<p>India on Tuesday (Jul 9) extended the ban on the Khalistani group 'Sikhs For Justice' (SFJ) by another five years. The decision came after an investigation by the country's anti-terror National Investigation Agency (NIA) revealed new findings. The SFJ is a US-based group that is managed by Khalistani leader Gurpatwant Singh Pannun, who is a designated terrorist under India's Unlawful Activities (Prevention) Act (UAPA) since July 1, 2020.</p>

<p>Earlier, India's Home Ministry imposed a ban on SFJ in 2019 for five years under the UAPA for separatist activities.</p>

<p>“In the garb of the so-called referendum for Sikhs, SFJ is actually espousing secessionism and militant ideology in Punjab, while operating from safe havens on foreign soils and actively supported by inimical forces in other countries,” a 2019 notification by the ministry read.</p>

<h2><strong>NIA's fresh cases against SFJ</strong></h2>

<p>Now, the NIA has registered fresh cases against both Pannun and the SFJ. Last year, Pannun's properties in India were confiscated as well.</p>

<p>The Indian government issued a fresh notification on Tuesday which said the group continues to engage in "the activities which are prejudicial to the integrity and security of the country and is involved in anti-national and subversive activities in Punjab and elsewhere, intended to disrupt the sovereignty and territorial integrity of India."</p>

<p>A year ago, Nikhil Gupta was arrested in Prague under an extradition order from the US Justice Department.&nbsp;</p>

<p>As per the Department of Justice, Gupta was after Pannun, "a vocal critic of the Indian government who leads a US-based organisation that advocates for the secession of Punjab".&nbsp;</p>

<p>Federal prosecutors allege that Gupta was working for an unknown Indian government official who had told him to pay a $15,000 upfront payment to a hitman to get Pannun killed.&nbsp;</p>

<p>The Washington Post, in April 2024, reported that the operation was conducted at the behest of Vikram Yadav, an officer with India's elite intelligence agency, the Research and Analysis Wing (R&amp;AW), under the command of the then-R&amp;AW chief Samant Goel.&nbsp;</p>

<p>The Ministry of External Affairs in India, which has launched a high-level inquiry into the matter, dismissed the report and said it makes "unwarranted and unsubstantiated imputations".&nbsp;</p>

Gupta was arrested in the Czech Republic last year at the request of American authorities on charges of being involved in the plot.</p>

<p>He is expected to be produced before a federal court in New York on Monday. The Washington Post report on Sunday said that Gupta, 52, arrived in New York over the weekend, and typically&nbsp;extradited defendants must appear in court within a day of their arrival in the country.</p>

<h2><strong>Gupta's lawyer writes to Indian Supreme Court</strong></h2>

<p>Gupta's lawyers have said that their client&nbsp;is a law-abiding businessperson&nbsp;unjustly caught in the escalating geopolitical “crossfire” between the US and India.&nbsp;Rohini Musa, one of the attorneys of the 52-year-old, wrote to the Indian Supreme Court saying that her client was being unfairly prosecuted.</p>

<p>She also complained that Gupta received adverse legal advice from a Czech government-appointed attorney “under the undue influence of … US&nbsp;Agencies” during the initial phase of his detention.</p>

<p>The lawyer pointed out that Washington and New Delhi were going back and forth to blame each other for their foreign policy.&nbsp;</p>

<h2><strong>What prosecutors said</strong></h2>

<p>Earlier, federal prosecutors said that an Indian government intelligence employee ordered the killing of Pannun in May and hired Gupta to arrange the hit.&nbsp;</p>

<p>India has dissociated itself from the plot against Pannun, saying it was against government policy. New Delhi&nbsp;said it would formally investigate security concerns raised by Washington.</p>

<p>Eleven days later (on January 30), the top court said that&nbsp;Gupta’s&nbsp;extradition to the US for criminal prosecution would result in disproportionately&nbsp;greater&nbsp;harm to the man than anyone else.</p>

