Shahzadi Khan, a 33-year-old caregiver from Uttar Pradesh's Banda district, was convicted by an Abu Dhabi court for the death of a child under her care. She was sentenced to death on July 31, 2023.
She was allegedly deceived by a fraudster and trafficked to Abu Dhabi, where she was implicated in the crime that she had consistently denied committing.

According to her father&rsquo;s petition, Shahzadi Khan moved to Abu Dhabi in December 2021 on a legal visa. Khan was promised treatment in the UAE for her burn injuries by a man named Uzair, whom she befriended on Facebook. The man claimed to be a social worker and a businessman from Agra in Uttar Pradesh.
&ldquo;Uzair told her he would be able to get her better medical attention in the UAE and, circumstances permitting, even a job,&rdquo; her father said. &ldquo;He told her his uncle and aunt lived in Abu Dhabi and they could help with a tourist visa. And she could work for them while she was there.&rdquo;

Her father added that while she was hesitant, Uzair reassured her, saying that the visa was only for 90 days and she could return home after that.
However, after arriving in the Gulf country in November 2021, she discovered that her visa was for six months and that she had been &ldquo;sold&rdquo; to a married couple as a labourer for a hefty sum of money. There, she was tasked to look after the couple&rsquo;s four-month-old baby.

Things took a drastic turn when the baby died in February next year and Shahzadi was implicated by the couple, her father alleged.
She was &ldquo;trapped and forced to sign a false confession&rdquo; by the baby&rsquo;s mother, which led to her wrongful conviction, said her father.
Her father was informed last year that she was imprisoned in Al Batwa jail and could be executed any day after September 20, 2024.

The court noted that in the present case, the prosecutrix unequivocally stated that her relationship with the respondent was consensual during her statement under Section 164 of the CrPC. She also testified in court that the physical relations between her and the respondent were consensual.
The evidence in this case clearly indicates the prosecutrix's willingness to accompany the respondent, and the physical relations were established with her consent.
Furthermore, the court observed that the MLC report of the prosecutrix does not support the prosecution's case, as there were no injuries indicating resistance to the sexual act. Consequently, it was determined that the relations between the prosecutrix and the appellant were consensual.

The court was dealing with an appeal filed by the Delhi Police challenging a trial court order that had acquitted the respondent under Section 4 of the POCSO Act. The trial court had observed that the prosecution failed to prove beyond reasonable doubt that the child victim was less than 18 years old on the date of the incident.
Additionally, it was established that the accused had physical relations with the child victim with her consent. As per the well-settled law, the benefit of doubt always goes in favor of the accused. Accordingly, the accused, Hitesh, was acquitted under Section 4 read with Section 3 of the POCSO Act.

In September, the central government discharged Khedkar from the Indian Administrative Services after allegations emerged that she had fabricated her identity to gain additional attempts in the UPSC Civil Services Examination. Officials confirmed that her dismissal followed a formal enquiry into the allegations.
Khedkar is accused of providing false information in her 2022 UPSC Civil Services Examination application to claim reservation benefits. Both the Delhi Police and the UPSC opposed her plea for pre-arrest bail.

Instead, resources were being diverted towards offering freebies, which, the court noted, would not contribute to infrastructure growth. “They are only spending it on freebies. Freebies will not make your infrastructure; they will only ensure that you remain where you are. Today, the only thing the political class is doing is selling slogans, and we are buying it,” the high court said, as reported by PTI. First, we had a situation of drought and people were going on fast saying there is no water, then there was flooding and people lost their lives. Then look at this pollution and AQI level,” the court noted. The judges emphasised that Delhi was moving from one crisis to another and called for effective governance to address these challenges. “Just look at what the city is going through. It is going from one crisis to another, and it requires very serious management,” the bench added. The court also criticised the political establishment for not addressing the concerns of those affected. “We as the citizens have to take a call whether the city can accommodate 3.3 crore people or not. Do we have the infrastructure for 3.3 crore people or not? That's the fundamental issue which needs to be decided. We cannot be at 3.3 crore population and still grow without the expenditure or infrastructure. We need a huge outlay on expenditure. We don't have it,” it stated. The bench also expressed frustration at the inefficiency of the city administration, pointing out that much of the burden of governance had fallen on the judiciary. “We have got a very inefficient system and all the organisations are working in silos. The entire load is coming to the judiciary. We are not supposed to be taking care of drains and unauthorised constructions, but half of the day we are doing this which is not our job. This has to be done by the administration,” it said, according to PTI. The residents of Madrasi Camp, located near the Old Barapullah Bridge, are being evicted to facilitate the construction of a new flyover. Notices issued by the Public Works Department (PWD) in September directed them to vacate the area. The frozen semen of Preet&nbsp;was preserved at the Sir Ganga Ram Hospital in Rajinder Nagar, Delhi. The court asked the hospital authorities to release the cancer victim’s semen sample to his parents, after he passed away on 1 September 2020. Later that year in December, his parents Gurvinder Singh and Harbir Kaur requested the hospital to release the preserved sample to them.

