A case has been registered against Russia by Ukraine at the United Nations' highest court. Kyiv has accused Moscow of planning genocide and asked the court to intervene to halt the attack and order Russia to pay reparations.

In the case, Ukraine on Sunday, also asked the International Court of Justice, which is based in The Hague, to indicate "provisional measures" and order Moscow to "immediately suspend the military operations" launched on February 24.

The silencing of church bells in a recent court ruling seems to have not gone down well in a small town in northern Italy.

The decision to remove the bells was taken by a judge in nearby Trieste. It had also preceded a petition to put an end to “loud and excessive” ringing.

Now, the row has led to anger among the population of 4,800 in Dolina, which is close to Italy’s border with Slovenia. It also has a minority Slovene community.

In the town, some people miss bells of Sant’Ulderico church while others claim to have got the much-needed respite. Now, there have been accusations of personal vendettas as well.

Some people are calling on the European Commission to act to “protect traditions”. They said that bells used to serve as a clock and inform people about the start of mass or a feast day.

“Fines have been given to Italian parishes if bells are too noisy, but they have never been confiscated before. This reaction was a bit too heavy,” said the parish priest, Klemen Zalar.

The issue began during Covid lockdown in 2020 when the automatically operated bells became intolerable for some people, who were stuck at home.

“It was bam-bam, bam-bam all day long,” said Mauro Zerial, the organiser of the petition, who counted 550 strokes in a day between Monday and Saturday, and 1,350 on a Sunday.

“It would start at 6am, with 70 strokes for the Ave Maria, then seven at 7am, and then every 15 minutes until another long ring for the start of evening mass. It was crazy. But nobody wanted the bells to be silenced, we just wanted them to be operated within the norms. And in no way was this an attack against Slovenian traditions,” said Zerial.

The Australian government has agreed to pay "an historic settlement" to three women who accused a former top justice of sexual harassment, lawyers for the trio said Monday.

Rachael Patterson Collins, Chelsea Tabart and Alex Eggerking all worked as associates at the High Court of Australia, where they alleged they were sexually harassed by Dyson Heydon, then a justice.

The Attorney-General's Department confirmed the deal, which followed a High Court internal inquiry that upheld the women's claims against Heydon, and those of three other women who had also worked at the court.

Lawyers from Maurice Blackburn called the settlement "historic", saying they believed it to be the first involving sexual harassment allegations against a serving federal justice.

Heydon has denied "any allegation of predatory behaviour or breaches of the law" made against him.

In June 2020, the High Court apologised to all six women, with current Chief Justice Susan Kiefel saying, "We are ashamed that this could have happened at the High Court of Australia."

Patterson Collins, Tabart and Eggerking entered into negotiations with the federal government shortly after that apology.

The sum paid by the government will remain confidential due to non-disclosure agreements included in the settlement despite coming from public coffers.

Attorney-General Michaelia Cash said only that the government "has taken these claims very seriously. The settlements we have reached are consistent with that".

She also commended the bravery of the women in coming forward.

Ousted Myanmar leader Aung San Suu Kyi returned to a junta court on Friday after skipping a previous hearing because she felt unwell, a source with knowledge of the case said.

Suu Kyi has been detained since her civilian government was ousted in a coup last year that triggered mass protests and a bloody military crackdown, with more than 1,500 civilians killed, according to a local monitoring group.

Cut off from the world except for brief meetings with her legal team and court appearances, the Nobel laureate faces a raft of charges that could see her jailed for more than 150 years.

She skipped Thursday's hearing in her trial on charges of breaching the official secrets act because she felt "dizzy", a source with knowledge of the case said.

Detained Australian academic Sean Turnell is a co-defendant alongside Suu Kyi in that case.

Suu Kyi returned on Friday for the latest hearing in one of her corruption trials, related to the leasing of a helicopter, the source said.

"Now she is well," the source added.

The 76-year-old Suu Kyi missed a hearing in September due to illness, and in October her lawyer said her health had suffered from her frequent appearances before the junta-run court.

Journalists are barred from the proceedings in the military-built capital Naypyidaw and her lawyers have been barred from speaking to the press.

On Thursday the junta announced it had filed an eleventh corruption charge against Suu Kyi for allegedly receiving $550,000 as a donation for a charity foundation named after her mother.

