A movie weapons supervisor is facing up to 18 months in prison for the fatal shooting of a cinematographer by Alec Baldwin on the set of the Western film “Rust,” with her sentencing scheduled for Monday in a New Mexico state court.

Movie armourer Hannah Gutierrez-Reed was convicted in March by a jury on a charge of involuntary manslaughter in the death of cinematographer Halyna Hutchins and has been held for more than a month at a county jail on the outskirts of Santa Fe.

Baldwin, the lead actor and co-producer for “Rust,” was pointing a gun at Hutchins when the revolver went off, killing Hutchins and wounding director Joel Souza.

Baldwin has pleaded not guilty to an involuntary manslaughter charge and says he pulled back the gun’s hammer, but not the trigger before the gun went off. His trial is scheduled for July before the same judge, Mary Marlowe Sommer, who oversaw the trial of Gutierrez-Reed.

Gutierrez-Reed could also receive a $5,000 fine.

Prosecutors blamed Gutierrez-Reed for unwittingly bringing live ammunition onto the set of “Rust” where it was expressly prohibited and for failing to follow basic gun safety protocols. After a two-week trial, the jury deliberated for about three hours to reach its verdict.

It’s been a year since a US court directed the makers of the ill-fated film&nbsp;Rust to pay compensation to the family of Halyna Hitchins, the cinematographer killed when a gun held by actor Alec Baldwin accidentlly went off.&nbsp;

The gun accident took place in 2021 and the compensation settlement was reached in March 2023.

A court had ordered the&nbsp;producers of the film to pay the compensation for loss of life to Hitchins' widower and son, but haven’t yet paid up.

<h2>Where is the settlement money?</h2>

Baldwin, who co-produced the film,&nbsp;and the other producers had announced a settlement after the Hitchins family filed a wrongful death lawsuit in October 2022.

It was decided in March 2023 that once Rust wrapped up, the producers will collectively make payments to the Hutchins estate, including insurance funds and a portion of the profits.

Rust Movie Productions LLC was supposed to make the full guaranteed payments by June 13, 2023, according to a February 7 filing from the estate’s attorneys. But it hasn’t happened.&nbsp;

Since the money hasn’t come in, the Hutchins family estate is now considering resuming the wrongful death lawsuit or filing a new one.

There is no information on why there is a delay in the payments.

Production for Rust resumed last April at a film ranch in Montana, several months behind schedule. It finished production in May.&nbsp;

In addition to the ones accusing Baldwin, there have been several lawsuits and countersuits involving Gutierrez Reed, Hutchins’ relatives, crew members, the production company, insurance companies, and the Bonanza Creek Ranch, where the incident took place.

Defence attorneys highlighted Gutierrez-Reed’s unusual disadvantage and vulnerability at the time as a part-time, 24-year-old armourer without trade-union membership on a set where few dared confront Baldwin directly about concerns about safety and related budgeting.

Monday’s testimony veered into the actor’s handling of the revolver that killed Hutchins — including a video of Baldwin twice practising a cross-draw manoeuvre for a camera on Oct. 21, 2021, shortly before the fatal shooting that day. Investigators found no video of the shooting.

The video of Baldwin was accompanied by searing testimony from Ross Addiego, a front-line Rust&nbsp;crew member who helped guide the film’s camera. Addiego said that in the moments after a shot rang out on set, he made eye contact with a wounded Hutchins and tried to calm wounded director Joel Souza.

“The first person I made eye contact with was Halyna, who was clearly injured. In fact, she was starting to go flush and I think holding her right side,” said Addiego, breaking into tears. “I think I yelled out, ‘If you can’t help, get ... out of here, and someone calls 911.’”

Prosecutors guided Addiego through testimony in which he described his anger and frustration with safety procedures on set, including the sight of a storage cart for guns and ammunition that frequently appeared to be unattended and Gutierrez-Reed’s work as an armourer in charge of loading guns with blank and dummy rounds. Addiego noted two gun misfires on set — confirmed as blank rounds without projectiles by workplace safety regulators — and just one safety meeting over the course of about two work weeks when daily meetings are the norm.

