The US Justice Department's antitrust trial has revealed that Alphabet's Google pays Apple about 36 per cent of the revenue generated from search advertising through the Safari browser.

According to a Bloomberg report, the disclosure by Alphabet's main economics expert Kevin Murphy has brought attention to the closely guarded details of the longstanding partnership between Google and Apple. The disclosure prompted a visible reaction from Google's main litigator, John Schmidtlein, as both companies had initially objected to publicly revealing specifics about their agreement.

Google and Apple first partnered in 2002, when Google was set as the standard search engine in Apple's Safari browser. Over the years, this deal has become increasingly crucial for Google, especially as it designates the search engine for the iPhone, the most widely used smartphone in the United States.

The Justice Department is scrutinising this agreement as potential evidence that Google is unlawfully maintaining its dominance in both the search engine and search advertising markets.

While Google and Apple had sought to keep the details of their agreement confidential, the revelation of the 36 per cent revenue-sharing arrangement has raised questions about the dynamics of their partnership.

In a court filing last week, Google argued that disclosing additional information about the deal could "unreasonably undermine Google’s competitive standing in relation to both competitors and other counterparties."

This ongoing antitrust trial is shedding light on the intricacies of the tech industry's relationships and their potential impact on market competition.

Apple encountered a potential setback as an adviser to the European Union's highest court contended that an EU tribunal made a mistake in its ruling, favouring Apple over a 13-billion-euro ($14 billion) tax order, Reuters reported on Thursday.

The tax case, a part of EU antitrust chief Margrethe Vestager's vigorous campaign against perceived unfair state aid between multinationals and EU nations, centres on Apple's alleged benefit from two decades of Irish tax rulings, artificially diminishing its tax obligations. According to the European Commission's 2016 decision, Apple's tax burden plummeted to as low as 0.005 per cent in 2014.

Advocate General Giovanni Pitruzzella at the EU Court of Justice (CJEU) challenges the General Court's 2020 decision that upheld Apple's appeal. Pitruzzella argues that the General Court made legal errors and failed "to assess correctly the substance and consequences of certain methodological errors that, according to the Commission decision, vitiated the tax rulings."

Recommending a reconsideration, he proposes setting aside the General Court ruling and referring the case back for a fresh evaluation. The CJEU is expected to make a final ruling in the upcoming months, following the usual practice of adopting about four in five such recommendations.

Despite both Apple and Dublin appealing the tax order, Apple had to transfer the entire amount to an escrow account in Ireland. The Irish government reiterates its position, stating that it provided no state aid to Apple.

Michael McGrath, an Irish official, maintained that Pitruzzella's opinion doesn't form part of the CJEU judgment but is considered in the final ruling. "It has always been, and remains, Ireland's position that the correct amount of Irish tax was paid, and that Ireland provided no state aid to Apple,” Reuters quoted McGrath as saying.

Reacting to the recent developments, an Apple spokesperson expresses gratitude to the court for its consideration, emphasising the General Court's previous ruling that Apple received "no selective advantage and no state aid."

Margrethe Vestager, recognised for the tax crackdown, has experienced a mixed record in court, achieving victories against companies like Stellantis while facing setbacks in cases involving Amazon and Starbucks.

Vestager is currently engaged in investigations into the tax arrangements of Inter IKEA, Nike, and Huhtamaki.

US Department of Justice (DOJ) said on Thursday (November 9) that Apple has agreed to pay USD 25 million to settle (DOJ) claims which said that the tech giant illegally favoured hiring of immigrant workers over US citizens for certain jobs.

The Justice Department in a statement said Apple did not recruit US citizens or permanent residents for jobs that were eligible for a federal programme, allowing employers to sponsor immigrant workers for green cards. This violated a law against discrimination based on citizenship.

The settlement amount is the biggest ever for the Department of Justice among cases involving claims of discrimination based on citizenship. The settlement saw Apple pay USD 6.75 million in civil penalties and UD 18.25 million to affected workers, the number of whom was not specified.

In a statement, Apple said that it had "unintentionally not been following the DOJ standard".

“We have implemented a robust remediation plan to comply with the requirements of various government agencies as we continue to hire American workers and grow in the US," the company said.

Foxconn, the world's largest iPhone assembler, has experienced a 4.6 per cent decline in its October sales, raising concerns about the company's future amidst a Chinese investigation.

The investigation initiated by Beijing has cast uncertainty over Foxconn's business, causing ripples in the tech industry, Bloomberg reported.

Foxconn reported a decline in revenue for October, with sales amounting to NT$741.2 billion ($23 billion). Despite this setback, the company has maintained a "significant growth outlook" for the December quarter, which is traditionally its busiest period due to the year-end iPhone shipments. Notably, Apple released its latest iPhone 15 in September.

