The government has rejected a long-standing demand of the armed forces for higher Military Service Pay (MSP) for over 1.12 lakh military personnel including Junior Commissioned Officers of the Army, official sources said Tuesday.

They told PTI that the Army headquarters is "very anguished" over the decision by the Finance Ministry, and will seek its immediate review.

Around 1.12 lakh military personnel including 87,646 JCOs and 25,434 personnel of equivalent rank from the Navy and the Indian Air Force will be affected by the decision.

The demand was to increase the monthly MSP from Rs 5,500 to Rs 10,000 and the total annual financial outgo would have been Rs 610 crore if the government had accepted the demand, sources said.

The MSP for the military personnel was introduced recognising their unique service conditions and hardships.

"The proposal for higher MSP for JCOs and equivalent rank of the Navy and IAF has been rejected by the Finance Ministry," said a source.

At present, the MSP has two categories -- one for officers and another for JCOs and jawans.

The seventh Pay Commission had fixed Rs 5,200 as MSP per month for JCOs and jawans while putting it at Rs 15,500 for officers between Lieutenant-rank and Brigadier-rank.

The Army has been pressing for granting an higher MSP to the JCOs, arguing that they are gazetted officers (Group B) and play a very vital role in command and control structure of the force.

"Since JCOs are Group B gazetted officers and also have a considerable length of service, it is incorrect to grant them MSP on par with the jawans.

It is very unfair," said a military officer who wished not to be named.

The Army had taken up the issue strongly with the Defence Minister and the three services as well as the Defence Ministry were on the same page on the issue, the sources said.

The MSP was first introduced by the 6th Pay Commission, accounting for compensation for intangible aspects of military service.

It accounts for a range of "hardships and disadvantages" which cannot be evaluated while assessing pay comparability.

The concept of MSP for armed forces personnel is widely prevalent in European countries.

The armed forces were pressing for a separate slab of MSP for JCOs and equivalent rank.

In November last year, the Army clarified JCOs are gazetted officers and cancelled a seven-year-old note describing them as "non-gazetted" officers.

The decision by the Army came amid growing resentment among a large section of its officers over the controversial issue of rank-parity between them and their civilian counterparts in the service headquarters.

The Supreme Court on Tuesday allowed the Income Tax Department to reopen tax assessment of top Congress leaders Rahul and Sonia Gandhi for 2011-12 in connection with the National Herald case.

The apex court, however, restrained the department from implementing its order in the proceedings against Rahul, who is the Congress president, and his mother Sonia till the pendency of the matter before the court.

The court also said that it was not expressing any opinion on the merits of the pleas filed by Rahul and Sonia Gandhi in the case.

The tax matter is related to the National Herald case in which the Congress leaders are also facing criminal proceedings.

A bench headed by Justice A K Sikri posted the matter for further hearing on January 8.

Solicitor General Tushar Mehta, appearing for the I-T department, said the court should not restrain it from implementing the assessment orders against the Gandhis and others.

He said the court should hear the matter and pass appropriate orders.

However, the bench, also comprising Justices Ashok Bhushan and S Abdul Nazeer, said that due to the paucity of time, the matter cannot be heard on Tuesday and it is just an interim order which should be equitable to both the parties.

It made it clear that it is not going into the merits of the case for which it requires a detailed hearing.

The Gandhis and senior Congress leader Oscar Fernandes have challenged the Delhi High Court's September 10 verdict that dismissed their plea against the re-opening of their tax assessments for 2011-12.

The apex court on November 13 had said it would hear final arguments on December 4 on the matter which required "consideration".

It had not issued formal notice on the petitions filed by Rahul, Sonia and Fernandes as the I-T Department was represented by its counsel.

They have challenged the judgement of the high court which had given the opportunity to the department to scrutinise their records.

In the last hearing, their lawyers had said the question was whether the reasons given in the notice by the department were right or not.

Senior advocates Kapil Sibal, P Chidambaram and Arvind Datar have been appearing for the Congress leaders.