The makers of the show, which was stated to have been on air for over 16 years with approximately 4,000 episodes, alleged that several entities were using its names, images of characters, etc. for commercial gains by running websites, selling merchandise and even publishing "sexually explicit and vulgar" videos on YouTube.

In an interim order passed against several known and unknown entities on a lawsuit by show's producer, Justice Mini Pushkarna said if the ex-parte ad interim injunction is not granted, the plaintiff will suffer an irreparable loss.

The plaintiff, Neela Film Productions Pvt Ltd, said it has statutory rights over several registered trademarks in India pertaining to their show and its characters, some of its trademarks being 'Taarak Mehta Ka Ooltah Chashmah', 'Ooltah Chashmah', 'Taarak Mehta', 'Jethaalal', 'Gokuldhaam', etc.

The court was informed that while the plaintiff enjoys copyright of its various characters and animations, some entities were unauthorisedly selling merchandise such as T-shirts, posters and stickers bearing the images and dialogues of characters from the show, through websites and e-commerce platforms.

It was also claimed that there was content generated through use of artificial intelligence or deep fakes of characters as well as video games.

"An order of ex parte ad-interim injunction is passed thereby restraining the defendant nos. 1 to 12 and 14 to 21, ... from in any manner ...publishing ...offering for sale on their websites ...the plaintiff's copyrighted material/registered trademarks, including, but not limited to the title, the characters, format and underlying materials in the said show or anything else, which otherwise amounts to an infringement of the plaintiff's copyright/registered trademarks/passing off of the goods/services offered by the defendants," the court said in an order passed on August 14.

The court further ordered that YouTube videos, which contain characters or material from the show, including pornographic content, were required to be brought down by those making the uploads.

In case the infringing videos are not brought down within 48 hours, the IT Ministry and the Department of Telecom will ask the respective internet service providers/intermediaries to suspend all links or videos, the court said.

It also granted liberty to the plaintiff to notify YouTube to block/suspend all the infringing links and also directed the platform to provide the plaintiff with the necessary details of offending uploaders.

Delhi High Court dismisses CM Arvind Kejriwal’s plea against arrest by CBI in excise case

"What is the Delhi Police doing? Have they lost it?," wondered the Delhi High Court on Wednesday, while castigating the police for a "strange" probe by arresting an SUV driver for his alleged role in the drowning of three civil services aspirants at a coaching centre in Old Rajinder Nagar area in the national capital.

The strong words of the high court, however, did not come to the rescue of jailed SUV driver whose bail plea was dismissed by a magisterial court later in the day.

Judicial Magistrate Vinod Kumar rejected the bail plea of five accused, including SUV driver Manuj Kathuria, who was termed a "masti-khor" (fun lover) by the Delhi Police in their vehement opposition to his bail plea.

In the high court, a bench of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela said a "strange probe" was going on with the Delhi Police taking action against a man who drove a car outside the coaching centre in Old Rajinder Nagar here but not acting against the Municipal Corporation of Delhi (MCD) officials.

"What is the Delhi Police doing? Have they lost it? What are its officials who are monitoring the probe doing? This is a cover-up or what?" the court said.

The bench said the police have arrested a bystander or some person who was driving the car over there. It asked whether some official (of MCD) has been held accountable for the incident till now.

"We are telling you, once the responsibility is fixed on officials, no such incident will ever happen in future," the bench said.

The high court was hearing a plea by an organisation, Kutumb, seeking the constitution of a high-level committee to investigate the deaths of the three civil service aspirants on the evening of July 27.

During the hearing, the bench allowed an oral prayer of the petitioner's advocate Rudra Vikram Singh to implead Delhi Police as a party to the petition.

"Where is the police? Who is investigating this matter? They are trying to get hold of any passerby or driver and saying this happened because you drove a car."

"Has any official been caught or interrogated? Have they interrogated the official who has not de-silted this drain? Was the drain de-silted properly and in time?,” the court asked and said, "Some sort of very strange investigation is going on."

The court hinted at asking a central agency to probe the incident and directed the Municipal Corporation of Delhi (MCD) commissioner, deputy commissioner of police concerned and the investigating officer (IO) of the case to appear before it on Friday.

