The previous version allows only a three-year prison increase. 
 
The actor's lawyers have asked to throw out the enhancement as a violation of the constitution’s “ex post facto” clause, per Variety.&nbsp;

Alec Baldwin accuses prosecutor of ‘basic legal error’

The parents and sister of the cinematographer who was shot dead on the set of a low-budget western are suing star Alec Baldwin and the movie's producers, lawyers said Thursday.

Halyna Hutchins was killed when a Colt .45 that Baldwin was holding went off during rehearsals in New Mexico in October 2021. Director Joel Souza was injured.

Baldwin, along with the film's armorer Hannah Gutierrez-Reed, already face manslaughter charges which could see them jailed.

The lawsuit was filed in Los Angeles on behalf of Hutchins' mother Olga Solovey, father Anatolii Androsovych and sister Svetlana Zemko, who live in Ukraine near Kyiv.

It seeks an unspecified sum in compensation for battery, intentional infliction of emotional distress, negligence and "loss of consortium," which is a term referring to being deprived of a relationship, said their lawyer, celebrity attorney Gloria Allred.

"Of course, for all of our three clients, the tragic loss of their daughter and sister is heartbreaking, but now in addition to this tragedy they have to try to cope with that loss while living in Ukraine in the midst of (Russian President Vladimir) Putin's war," Allred told reporters. 
 
"Olga is doing her best to cope with the loss of Halyna while at the same time acting as an emergency operating room nurse in a hospital in Ukraine, where she is caring for those who have been hurt in battle."

Baldwin and other producers of 'Rust'&nbsp;have already reached a financial settlement with Hutchins' widower Matthew.

Allred said the new case was separate to that settlement and was possible under New Mexico law which allows parents and other close family members to take action.

"To lose my sister... was a horrible experience and it is one of the biggest losses of my life," said Zemko in a video that was played during a Los Angeles press conference.

"I believe to let this go and to leave this unpunished, is unallowable."

Allred said Baldwin had not reached out to the family of 42-year-old Hutchins in the wake of the tragedy, and his attorneys had resisted efforts to settle the matter.

The suit also names Gutierrez-Reed, as well as the film's producers and various crew.

Baldwin, 64, has vehemently denied culpability for Hutchins' death, and repeatedly said he was told by film crew that the gun was not loaded. 
 
The former '30 Rock'&nbsp;star has also previously insisted he did not pull the trigger, though FBI firearms experts have said this is not possible.

Assistant director Dave Halls, who handed Baldwin the weapon, is also named in the suit. He has agreed to plead guilty in New Mexico to negligent use of a deadly weapon.

Baldwin and Gutierrez-Reed, who have denied the criminal charges they face, as well as Halls are expected to appear in court in New Mexico later this month for a virtual hearing.

Baldwin's lawyers have argued that a person cannot simultaneously serve as a prosecutor and a state legislator.&nbsp; 
 
Reports state Andrea Reeb was recruited by the First Judicial District Attorney in Santa Fe last year to assist with the ‘Rust’ case. Reeb, a Republican, previously served as the state’s Ninth Judicial District’s elected prosecutor. In November, she was elected to the state House of Representatives. 
 
Baldwin’s lawyers contend in the motion filed on Tuesday that the state constitution’s separation of powers section precludes Reeb from acting as both a prosecutor and a state legislator. 
 
“Doing so vests two core powers of different branches — legislating and prosecuting — in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution,” Baldwin’s lawyers wrote. 
 
“Were the arrangement here approved by the courts, future District Attorneys could seek to curry favour with legislators who control their budgets by appointing them to high-profile cases — distorting the legislative process,” they argued. 
 
In a statement Tuesday afternoon, the First Judicial District Attorney’s Office called Baldwin’s motion a distraction.

“Mr. Baldwin and his attorneys can use whatever tactics they want to distract from the fact that Halyna Hutchins died because of gross negligence and a reckless disregard for safety on the ‘Rust’ film set,” said Heather Brewer, a spokesperson for the office.