The income tax probe against the Congress leaders has arisen from the probe into a private criminal complaint filed by BJP leader Subramanian Swamy before a trial court here in connection with the National Herald case, in which the trio is out on bail.

Sonia and Rahul were granted bail in the case by the trial court on December 19, 2015.

A tax evasion petition (TEP) was also addressed to the finance minister by Swamy.

In the complaint before the trial court, Sonia, Rahul and others have been accused of conspiring to cheat and misappropriate funds by paying just Rs 50 lakh, through which Young Indian (YI) had obtained the right to recover Rs 90.25 crore Associated Journals Ltd (AJL) owed to the Congress party.

It was alleged that YI, which was incorporated in November 2010 with a capital of Rs 50 lakh, had acquired almost all the shareholding of AJL, which was running the National Herald newspaper.

The I-T department had said the shares Rahul has in YI would lead him to have an income of Rs 154 crore and not about Rs 68 lakh, as was assessed earlier.

It has already issued a demand notice for Rs 249.15 crore to YI for the assessment year 2011-12.

The Supreme Court on Tuesday allowed the Income Tax Department to reopen tax assessment of top Congress leaders Rahul and Sonia Gandhi for 2011-12 in connection with the National Herald case.

Senior Bharatiya Janata Party leader Subramanian Swamy on Tuesday alleged that there could be Congress party`s hand in the Bulandshahr violence, which left two people, including a senior police officer, dead on Monday.

"This incident occurred because of some miscreants, we will find out whether they were Congressmen who are trying to give a bad name to Uttar Pradesh chief Minister Adirtyanath Yogi government or something else," Dr Subramanian Swamy told.

Responding to the Congress party`s allegations that "Uttar Pradesh is burning and Yogi is busy in campaigning", Swamy said, "Wasn`t India burning during 1984 anti-Sikh riots? In fact, nothing has brought us as bad a name as the genocide of 1984. What about thousands of innocent people who were put in jail without any trial during the emergency?"

Violent protests erupted in Uttar Pradesh`s Bulandshahr district on Monday, over reports of a cattle carcass lying in the fields.

The angry mob threw stones and torched vehicles outside a police station. Inspector Subodh Verma and a local youth, identified as Sumit, died in the clashes.

"Two people have been taken to custody. A Special Investigation Team has been formed to investigate why the violence happened and why the police personnel left Inspector Subodh Kumar alone," Prashant Kumar, ADG Meerut Zone, told.

The Supreme Court of India on Monday deferred hearing on the plea of Zakia Jafri till the third week of January 2019.

According to reports, Jafri's plea challenges the clean chit given by the Special Investigating Team (SIT) to PM Narendra Modi, who was then Gujarat Chief Minister, in connection with the 2002 post-Godhra riots.

Jafri's plea was deferred till November 26 by the apex court previously.

Zakia, the wife of Ehsan Jafri, an ex-Congress lawmaker who was killed in one of the worst incidents during the riots, has challenged the Gujarat High Court's October 5, 2017 order rejecting her plea against the SIT's decision, news agency PTI reported.

A bench headed by Justice A M Khanwilkar said, "The matter will take some time for hearing. The plea will be heard on November 26".

During the previous hearing, Ms Jafri's counsel had said that notice needs to be issued in the plea as it pertains to the aspect of alleged "larger conspiracy" during the period from February 27, 2002 and May 2002 and had also maintained that after the SIT gave a clean chit in its closure report in the case before a trial judge, a protest was filed by the petitioner which was dismissed by the magistrate without considering "substantiated merits".

On February 8, 2012, the SIT filed a closure report, giving the clean chit to PM Modi and 63 others, including senior government officials, saying there was "no prosecutable evidence" against them.

The CBI has said Jain and his relatives had stakes in companies Prayas Info Solutions, Akinchan Developers, Mangalyatan Projects and Indo Metal Impex Pvt Ltd.

