Apple takes a surprising turn in the highly competitive Chinese smartphone market. The US tech giant is slashing prices on some of its iPhones by as much as 5%, a move aimed at countering the increasing pressure from local rivals such as Huawei and Xiaomi. This limited-time lunar new year promotion, scheduled from January 18 to 21, comes amid a challenging landscape for Apple.

Apple drops iPhone prices in China amid fierce competition

Apple Inc. has taken an unusual step by offering discounts of up to 500 yuan ($70) on its latest iPhones in China, marking a rare move that has triggered concerns about diminishing demand for its flagship device.

According to a Bloomberg report, the discounts, introduced on Apple's official website in China, are valid from January 18 to January 21, strategically timed ahead of the Lunar New Year shopping season.

This price reduction, equivalent to approximately 5 per cent off its top-tier iPhone models, signals a departure from Apple's traditional pricing strategy in the region.

The decision to slash iPhone prices comes in the midst of changing consumer preferences in China, where local brands like Huawei Technologies Co. are gaining popularity.

Apple's latest iPhone 15 faced disappointing sales compared to its predecessor after its debut in China last year, a trend attributed to a growing affinity for homegrown brands and the imposition of restrictions on the use of foreign devices in state-backed agencies and companies.

Jefferies' warning about a potential 30 per cent drop in 2023 iPhone sales in China adds to the apprehensions surrounding Apple's market position.

Analysts suggest that the introduction of Huawei's Mate 60 series with a 7-nanometer made-in-China processor, seen as a national breakthrough despite US sanctions, contributed to the decline in iPhone sales in the region.

Apple's move to discount its latest iPhones in China is a notable shift, considering its longstanding practice of refraining from price cuts on its newest devices.

The Lunar New Year discounts, a customary practice for Apple, have typically excluded the latest iPhone models. However, this year's offerings encompass discounts on the iPhone 13 to the iPhone 15 Pro Max, reflecting the company's acknowledgment of market dynamics and the need to bolster demand.

Apple's Chinese retail partners have previously offered more substantial discounts on the latest iPhones, but the Cupertino-based tech giant has now directly embraced the practice.

The discount initiative extends beyond iPhones, including the MacBook Air, various iPad models, select AirPods, and the Apple Watch SE. The MacBook Air, in particular, is witnessing a significant markdown, with Apple reducing its price by up to 800 yuan.

Microsoft takes Apple's crown, becomes world's most valuable company

Tech titans in valuation race

The valuation war between tech titans took an interesting turn on Thursday when Microsoft briefly overtook Apple as the world's most valuable company for the first time since 2021. This came as the iPhone maker's shares began 2024 on a weak note amid growing demand concerns.

Silicon Valley giants Apple and Microsoft are locked in a tight race for the title of world's most valuable company, with recent market shifts putting Microsoft within striking distance.

This is based on a Reuters report.

Apple's crown has grown unsteady, weighed down by declining iPhone sales in China and analysts doubts about the impact of its upcoming mixed-reality headset. Its shares have dipped 4 per cent this year, eroding its market capitalisation to $2.866 trillion.

Microsoft, on the other hand, is riding a wave of success, with its stock price up 2 per cent year-to-date and market value hitting $2.837 trillion. This surge is fuelled by the continued strength of its cloud computing business, Azure.

The gap between the two tech titans is narrow, with Apple clinging to a mere $29 billion lead. In December, the gap was even smaller.

Apple's iPhone performance, particularly in China, is a major concern. Jefferies analysts reported a 30 per cent drop in iPhone sales in China during the first week of 2024, raising fears about growing competition from Huawei and other domestic players.

While Apple's upcoming Vision Pro headset launch is its biggest product reveal since the iPhone, analysts at UBS doubt its immediate impact on earnings. They predict its contribution to be "relatively immaterial" in 2024.

This isn't the first time Microsoft has threatened Apple's top spot. Since 2018, they have briefly exchanged positions several times, including in 2021 when COVID-related supply chain issues hit Apple hard.

Both companies currently trade at relatively high valuations compared to their expected earnings. Apple's forward price-to-earnings ratio is at 28, significantly above its historical average of 19. Microsoft fares slightly better at 31, still surpassing its 10-year average of 24.

