The motion also contends that Gutierrez-Reed's "selective prosecution" violates the equal protection clause of the 14th Amendment of the US Constitution. New special prosecutor Kari Morrissey is expected to file a response to the motion.

Manslaughter charges against Alec Baldwin over a fatal shooting on a movie set were formally dropped by prosecutors Friday.

A New Mexico court filing said the case against Baldwin "is dismissed without prejudice," but investigations remain "active and on-going" into the death of cinematographer Halyna Hutchins during the filming of the Western Rust&nbsp;in New Mexico in 2021.

Baldwin was holding a Colt .45 handgun during rehearsals when it discharged, killing Hutchins and wounding director Joel Souza.

He has always insisted he was told the gun was safe and that he did not pull the trigger, and had pleaded not guilty to the charges.

The court filing said "new facts were revealed that demand further investigation and forensic analysis which cannot be completed" in time for a preliminary hearing that had been scheduled for May.

The Los Angeles Times reported that prosecutors had received information that the gun had been modified in a manner increasing the odds it might have misfired, citing three anonymous sources.

The criminal case against Hannah Gutierrez-Reed, the young armorer who had been responsible for weapons on the set of the film, remains ongoing.

At a court status conference Friday, all parties agreed to postpone a preliminary hearing for those proceedings until August.&nbsp;

Filming of Rust&nbsp;resumed at a new location in Montana this week, producers said Friday, with Baldwin and Souza among those returning to complete the film.

Principal photography is scheduled to be completed by the end of May.

The criminal case against Baldwin had hit multiple legal potholes in the past few months.

Baldwin and Gutierrez-Reed were each initially charged with two alternative counts of voluntary manslaughter.

The judge hearing the wrongful death lawsuit against actor Alec Baldwin and an array of producers and crew linked to a fatal film set shooting agreed Monday to seal from public view the terms of a proposed settlement agreement in the case that benefits the son of slain cinematographer Halyna Hutchins.

The New Mexico judge said the right to privacy for Hutchins’ 10-year-old son overrides obligations for public disclosure and ordered that settlement documents and approval hearings be sealed in the civil lawsuit that argues that Baldwin and other film crewmembers ignored industry gun safety standards on the set of the Western film Rust&nbsp;ahead of the 2021 shooting.

“What is driving my decision is really the interests of the minor child. And that is one of the very most powerful reasons to seal a matter,” District Court Judge Bryan Biedscheid said in a videoconference hearing of the Santa Fe-based court.

Baldwin, an actor and coproducer of the film, was pointing a pistol at Hutchins during a rehearsal on the film’s set outside Santa Fe when the gun went off, killing her and wounding director Joel Souza. He and other defendants have disputed the accusations that they were lax with safety standards.

Widower Matthew Hutchins filed the wrongful death suit last year against Rust&nbsp;producers, including Baldwin, as well as members of the film crew with safety responsibilities and an ammunition supplier. Son Andros Hutchins, who was 9 at the time of the shooting, is also named as a plaintiff.

Attorneys for the boy said Monday that secrecy provisions are paramount to protect his privacy and finalize a settlement with Rust&nbsp;producers.

Knowledge of the settlement terms also will be off limits to people beyond “Rust” producers who were named as defendants in the lawsuit, including weapons supervisor Hannah Gutierrez-Reed. Several of those defendants objected to being left in the dark on details of the settlement, though approval of the agreement should end their involvement in the wrongful death suit.

Gutierrez-Reed and Baldwin are also confronting criminal charges of involuntary manslaughter in separate court proceedings and have pleaded not guilty, with two weeks of evidentiary hearings scheduled in May.

Halls handed Baldwin the loaded gun in October 2021 which ultimately discharged, killing cinematographer Halyna Hutchins and wounding the film's director, Joel Souza.

Under the plea agreement, 63-year-old Halls will serve no jail time but must complete six months of unsupervised probation.

Halls had told Baldwin the gun was "cold" -- industry speaks for safe.

According to court filings, the film's armourer Hannah Gutierrez-Reed loaded the gun and handed it to Halls, who then checked the firearm to ensure that the bullets were "dummy" rounds -- meaning they held no gunpowder.

Prosecutor Kari Morrissey, during the hearing Friday, described Halls as the "last line of defense" on the set, saying he failed to "check every round that was in the gun to confirm that it was a dummy round."

Both Baldwin -- a co-producer and the lead actor -- and Gutierrez-Reed, who was responsible for the weapons on set, face two alternative counts of voluntary manslaughter.

If found guilty, they face up to 18 months in jail and a $5,000 fine.

Baldwin, 64, has repeatedly said he was told by the crew that the gun was not loaded.

In accepting the deal on Friday, Halls agreed to testify in any future proceedings related to the matter.

They have been sued for compensatory and punitive damages following injuries suffered on Rust set, "including, but not limited to, hearing loss, temporary deafness, and vibrational shock".&nbsp;

They alleged that assistant director David Halls "cut corners" with safety and skipped crucial set moves. They claim that Halls also failed to "properly distribute" safety bulletins on how cast and crew should handle weaponry.

"These injuries were caused by Defendants' failure to follow industry safety rules," the docs stated. "Defendants cut corners; ignored reports of multiple, unscripted firearms discharges; and persisted, rushed and understaffed, to finish the film."

The parents and sister of the cinematographer who was shot dead on the set of a low-budget western are suing star Alec Baldwin and the movie's producers, lawyers said Thursday.

