The plea has been dismissed by High Court stating that&nbsp;no representation about the issue had been made to the Delhi Metro Rail Corporation (DMRC) before moving the court.

The petitioners had requested to link the metro cards with the address and identity proof. The request was made to make sure that a right to ownership can be claimed over the metro cards and tokens, in case it is stolen or lost.

They also stated that it will help the government keep a track of commuters in the pandemic situation.

The bench consisted of Justice Manmohan and Justice Sanjeev Narula. The bench has asked the petitioners to to first move the representation before the DMRC on this issue.

In case the petitioners move a representation to the DMRC, it is supposed to dispose of the plea within four weeks by a reasoned order after taking inputs from authorities concerned.

A public interest litigation (PIL) has been moved in Delhi High Court seeking a SIT or CBI investigation into the case related to 'Bois Locker Room'&nbsp;social media group, in which a bunch of schoolboys allegedly shared objectionable pictures of minor girls and discussed techniques of raping women.

The PIL, filed by Dev Ashish Dubey through advocates Dushyant Tiwari and Omprakash Parihar on Friday, sought protection for the girls and women who called out the alleged criminal activities in the social media group. The plea is likely to be heard by the court on May 13.

The petition said that screenshots from an Instagram group called "Bois Locker Room" were shared by social media users, which revealed chats between a group of school students from Class 11 and 12 sharing photos of underage girls, followed by lurid discussions on their bodies.

It said that the group also allegedly used to share nude/morphed photographs of women.

"The group is run by and has membership of 16 to 18-year-old boys from posh schools in South Delhi, all of whom were involved in the objectification of their classmates and other women, some as young as 14 years of age," the petitin said.It said that the expletive-laden chats show the boys discussing having physical relationship with their classmates as well as rating them on a scale of beauty."

The obscene and objectionable pictures and vulgar comments by members of the group and once their comments came to light, instead of being apologetic or fearful, they openly threatened the girls who called them out with dire consequences, which shows that these girls might face threat such as rape, gang-rape, torture, etc," the plea said.

"The offence committed by these students through the group is illegal and amounts of violation of various laws of India. Morphing photos and sharing images of people's private parts is a violation of Section 66E of the Information Technology Act, as well as Section 354C of the Indian Penal Code," it added.

The plea claimed that the members of the group have committed several offences, including defamation, threatening women, etc, which are punishable under several sections of the Indian Penal Code (IPC).

It said that the actions of these students show the mindset of the young generation towards girls and added that if it is not stopped and these people are not punished, it may lead to an increase in crime against the women in the future.

The issue needs to be investigated by SIT or CBI as these students belongs to high profile families and there is an apprehension that the investigation or enquiry conducted by the local police will be influenced and wrongdoer`s will never be arrested and punished, the plea said.

The Delhi High Court Wednesday directed the Ministry of External Affairs (MEA) to ensure welfare and safety of around 300 Indian students stranded at Almaty Airport in Kazakhstan for the past 2-3 days without food and medical aid due to coronavirus pandemic. 
 
A bench of justices Siddharth Mridul and Talwant Singh, which conducted the hearing through video conferencing, asked the authorities to expeditiously provide the students basic amenities and assistance with regard to food, medical care, lodging and transportation. 
 
The hearing was conducted through video conferencing. The two judges joined from their homes while advocate Fozia Rahman, who appeared for the petitioner, and central government standing counsel Jasmeet Singh, who represented the MEA, were at their offices.

The court issued notice to the Centre through MEA and granted time to file response to the petition.

The Delhi High Court on Saturday dismissed a bail plea of EPFO worker who was accused of siphoning a huge amount of provident funds (PF) and causing a misappropriation of approximately Rs 3.88 crores.

Justice Suresh Kumar Kait dismissed the bail plea of Uaday Singh who has been in judicial custody since March last year. The accused was working as a Data Base Administrator at EPFO before he was put behind the bars. Initially, an FIR was registered by the Delhi Police but later it was transferred to the Central Bureau of Investigation (CBI).

During the course of the investigation, it was revealed that petitioner Singh joined EPFO in October 2011 and his co-accused Devender Choudhary was also working as Project Engineer with EPFO.

Both Choudhary and Singh were engaged in developing the software of EPFO Department and were dealing with online claims and deductions.

Singh was acquainted with the loopholes of the software programme following which he conspired with Choudhary and planned to withdraw the amount from the Central Account of EPFO, the investigating agency alleged adding that it was decided by them that share of each person would be 20 per cent. According to the agency, all the accused filled in the details of the fake members in the EPFO portal and the huge amount was transferred in various fake accounts.