<p>These developments come a week after the US reiterated its stance on seeking accountability from the Indian government about the ongoing investigation into the murder plot of Pannun.&nbsp;</p>

<p>Addressing a briefing at the White House on April 30, State&nbsp;Department's&nbsp;Principal Deputy spokesperson Vedant Patel said&nbsp;that there&nbsp;is an ongoing dialogue and that the US expects accountability from the Indian authorities.</p>

<p>Pannun, writing on social media, called the incident a "drive-by shooting".</p>

<p>Canada's Prime Minister Justin Trudeau in September directly linked New Delhi to the killing of another Khalistani terrorist Hardeep Singh Nijjar.&nbsp;</p>

<p>“My approval was the result of months of painstaking discussions. While I’m fully aware of the significance of this sale, for US national security and strategic interests,” Cardin said.</p>

<p>"I have consistently conveyed my concerns regarding the timing of this sale to administration officials in light of the alleged murder-for-hire plot involving Indian officials to attempt to assassinate an American citizen on US soil," he added.&nbsp;</p>

<p>Cardin's statement came after the Defense Security Cooperation Agency (DSCA) on Thursday (Feb 1) delivered the required certification notifying US Congress of the sale of 31 of these Unmanned aerial vehicles (UAVs). The deal involving MQ-9B drones comes at an estimated cost of $3.99 billion.</p>

<p>Under the proposed deal, New Delhi will receive 31 High Altitude Long Endurance (HALE) UAVs, of which the Navy will get 15 SeaGuardian drones while the Army and AIr Force will receive eight each of the land version.&nbsp;</p>

<p>The procurement of these drones by India comes as the country is looking to enhance its maritime security. This also comes at a crucial juncture as recent attacks on Red Sea shipping by Houthi rebels have raised concerns globally and exposed the vulnerability of maritime trade routes to threats.</p>

<p>Sikhs for Justice (SFJ) leader and Khalistani terrorist Gurpatwant Singh Pannun on Tuesday (Jan 16) reportedly issued fresh threats to Indian Prime Minister Narendra Modi and dared him to attend the Republic Day parade without security.&nbsp;</p>

<p>India-based news agency PTI accessed two videos and an email which was sent to some journalists. In one of the purported videos, he was heard saying: "I dare Modi, you come to Delhi without your security."&nbsp;</p>

<p>He added, "If you are a popular leader, come to Delhi on R-Day without security and SFJ is going to avenge the assassination of Shaheed Nijjar by raising the Khalistan flag."&nbsp;Notably, Nijjar was killed by unidentified assailants at a gurdwara in Canada's Surrey.&nbsp;</p>

<p>January 26 is when the entire nation celebrates the date on which the Constitution of India came into effect in 1950.&nbsp;</p>

<p>In one of the videos, Pannun compared Mann with former Punjab chief minister Beant Singh, who was assassinated in a bomb blast on August 31, 1995.&nbsp;</p>

<p>The blast had claimed the lives of 17 others. The banned terror group — Babbar Khalsa International had carried out the blast.&nbsp;</p>

<p>While mentioning the Punjab top cop Yadav, Pannun compared him to assassinated police officer Gobind Ram, who was killed in a bomb blast in 1990.&nbsp;</p>

<p>The Union Home Ministry labelled Pannun as a terrorist under the anti-terror law Unlawful Activities (Prevention) Act, and SFJ was banned in 2020.&nbsp;</p>

<p>Afterwards, the Justice Department said an Indian man, identified as Nikhil Gupta, arrested by Czech authorities in June, who worked with an Indian government employee was behind the killing plot,&nbsp;</p>

<p>"The defendant conspired from India to assassinate, right here in New York City, a US citizen of Indian origin who has publicly advocated for the establishment of a sovereign state for Sikhs," Damian Williams, the top federal prosecutor in Manhattan, said in a statement.</p>