He said prior to the fatal shooting he lodged safety complaints with union representatives and the film’s top safety official, assistant director David Halls, who pleaded no contest last year to a charge of negligent use of a deadly weapon and may be called on to testify.

“At times we seemed to be working at ludicrous speeds,” said Addiego, who also testified to the grand jury that indicted Baldwin in January. “We always seemed to be rushed and under the gun.”

In a tense cross-examination, defence attorney Jason Bowles asked Addiego whether he was aware that Gutierrez-Reed had unsuccessfully requested more time to focus on her responsibilities as armourer instead of other prop duties, such as rolling cowboy cigarettes.

“Did you ever stand up to Mr. Baldwin and say, ‘No, we’re not going to move this fast?’” Bowles asked.

“That’s not my job,” Addiego said.

Bowles continued: “With everybody else, grown men, not standing up to Mr. Baldwin, wouldn’t you find that difficult for her also?”

Also on Monday, prosecutors called on a series of FBI forensic experts in firearms, fingerprinting, gunpowder and DNA-evidence tracing to testify about their examination of a revolver and ammunition seized from the “Rust” set and an ammunition supplier to the film based in Albuquerque.

Prosecutors argue that Gutierrez-Reed is to blame for bringing live ammunition on set. They say six live rounds found on the Rust&nbsp;set bear identical characteristics — and don’t match live rounds seized from the movie’s supplier in Albuquerque.

“When I received the firearm and I did an initial function examination, it did not appear that any of the safeties were malfunctioning or anything like that,” Ziegler said.

But Ziegler described additional “accidental discharge testing” on the gun in response to Baldwin’s assertions that the gun went off when he did not press the trigger. Ziegler said the only way he could get the gun to fire without pulling the trigger was by striking the gun with a mallet, knowing that it could break under the procedure and receiving permission to proceed.

“The function of that test is to see if I can get this firearm to fire without actually pulling the trigger,” Ziegler said.

“As I tested in my laboratory, it would not fire without pulling the trigger in the full-cocked setting, without being broken,” he said.

Gutierrez, also known as Hannah Gutierrez-Reed, has denied involuntary manslaughter.

The prosecution opened its case by portraying Gutierrez&nbsp;as consistently "unprofessional and sloppy."&nbsp;

Prosecutor Jason Lewis alleged Gutierrez failed to properly check Baldwin's gun, frequently rushed or skipped safety procedures, and routinely left guns and ammo unattended on set.

A crime scene technician said real bullets had been found loose alongside fake rounds atop a "prop cart," and tucked into holsters used by actors including Baldwin.

"The evidence will show that the defendant treated the safety protocols as if they were optional, rather than that people's lives counted on her doing her job correctly," said Lewis.

Introducing their first witnesses -- two police officers -- prosecutors showed graphic footage taken from their bodycams of some of Hutchins' final moments, as she lay barely moving on the floor of the movie set's chapel, being treated by medics.

By her side director Joel Souza, who was also shot but survived, is heard in the video groaning in severe pain, while a silent Hutchins is carried out and loaded into an ambulance.

A second video showed Gutierrez panicking and repeating "Oh my God," "Sorry" and "Are they OK?" as she hands the gun to police, before being asked to wait alone in a police car, where she begins hyperventilating.&nbsp;

Attending court Thursday, Gutierrez -- dressed in a dark gray suit jacket and pants, and with her formerly bright purple-and-green hair now a natural brown -- looked composed as she watched the video, and did not speak.

One of the key questions surrounding the death of Hutchins is how a live bullet found its way onto the set and into Baldwin's gun.

Prosecutors displayed a photo of Gutierrez that they said showed a live round in a case resting on her lap more than a week before the incident.

"This means that the live ammunition could not have been... supplied by somebody other than Miss Gutierrez," said Lewis.&nbsp;

But defence lawyer Bowles disputed the evidence, arguing it is not possible to distinguish a live round from a dummy round purely on the evidence of photos.