Apple's recent quarterly report offered a lukewarm outlook for the holiday season, missing Wall Street expectations due to weak demand for iPads and wearables. Analysts still anticipate a meagre 0.7 per cent revenue increase for the December quarter, marking the first year-on-year increase in four quarters. Apple's official results are due on February 1st.

Microsoft, on the other hand, is expected to report a 16 per cent revenue increase to $61.1 billion in the coming weeks, driven by the robust performance of Azure.

Silicon Valley Showdown: Microsoft nips at Apple's crown as world's most valuable company

Apple has lodged a challenge against the European Union's tech rules, specifically contesting the classification of its five App Stores as a single core platform service under the Digital Markets Act (DMA).

According to a Reuters report, the company argues that EU regulators have misunderstood and misapplied the legislation, which became effective in May 2022.

Apple, in its plea to the General Court, criticised the European Commission, stating that it made "material factual errors" by considering the five App Stores as a single core platform service.

Apple contends that each App Store is designed for a specific operating system and Apple device, encompassing iPhones, iPads, Mac computers, Apple TVs, and Apple Watches.

The DMA, designed to regulate tech giants, imposes certain obligations on companies like Apple, including facilitating third-party interoperability with its services and allowing business users to promote offers and conclude contracts outside its platform.

Apple challenges the characterisation of its operating system, iOS, as a significant gateway for business users to reach end users, questioning the associated interoperability obligations.

The lawsuit, filed in November 2022, highlights the company's resistance to complying with the DMA's requirements, signalling potential legal battles between tech giants and EU regulators.

Apple's legal action extends beyond App Stores and iOS, addressing the European Commission's designation of its messaging service, iMessage, as a number-independent interpersonal communications service (NIICS).

This designation prompted an EU investigation into whether iMessage should comply with DMA rules.

Apple challenges EU rules on App stores and iOS designation as one service

Users who filed compensation claims in the Apple "batterygate" controversy are now receiving payments from the tech giant. Apple had agreed to a settlement of up to $500 million to resolve a lawsuit related to the issue, and reports from Mac Rumors indicate that some users have seen payments, such as $92.17 (approximately ₹ 7,600), deposited into their accounts.

Background: What's the 'batterygate' saga?

The "batterygate" saga unfolded in 2017 when a developer in the United States revealed that certain iOS 10 updates were causing slowdowns in earlier iPhone models like the iPhone 6S and iPhone 7.

Users alleged that this intentional slowing down misled them into thinking their phones were aging rapidly, pushing them to replace or install new batteries.

Apple had initially not disclosed the reason for the slowdown, claiming it was to prevent abrupt shutdowns when the battery hit a particular threshold.

Numerous class-action lawsuits were filed, accusing Apple of prompting premature phone updates rather than merely offering affordable battery replacements.

In 2018, Apple issued an apology for the lack of transparency and reduced the price of iPhone battery replacements to $29.

Apple explained that its engineers promptly addressed the issues, attributing them to consumption spikes, temperature fluctuations, and other factors.

However, in 2020, while denying wrongdoing, Apple settled the nationwide case to avoid the costs and burdens of prolonged litigation.

'Fully embellished': Indian minister rebuts report on centre allegedly targetting Apple

Apple has secured a temporary victory in its legal tussle over smartwatches, as a US appeals court temporarily lifted a government commission's import ban imposed in a patent dispute with medical technology firm Masimo.

The tech giant swiftly filed an emergency request with the US Court of Appeals for the Federal Circuit, seeking a halt to the US International Trade Commission's (ITC) order that claimed Apple had violated Masimo's patents.

The ITC had banned imports and sales of certain Apple Watches featuring blood-oxygen level reading technology, citing patent infringement.

While a final decision could potentially lead to significant financial repercussions for both companies, analysts note that the adverse publicity generated by the lawsuit may overshadow any financial impact on Apple. Following the court's decision, Masimo shares closed 4.6 per cent lower, while Apple's shares remained flat.