The agency further claimed that the EPFO data created by the accused has caused a misappropriation of approximately Rs 3.88 crores. According to an FIR, Singh is alleged to have information about receiving the amount by co-accused Neeraj Kumar in his account from Devender Chaudhary. However, Singh`s counsel said that there are no allegations of misappropriation or transferring of money by his client.

But the investigating agency said that co-accused Kumar, in his statement has alleged that Singh had knowledge about the crediting of the sum of money in his account, which allegedly he, later on, shared with Singh and Devendra Chaudhary. Neeraj Kumar was granted bail on April 13, 2018, by a trial court. Singh has moved the bail plea seeking parity with co-accused Neeraj Kumar.

However, Singh bail plea was dismissed by the trial court on the grounds that he had played a key role and has siphoned off a huge amount.CBI has also opposed Singh`s bail plea in the Delhi High Court saying that the investigation is at the advanced stage and probe agency has decided to file an application for cancellation of bail of Neeraj Kumar. It also stated that further investigation is required as to how the money was siphoned off.

"In view of the serious allegations and fraud played upon the EPFO department and the fact that Devender Chaudhary is absconding, I am of the view that present case is not fit for bail," Justice Kait added.

Violent clashes erupted in the parts of the northeast area of Delhi last week after rival groups clashed over the Citizenship Amendment Act.

The clashes led to widespread vandalism and arson for over three days now while at least 34 people lost their lives. Over 200 were injured.

Speaking to media on Wednesday, Union Defence Minister Rajnath Singh said that the situation is under control and is moving towards normalcy.

The law and order situation and traffic in violence-affected parts of Delhi is normal and peaceful, said Joint Commissioner of Police (Traffic) Narendra Singh Bundela also said.

"The situation is quite normal and peaceful as far as security and traffic are concerned. We have held talks and conducted patrols with people of all communities. Services such as road cleaning have resumed and traffic flow is normal," Bundela told ANI here.

On Thursday, the High Court had expressed anguish over the delay in action by the law enforcement agencies in containing violence and directed the Delhi Police to examine the videos related to hate speeches by political leaders which allegedly led the violence in northeast Delhi.

"We cannot let another 1984 happen in this country; not under the watch of this Court," the court said.

"We are surprised at the conduct of the police," Justice Muralidhar said while advising the police commissioner to register an FIR against the leaders.

It is delay tactic to avoid execution, says Nirbhayas mother on convicts plea in Supreme Court

In a petition filed through advocate Amresh Mathur, the petitioner told the court that the Board exams for Class 10 and 12 are fast approaching in February and March and pre-board exams are set to take place shortly.

Several commuters using this road have been forced to use alternative routes such as Delhi-Noida-Delhi (DND) Expressway and Ashram.

Scores of protesters have been agitating in the area against the CAA and NRC for over a month now.&nbsp;

Barricades have been put in place to keep the stir in control.

On January 10, the High Court refused to entertain a petition seeking removal of police barricades in Delhi's Shaheen Bagh area contending that it is causing traffic issues and demanding that protestors be shifted to some other location.

The Delhi Police has time and again issued an advisory regarding closure or obstruction due to traffic in the area.

Apart from the temporary road closures, traffic has also been affected because a part of Mathura Road is dug up to for the construction of an underpass, which is expected to ease congestion at Ashram Chowk, Mathura Road and the adjoining arteries by connecting Nizamuddin to New Friends Colony.

Sahni also said that office goers are facing inconvenience and children are compelled to leave home two hours before the school opens.

The petitioner also told the court that he made a representation to the respondents on January 3 but no action has been taken upon the same till date.

Nirbhaya case: Delhi High Court dismisses plea of convict who claims he was juvenile in 2012

New Delhi [India], Dec 9 (ANI): The Delhi High Court on Monday refused to pass any directions to the Centre on a plea seeking to formulate a policy related to linking social media accounts of individuals with Aadhaar and other identification proofs to weed out fake and ghost accounts.

A division bench of Chief Justice DN Patel and C Hari Shankar left over the central government to decide over any policy required to frame on this issue.

The court observed that to weed out the around 18 and 20 per cent fake and ghost account, date related to Aadhaar, Voter Id card, PAN card and other identification proof of 80 per cent genuine account holders will go to a foreign country.

"If such type of direction for linkage of Aadhaar, PAN or Voter ID is ordered by the court, there may be a situation where data of genuine account holder (who are 80 per cent of the total) will also go in a foreign country, which may be unnecessary," the court said.

The Centre apprised the court that the government is under consideration and also got some suggestions from law commission on this regard.