'Have they lost it?': Delhi High Court questions police arrest of SUV driver in coaching centre tragedy

Kejriwal's counsel Abhishek Mau Singhvi, N Hariharan and Ramesh Gupta called CBI's allegations as poetic and said the excise policy was prepared by an expert committee, not the CM alone.&nbsp;

“Sutradhar is the word used. CBI is poetic. The first time excise policy went into making is 4-9-2020. There were nine expert committees for one year. These included four departments…After one year, in July 2021, for the first time, policy is published. At least 50 bureaucrats were involved,” Singhvi said.

While dealing with a matter related to a missing minor girl, the Delhi High Court said that the first 24-hour period is crucial for tracing a missing person or child.

"There is no scope for any speculation or conjecture that the child may return home in 24 hours, and hence the police can wait. In fact, the first 24-hour period is the crucial period, when steps for tracing the missing person or child could lead to a positive outcome," the division bench of Justices Prathiba M Singh and Amit Sharma said on Tuesday.

The bench referred to the Standard Operating Procedure (SOP) and directed, "All the police stations shall ensure that there shall be no waiting period for 24 hours in the case of missing children to start an inquiry or investigation."

"Accordingly, let the Commissioner of Police look at the matter and give directions to all police stations to ensure that the waiting period of 24 hours is wholly unnecessary and in fact, whenever a complaint is received, the inquiry, and investigation should immediately commence," the High Court ordered on July 9.

The High Court, after noting the submissions of standing counsel for Delhi police, has also transferred the present case to the Anti-Human Trafficking Unit (Crime Branch), Delhi police, who shall conduct an immediate and diligent investigation under the supervision of a senior officer not below the rank of an ACP.

The bench also directed the filing of a Status Report within a period of one week from today. The matter has been listed on July 16 for a hearing.

It is the case of the petitioner that his daughter was missing on February 19, 2024, around 10:00 am.

Thereafter, the petitioner again approached the police on February 20, 2024, and a 'missing person report' was registered instead of an FIR being registered for the offence of kidnapping.

The Delhi High Court on Wednesday heard the plea filed by Bibhav Kumar, an aide to Delhi Chief Minister Arvind Kejriwal,&nbsp;challenging his arrest. Kumar&nbsp;is accused of assaulting Aam Aadmi Party (AAP) MP Swati Maliwal.

According to ANI, Kumar also requested in his appeal that he receive "appropriate compensation" for his "illegal" incarceration.

A sessions court earlier on Monday rejected Kumar's bail request, stating that the charges against him could not be "wiped away" and that there was no "pre-meditation" on the part of the AAP MP in filing the FIR. A Delhi court noted its "bonafide requirements" and sentenced Kumar to three days of police imprisonment the next day.

The police "cannot be deprived of its right," the court said, to retrieve the cell phone he was holding at the time of Maliwal's alleged attack.

"The presence of the accused in a room where NVRs (network video recorders) are installed is not denied by him or his lawyer. To the mind of this court, the reason for remaining there for a sufficient time is obviously a question which needs to be investigated for which custodial interrogation is necessary," Metropolitan Magistrate Gaurav Goyal said, as quoted by PTI.

The Delhi Police requested that Kumar be questioned in prison, but Kumar's attorney objected, saying they lacked "evidence to nail him" and "no justification for seeking his custody."

Kumar's requests for medication and for regular visits with his advocates, his wife and daughter were approved by the court in the interim.

After Maliwal accused Kumar in a formal complaint of assaulting her on May 13 at Kejriwal's house, Kumar was taken into custody on May 18. The FIR said that Kumar repeatedly kicked her in the stomach and pelvic area after slapping her multiple times.

Sections 354, 506, 509, and 323 of the IPC, which address offences like assault or criminal force on a lady with intent to insult her modesty and criminal intimidation, are where the police filed a FIR against Kumar after receiving the complaint.

The Delhi High Court on Wednesday (May 29) granted bail to Sharjeel Imam, a student activist jailed in connection with a 2020 communal riots case that involved allegations of sedition and unlawful activities.

The prosecution has accused Imam of making provocative speeches at Delhi's Jamia Millia Islamia on December 13, 2019, and at the Aligarh Muslim University on December 16, 2019. In these speeches, he allegedly threatened to cut off Assam and the rest of the North East from India.

Imam has been in custody for over 1580 days, since January 28, 2020.