Apple expressed its enthusiasm to reintroduce the Apple Watch line-up to customers, stating, "We are thrilled to return the full Apple Watch line-up to customers in time for the new year."

The company plans to resume sales of the Apple Watch Series 9 and Apple Watch Ultra 2, featuring the blood oxygen feature, in the US.

Masimo, based in Irvine, California, refrained from commenting on the court decision. The ITC's ban, in place since Apple's Series 6 model in 2020, centred on technology for blood-oxygen level monitoring.

Masimo accused Apple of coaxing its employees, stealing pulse oximetry technology, and incorporating it into Apple Watches. Apple, in turn, countersued, characterising Masimo's legal actions as a strategy to pave the way for its own competing smartwatch.

Stuart Cole, Chief Macro Economist at Equiti Capital, noted that Apple's focus is not just on the blood oxygen monitoring software but also on the broader implications for its future health-wearable products. He emphasised that Apple, with its financial strength, can develop its blood monitoring software, but the public relations aspect remains a significant concern.

In response to Apple's motion for a longer-term pause during the appeals process, the appeals court issued a four-paragraph ruling, temporarily lifting the ban. The court has given the ITC until January 10 to respond to Apple's request.

Meanwhile, the Biden administration opted not to veto the ban, allowing it to take effect. Apple is actively exploring legal and technical options, and the US Customs and Border Protection is evaluating redesigned versions of Apple Watches to determine potential patent infringement.

This legal battle has led to a temporary pause in Apple's sales of the affected devices in the US, though they remain available through various retailers. The ban specifically targets Apple Watches with blood-oxygen monitoring, leaving the less-expensive Apple Watch SE unaffected. A jury trial earlier this year in California federal court regarding Masimo's allegations against Apple ended with a mistrial.

Apple expressed its enthusiasm to reintroduce the Apple Watch line-up to customers, stating, "We are thrilled to return the full Apple Watch line-up to customers in time for the new year." The company plans to resume sales of the Apple Watch Series 9 and Apple Watch Ultra 2, featuring the blood oxygen feature, in the US. (With inputs from Reuters) WATCH WION LIVE HERE

Apple wins reprieve in smartwatch battle as appeals court lifts import ban

Apple is currently entangled in a dispute with medical technology company masimo, following a ban on imports of its watches. The ban, initiated by the u.S. International trade commission (itc), is a response to allegations from masimo, accusing apple of employee poaching and the misappropriation of pulse oximetry technology.

A ban restricting imports of Apple Watches in the United States has gone into effect. Here is a look at what the ban means for consumers & what is next for Apple.

What's next after the US Apple Watch import ban?

President Joe Biden administration in the US has refused to reverse a government tribunal's decision to impose ban on Apple Watches. Reuters reported that US Trade Representative Katherine Tai decided not to veto import ban on Apple's Series 9 and Ultra 2 smartwatches. The order of import ban has been passed by US International Trade Commission (ITC) following a complaint from Massimo, a medical monitoring tech company. The company has accused Apple of stealing its pulse oximetry technology and hiring away its employees.

ITC's order on import ban has gone into effect on Tuesday (Dec 26). Apple has decided to appeal the ban in US Court of Appeals for the Federal Circuit in Washington. The tech giant had previously made a request to ITC to pause the ban during the appeal process. The request has been rejected.

Apple claims that Masimo's legal action is just a "manoeuvre to clear a path" so that the company can introduce its own smartwatch to compete with Apple.

Apple has also sued Masimo for patent infringement in federal court in Delaware.

In the US, a presidential administration has not reversed ITC's ruling since the year 2013. At the time, administration led by president Barack Obama overturned import ban on Apple iPhones during the tech giant's patent dispute with Samsung.

In response to a patent dispute affecting the blood oxygen feature, Apple has announced the temporary suspension of sales for its Series 9 and Ultra 2 smartwatches in the United States, as reported by Reuters.

The move follows an October order from the US International Trade Commission (ITC) that could prohibit Apple from importing these smartwatches due to alleged patent violations against medical technology company Masimo.