“However, the district attorney and the special prosecutor will remain focused on the evidence and on trying this case so that justice is served,” she added.&nbsp;

Baldwin’s lawyers contend in the motion filed on Tuesday that the state constitution’s separation of powers section precludes Reeb from acting as both a prosecutor and a state legislator. “Doing so vests two core powers of different branches — legislating and prosecuting — in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution,” Baldwin’s lawyers wrote. “Were the arrangement here approved by the courts, future District Attorneys could seek to curry favour with legislators who control their budgets by appointing them to high-profile cases — distorting the legislative process,” they argued. In a statement Tuesday afternoon, the First Judicial District Attorney’s Office called Baldwin’s motion a distraction. “Mr. Baldwin and his attorneys can use whatever tactics they want to distract from the fact that Halyna Hutchins died because of gross negligence and a reckless disregard for safety on the ‘Rust’ film set,” said Heather Brewer, a spokesperson for the office. “However, the district attorney and the special prosecutor will remain focused on the evidence and on trying this case so that justice is served,” she added. The court released documents on Tuesday detailing the charges. The first judgement came in on January 19 and the investigation in the case portrays a chaotic set with a reckless approach to gun safety.

According to Robert Shilling, a special investigator for the district attorney's office, Baldwin was 'distracted' talking to family members on his mobile phone during training on how to operate the prop gun. Shilling cites the incident as a probable cause for the later fatal shooting.&nbsp; 
 
If Baldwin had performed mandatory safety checks with armourer Hannah Gutierrez-Reed and not pointed the gun at Hutchins, the "tragedy would not have occurred", Shilling stated. 
 
"This reckless deviation from known standards and practice and protocol directly caused the fatal shooting," he said. 
"Baldwin knew the first rule of gun safety is never point a gun at someone you don't intend on shooting," Shilling added. 
 
Former '30 Rock'&nbsp;star Baldwin has repeatedly said he was told by the crew that the gun was not loaded and that he did not pull the trigger.

Baldwin's attorney Luke Nikas has vowed to beat the charge, which he called a "terrible miscarriage of justice."

Lawyers for Gutierrez-Reed said Tuesday that prosecutors had "completely misunderstood the facts" and had "reached the wrong conclusions."

"We will fight these charges and expect that a jury will find Hannah not guilty," said Jason Bowles and Todd Bullion.

Separately, 'Rust'&nbsp;assistant director Dave Halls, who handed Baldwin the weapon and told him it was "cold" -- industry speak for safe -- pleaded no contest to negligent use of a deadly weapon.

His plea agreement will be made public after a judge's approval.

Baldwin, a co-producer of the movie, and Gutierrez-Reed have both been charged with two alternative counts of manslaughter, each involving different levels of negligence.

An investigation by Santa Fe County Sheriff's Office has yet to reveal how live rounds got inside the production.

Legal analysts said prosecutors face an uphill battle convicting Baldwin of criminal charges without proof he knew live ammunition was present and took no precautions.

"There doesn't seem to be a lot of evidence that people were acting in a way that they were actually aware of what the danger was, and acting with disregard for the danger," said Kate Mangels, an attorney with entertainment law firm Kinsella Weitzman Iser Kump Holley.

After the shooting, Baldwin had said the gun had misfired. He added that he did not pull the trigger on the gun and he was not aware that it was loaded.

"I don't know what happened on that set. I don't know how that bullet arrived in that gun. I don't know," he said in December 2021.

In October, the 64-year-old actor and the film's production company reached a settlement for an undisclosed amount with the family of Hutchins, the deceased cinematographer.&nbsp;

It came after the cinematographer's husband, Matthew, filed a wrongful death lawsuit which claimed violations of industry safety standards.

"All of us believe Halyna's death was a terrible accident," &nbsp;Hutchins said in a statement at the time. "I have no interest in engaging in recriminations or attribution of blame."