The CBI on Monday chargesheeted Delhi minister Satyendar Jain for allegedly amassing assets to the tune of Rs 1.47 crore, which the agency said was “217.20 per cent” above his known sources of income between 2015-17.

In the chargesheet filed in special CBI court at Patiala House, the agency alleged that “ill-gotten money” was routed to four companies controlled by Jain and his relatives through “accommodation entries” — a term used for hawala transfers — in Kolkata-based shell companies.

It alleged that his wife Poonam Jain was actively involved in the process hence she has been made accused along with Jain’s business associates and relatives — Ajit Prasad Jain, Vaibhav Jain, Sunil Kumar Jain and Ankush Jain.

The CBI has said Jain and his relatives had stakes in companies Prayas Info Solutions, Akinchan Developers, Mangalyatan Projects and Indo Metal Impex Pvt Ltd.

Jain, the minister for health, home, power, PWD, industries, urban development and flood and irrigation in the Aam Aadmi Party’s Delhi government, was director in all but one — Mangalyatan Projects, the CBI alleged.

Although he resigned from the directorship before Delhi Assembly elections in 2013, family members continued to hold shares in these companies and his shares were transferred to his wife on February 10, 2015 through whom he kept “effective” control over the firms, the agency has alleged.

It is alleged that three companies — Prayas Info Solutions, Akinchan Developers, and Mangalyatan Projects — received Rs 1.53 crore as accommodation entries from Kolkata-based shell companies.

The CBI has alleged that there is no explanation for Rs 1.47 crore, which is 217.20 per cent over and above his legitimate income between 2015 and 2017.

The CBI has alleged that Jain was assisted in routing this “ill-gotten money through shell companies” by chartered accountant JP Mohta and a hawala operator Rajendra Bansal.

It has claimed that he and Vaibhav Jain sent money to Bansal, who in turn provided accommodation entries in the form of share application money in the said firms from the shell companies between 2010 and 2016 — even after becoming minister in the Aam Aadmi Party government.

Reacting to the development, Delhi Chief Minister Arvind Kejriwal said on Twitter that Jain is being charged because of his scheme to convert unauthorised colonies into regular ones as Prime Minister Narenda Modi is fearful of that.

He said people will give a reply to Modi.

The CBI has said Jain and his relatives had stakes in companies Prayas Info Solutions, Akinchan Developers, Mangalyatan Projects and Indo Metal Impex Pvt Ltd. The CBI on Monday chargesheeted Delhi minister Satyendar Jain for allegedly amassing assets to the tune of Rs 1.

Bharatiya Janata Party (BJP) chief Amit Shah on Monday said that Congress president Rahul Gandhi did not know if he were campaigning for the BJP as he often used Prime Minister Narendra Modi`s name in his speeches.

Addressing an election rally here, Shah said, "Rahul Gandhi uses the name of Modi ji more than the BJP. We don`t understand if he is campaigning for the Congress or for the BJP."

Claiming that BJP will win assembly elections of Madhya Pradesh and Rajasthan, Shah said, "Rahul should stop daydreaming of winning these two states because the BJP government is an immovable foot of Angad (a character in Ramayana). Nobody can oust the BJP from the state," he said.

Continuing his tirade attack against the Congress, Shah even questioned the existence of Congress stating, "Time has come that one needs a telescope to find if Congress exists."

Comparing the work of the Congress and BJP in Rajasthan, Shah said, "During the Congress regime, the total budget for Rajasthan was only Rs 1.9 lakh crore. When Prime Minister Narendra Modi took the charge in Delhi, the state's budget was raised to more than Rs 2.63 lakh crore."

Shah also raked up the issue of surgical strikes, carried out by India against terror camps in Pakistan-occupied Kashmir in 2016. He said that the Congress was ashamed of saying 'Bharat Mata ki Jai.'

Shah also praised the efforts of Rajasthan Chief Minister Vasundhara Raje.

"She provided free electricity to the state farmers, free health check-up under Bhamashah Yojana, loans under Mudra Bank scheme and gas connections and free mobiles to women," he said.