The ITC order, currently under review by President Joe Biden until December 25, may take effect on December 26 if not vetoed. Apple has indicated that it will comply with the ruling if it stands. The ban would restrict the import of Apple Watches and is based on the allegation that the devices violate Masimo's patent rights.

Apple has outlined its compliance plan, announcing a pause in sales on its website starting from December 21 and in Apple retail locations after December 24. However, models without the blood oxygen sensor, such as Apple's lower-priced Apple Watch SE, remain unaffected.

While the impact on holiday sales is expected to be minimal, Ryan Reith, program vice president for research firm IDC's mobile device tracking efforts, anticipates the full effect in January and February. Reith notes that Apple has sufficient inventory of Watch 8 and SE to meet demand during this period.

Masimo CEO Joe Kiani expressed openness to negotiating a deal with Apple in October. The company, in a statement, emphasised the importance of respecting the ITC decision to protect intellectual property rights. Apple, holding about a quarter of the global smartwatch market, plans to appeal the decision to the Federal Circuit.

In response to the ban, Apple is reportedly making changes to algorithms in the smartwatches to address the dispute. The technology's oxygen saturation calculation and consumer data presentation are being tweaked by engineers. Apple is exploring legal and technical options and has begun preparing stores for potential changes.

While the ban does not impact sales outside the United States, Apple's wearables, home, and accessory business, including the Apple Watch, generated $8.28 billion in revenue during the third quarter of 2023.

More Chinese agencies and state-backed companies across the country have asked their staff to not bring Apple iPhones and other foreign devices to work, Bloomberg News reported on Friday, citing people familiar with the matter.

For over a decade, China has been seeking to reduce reliance on foreign technologies, asking state-affiliated firms such as banks to switch to local software and promoting domestic semiconductor chip manufacturing.

Multiple state firms and government departments across at least eight provinces have instructed employees in the past month or two to start carrying local brands, the Bloomberg News report said.

Apple did not immediately respond to Reuters' request for a comment.

In December, smaller firms and agencies in lower-tier cities from provinces including Zhejiang, Shandong, Liaoning and central Hebei, which houses the world's largest iPhone factory, issued their own verbal directives, the Bloomberg News report said.

Reuters reported in September that staff in at least three ministries and government bodies were told not to use iPhones at work.

Apple's shares were marginally down at $196.50 in extended trading.

As trade tensions between Washington and Beijing continue to escalate, Apple is chalking up a strategy of diversifying its operations. India has already been a base for assembling and manufacturing iPhones for Apple and bringing battery production might be the next logical step.

The wheels have already started moving to make the change happen. Earlier this month Union Minister Rajeev Chandrasekhar announced that Japanese electronic part maker TDK Corp will begin manufacturing lithium-ion battery cells for Apple iPhones in India.

“Another big win for PM @narendramodi ji’s visionary PLI scheme in shifting the mobile manufacturing ecosystem to India. Blow for China: Apple prefers India to manufacture batteries for next-gen iPhone 16 - Report

Disruptions have hit Apple's supply chain as heavy rains and Cyclone Michaung created chaos in Chennai in India. Foxconn and Pegatron, major iPhone manufacturers have temporarily halted production at their facilities, affecting Apple's output.

Cyclone Michaung: Chennai floods disrupt iPhone manufacturing at Foxconn & Pegatron | World DNA

Taiwanese tech giants Foxconn and Pegatron on Monday (Dec 4) halted production of Apple iPhones at their facilities near the south Indian city of Chennai in Tamil Nadu, owing to the incessant rains in the region brought by Cyclone Michaung, according to a Reuters report.

The company is yet to take a call on whether to resume production on Tuesday (Dec 5). Foxconn employs as many as 35,000 people at its factory and the halt could have serious ramifications on the production of the iPhones.

This is the second time in recent months that Pegatron has had to bring shutters on production. In September, the Pegatron facility was shut for three days due to a fire accident.

Multiple reports at the time claimed that the fire was sparked by a short-circuit after an electrical switch was left on, following testing of the devices as they were being put together.

The models being assembled at Pegatron are Apple iPhone 14 Plus and 15 Plus. Considering the average cost of these models is around $1000, the impact of not operating for a day means that $20 million worth of phones are not produced.