The court was hearing a Public Interest Litigation (PIL) filed by advocate Ashwini Upadhyay seeking direction to the Centre to take appropriate steps to link social media accounts with Aadhaar, PAN, voter ID card or any other identification proof to weed out fake and duplicate accounts and to control fake and paid news which may affect the election process.

The plea, also sought direction to the central government to declare that the publication of `paid news` and political advertisements during the last 48 hours before polls is a "corrupt practise" under Section 123(4) in The Representation of the People Act, 1951.

"The publication of fake news involves the use of black money, under-reporting of election expenses of political parties and candidates and indulging in other kinds of malpractices. The influence of black money also has the potential to result in an imbalanced election between people of different financial statures," the plea claimed."

Thus, in order to have free and fair elections, which is a basic dictum of democracy, the level playing field is paramount and this cannot be achieved without mitigating the instances of fake news," the petition added.

Upadhyay, through his plea, sought Centre`s direction to take appropriate steps for deactivation of fake, duplicate and ghost social media accounts.

The plea claimed that the hundreds of fake Twitter handle and bogus Facebook accounts in the name of eminent peoples and high dignitaries including the President, Vice President, Prime Minister, Chief Ministers, Cabinet Ministers, Chief Justice of India and the judges of the Supreme Court and High Courts.

"These fake Twitter handles and bogus Facebook accounts use the real photos of the constitutional authorities and eminent people," the petitioner said.

The plea stated that fake and paid news prevents the free exercise of the right to vote due to the use of money and muscle power by candidates.

"It affects the rights of the ordinary citizens to get elected and puts them at a great disadvantage due to reduced win-ability factor as an independent. Use of fake and paid news is arbitrary and unfair because it invites and enables people with criminal backgrounds to buy tickets from national and state recognised political parties and contest elections," the petitioner claimed.

"A person convicted of rape, extortion, kidnapping and murder can come back into the electoral arena. A person guilty of corruption and terrorism can also become a candidate of national and state recognised parties. Take the case of 2G, CWG and Coalgate. The accused are coming back to the election arena through national or state recognised parties. Would they not affect the elections with money and muscle power, offsetting the valuable freedom to vote without fear or favour?" the plea added.

Upadhyay said that the principle of one man, one vote is based on the freedom to vote in a fair election, which is impossible without weeding out fake accounts.&nbsp;

A Division Bench headed by Chief Justice <a href="https://www.wionews.com/india-news/supreme-court-collegium-recommends-justice-dn-patel-as-next-chief-justice-of-delhi-high-court-218328">DN Patel </a>asked the government to decide the issue as per law.

"There is no need for further guidelines. There are enough guidelines. No reason to constitute a high power committee. Govt has enough number of officers. As far as <a href="https://www.wionews.com/india-news/jnu-executive-council-approves-recommendations-of-high-level-committee-on-revised-hostel-manual-charges-264573">JNU </a>sloganeering case is concerned, the petitioner has requested directions to the Delhi government to grant sanction. The government may act as per rules and regulations," the court observed.

Petitioner Nand Kishore Garg, a former BJP MLA, through his counsel, advocate Shashank Deo Sudhi, prayed for an immediate grant of sanction for the trial of Kanhaiya Kumar and others and argued that Delhi government is harboring political prejudices by not granting the sanction in the case since one year. 
The counsel further argued that the Delhi government is guilty of obstruction of justice in such serious criminal cases which are clearly opposed to the constitutional commitment made by the government at the time of taking an oath.

The counsel further argued the oath obliges the government to act in accordance with the letter and spirit of the Constitution of India.

There is already a growing perception among the common people that law is differently applied to different people in our country and finally counsel argued that a high powered committee may be instituted to look into the lapses on the part of government officials in the issuance of said sanction for the prosecution of accused, the petitioner contended.

The plea had sought directions for issuance of guidelines for expeditious prosecutions in respect of all sensitive criminal and corruption-related cases where the allegations are serious in nature and are having widespread ramifications on the community. 
The public prosecutor had recently informed Patiala House court, where the case is pending, that the matter regarding grant of sanction is still pending to prosecute Kanhaiya Kumar and others in the JNU sedition case.

Court had adjourned the matter after the prosecutor informed that the sanction of the charge sheet is still pending and that the Home Department has not given the sanction yet. 
The Chief Metropolitan Magistrate (CMM) court had issued the summons to the investigating officer of the case and slated the matter for December 11.

In the charge sheet filed in the court in January, Delhi Police had said there was video footage wherein Kumar is "seen leading the students who were raising anti-national slogans" and that he had been identified by the witnesses in the videos.