The 200-member Rajasthan Assembly is scheduled to go to polls on December 7.

The counting of votes will take place on December 11.

Rahul doesn't know if he campaigns for BJP or Congress: Amit Shah

BJP president Amit Shah Monday asserted all “intruders” would be pulled out of the country if BJP was voted back in 2019, as he appealed to people to return the Vasundhara Raje government in Rajasthan and the Modi government at the Centre.

Addressing a public rally here, he said if the BJP led dispensation is re-elected, “each and every intruder from Kashmir to Kanyakumari would be identified and pulled out of the country”.

Shah criticised Congress national president Rahul Gandhi terming surgical strike to be ‘BJP’s political assets’ saying that martyrdom and sacrifices of the soldiers, pain and plight of their families fail to be visible to “Rahul Baba through his Italian goggles’.

Shah slammed Rahul Gandhi and the Congress party for “worrying and growing restless for the 40 lakhs intruders” the BJP government had identified after assuming power in Assam

It may be recalled that as many as 40 lakh people were left out in the final draft of the National Register of Citizens (NRC) in Assam and the process of filing of claims and objections of these people commenced in September.

‘Are they (intruders) your (Rahul’s and Congress’) cousin and that’s why you are worrying where they would go, what they would eat…?’ Shah asked and alleged Congress perceived its vote bank in intruders as they (Rahul’s and Congress’)don’t worry about the safety and security of the nation.

Shah mocked at Rahul Gandhi and the Congress party for raising questions over Vijay Mallya and Nirav Modi fleeing the country and said this was due to stern and strict rules and regulations brought by the Modi government.

Shah charged that the Congress during its ten years of rule gave away huge loans through banks that eventually turned NPA.

“They (people like Mallya and Nirav Modi) did not flee during their reign (Congress) because they (Congress) had their share with them”, Shah alleged. ‘Chor –chor Mosere Bhai’, he added.

Counting the achievements of the Centre and Vasundhara Raje’s state government in Rajasthan, the BJP president said the Modi government, among other things, has given gas connections to about 6 crore mothers, two crore houses, 2.5 crore electricity connections and 8 crore toilets.

The Supreme Court Monday refused to entertain a fresh plea seeking imposition of a lifetime ban on lawmakers following their conviction in criminal cases.

A bench headed by Chief Justice Ranjan Gogoi dismissed the petition filed by NGO ‘Lok Prahari’ through its General Secretary S N Shukla, saying that it was already seized of a similar petition on the same issue.

“We are already examining the same thing in a petition filed by Ashwini Kumar Upadhyay,” said the bench, also comprising Justices S K Kaul and K M Joseph.

The apex court dismissed the petition as it was already scheduled to hear a similar PIL filed by lawyer and BJP leader Upadhyay tomorrow, who in his plea has sought to bar of convicted politicians for life.

“Why have you filed a separate petition when the court is seized of the same issue in another pending petition. We don’t think we need to hear it. Dismissed,” the bench said.

The bench while listing Upadhyay’s plea for hearing on December 4 had said that it could not lose sight of the fact that the PIL was seeking a lifetime ban on politicians convicted in the criminal case, besides setting up of special courts to expeditiously try criminal cases involving elected representatives.

“We should not lose sight of the fact that the main prayer in the PIL is to impose the lifetime ban on convicted elected representative,” the bench said, adding that the government servants and judicial officers cannot come back after their convictions.

At present, a legislator, when convicted is debarred for six years from contesting elections.

The apex court has been approached with several pleas seeking a lifetime ban on lawmakers as the provision stood for the judiciary and the executive, where one could not hold office post-conviction.

The Centre during the last hearing in the matter had submitted that it had no objection in setting up of special courts for exclusively trying the criminal cases involving elected representatives. However, it has not been in favour of banning the convicted lawmakers for life.

The apex court was earlier informed that 12 special courts set up to try lawmakers exclusively have not been constituted on a uniform pattern, and their number needs to be raised to 19 for trying cases at the sessions level.