Film's production was scheduled to resume this year. It remains unclear if the film's schedule will be resumed any time soon.&nbsp;

On Thursday, New Mexico First Judicial District Attorney Mary Carmack-Altwies will announce whether charges will be pressed in the case. There will be no press conference regarding the announcement. "Regardless of the District Attorney’s decision, the announcement will be a solemn occasion, made in a manner keeping with the office’s commitment to upholding the integrity of the judicial process and respecting the victim’s family," Heather Brewer, spokesperson for the office of the First Judicial District Attorney said in a statement.&nbsp;

Alec Baldwin was practising a scene on October 21, 2021, on the sets of 'Rust' which was Baldwin's passion project. The crew along with the actor was rehearsing in a small church on the Bonanza Creek Ranch set. Baldwin says he did not pull the trigger. As the gun discharged, it left Hutchings dead and Joel Souza injured. &nbsp;The Santa Fe County Sheriff's Department has spent investigating the case for the past year and understands how live rounds made it to the movie set in the first place. Initial investigations revealed that only armourer Hannah Gutierrez-Reed and assistant director Dave Halls had handled the gun on the said day before the fatal accident.&nbsp;

What happened on the sets of 'Rust' 
 
 
October 21, 2021 was the twelfth day of filming of the Indie-film 'Rust'. The cast and crew were rehearsing a gunfight scene inside a&nbsp;church at the Bonanza Creek Ranch. Firearms and ammunition were retrieved from a locked safe and Hannah had placed three guns used as props on a cart. One was a plastic gun, another modified weapon and a solid frame .45 Colt revolver replica made by Pietta which was ultimately fired accidentally by Baldwin.&nbsp; 
 
Reports stated that a new box of ammunition had arrived from an uncertain source earlier that morning.&nbsp; 
 
Baldwin was reportedly handed the gun by assistant director Halls who took it from the prop cart and handed it to the actor. The scene involved Baldwin's character removing a gun from its holster and pointing it toward the camera. Halls reportedly had mentioned to Baldwin that it was a cold gun. When Baldwin removed the gun from the holster, B-camera operator Reid Russel, director Joel Souza and Hutchins were huddled behind the monitor position about two feet away from where the shot was filed.&nbsp; 
 
The projectile flew towards the three behind the monitor, striking Hutchins in the chest and Souza in the shoulder. Hutchins was flown by helicopter to the University of New Mexico Hospital in Albuquerque, where she was pronounced dead. Souza was treated by EMS and transported by ambulance to Christus St. Vincent Regional Medical Center in Santa Fe, where he was admitted and released by the following morning. 
 
Legal case against Alec Baldwin and crew of 'Rust' 
 
Multiple lawsuits have been filed following the incident. A month after the incident which led to Hutchins' death, the film's gaffer Serge Svetnoy filed a lawsuit against the production for general negligence. The same month, script supervisor Mamie Michell claimed that the script did not require discharging of a firearm, raising questions about Baldwin's rehearsing the scene. On January 23, 2022, Baldwin and other producers filed a memorandum that asked a California judge to dismiss the November 17, 2021 lawsuit by Mitchell. 
 
In January 2022, Gutierrez-Reed filed a lawsuit against armourer Seth Kennedy and his company PDQ Arm and prop for providing live rounds on set. Lawsuits were also filed against the crew for negligence on set. On February 15, Hutchins's family filed a wrongful death suit against Baldwin, Halls, , Gutierrez-Reed, prop master Sarah Zachry, and others as defendants and sought unspecified damages.&nbsp; 
In October 2022, the Hutchins family settled the lawsuit.&nbsp;

Filming of 'Rust' to resume&nbsp; 
 
It was announced in late 2022 that the filming of 'Rust' was to resume in January with Matthew Hutchins as an executive producer. "The production of 'Rust' will not return to New Mexico," Melina Spadone, attorney for the film told news channels. "The production is considering other locations, including in California, but no decisions have been made." 
 