In a brief statement, Foxconn mentioned that "operations will ramp up sequentially", without providing further details. The ongoing investigation by Chinese authorities has added complexity to Apple's position in its largest international market and primary production base. Regulators in China are currently conducting tax audits and reviewing land use by Foxconn, as reported by state media on October 22.

The report by Bloomberg said that investor concerns have escalated regarding the prospects of Apple's iPhone sales in China, a market that constitutes approximately one-fifth of the tech giant's total sales.

The Chinese consumer economy is grappling with challenges, while U.S. businesses continue to face a hostile environment due to ongoing technology conflicts between the U.S. and China. Additionally, the surprise introduction of a smartphone by Huawei Technologies Co. featuring an advanced made-in-China 5G processor has stirred nationalist sentiment and encroached on iPhone sales.

Hon Hai, the public arm of Foxconn Technology Group, has expressed its intention to cooperate with the Chinese authorities in their investigation. However, the news of the probe has taken a toll on the company and its mainland-listed unit, Foxconn Industrial Internet Co. At one point, the combined market value of these entities plummeted by approximately $9 billion.

Separately, Taiwan has also initiated an investigation into suspected bribes associated with Foxconn founder Terry Gou's presidential campaign. This development comes as the billionaire submits signatures to run in next year's presidential election.

Foxconn sees decline in sales amid Chinese investigation: Report

A purported fake letter being attributed to Karnataka Deputy Chief Minister DK Sivakumar created a massive furore in the political circles that saw him having a spat with the chief minister of neighbouring Telangana K Chandrashekar Rao.

It all started when the letter dated September 25 started circulating on social media on Sunday (Nov 4) asking the chairman of Foxconn Technology Group—one of the Apple products manufacturing partners—to relocate to Bengaluru from Hyderabad.

The letter said, “On behalf of our government, I propose that you consider relocating the Apple AirPods industry, which you plan to set up in Hyderabad, to Bangalore. This move holds numerous mutual benefits. Not only will it complement the Apple phone manufacturing industry, but it will also leverage the city’s transportation facilities, infrastructure, and available workforce. Being located in Bangalore will also enhance your international recognition.”

“Moreover, Bangalore, when compared to Hyderabad, is known for its safety and has a well-established IT industry with a history spanning 50 years. The city boasts superior logistics capabilities, especially when taking into account the past incidents of communal disturbances in Hyderabad, which pose a potential risk to your business,” it said.

“Furthermore, several international industries in Hyderabad have expressed interest in relocating to Bengaluru. We anticipate forming a friendly government in Telangana soon, assuring that you will encounter no hindrances there. Hence, it would be mutually beneficial for your ancillary industry to make the move as well,” said the letter.

Telangana's BRS slams Sivakumar

After the letter went viral, Telangana’s ruling Bharat Rashtra Samithi (BRS) party accused the Karnataka government of a “huge conspiracy against Hyderabad”—a charge vehemently denied by Sivakumar.

The BRS alleged that the letters were written to many companies offering incentives to come to Bengaluru.

Later, personal secretary to Shivakumar, Rajendra Prasad M N, filed a complaint with the Vidhana Soudha police on Saturday.

What does Apple's warning of 'state-sponsored attack' mean, experts explain

Apple said on Thursday (Nov 2) that iPhone demand in China remains strong, in an attempt to reassure investors who are worrying that the tech giant is losing ground to China's Huawei Technologies and other Chinese brands.

"In mainland China, we set a quarterly record for the September quarter for iPhone," Chief Executive Tim Cook told Reuters in an interview. "We had four out of the top five best-selling smartphones in urban China."

Cook reportedly said that Apple has gained market share in China in July-September, although overall, smartphone market has contracted.

He added that the company expects increase in iPhone sales in the holiday quarter.

According to research firm Canalys, overall smartphone sales in China fell by 3 per cent in July-September as compared to a year earlier. The reason? Consumers bought fewer smartphones in the wake of weak economic recovery.

However, there are signs that the slump is gradually easing.

He hoped that Apple would cooperate with the investigation by CERT-In on the issue.

"CERT-In has started its probe... they (Apple) will cooperate in this probe," Krishnan told reporters on the sidelines of an event related to the Meity-NSF research collaboration.

In his most substantial stock sale in two years, Apple's Chief Executive Officer, Tim Cook, has realised $41.5 million after taxes, as indicated in a U.S. securities filing.

Cook's recent transaction involved the sale of 511,000 shares, initially valued at approximately $87.8 million before factoring in tax deductions. This follows a significant stock sale in August 2021 that raked in $355 million for Cook.

The filing reveals that even after this sale, Tim Cook still retains ownership of around 3.3 million shares, with a total value of approximately $565 million.