It was also suggested to the top court that another 51 such courts are required for magisterial trial cases.

The amicus had further said that special courts were constituted to exclusively deal with all cases including complaint cases against MPs, MLAs including the former ones, irrespective of the fact as to whether the same was committed when the concerned lawmaker was holding the said office

"...We are in the advanced stage of consultation. We are confident of complete support of the state government for allowing us the much-required land for infrastructure augmentation," he said.

On talks with the Sri Lankan Navy and Coast Guard that are likely to be held in May 2019, Bhatnagar said that these are centred around smuggling of contraband goods, counterfeit currency and other illegal activities.

"Besides, we will put forth before Sri Lanka, the concerns of the Indian fishermen and tell the island nation not to harm them when they cross maritime limits accidentally," he said.

In a punitive action, the Navy has encashed a bank guarantee given by the Reliance Naval Engineering Ltd due to inordinate delay in supplying five offshore patrol vessel and said Monday the deal is being looked into.

"There is no preferential treatment being given to RNEL. Its bank guarantee has been encashed. Punitive action has been taken against it. The process is being taken forward," Navy Chief Admiral Sunil Lanba said at a press conference.

The Navy Chief was asked about the huge delay in delivery of the vessels by the company and whether Navy is under any pressure to not initiate any action against the company.

Admiral Lanba said the deal is not being cancelled at the moment but added that it is being looked into, indicating that government may take a call on the issue.

The Navy chief also said that the company is undergoing corporate debt restructuring.

There was no immediate reaction from RNEL about the Navy Chief's comments.

Anil Ambani's Reliance Defence has been at the centre of a controversy over the Rs 58,000-crore Rafale jet fighter deal. The Congress has accused the government of favouring the company.

The company, as well as the government, have rejected the charges.

The original contract worth Rs 3,000 crore for five offshore patrol vessels was won by Pipavav Defence and Offshore Engineering in 2011. The company was bought over by Anil Ambani group in 2016.

According to the original contract, the first vessel was to be delivered by early 2015. However, the deadline was pushed several times.

West Bengal Chief Minister Mamata Banerjee said the BJP will be ousted from power at the Centre like the CPI(M) was removed from the state.

The Bharatiya Janata Party (BJP) government had only changed the names of historical places in the country, Banerjee, a strident critic of the saffron party, said.

"We are not afraid of the red eyes of Delhi. The BJP will be out of power at the Centre soon. We (TMC) drove away from the CPI(M) from Bengal, the BJP will be ousted from power at the Centre by people in the near future. This is is our pledge, our commitment," she said, speaking at a rally here in Paschim Midnapore district.

Banerjee, who is also the Trinamool Congress (TMC) supremo, has called a mega rally of opposition parties in Kolkata on January 19 next year as part of efforts to stop the BJP from coming back to power in the 2019 Lok Sabha election.

Slamming the saffron party's Hindutva agenda, she said, "I have great respect for the seers of the Ramakrishna Mission. But I do not respect those in the BJP, who only do drama in the name of Hindutva."

In an apparent reference to Uttar Pradesh Chief Minister Yogi Adityanath's recent statement in poll-bound Rajasthan that Hanuman was a Dalit, Banerjee alleged that the BJP was insulting the Dalits. She, however, did not take any name.

The chief minister accused the BJP of converting institutions like the Central Bureau of Investigation (CBI) and the Reserve Bank of India (RBI) into its party offices. "This has never happened before," she said.

Banerjee claimed that the Communist Party of India (Marxist) workers, who used to torment the people of the state during the previous Left Front rule, had now shifted to the BJP and were trying to mislead people.

Prime Minister Narendra Modi on Monday escalated his attack on the Congress party, which he said, is "a university for spreading lies and falsehood."

"The Congress party has become a university for spreading lies and falsehood. When anyone gets admission to do PhD and those who are more proficient in speaking lies get higher marks, they are given a new position and a degree," the Prime Minister said while addressing an election rally here.