Halyna Hutchins was killed when a Colt .45 that Baldwin was holding went off during rehearsals in New Mexico in October 2021. Director Joel Souza was injured.

Baldwin, along with the film's armorer Hannah Gutierrez-Reed, already face manslaughter charges which could see them jailed.

The lawsuit was filed in Los Angeles on behalf of Hutchins' mother Olga Solovey, father Anatolii Androsovych and sister Svetlana Zemko, who live in Ukraine near Kyiv.

It seeks an unspecified sum in compensation for battery, intentional infliction of emotional distress, negligence and "loss of consortium," which is a term referring to being deprived of a relationship, said their lawyer, celebrity attorney Gloria Allred.

"Of course, for all of our three clients, the tragic loss of their daughter and sister is heartbreaking, but now in addition to this tragedy they have to try to cope with that loss while living in Ukraine in the midst of (Russian President Vladimir) Putin's war," Allred told reporters. 
 
"Olga is doing her best to cope with the loss of Halyna while at the same time acting as an emergency operating room nurse in a hospital in Ukraine, where she is caring for those who have been hurt in battle."

Baldwin and other producers of 'Rust'&nbsp;have already reached a financial settlement with Hutchins' widower Matthew.

Allred said the new case was separate to that settlement and was possible under New Mexico law which allows parents and other close family members to take action.

"To lose my sister... was a horrible experience and it is one of the biggest losses of my life," said Zemko in a video that was played during a Los Angeles press conference.

"I believe to let this go and to leave this unpunished, is unallowable."

Allred said Baldwin had not reached out to the family of 42-year-old Hutchins in the wake of the tragedy, and his attorneys had resisted efforts to settle the matter.

The suit also names Gutierrez-Reed, as well as the film's producers and various crew.

Baldwin, 64, has vehemently denied culpability for Hutchins' death, and repeatedly said he was told by film crew that the gun was not loaded. 
 
The former '30 Rock'&nbsp;star has also previously insisted he did not pull the trigger, though FBI firearms experts have said this is not possible.

According to the latest update, Alec&nbsp;will continue to play grandfather Harland Rust in the film while Joel will return as its director following his wounding in the fatal October 2021 shooting, revealed Melina Spadone, an attorney for 'Rust' movie productions.

The late cinematographer&nbsp;Hutchins' husband Matt Hutchins will remain&nbsp;executive producer of the project, she added. "The film is still on track to be completed," Spadone shared&nbsp;in the statement.

This Thursday, Santa Fe District Attorney Mary Carmack-Altwies&nbsp;said that she plans to charge both Baldwin and the film's armourer, Hannah Gutierrez-Reed, with two counts of involuntary manslaughter in connection with the cinematographer's death.

Baldwin in October reached a settlement of a wrongful death lawsuit filed by the Hutchins family under which Hutchins would take a production role in 'Rust' and filming would resume this month.

"On my watch, no one is above the law, and everyone deserves justice," she said.

If convicted, both Baldwin and Guitierrez Reed face up&nbsp;to 18 months in jail and a $5,000&nbsp;fine. They will be tried by a jury, prosecutors said.

After the shooting, Baldwin had said the gun had misfired. He added that he did not pull the trigger on the gun and he was not aware that it was loaded.

"I don't know what happened on that set. I don't know how that bullet arrived in that gun. I don't know," he said in December 2021.

In October, the 64-year-old actor and the film's production company reached a settlement for an undisclosed amount with the family of Hutchins, the deceased cinematographer.&nbsp;

It came after the cinematographer's husband, Matthew, filed a wrongful death lawsuit which claimed violations of industry safety standards.

"All of us believe Halyna's death was a terrible accident," &nbsp;Hutchins said in a statement at the time. "I have no interest in engaging in recriminations or attribution of blame."

Film's production was scheduled to resume this year. It remains unclear if the film's schedule will be resumed any time soon.&nbsp;

Reports stated that a new box of ammunition had arrived from an uncertain source earlier that morning.&nbsp; 
 
Baldwin was reportedly handed the gun by assistant director Halls who took it from the prop cart and handed it to the actor. The scene involved Baldwin's character removing a gun from its holster and pointing it toward the camera. Halls reportedly had mentioned to Baldwin that it was a cold gun. When Baldwin removed the gun from the holster, B-camera operator Reid Russel, director Joel Souza and Hutchins were huddled behind the monitor position about two feet away from where the shot was filed.&nbsp; 
 
The projectile flew towards the three behind the monitor, striking Hutchins in the chest and Souza in the shoulder. Hutchins was flown by helicopter to the University of New Mexico Hospital in Albuquerque, where she was pronounced dead. Souza was treated by EMS and transported by ambulance to Christus St. Vincent Regional Medical Center in Santa Fe, where he was admitted and released by the following morning.

Lawsuits were also filed against the crew for negligence on set. The documents, however,&nbsp;offered no conclusive answers on how live ammunition got onto the film set and into a replica Colt .45-caliber revolver that was allegedly fired by Baldwin. For those unaware, Baldwin was handed the gun during the rehearsal at a ranch outside Santa Fe.

Whitaker also denied the motion to remove Mitchell's claim for punitive damages. “Accordingly, the Court finds plaintiff’s allegations in the SAC [second amended complaint] demonstrates alleged despicable conduct carried out by the demurring defendants with a willful and conscientious disregard of the rights or safety of other sufficient to withstand a motion to strike,” he wrote in his ruling.