"The location of mobile phone at the place of occurrence" was also cited as evidence against Kumar in the 1200-page charge sheet. 
As part of other evidence, the police said the Forensic Science Laboratory had retrieved an SMS sent by Khalid to Kumar asking him to "arrive at Sabarmati Dhaba, JNU, as their permission had been canceled by the JNU administration".

Delhi High Court lifts stay on bar elections at Tis Hazari, Karkardooma district courts

The victim, who was severely assaulted and thrown out on the road along with her male friend, succumbed to injuries a few days later.

Out of the six perpetrators, one committed suicide by hanging himself in prison, while another, a juvenile, served maximum punishment of three years in a reform home and was set free in 2015.

The remaining four rapists were convicted and handed death sentence by a trial court in 2013, which was confirmed by the Delhi High Court in March 2014.

Nirbhaya case: Parents' plea seeking to expedite execution of convicts to be heard by new judge

"The court has passed an order placing restrictions on any sale, disposal or creation of any encumbrance on any assets of the company, which inter-alia include the company's 4.28 per cent shareholding in Reliance Nippon Life Asset Management Ltd, till December 16," Reliance Capital informed stock exchanges in regulatory filings. The formal order of the high court is awaited. "The company will take all appropriate steps in the matter as legally advised, including to file an appeal against the said order to protect the interests of its lenders and other stakeholders," it said late on Wednesday. As many as eight lawyers and about 20 policemen including Additional Deputy Commissioner of Police (North), two Station House Officers (SHOs) sustained injuries in the clash on Saturday.

The high court took Suo moto cognizance of the matter on Sunday and directed Police Commissioner Amulya Patnaik to transfer two officers while directing him not to take any coercive action against any lawyer.

Tis Hazari Court clash: Delhi High Court orders judicial probe

The Delhi High Court on Thursday directed All India Institute of Medical Sciences (AIIMS) to submit a report regarding health issues of Congress leader P Chidambaram, who is currently <a href="https://www.wionews.com/india-news/seven-member-cbi-team-climbs-wall-to-arrest-chidambaram-at-his-residence-244683">lodged in jail </a>in connection with INX media money laundering case being probed by the Enforcement Directorate (ED).

The High Court directed AIIMS to constitute a medical board comprising of Dr Nageshwar Reddy (family doctor of P Chidambaram from Hyderabad) for Chidambram's treatment in AIIMS.

The court has asked AIIMS to submit the report before Friday.

AIIMS Medical board will sit at 7 pm today to discuss the matter.

The Congress leader is <a href="https://www.wionews.com/india-news/p-chidambaram-seeks-bail-in-inx-media-money-laundering-case-257685">seeking interim bail</a> on medical grounds. Chidambaram's lawyer had sought interim bail for him to consult and get examined by his regular treating doctor D Nageshwar Reddy at the Asian Institute of Gastroenterology in Hyderabad.

His regular bail plea is also pending for detail hearing on November 4 before the same Bench of the Delhi High Court.

Advocate Kapil Sibal, appearing for Chidambaram argued that his medical condition is very serious. "We want his treatment in Apollo with his doctor Nageshwar reddy. He needs a sterile environment. Right to life is very important. He needs immediate attention. He has a medical history. A man of 73 kg has now become a 66kg man. He has lost weight. AIIMS put him on steroids dose for 16 weeks which will not cure the decease. It will only suppress the pain and inflammation," he said.

Tushar Mehta appearing for ED said that Chidambaram has been given the best treatment. "We have taken him in AIIMS. He took the name of Doctor Ahuja, who is the best doctor for his disease. Doctor Ahuja also talked with his family doctor Nagesh Reddy who can be the part of AIIMS team. We have no objection in that."

Sibal opposed the treatment being provided in AIIMS stated that it has no sterile atmosphere and Chidambaram should get treatment at Apollo. However, he agreed that AIIMS should provide him a private ward with sterile environment.

October 30, a special court in Delhi sent Chidambaram to judicial custody till November 13.

The Congress leader was produced before the court on completion of his ED custody in the case.

The court had, on October 24, extended the Enforcement Directorate (ED) custody of Chidambaram till October 30 in connection with the case.

The ED, which is probing the money laundering charges against the leader, had arrested him on October 16.

This is the second time Chidambaram is being sent to Tihar jail.

He was earlier sent to Tihar following his CBI arrest on August 21 in connection with the INX media case.

The CBI had registered an FIR alleging irregularities in a Foreign Investment Promotion Board (FIPB) clearance granted to the INX Media group for receiving overseas funds of Rs 305 crore in 2007, during Chidambaram's tenure as finance minister.

Thereafter, the ED had lodged a money laundering case in this regard.