The trial is the latest attempt to hold someone accountable for an on-set tragedy that shocked Hollywood and led to calls for a tightening of rules around the use of firearms in movies.

Bowles pointed to alleged gaps in evidence collected by police investigating the incident, and said the movie's producers wanted to make Gutierrez a "scapegoat."

He said Gutierrez had been tasked with two jobs: props assistant and armourer.

She had been performing tasks like rolling "cowboy cigarettes" instead of being allowed to spend time on weapons safety, he told jurors.

Evidence would show that having "a part-time armorer" on a film with so many weapons was "a terrible idea, but that's what they did," said Bowles.

"The primary thing here was 'rush, get this done, so we get the money,'" he added. "And that's all on production. And Mr. Baldwin is one of the primary producers."

The Gutierrez trial is expected to last two weeks. Baldwin could appear in court for his own trial within months.

In addition, the employer is always responsible for providing a safe work environment at all times, including hiring and supervising the work of professionals trained in weapons," SAG-AFTRA continued.

“We don’t know exactly what their theory is,” Day said. “It could be that they’re including his role as basically CEO of the production ... not having a safe workplace and somebody dies and you’re at the top of the pyramid.”

The company Rust Movie Productions has paid a $100,000 fine to state workplace safety regulators following a scathing narrative of safety failures in violation of standard industry protocols, including testimony that production managers took limited or no action to address two misfires on set before the fatal shooting.

Two related trials

Separately, special prosecutors Kari Morrissey and Jason Lewis are preparing for a February trial against Rust&nbsp;armourer Hannah Gutierrez-Reed, who has pleaded not guilty to involuntary manslaughter and evidence tampering in the case.

That trial is likely to proceed independently — and could give Baldwin’s attorneys insights into prosecution strategies and testimony from key witnesses who are likely to also testify in proceedings against Baldwin.

“His attorneys will certainly be watching the armourer’s trial closely,” said Los Angeles-based entertainment litigator and defence attorney Kate Mangels, who is not involved in the case. “It could offer a preview of the prosecution’s approach and potential witness testimony.”

Baldwin’s case was assigned to Santa Fe-based state District Court Judge T. Glenn Ellington, a specialist in criminal cases. The Gutierrez-Reed case is overseen by a different judge.

Defence attorney Jason Bowles has described Hutchins’ death on Oct. 21, 2021, as a tragic accident and says that Gutierrez-Reed committed no crime. Gutierrez-Reed has not entered a plea to charges of involuntary manslaughter and evidence-tampering. If convicted, she faces up to three years in prison.

Rust&nbsp;safety coordinator and assistant director David Halls has pleaded no contest to a charge of unsafe handling of a firearm and received a suspended sentence of six months’ probation.

In April, prosecutors dropped charges against Baldwin, who was pointing a gun at Hutchins when it went off, killing her and injuring director Joel Souza.

That left Gutierrez-Reed as the sole remaining defendant.

Baldwin has said the gun fired accidentally after he followed instructions to point it toward Hutchins, who was behind the camera. He said he pulled back the hammer — but not the trigger — and the gun fired.

Prosecutors have reserved the right to refile charges against Baldwin and commissioned additional weapons testing to investigate whether the gun’s hammer was intentionally modified.

Authorities have not fully explained how live ammunition found its way onto the film set and into the .45-caliber revolver.

Authorities say Gutierrez-Reed loaded the gun prior to a lunch break with what should have been inert dummy ammunition. Prosecutors say the armourer was negligent amid a breakdown of safety protocols as cast and crew began rehearsing with the weapon — containing a live round — in the early afternoon.

Prosecutors have recently filed the evidence-tampering charge on allegations that Gutierrez-Reed handed off a small bag of narcotics to a colleague amid police interviews on the day of the shooting.

Bowles says prosecutors are engaged in “character assassination.” Gutierrez-Reed will undergo regular drug testing at her own expense under new terms of pretrial release approved Thursday by a New Mexico judge.

The filming of “Rust” resumed in April in Montana under an agreement with the cinematographer’s husband, Matthew Hutchins, that makes him an executive producer.

