We knew this was gonna go long. But who knew it was going to go into maybe tomorrow morning? maybe even longer? But, look, we feel good about where we are, we really do.. I'm here to tell you tonight we believe we're on track to win this election," he said.</p>

<p>Two minutes into Biden's speech, Trump claimed that Democrats were trying to steal the election. Twitter flagged the tweet.</p>

<p>He amplified the charge of theft 2 hours later at White House East Room.</p>

<p>"And we were getting ready for a big celebration. We were winning everything, and all of a sudden it was just called off (...) Millions and millions of people voted for us today. And. A very sad group of people is trying to disenfranchise that group of people, and we won't stand for," he said.</p>

<p>By then, there was already a buzz that Trump was furious. His favourite news channel, Fox News had called Arizona in favour of Biden. But that did not keep the president from declaring victory.</p>

<p>"And I mean, this is a very sad moment and we will win this. And as far as I'm concerned, we already have won it. So, I just want to thank you, thank all of our support, I want to thank all of the people that worked with us," said Trump.</p>

<p>Trump supporters driving pick-up trucks down a Texas highway on Friday surrounded a tour bus carrying Biden campaign staff. In North Carolina over the weekend, police pepper-sprayed a group of mostly Democrats marching to polling stations. <p>The jockeying has already begun. If Biden wins, progressive Democrats are preparing to break their election-season truce, laying plans to push for liberals in key government posts, including Sen. Elizabeth Warren of Massachusetts as Treasury secretary. If Biden loses, progressives will argue that he failed to embrace a liberal enough platform.</p>

<p>Former Sen. Jeff Flake, R-Ariz., said he expected Trump to lose and that he hoped the defeat would refocus the party from “anger and resentment” to developing an inclusive message that could win in an increasingly diverse country.</p>

<p>“Nothing focuses the mind like a big election loss,” said Flake, who was one of many Republicans to retire in 2018 and who has endorsed Biden for president. “The bigger the better when it comes to the president.”</p>

<p>He added, “Trumpism is a demographic cul-de-sac.”</p>

<p>Flake would like the party to resurrect its 2012 “autopsy,” an assessment commissioned by the Republican National Committee to explore why the party had lost its bid for the White House that year. The report urged the party to better embrace voters of color and women.</p>

<p>A co-chair of the project, Ari Fleischer, said there was no returning to the days of that message. Trump, he said, had accomplished the goal of the report, expanding the party — just in a different way.</p>

<p>Rather than engage women or voters of color, the president expanded Republican margins with white, working-class voters, said Fleischer, a former press secretary for Bush who has come to embrace Trump after leaving his ballot blank in 2016.</p>

<p>Sara Fagen, who was the White House political director for Bush, agreed: “Trumpism is cemented in,” she said. “The base of the party has changed; their priorities are different than where the Romneys and Bushes would have taken the country.”</p>

Aiming to avoid the problems that occurred in the 2016 campaign, Facebook, Twitter and Google-owned YouTube were implementing policies aimed at heading off the spread of false information designed to influence or intimidate voters at the last minute.<br />