<p>The family members of Indian national Nikhil Gupta - who has been accused of&nbsp;plotting to kill Sikh separatist Gurpatwant Singh Pannun - made shocking claims of how his fundamental rights were violated multiple times in the petition.&nbsp;</p>

<p>As per the family members of Gupta once he&nbsp;landed at the Vaclav Havel Airport in Prague on June 30, he was taken away by "American agents" in a black SUV where he was interrogated for three hours and his mobile phone was seized.&nbsp;</p>

<p>52-year-old Gupta moved the Supreme Court on Friday (Dec 15) through his family member - whose identity was not revealed - and claimed how his fundamental rights were violated and his family and Gupta himself were threatened while requesting the Indian government to intervene in his extradition from the United States where he has been held on murder-for-hire charges.&nbsp;</p>

<p>In the petition, X said Gupta was "approached by certain individuals who identified themselves to be law enforcement" and was detained by officials outside the Prague airport without any valid reason.</p>

<p>The petition further pointed out that the officials did not arrest him at the airport's immigration counter, as per the norm, but after &nbsp;Gupta cleared entry formalities, "... when (he) had, in fact, exited Vaclav Havel Airport... meaning this round of questioning in the back of an SUV for three hours was absolutely illegal and against the principles of both international and municipal law".</p>

<p>The family member X further said that the "American agents" also threatened the petitioner before he was handed over to local authorities, where his blood and biometrics were collected.</p>

<p>"Subsequently, the petitioner was appointed a defence attorney by the Czech authorities who advised the petitioner... to give his consent to be taken to New York," said X, in the petition.</p>

<p>The petitioner further noted "... this advice was against the best interest of the petitioner and under the undue influence of US agencies who were trying to extradite the petitioner as soon as possible".</p>

<p>Nikhil Gupta, the man accused of plotting to kill Khalistani terrorist Gurpatwant Singh Pannun on US soil, has filed a&nbsp;petition in the Supreme Court seeking intervention from the Indian government to release him from prison in the Czech Republic.&nbsp;&nbsp;</p>

<p>The Habeas Corpus petition was filed by Gupta's family on his behalf wherein he claims that the Czech prison authorities forced him to consume beef and pork, despite being a devout Hindu.&nbsp;</p>

<p>Gupta also claimed that he was denied consular access, the right to contact his family in India and the freedom to seek legal representation.&nbsp;</p>

<p>"The circumstances (of the arrest in Prague) were marked by irregularities, with no formal arrest warrant presented, and the apprehension executed by self-claimed US agents rather than local Czech authorities," the petition stated.&nbsp;</p>

<p>The apex court heard the petition and adjourned the case&nbsp;till January 4.</p>

<p>According to&nbsp;Vladimir Repka, a spokesperson for the Czech Ministry of Justice, Gupta was arrested at the request of the US which later also submitted an extradition request.&nbsp;</p>

<h2><strong>What did the US allege?</strong></h2>

<p>It was last month that Washington alleged that Gupta had attempted to kill Pannun after he was assured by the Indian government official directing him that a purported Gujarat case against him would be taken care of.</p>

<p>Described as CC-1 in the US Justice Department papers, he has also been&nbsp;accused of dabbling in international narcotics and weapons trafficking.</p>

<p>"The defendant conspired from India to assassinate, right here in New York City, a US citizen of Indian origin who has publicly advocated for the establishment of a sovereign state for Sikhs," Damian Williams, the top federal prosecutor in Manhattan, said in a statement.</p>

<p>Gupta is charged with murder-for-hire and conspiracy to commit murder-for-hire. Each count carries a maximum statutory penalty of 10 years in prison.</p>

<p>New Delhi was the first to temporarily suspend certain visa services which put Ottawa in a fix. However, despite the allegations, the Canadian government is yet to present proof to back up its allegations.&nbsp;</p>