She has already been sentenced to six years in jail for incitement against the military, breaching Covid-19 rules and breaking a telecommunications law -- although she will remain under house arrest while she fights other charges.

France on Friday upheld its decision of imposing a $111 million fine on Google for the 'Cookie' breach. The decision was made by the country's supreme administrative court Conseil d'Etat.

A group of women from Maryland, US, have challenged a ban on topless sunbathing. The petitioners are asking the Supreme Court to review a law that allows men to show skin but bans women from doing the same.

As per the petitioners, the court is so preoccupied with “protecting traditional moral sensibilities” that it permits “discrimination against all women.”

In 2017, Ocean City had passed a law banning women from exposing their skin at the beach after one of their plaintiffs, Chelsea Eline, complained to local authorities that she had a right to go topless.

According to a report by The Associated Press, Judge A. Marvin Quattlebaum, also one of the panel members said that Ocean City is within their rights to impose such a ban to protect “public sensibilities."

The court had also denied a request to rehear the case.

Chief judge Roger Gregory said that the court should reconsider its decision. Gregory wrote, "At first glance, Ocean City’s ordinance seems innocuous enough … But we must take care not to let our analysis be confined by the limits of our social lens. Suppose the ordinance defined nudity to include public exposure of a woman’s hair, neck, shoulders, or ankles. Would that law not run afoul of the Equal Protection Clause?"

The petition was filed on December 1 and the court can respond till January 7.

Ruling on US government's appeal opposing a previous order against extradition of Wikileaks founder Julian Assange is due to come on Friday.

Court listings for the Royal Courts of Justice in London published on Thursday said a judgment in the long-running case will be handed down at 1015 GMT on Friday.

USA wants to put 50-year-old Julian Assange on trial for leaking thousands of classified military documents about US war in Iraq and Afghanistan.

The extradition was blocked in January this year. The grounds for blocking extradition were Assange potentially being a suicide risk if he was removed to the United States and held in isolation.

But lawyers for the US government in October argued the original judge had not given sufficient weight to other expert testimony about Assange's mental state.

They have also sought to assure the court he would not be held in a federal supermax prison, and would receive appropriate treatment.

The case has become a cause celebre for free speech with Assange's supporters arguing WikiLeaks has the same rights as other media to publish secret material in the public interest.

Assange himself has been in custody since 2019, despite having served a previous sentence for breaching bail conditions in a separate case.

The maverick publisher spent seven years at Ecuador's embassy in London to avoid being removed to Sweden to face sexual assault allegations that were later dropped.

While at the South American country's mission, he fathered two children with his partner, Stella Moris, a member of his legal team.

In a landmark judgement, a court in Germany has ruled that walking from bed to home office is technically commuting and if a person falls while making this journey for the first time, it comes under workplace accident insurance.

In its decision, the federal social court, which undertakes social security issues, said, the man was working from home and was going to his desk one floor below the bedroom.

The man, who has not been named, slipped while walking on the spiral staircase connecting the rooms and broke his back.

The German federal court ruled, “The plaintiff suffered an accident at work when he fell on the way to his home office in the morning. If the insured activity is carried out in the household of the insured person or at another location, insurance cover is provided to the same extent as when the activity is carried out at the company premises.”

The court also said that it had found that “the first morning journey from bed to the home office [was] an insured work route”.

Earlier, the employer’s insurance had refused to cover the claim while two lower courts had also disagreed on whether the travel was a commute or not.

In what can be described as a tormenting experience owing to a mix-up at an IVF clinic, a court has directed the hospital in Belgium to compensate a couple for a botched-up treatment.

The Spanish couple, who already had a son with beta thalassaemia, thought to have a second child, who could act as a donor or ‘saviour’ for their first child as bone marrow transplant can be a potential solution to his genetic disorder.

So, they approached a fertility clinic at the Universitair Ziekenhuis Brussels hospital where doctors used in vitro fertilisation and “pre-implantation diagnosis” to ensure the second child conceived was a suitable donor.

In the case, a judge awarded damages of €27,000 (£23,000) to the mother and €11,000 to the father, for “the shock they suffered after learning that the twins were not suitable as donors” and for the “anxiety and risks generated by a new pregnancy”, as per Flemish newspaper ‘De Standaard’.

