Batsman Dawid Malan will replace Ben Stokes in England's One-Day International squad for the upcoming five-match series in Australia.
The replacement comes as Stokes is unavailable following an incident outside a Bristol nightclub in September.
According to reports, the ECB has decided that the case against him is unlikely to be resolved before the ODI series, starting on January 14.
Stokes was arrested in Bristol in September and the 26-year-old spent the night in prison but was later released without any charge.
His case was handed over to the Criminal Prosecution Service by Avon and Somerset police in late November.
Meanwhile, Malan has had a good tour of Australia so far.
He made an impressive international debut in T20Is against South Africa scoring an aggressive 44-ball 78 runs.
He was awarded with a Test cap during the four-Tests against Proteas.
After the fifth and final Ashes Test, England will gear up for five ODIs and a T20I tri-series against Australia and New Zealand.