Asserting that the Bharatiya Janata Party (BJP) will retain power in Rajasthan, Prime Minister Modi said the Congress party was highly mistaken if they believed that they would win the state Assembly polls "on the basis of lies."

"They were thrown out from other states and they will also face the same fate here," the Prime Minister said. He added that the Congress does not believe in the politics of progress and development, and only concentrates on professing caste-based politics.

Sharpening his attack on Congress president Rahul Gandhi, who had accused him of not knowing anything about Hinduism religion, Prime Minister Modi said, "Now, this 'naamdaar' (Rahul) is saying that I don't have knowledge on Hinduism. Will this topic even determine the voting process in Rajasthan?"

"Hinduism and Hindutva are ancient ideologies that are so rich that I can never know the entire thing. Many learned men and intellectuals also don't claim that they know the entire thing. However, the Congress seems to know what the greatest intellectuals don't," he added.

Taking on the Congress for not prioritising cleanliness drives in the country when they were in power at the Centre, Prime Minister Modi asserted that the party never spoke on the topic before in the last 70 years.

Highlighting the works done by BJP government in Rajasthan under the 'Swachch Bharat Abhiyan', Prime Minister Modi said, "I started the Swachch Bharat Abhiyan, which not only cleaned the country but also generated employment. When I came to power, I didn't promise to construct hotels. Instead, I promised to construct toilets. In Rajasthan alone, 80 lakh toilets have been constructed so far."

Lauding the Bishnoi community in Jodhpur for laying down their lives for the protection of the environment, Prime Minister Modi said, "When the people didn't know about climate change ages back, it was this community who really cared for our environment. It is because of them that India today has won the 'Champion of the Earth' award." He also informed that Chief Minister Vasundhara Raje approved 7000 megawatts of solar energy project in the state.

Prime Minister Modi went on to say that while the Congress harboured loan defaulters, the BJP made stringent laws under the Insolvency and Bankruptcy Code, under which Rs 3 lakh crore have been recovered.

The 200-member Rajasthan Assembly is scheduled to go to polls on December 7. The counting of votes will take place on December 11.

In an alleged statement, the Liberation Tigers of Tamil Eelam (LTTE) has claimed that they had 'no link' in the assassination of former Prime Minister Rajiv Gandhi in May 1991.

The alleged letter from LTTE has been signed by their Political Wing representative Kurburan Guruswami and Legal Wing representative Lathan Chandralingam.

Claiming itself to be an organization "by the people, for the people and of the people of Tamil Eelam," LTTE, in its alleged statement, said that time and again they have "clearly demonstrated with evidence in support that the LTTE has not been involved in any kind with the murder of Rajiv Gandhi, this unverified allegation is still being imposed."

"Due to this defamation campaign, our people are being pushed into instability. Some others even go too far as to assert that the lives of the 1,50 000 people killed in Mullivaikaal do not worth altogether to the single life of Rajiv Gandhi".

"This declaration is hurting," the alleged statement read.

"The LTTE never intended to demolish the leadership of India nor attack India. We never turned our guns toward any person or leader who was not part of Sri Lanka. We never planned any attack against any non-Sri Lankan leader. We never developed any action against any national leader of India," it added.

It further claimed that "the pre-planned murder of Rajiv Gandhi is the result of a conspiracy motivated by the purpose of dismantling the strong relationship between the Indian government and the LTTE."

"We ask for an immediate cessation of this allegation of defamation upon the LTTE concerning the murder of Rajiv Gandhi. As a result, we hope to put an end to the infamy on the LTTE on an international platform and that the International Community would at last end the ban on the LTTE that prevents our People to breathe the air of freedom," LTTE added.