It isn't yet clear if Baldwin would rejoin the production although it is being claimed that the original principal players would resume their work on the project.&nbsp;

The bullet passed through her body and lodged in the shoulder of director Joel Souza. She was airlifted to a hospital, where she died. Souza, who is returning to complete the film, was released from the hospital later that day.

Matthew Hutchins said in a statement, “We have reached a settlement, subject to court approval, for our wrongful death case against the producers of Rust, including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our case will be dismissed. The filming of Rust, which I will now executive produce, will resume with all the original principal players on board in January 2023."

He added, "I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin). All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.” &nbsp;&nbsp;

Luke Nikas, Alec Baldwin’s attorney said in a statement, “Throughout this difficult process, everyone has maintained the specific desire to do what is best for Halyna’s son. We are grateful to everyone who contributed to the resolution of this tragic and painful situation.”&nbsp;

Set in 1880s Texas, the film also had Travis Fimmel, Frances Fisher, Jensen Ackles, and Devon Werkheiser in the cast.

The tragic incident has ignited a debate over the handling of firearms on movie or TV show sets, the resulting dangers, and how to minimise them. There have been proposals by organisations involved in the film business to make sure such tragedies never happen in future.

Hollywood star Alec Baldwin has, once again, embraced parenthood with open arms. The actor has welcomed a baby daughter with his wife Hilaria. This is their seventh child together. Sharing the happy news on social media,&nbsp;Hilaria shared that both she and her daughter is healthy.

Taking to Instagram on Saturday, Hilaria shared a short clip of her baby daughter from the&nbsp;hospital. In the caption, she wrote, "She’s here! We are so excited to introduce you to our tiny dream come true, ilaria catalina irena 9-22-22&nbsp;6lbs 13oz Both she and I are happy and healthy. Her Baldwinito siblings are spending the day bonding and welcoming her into our home."

"Much love to you all. We are so happy to celebrate this wonderful news with you," the post further read.

While speaking to CNN, Baldwin said, "I got fired from another job yesterday. There I was all set to go to a movie, jump on a plane... I’ve been talking with these guys for months and they told me yesterday we don’t want to do the film with you because of this."

Talking about his wife's support, he shared, "If I didn’t have my wife, I don’t know where I would be right now... if I didn’t have her, I probably would have quit, retired, gone off, you know sold everything I owned, got a house in the middle of nowhere and just you know did find something else to do, sell real estate."

Speaking to CNN, Baldwin disclosed he has hired a private investigator to assess culpability for the tragedy.&nbsp;He said that he does not anticipate facing any criminal charges based on the information his private investigator has provided&nbsp;him.

"I sincerely believe... (investigators are) going to say that this was an accident. It's tragic," said Baldwin as he talked about the episode.

The shooting is still under criminal investigation, and prosecutors have not yet ruled out charging anyone.

Baldwin said&nbsp;that for the last ten months, he has been repeatedly thinking about the&nbsp;events leading up to the tragedy. While&nbsp;saying&nbsp;that he does not wish to "condemn" Hannah Gutierrez-Reed the film set's armourer and props assistant, Baldwin blamed her and the assistant director Dave Halls, who gave him the gun just before the incident.

"Someone put a live bullet in the gun who should have known better," he said, adding "That was (Gutierrez-Reed's) job. Her job was to look at the ammunition and put in the dummy round or the blank round, and there wasn't supposed to be any live rounds on the set."

"There are two people who didn't do what they were supposed to do."

As per AFP, the actor said that he does not "want them to, you know, go to prison," or "want their lives to be hell" but he wants everyone to know that they are responsible for the accident.

Following the interview, attorneys for Gutierrez-Reed and Halls said that the actor was attempting to shift responsibility away from himself.

Baldwin also addressed former US President Donald Trump's assertion that he might have killed Hutchins on purpose during the CNN interview.

Halyna Hutchins, a cinematographer for the low-budget film, died last October after being struck by a live bullet from a gun Baldwin was holding as he was rehearsing on the set in New Mexico.