A bankruptcy court in New York has dismissed a petition of Indian fugitive diamond merchant Nirav Modi and his associates, seeking dismissal of fraud allegations against them.

The allegations were made by Richard Levin, the court appointed trustee of three US corporations--Firestar Diamond, Fantasy Inc and A Jaffe--indirectly owned by Nirav Modi previously.

Levin had also sought a minimum compensation of USD 15 million for harm suffered by the debtors of Modi and his associates Mihir Bhansali and Ajay Gandhi.

Southern District of New York Bankruptcy Court Judge Sean H Lane issued the order last Friday, in a major blow to the Indian fugitive and his accomplices.

SDNY Bankruptcy Court Judge Lane in a clear decision denied defendants Modi, Bansali and Gandhi's motions to dismiss US Trustee Richard Levin's amended complaint in the adversary proceeding arising out of Modi's initial chapter 11 bankruptcy petition, alleging fraud, breach of fiduciary duties, RICO and related state law claims, Indian American attorney Ravi Batra told PTI.

Explaining the 60-page order, Batra said Modi ploughed his profits back into his own company as additional sales to falsely raise the stock price/company valuation by setting up a scheme to defraud Punjab National Bank and others of over USD1 billion.

But to get the ill-gotten funds by bank fraud out of his companies, he engaged in a separate fraud to hide those withdrawals for personal benefit as if they were ordinary business transactions, Batra said.

According to the court order, Levin's petition sought to recover damages for harm inflicted by Modi and his two accomplishes on the debtors and their estates as a result of the his six-year extensive international fraud, money laundering and embezzlement scheme.

It said from early 2011 to early 2018, Modi and his associates orchestrated and carried out a scheme to obtain loans, credits, or other funds under false pretences and without collateral? from numerous banks, including the PNB.

The bank fraud involved the use of letters of undertaking (LoUs), a financial instrument unique to India, designed to facilitate efficient import transactions. Modi and the co-conspirators sought to artificially inflate the import volumes of Modi's India-based companies with sham transactions so as to obtain more LoU funding, it alleged.

To carry out this scheme, Modi and his co-conspirators used a web of shell companies known as shadow entities based in Hong Kong and Dubai that posed as legitimate businesses to create fake import transactions and launder the proceeds, it said.

The PNB and the other defrauded banks are reported to have lost in excess of USD1 billion as a result of the fraud, the judge wrote in his order.

In his petition, Levin listed examples how Modi, Bhansali and Gandhi directly benefited from fraudulently issued LoUs and were involved in circular transactions until early 2013, when the debtors no longer directly participated in import and export transactions underlying LoU issuances and instead received proceeds indirectly through the shadow entities.

US court dismisses plea filed by Indian fugitive diamond merchant Nirav Modi, associates

The Australian government on Monday began its legal challenge to a Federal Court's landmark decision that it has a duty of care to protect children from future personal injury caused by climate change, according to media reports.

In May, Anjali Sharma, a 17-year-old high-school student of Indian origin from Melbourne and seven other teenage environmentalists, led the legal battle against the Australian government.

Sharma and the group had argued the continued emission of carbon dioxide into the atmosphere would drive intense bushfires, floods, storms and cyclones and leave them vulnerable to injury, sickness, economic loss and even death towards the end of this century, news.com.au reported.

They urged the court to prevent Environment Minister Sussan Ley from approving a proposal to expand the Vickery coal mine in northern New South Wales.

In his ruling, Justice Mordecai Bromberg approved the extension of the coal mine project.

However, he did find that the minister had "a duty to take reasonable care to avoid causing personal injury" to children when she decided on the project extension under the Environment Protection and Biodiversity Conservation (EPBC Act), a report in news.com.au said.

The ruling was heralded as a significant win for the teenagers and the group of climate activists around the world.

Ley has since given the nod for the mine's expansion.

For Sharma, it was the concern for the environment, her family and future generations, which fuelled her legal charge against the Australian government, a Sydney Morning Herald report said. Born in India, Sharma and her family moved to Australia when she was barely 10-months-old. Her relatives are farmers, who hail from Lucknow.

Growing up, she had heard about global warming and decided to seek more information by watching Youtube videos, the report said.

"Growing up in Australia I consider myself really fortunate," she said. "I got an education that helped me make sense of what was happening," Sharma was quoted as saying in the report.