Claiming itself to be an organization "by the people, for the people and of the people of Tamil Eelam," LTTE, in its alleged statement, said that time and again they have "clearly demonstrated with evidence in support that the LTTE has not been involved in any kind with the murder of Rajiv Gandhi, this unverified allegation is still being imposed." "Due to this defamation campaign, our people are being pushed into instability. It further claimed that "the pre-planned murder of Rajiv Gandhi is the result of a conspiracy motivated by the purpose of dismantling the strong relationship between the Indian government and the LTTE." "We ask for an immediate cessation of this allegation of defamation upon the LTTE concerning the murder of Rajiv Gandhi. As a result, we hope to put an end to the infamy on the LTTE on an international platform and that the International Community would at last end the ban on the LTTE that prevents our People to breathe the air of freedom," LTTE added.

The Centre Monday told the Supreme Court that it may not be necessary to substitute retired IPS officer Rajdeep Singh who has declined to be a part of three-member SIT supervising further probe into 186 cases of the 1984 anti-Sikh riots citing personal reasons. The government told a bench of Justices Madan B Lokur and Deepak Gupta that they have no objection if the other two members of the special investigation team (SIT) — former Delhi High Court judge Justice S N Dhingra and serving IPS officer Abhishek Dular — continue with the work.

The bench said however that since the January 11 order constituting a three-member SIT was passed by a bench of three judges, they cannot modify it while sitting in a combination of two judges. The bench has posted the matter for hearing tomorrow. Additional Solicitor General (ASG) Pinky Anand, appearing for the Centre, said she has no objection to the suggestions given by the counsel for the petitioner that the other two members should continue with the work.

On January 11, the top court had constituted a three-member SIT headed by Justice (retired) Dhingra to supervise further probe into the 186 cases, in which closure reports had been filed earlier. Large-scale riots had broken out in the national capital in the aftermath of the assassination of the then Prime Minister Indira Gandhi by her two Sikh security guards on the morning of October 31, 1984. The violence had claimed 2,733 lives in Delhi alone.

On February 5, the Centre had moved the court requesting it to include former DG-rank officer Navneet Rajan Wasan, who had earlier served as the Director General of Bureau of Police Research and Development (BPR&D), in the SIT to replace Singh. Wasan, now retired, is a 1980-batch Andhra Pradesh cadre officer and had also served as Special Director General in the National Investigation Agency (NIA). During the hearing on Monday, the ASG told the bench that they have suggested the name of former IPS officer Wasan to substitute Singh.

“You cannot choose your own judge. Give two-three names,” the bench told the ASG, who said that the apex court could appoint anybody to substitute Singh. Senior advocates R S Suri and H S Phoolka, representing the petitioner, said appointing a third member in the SIT might delay the process and the other two members should continue with their work. The top court had earlier appointed the three-member SIT after the Ministry of Home Affairs and counsel for petitioner S G S Kahlon arrived at a consensus with regard to the persons who could be appointed in the fresh SIT.

The court had earlier said the previous SIT did not carry out a further probe into the 186 cases in which closure reports were filed, and had directed setting up of a fresh SIT comprising a former high court judge and two police officers. Justice Dhingra, who had retired from Delhi High Court, had dealt with several high-profile cases including the 2001 Parliament Attack case as a trial judge. As the judge of the trial court, he had dealt with many of the 1984 riot cases, and his verdicts had resulted in a conviction in 16 cases. On August 16 last year, the apex court had appointed a supervisory panel to examine the earlier SIT’s decision to close 241 cases.

The Centre had said that out of 250 riots cases which were probed by that SIT, closure reports were filed in 241. It said some cases were still being investigated by the SIT, and two by the CBI. The earlier SIT was headed by Pramod Asthana, an IPS officer of 1986 batch, and had Rakesh Kapoor, a retired district and sessions judge, and Kumar Gyanesh, an additional deputy commissioner of Delhi Police, as its members.

Petitioner S Gurlad Singh Kahlon had earlier told the bench that a total of 293 riot-related cases were taken up for scrutiny by the earlier SIT which had decided to close 199 of them. Kahlon, a member of the Delhi Sikh Gurdwara Management Committee, had sought the court’s direction for setting up another SIT to ensure speedy justice to the riot victims.
