Supreme Court on Wednesday issued a stay order on all the pending cases against actor Priya Prakash Varrier and said that no criminal proceedings to take place against the actress until further hearing.
The court's order comes after Varrier and director Omar Lulu moved the apex court over a case registered against her film "Oru Adaar Love" in Telangana under Section 295A.
In the petition, the actress stated that fringe elements have "misunderstood the lyrics of the song" which they claim allegedly offended their religious sentiments.
The petition further said that it adversely affected the petitioners right to life, liberty and freedom of expression under Articles 19(1)(a), 19(1)(g) and 21 of the Constitution.
Artists have the right to express themselves in a lawful manner, the petition stated, adding that the legality of the content of the film and the certification on the same can only be dealt with under law by the Central Board of Film Certification (CBFC) as prescribed under the provisions of the Cinematograph Act, 1952.
FIRs cause nothing but "hindrance in the freedom of speech and expression" granted under Article 19(1)(a) of the Constitution and the same is an outright abuse of the process of law, the petition said.