While Apple's shares once soared to a record high of $198.23 in July, they have since experienced a 13 per cent decline. Investors have expressed concerns over the slower-than-expected recovery in smartphone demand.

Notably, Apple introduced its latest iPhone 15 lineup just last month, without increasing prices. This strategic move was seen by industry experts as a response to a global decline in smartphone sales.

Prior to the stock market's opening, shares of the Cupertino-based tech giant were down by 0.6 per cent.

In response to these market dynamics, analysts at KeyBanc downgraded Apple's stock rating from "overweight" to "sector-weight" on Wednesday. Their apprehensions primarily stem from worries that sales growth in the United States, Apple's largest geographical market, is poised to decelerate further in the fourth quarter. The brokerage highlighted the fact that escalating inflation was discouraging fewer American smartphone users from upgrading their devices.

A report from research firm Canalys projected a substantial 12 per cent decline in North American smartphone shipments for 2023, adding to the concerns surrounding Apple's performance in the region.

Apple CEO Tim Cook nets $41 million in largest stock sale in two years

China has been expanding oversight of mobile app usage over the past several years now it requires app stores to submit business details to the government and definitely is not very happy about this at all.

Beijing tightens oversight of mobile apps

Apple enforces new checks on apps in China

Apple has started requiring new apps to provide proof of a Chinese government licence before being made available on Apple's China App Store, joining local rivals that had adopted the policy years earlier to comply with the stringent state regulations.

According to information on Apple's website for developers, the company started forcing app developers last Friday (29 Sep) to submit the "internet content provider (ICP) filing" whenever they publish new apps on the App Store.

What is ICP filing?

An ICP filing is a long-standing registration method, which is necessary for websites to operate lawfully in China. Since at least 2017 most local app stores, including those run by Tencent and Huawei, have adopted it.

To obtain an ICP filing licence, developers need to have a firm in China or collaborate with a local publisher, which has been a barrier for many overseas apps.

Due to its lax ICP policy, Apple has been able to sell significantly more mobile apps than its local competitors, which has increased the US tech giant's popularity in China, its third-largest market after the Americas and Europe.

Apple made its decision after China further tightened its regulation of mobile applications in August by issuing a new rule requiring all app stores and app developers to submit an "app filing" with the regulators that contains information about their businesses.

Chinese regulators last week released names of the first batch of mobile app stores that completed app filings last week, but Apple's App Store was not on the list.

Apple has not responded to a request for comment.

Impact on the accessibility of apps

The accessibility of hundreds of thousands of apps on Apple's App Store in China, including well-known international apps like X, formerly known as Twitter, and Telegram, which gained popularity during protests over COVID-19 lockdowns last year, may depend on Apple's compliance status.

As Beijing places a greater emphasis on security, Apple is also having issues in China, as evidenced by some government organisations forbidding staff from using iPhones, as Reuters reported last month.

Rich Bishop, CEO of app publishing firm AppInChina, said demanding ICP filings from developers brings Apple one step closer to being fully compliant in China.

What developers and users have to say

Many developers have expressed their concerns about Apple's move on social media, fearing that the company may impose stricter rules to fully adhere to China's regulations.

Several iPhone users from China have reported on X that they might need to switch to Apple accounts from other countries to use their favourite apps.

Under the new rule, apps without proper filings will be penalized after the grace period, which will end in March next year, while newly built apps must comply with the law from September.

As Beijing tightens oversight, Apple imposes new check on apps in China

We have been hearing of many problems when it came to the iPhone 15 people across the globe have been complaining about quality issues in the new iPhones. Despite spending so much money people were unhappy with the way the new iPhone 15 model was heating up on the weekend. Apple has identified a few issues that can cause new iPhones to run warmer than expected including a bug in the iOS 7 software.

Apple identifies issues causing overheating iPhones 15

The highly-anticipated iPhone 15 Pro series made its global debut on September 22. However, shortly after people began using these devices equipped with the 3nm A17 Pro chip, reports of overheating problems started to emerge.

Apple has now officially addressed these concerns, attributing them to a combination of factors, including a bug in iOS 17 and certain third-party apps overloading the system.

The iOS 17 bug

Apple acknowledges that a few conditions can lead to the iPhone running warmer than expected.

While some initial warmth is common when setting up a new device due to increased background activity, it was abnormal for the heating to persist beyond the setup phase.

The company attributes this issue to a bug within iOS 17, which is causing the prolonged heating problem, reported Forbes.

In addition to the iOS 17 bug, Apple also identified problems with how certain third-party applications are interacting with the system.

These apps have been overloading the iPhone, exacerbating the overheating issue. Apple is actively collaborating with the developers of these apps to implement fixes that will be rolled out gradually.