Rust Movie Productions, the company that originally bankrolled the movie, has paid a $100,000 fine to New Mexico workplace safety regulators who issued a scathing narrative of “serious,” but not willful, safety failures, including testimony that production managers took limited or no action to address two misfires on set before the fatal shooting.

With major productions on hold during the Hollywood writers and actor strikes, no weapons of any kind are being used on those sets for the time being.

Gutierrez-Reed’s attorney Jason Bowles called the move “retaliatory and vindictive.”

“It is shocking that after 20 months of investigation, the special prosecutor now throws in a completely new charge against Ms Gutierrez Reed, with no prior notice or any witness statements, lab reports, or evidence to support it,” Bowles said in a statement.

Gutierrez-Reed is the sole remaining defendant in the case after prosecutors in April dropped an involuntary manslaughter charge against Baldwin, who was pointing a gun at cinematographer Halyna Hutchins during a rehearsal when it went off, killed her and injured director Joel Souza on Oct. 21, 2021. In his own filing Thursday, Bowles revealed that he had been accidentally included in an email to District Attorney Mary Carmack-Altwies from her lead investigator in the case, who slammed the law enforcement response to the shooting.

“The conduct of the Santa Fe County Sheriff’s Office during and after their initial investigation is reprehensible and unprofessional to a degree I still have no words for,” Robert Schilling wrote in the email, in which he said he will be stepping down so special prosecutors can use their own investigator. “Not I or 200 more proficient investigators than I can/could clean up the mess delivered to your office.”

Bowles said in his filing that the email demonstrates the weakness of the case against his client. He said it suggests that the prosecution has been withholding evidence from the defence.

Emails seeking comment from the Sheriff’s Office and the special prosecutors were not immediately returned.

Hollywood star Alec Baldwin, who has been embroiled in a number of lawsuits over the last two years, including&nbsp;the deadly shooting incident on his film set that resulted in the death of cinematographer Halyna Hutchins, has been accused of losing his temper and "yelling" at a waitress at a star-studded gala in New York.

If a report by Page Six is to be believed, the 65-year-old actor was seen "scolding" a young waitress at the 2023 PEN America Spring Literary Gala as she served dinner to the guests. An unnamed&nbsp;source told the publication that the server was shocked to see the star's alleged behaviour.&nbsp;

The drama reportedly began when Baldwin stood up to chat with another guest a couple of minutes before "the line of servers came all at once to deliver the meals". The waitress, said to be in her late 20s or early 30s, got&nbsp;stuck behind Alec for a few minutes.&nbsp;"Then, when she could pass, she started putting plates on the table. I guess he didn't like that she did that with him standing there," the source told the publication.&nbsp;

Alec Baldwin accused of 'yelling' at waitress for 'doing her job' at NY gala

Alec Baldwin is now a grandfather. The actor's eldest daughter Ireland Baldwin welcomed a baby girl on Thursday. Baldwin's wife, Hilaria took to social media to congratulate the new mother and wrote, "All of these aunties and uncles and us grandparents are so excited that Holland is here!!!" Hilaria wrote in an Instagram post that showed the couple with their brood of seven. "Congratulations to the mama and papa, Ireland and Andre. We love you so very much!" 
 
Ireland Baldwin is Kim Basinger and Alec Baldwin's daughter. Baldwin and Basinger separated when Ireland was 11 years old. The actor eventually married Hilaria with whom he shares seven children.

Alec Baldwin has been going through a rough patch professionally for a while now. The actor has been embroiled in controversy for the last two years after a gun he was holding went off on the set of the movie Rust in New Mexico, killing cinematographer Halyna Hutchins. Hutchins died on October 21, 2021. 
 
The incident led to investigations and legal cases against Baldwin and the crew and halted the production of Rust for over a year.&nbsp; 
 
Earlier this year, Baldwin was charged in New Mexico with two counts of involuntary manslaughter, but the charges were later dropped. He still faces a handful of lawsuits, including one brought by Rust&nbsp;script supervisor Mamie Mitchell, along with another by Hutchins' mother, father, and sister.&nbsp;