On Monday, Ley's lawyers told the Federal Court that the EPBC Act was not an appropriate vehicle for the "novel duty of care" as identified by Justice Bromberg.

They argued that Justice Bromberg had committed a mistake when he expanded the object of the act to not just be about protecting parts of the environment, but about protecting the interests of human beings living in the environment.

Her lawyers also contended that the duty of care is "incoherent" with the EPBC Act and distorts her capacity as minister.

They also claimed that there was no evidence that the additional coal from the expanded mine would increase the risk of the global temperature increasing beyond 2 degrees Celsius above pre-industrial temperatures, according to the Associated Press.

"We will proudly defend the historic ruling that all Australian children are owed a duty of care by our government, and fight to protect my generation from the increasing risks of climate change," Ms Sharma was quoted as saying in a statement by the Associated Press.

The eight young environmentalists were congratulated over the May ruling by Greta Thunberg, who rose to the forefront of the youth climate movement after she protested inaction by going on strike from school.

"This is a huge win for the whole climate movement. A big congratulations to the brave Australian teenagers who have achieved this," the 18-year-old Swedish environmentalist tweeted.

"Of course the action needed is still nowhere in sight, but these court cases are symbolic breaking points that could have huge snowball effects," Ms Thunberg had said then.

Australia has come under growing international criticism for failing to set more ambitious targets for reducing carbon emissions.

A landmark ruling by Poland's top court rejecting the supremacy of EU law marks an attack on the European Union, France's Europe Minister Clement Beaune said on Friday.

"It is very serious there is the risk of a de-facto exit" of Poland from the EU, he told the BFM-TV broadcaster in an interview, adding "I do not want the exit of Poland".

"This is an attack on the EU by a constitutional court that was modelled by the Polish government," Beaune said.

The court on Friday ruled that some EU treaty articles were "incompatible" with the Polish constitution and warned EU institutions not to "act beyond the scope of their competencies" by interfering with Poland's judiciary.

Poland and the EU are at odds over judicial reforms introduced by Poland's governing right-wing Law and Justice (PiS) party which Brussels warns threaten the country's democracy.

France calls Poland court ruling 'attack against EU'

Twitter has appealed a French court decision that ordered it to give activists full access to all of its relevant documents on efforts to fight hate speech, lawyers and a judicial source said on Saturday.

In July, a French court ordered Twitter to grant six French anti-discrimination groups full access to all documents relating to the company's efforts to combat hate speech since May 2020. The ruling applied to Twitter's global operation, not just France.

Twitter has appealed the decision and a hearing has been set for December 9, 2021, a judicial source told AFP, confirming information released by the groups' lawyers.

Twitter and its lawyers declined to comment.

The July order said that Twitter must hand over "all administrative, contractual, technical or commercial documents" detailing the resources it has assigned to fight homophobic, racist and sexist discourse on the site, as well as the offence of "condoning crimes against humanity".

It also said Twitter must reveal how many moderators it employs in France to examine posts flagged as hateful, and data on the posts they process.

The July ruling gave the San Francisco-based company two months to comply. Twitter can ask for a suspension pending the appeal.

The six anti-discrimination groups had taken Twitter to court in France last year, accusing the US social media giant of "long-term and persistent" failures in blocking hateful comments from the site.

The groups campaign against homophobia, racism and anti-Semitism.

Twitter's hateful conduct policy bans users from promoting violence or threatening or attacking people based on their race, religion, gender identity or disability, among other forms of discrimination.

Like other social media giants it allows users to report posts they believe are hateful, and employs moderators to vet the content.

But anti-discrimination groups have long complained that holes in the policy allow hateful comments to stay online in many cases.

News outlet CNN has said it scrapped its Facebook presence in Australia claiming that the social media behemoth refused to disable the comments section, while also citing the country’s high court ruling which made publishers responsible for defamatory comments posted by users on social media.

The move reportedly makes CNN the first major news organisation to pull its Facebook presence in Australia.

CNN said that Facebook declined a request to help it and other publishers disable public comments in the country following the ruling.

CNN's main Facebook page showed an error message when accessed from Australia on Wednesday.

While denying bail to one of the accused in the 2020 Delhi riots that claimed 53 lives and left more than 400 injured, the Delhi high court said the communal riots was “pre-planned and premeditated” intend to disturb law and order in the city.