Impact on long-term device performance

It's important to note that while these overheating issues are certainly a concern, they are not anticipated to have a lasting impact on the overall performance and efficiency of the iPhone 15 Pro series.

Apple assured users that it is committed to resolving these problems with the release of a forthcoming software update.

Apple has not provided a specific timeline for when users can expect these issues to be completely resolved.

Several third-party applications have been identified as contributing to excessive heating. Among them, Instagram (which has reportedly already received an update to mitigate the issue), Uber, and Asphalt 9, a popular racing game, have been named.

Contrary to speculations that the titanium build of the iPhone 15 Pro models might be the cause of the excessive heat, Apple's statement clarifies that the company is confident in its ability to resolve these issues. The overheating is attributed to software-related factors and is unrelated to the new titanium finish featured on the Pro models.

Among them, Instagram (which has reportedly already received an update to mitigate the issue), Uber, and Asphalt 9, a popular racing game, have been named. Apple claims software bug to be culprit behind iPhone 15 Pro overheating: Report

Apple Inc. is set to significantly increase its production capacity in India, with plans to expand its investment in the country to approximately $40 billion over the next four to five years.

Government sources, wishing to remain anonymous, disclosed this ambitious expansion strategy, noting that Apple had already crossed the $7 billion production milestone during the previous fiscal year.

According to the official, Apple's expansion in India is on course to extend beyond its current iPhone manufacturing operations. While iPhones have been manufactured in India, the company intends to begin the production of Airpods in the coming year. However, there are currently no immediate plans to manufacture iPads or laptops within India.

“They don't have any plans to participate in IT hardware PLI. They may come at a later stage but as of now their focus is to scale up existing production levels,” PTI quoted the official as saying.

Apple's commitment to India is evident in its recent product launches. On September 22, 2023, Apple introduced the highly anticipated iPhone 15 series, featuring the iPhone 15, iPhone 15 Plus, iPhone 15 Pro, and iPhone 15 Pro Max, which hit stores in India and various other countries simultaneously. Remarkably, Apple released the India-built iPhone 15 models on the same day they became available worldwide, underscoring India's importance in Apple's global production and distribution network.

Industry insiders cited by Business Today reported that the launch of the iPhone 15 series in India saw a remarkable 100 per cent growth in sales compared to the previous iPhone 14 series launch. Apple posted substantial financial figures for the fiscal year ending on September 25, 2022, with global iPhone sales reaching $191 billion and wearable, home, and accessories segment sales reaching $38.36 billion.

Market research firm Counterpoint Research also noted Apple's dominance in India's top smartphone market segment, which includes phones priced above Rs 45,000 ($541). Apple secured a 59 per cent market share in this category during the first quarter of 2023, confirming India's position as one of Apple's top five markets.

Apple's exponential growth in India's manufacturing and export landscape was highlighted by it surpassing Samsung as the leading exporter of smartphones from India. In the June quarter, Apple accounted for 49 per cent of the country's total smartphone shipments, compared to Samsung's 45 per cent, according to a report by the Economic Times. This highlights Apple’s rapid expansion and substantial investment in regional production and exports from India.

Apple aims to boost manufacturing and invest $40 billion in India: Report

Nearly three days after a fire incident caused the company to down shutters on the facility, Pegatron on Wednesday announced production had resumed at its Chennai facility in the southern Indian state of Tamil Nadu.

According to a Reuters report, citing government sources, manufacturing had resumed in a phased manner at the facility.

Multiple reports have claimed that the fire was sparked by a short-circuit after an electrical switch was left on, following testing of the devices as they were being put together.

After the incident, the Taiwanese firm confirmed "there was a spark incident" which was under control, adding that the incident did "not have significant financial or operational impact" for the company.

"There are no injuries, no casualties nor damage to other assets. The cause of the accident is currently under investigation by (the) relevant authority," Pegatron said.

Initial reports stated that Pegatron had cancelled two shifts on Monday. However, the company was forced to cancel shifts on the next two subsequent days as well.

It is understood that the factory works round-the-clock from Monday to Saturday with a scheduled off on Sundays. The factory's 24-hour workday is split into three shifts- A (6 am-2 pm), B (2 pm-10 pm) and C (10 pm-6 am).

Situated within the Mahindra World City in Chengalpattu district (nearly 60 km from the capital city of Chennai) of Tamil Nadu, the Pegatron facility is capable of assembling almost 20,000 iPhones per day.

The models being assembled here are Apple iPhone 14 Plus and 15 Plus. Considering the average cost of these models to be $1000, the impact of not operating for a day meant that $20 million worth of phones were not being produced.

Notably, Pegatron started assembling iPhones in India in September last year. Buoyed by the success of the plant, the company is in talks to open a second Indian facility for Apple near the current one in Tamil Nadu.