Previously, on February 17, a trial court had refused to grant Imam respite. The student activist claimed in front of the trial court that he could be released after over four years in custody.&nbsp;

Russian author Dostoyevsky wrote in Crime and Punishment, “The man who has conscience suffers whilst acknowledging his sin,” meaning, that if a man knows that he has done something wrong, he will suffer from the guilt and that will both be his prison and punishment.

A division bench of Justice Suresh Kumar Kait and Justice Manoj Jain said, “…keeping in mind the gravity of the matter, though, appellants did not deserve any unjustifiable leniency, at the same time, considering their…inclination of reformation… the life sentence was not warranted either…”

The bench further said, “We refer to a quote by Fyodor Dostoevsky, the author of ‘Crime and Punishment’… Dostoevsky writes that ‘if he has a conscience he will suffer for his mistake…”

The five men were earlier booked under Section 121A IPC, which refers to conspiring to commit an offence under Section 121 or conspiring by using criminal force on the Central government/any state government.&nbsp;

The five men are - Bilal Ahmad Mir, Sajjad Ahmad Khan, Muzaffar Ahmad Bhat, Mehraj Ud Din Chopan and Ishfaq Ahmad Bhatt. They had pleaded guilty before the trial court to the offences lodged against them under IPC and UAPA and were convicted. In September 2022, the five men were accused of “allegedly assisting JeM operatives and were involved in recruiting others for propagating and supporting the cause of JeM”.

“Jackie Shroff is so well known. People will think it is endorsed by him. He has a certain marketability to his name. It can’t be done without his consent,” the counsel said. 
 
The court was told that merchandise like mugs, signed posters, and bags was being sold on the internet in violation of Shroff’s rights. The lawyer for the plaintiff also said certain derogatory and objectionable content was also available as memes, morphed images, etc. 
 
“All are using his name, and images and earning huge money. This is all defamatory stuff…there are distasteful dirty words in voice-over. There is nothing legitimate about any of this,” added the counsel. 
 
In support of his case, Jackie Shroff’s counsel relied on orders passed by the high court in similar lawsuits by actors Amitabh Bachchan and Anil Kapoor.

Chief Minister Arvind Kejriwal on Tuesday moved the Delhi High Court challenging the summons issued to him by the Enforcement Directorate in an excise policy-linked money laundering case.

The petition of the AAP national convenor, who has been asked to appear before the agency on March 21, is listed for hearing on Wednesday before a bench of Justices Suresh Kumar Kait and Manoj Jain.

He has moved the court against the latest summons, the ninth issued by the ED asking him to appearing before it for questioning under the provisions of the Prevention of Money Laundering Act (PMLA).

Arvind Kejriwal has repeatedly refused to appear in response to these summonses, calling them illegal.

The case pertains to alleged corruption in formulating and executing the city government's excise policy for 2021-22, which was later scrapped.

Following a recommendation by Lt Governor VK Saxena, the CBI registered an FIR over alleged corruption which subsequently resulted in the money laundering probe.

The agencies have claimed that irregularities were committed while modifying the excise policy and undue favours were extended to licence holders.

AAP leaders Manish Sisodia and Sanjay Singh are in judicial custody in the case.

This decision follows a legal battle that saw the court setting aside the revocation order issued by the Authority under the Protection of Plant Varieties and Farmers' Rights Act.<o:p></o:p>

The court, in its ruling, stated, "The appeal of PepsiCo, LPA 590/2023 is allowed. The impugned judgment and order dated 5 July 2023 shall consequently stand set aside to the extent indicated above." <o:p></o:p>

Additionally, the bench set aside the revocation order issued by the Authority on December 3, 2021, along with the letter issued on February 11, 2022, rejecting the renewal application.<o:p></o:p>

“We are struggling to stay afloat,” the airline’s lawyer Amit Sibal told the judge.

SpiceJet said that it would deposit 750 million rupees ($9.08 million) within 10 days, but the judge instead demanded that the airline pay one billion rupees ($12 million) by September 10 or risk having its assets seized in order to recoup the debt.

In a statement, SpiceJet agreed to uphold the court decision and “make the specified payment within the prescribed timeframe.”

The directive was issued a few days after the Indian Supreme Court ordered SpiceJet’s managing director, Ajay Singh, to appear in court to defend Credit Suisse’s claims for certain outstanding dues that were owed.

The Supreme Court case and the Delhi High Court case will both be heard next on September 11.

Due a substantial decrease in costs brought by the operation of fewer flights, SpiceJet posted its biggest quarterly profit in four years, last month. As competition in the industry becomes tougher, SpiceJet has also been frantically trying to obtain funds and resume operations for nearly a fourth of its fleet, which has been grounded due to disputes with its lessors over payments.