Justice Subramonium Prasad made these remarks on Monday while denying the bail request of an accused, Mohammad Ibrahim, who was arrested in December in connection with the alleged murder of Delhi Police head constable Ratan Lal.

The court, while observing the video footage submitted by the prosecution, said the riots were meticulously planned to disrupt the normal life.

“The riots which shook the National Capital of the country in February 2020 evidently did not take place in a spur of the moment, and the conduct of the protestors who are present in the video footage which has been placed on record by the prosecution visibly portrays that it was a calculated attempt to dislocate the functioning of the government as well as to disrupt the normal
life of the people in the city," the Court said

.“This is also evident from the fact that innumerable rioters ruthlessly descended with sticks, dandas (batons), bats etc. upon a hopelessly outnumbered cohort of police officials,” the order stated.

The petitioner, Ibrahim, was arrested in December 2020 and has been in judicial custody since then. He sought bail on the ground that he never participated in any protest or the riots at any point in time and the place on a record by the prosecution did not place him anywhere close to the scene of the crime.

The case pertains to a mob attack on police officers at Chand Bagh in northeast Delhi at the peak of the riots revolving around protests over a new citizenship law.

2020 Delhi riots pre-planned & premeditated, didn't take place in spur of the moment, says court

The fate of a 6-year-old boy who was the sole survivor of a deadly cable car accident in Italy moved into an Israeli courtroom Thursday, in a bitter international custody battle that has drawn world attention.

Lawyers for the boy’s aunt, who lives in Italy, and his grandfather, who lives in Israel, squared off in a closed hearing at a family court in Tel Aviv. The court set a new hearing date for next month and ruled that until then the child, Eitan Biran, would remain in Israel and spend time with both sets of relatives.

Eitan was the sole survivor of a May 23 crash on a mountain overlooking Lake Maggiore in northern Italy that killed 14 people, including his parents and younger brother.

The boy and his family, who were from Israel, had been living in Italy at the time of the accident. The family was taking a Sunday afternoon cable car excursion up the nearly 5,000-foot peak of picturesque Mottarone mountain when a cable snapped, sending the car plunging to the mountainside below and then tumbling down the steep slope. The causes of the accident are still under investigation.

Two days later, an Italian court appointed his paternal aunt, Aya Biran, who lived in a small town near Pavia, Italy, as his legal guardian, a ruling challenged by the boy’s maternal relatives in Israel.

But this month, the boy’s maternal grandfather, Shmuel Peleg, spirited Eitan out of the country, to Israel via Switzerland, on a private plane. Peleg is now under investigation in Italy on charges of kidnapping and could face up to 15 years in prison if found guilty.

Both sides of the family say that they have only Eitan’s best interests at heart.

Biran said that Eitan has been “ripped out of his family” and out “of the country where he’s been living all his life,” disrupting months of physical and psychological care after the accident.

“It’s a tragedy over a tragedy,” she said in a telephone interview last week. “It’s hell on the earth right now.”

She has called on the Tel Aviv court to apply The Hague Convention on abducted minors and immediately return Eitan to Italy.

She said that Italy has been Eitan’s primary home since he arrived when he was weeks old so that his father, her brother, Amit Biran, could study medicine at the University of Pavia. The two families lived near each other, and Eitan and one of Aya Biran’s daughters attended years of preschool together. He was set to start elementary school there last week.

Peleg said that Eitan’s parents always intended to return to Israel, where the majority of their relatives live, and that their stay in Italy was meant to end with Amit Biran’s studies. Eitan and his family visited Israel often and spent nearly six months there last year.

“Eitan is an Israeli boy, he was born here” and has “Israeli roots,” Peleg said in an interview last week. “He has everything here. So why there? Why? All the family is here.”

Peleg has also challenged the validity of Biran’s appointment as Eitan’s custodian, arguing that the case was not heard in the proper court. He had already appealed the appointment twice, and lost, and a third challenge is scheduled for October.

“I lost my faith in the Italian system,” he said, explaining why he brought Eitan to Israel.

He had been frustrated, he said, that he could not communicate directly with the judges and had no say in Eitan’s care.

The boy was seriously injured in the accident and, although he is improving, still uses a walker and, when he leaves the house, a wheelchair.

Peleg said he had been told by one of his lawyers that he was not breaking any laws by bringing Eitan to Israel to seek better medical treatment.

He has been questioned as a suspect by Israeli police and placed under house arrest pending an investigation.

Mexico says US court agrees to hear suit against gunmakers

Brazil's Supreme Electoral Court (TSE) decided on Monday to open an investigation into far-right President Jair Bolsonaro for his statements claiming there will be fraud in next year's elections.

Bolsonaro, who is expected to seek a second term in 2022, has repeatedly said Brazil's electronic voting system is vulnerable to fraud.

Critics say Bolsonaro, like former US President Donald Trump, is sowing doubts with his unfounded claims in order to pave the way for him not to accept defeat in 2022.

The TSE also decided to ask the Supreme Court to investigate whether Bolsonaro committed a crime by attacking the electoral system on social media and threatening Brazil's democracy.

The TSE voted to investigate Bolsonaro after he accused the court's members of complicity in maintaining a voting system that would help former leftist President Luiz Inacio Lula da Silva return to power.

Bolsonaro is calling for the adoption of printed receipts that can be counted if any election result is disputed, a paper trail that would change the current all-electronic voting system. Bolsonaro has said he might not accept the result of next year's presidential election if the system is not changed.

Over the weekend, supporters of the president held demonstrations in several cities backing his proposal.

Earlier on Monday, a group of 18 active and former Brazilian Supreme Court justices, who also serve as judges on the TSE, said the election system is free of fraud.

"Brazil has eliminated a history of election fraud," the judges said in a statement, saying that since the electronic voting system was adopted in 1996, there has never been a documented fraud case in any election.

"The electronic voting system is subject to audits before, during and after the election," they said. The judges said all the steps are monitored by political parties, prosecutors, federal police, universities and the Brazilian Bar Association.

The judges said printed ballots are less safe than electronic voting, and that if Brazil goes back to manual counting of 150 million printed ballots, the chance of fraud would be higher.

A congressional committee will vote Thursday on a proposal pushed by Bolsonaro to introduce paper ballots.

The government solicitor general's office did not immediately reply to a request for comment on the TSE decision.

Brazil court to probe Bolsonaro for attacks on voting system

In a landmark verdict, Nepal's Supreme Court on Monday directed President Bidya Devi Bhandari to appoint Nepali Congress chief Sher Bahadur Deuba as prime minister by Tuesday and reinstated the dissolved House of Representatives for a second time in five months.

A five-member Constitutional Bench of the Supreme Court led by Chief Justice Cholendra Shumsher Rana issued the verdict stating that President Bhandari's decision to dissolve the lower house upon a recommendation of Prime Minister K P Sharma Oli was an unconstitutional act, delivering a major blow to the veteran Communist leader, who was preparing for snap polls.

The bench issued a mandamus to appoint Deuba as the Prime Minister by Tuesday. Deuba, 74, has served as the prime minister on four occasions.

The court also ordered summoning new session of House of Representatives at 5 PM on July 18.

Chief Justice Rana also said that the bench has concluded that party whip does not apply when lawmakers take part in the voting to elect new Prime Minister as per Article 76(5) of the Constitution.

TikTok was running again in Pakistan Saturday after a provincial court lifted suspension of the popular social media service but ordered it to address complaints that it hosted objectionable content.

The Pakistan Telecoms Authority (PTA) blocked access Thursday for a third time after a ruling by a Sindh court hearing a private citizen's petition against the Chinese-owned app.

Freedom of speech advocates have long criticised creeping government censorship and control of Pakistan's internet and media.

TikTok's suspension was slammed by the video sharing platform's huge fan base in Pakistan, many of whom use it to market and sell goods online.

But its critics in the deeply conservative Muslim nation say it promotes vulgarity and LBGQT content.

TikTok has been shut down twice before in Pakistan because of alleged "indecent" videos -- most recently in March, after which the platform pledged better moderation.

It said Wednesday it had removed more than six million videos from its Pakistan service in the past three months alone -- around 15 percent featuring "adult nudity and sexual activities".

A PTA official told AFP the court had Friday revoked its earlier order banning the app, and users confirmed it was running again.

Still, even senior Pakistan officials appeared confused by the to- and fro-ing.

"I am baffled after reading... verdict on suspension of TikTok," Information Minister Fawad Chaudhry tweeted.
