The South African double Olympic 800m champion, 32, had approached the European Court of Human Rights in February 2021 after losing appeals to the Court of Arbitration for Sport (CAS).

IN PICS | Who is Caster Semenya and what is the ongoing controversy with the South African athlete?

Double Olympic 800m champion Caster Semenya Wednesday hailed the decision of the&nbsp;European Court of Human Rights which ruled her human rights were violated by Swiss courts. "Justice has spoken but this is only the beginning," she said in a statement released by her lawyers a day after the ruling.

The 32-year-old South African appealed to the Strasbourg-based ECHR after the Swiss supreme court rejected her appeal against World Athletics' rules that she must take medication to lower her testosterone levels if she wishes to continue competing. Semenya, who is classed as having "differences in sexual development (DSD)" but has always been legally identified as female, has refused to take the drugs since the international federation introduced the rules in 2018.

As a result, she has been barred from competing at her favourite distance of 800m and the rules were extended in March this year, meaning she cannot compete at any distance unless she takes the testosterone-lowering medication.

Semenya said Tuesday's decision would be "significant for all sportspersons in throwing doubt on the future of all similar rules".&nbsp;She expressed the hope that the ruling will ensure all sporting bodies "respect the dignity and human rights of the athletes they deal with".

"My rights violated. My career impacted. All of it so damaging. Mentally, emotionally, physically and financially," she said, without hinting at her next steps.

Two back-to-back explosions were heard in a Ukrainian court in the capital Kyiv on Wednesday, leaving one dead and two injured, local media reported.

Ukraine's interior minister Igor Klymenko said that a man blew himself up on the court premises during which two law enforcement officers were also wounded

"An offender died at the scene. According to preliminary information, he blew himself up," Interior Minister Igor Klymenko said on social media.

Two law enforcement officers were wounded as they stormed the premises, Klymenko added.

The explosion took place at 5:20 p.m. (1420 GMT) in the toilet of the court, the Kyiv city military administration said.

Ihor Humenyuk, the suspect, was linked to the deaths of four Ukrainian national guardsmen in 2015 and was attending the court in that case.

Reportedly, following the hearing, Humenyuk barricaded himself inside a bathroom and threw an explosive device at two guards. Their prompt actions prevented him from escaping the building.

As law enforcement officers fired into the air to contain the situation, Humenyuk retreated into another room within the courthouse. Refusing to engage in negotiations with officials, he further resorted to violence by hurling another explosive device, injuring two officers in the process.

Unfortunately, the altercation ended with Humenyuk losing his life. An investigation is now underway to determine how he had come into possession of the explosives within the courtroom premises.

A first-of-a-kind trial is underway in Montana, the United States where 16 young people have filed a lawsuit which has sought to hold the officials in the state accountable over inaction on climate change. The young plaintiffs hope that this lawsuit would bring changes to the fossil fuel-friendly state.

<h2>Plaintiffs feel a sense of 'betrayal'</h2>

In his opening statement, Roger Sullivan, an attorney for the young plaintiffs, from non-profit Our Children’s Trust, reportedly listed the costs and consequences of Montana’s fossil fuel-friendly policies which he said are also in violation of the state constitutional provision that guarantees a right to a “clean and healthful environment.”

The trial is set to go on for two weeks and is being presided over by District Judge Kathy Seeley who the 16 young plaintiffs and their attorneys will try to convince that the state policies which supposedly favour fossil fuels not only endanger their health and livelihoods but also threatens the future generations.

It is also worth noting that the lawsuit centres around the state’s constitutional right to a “clean and healthful environment.” In line with this, Sullivan also said that Montana’s ongoing permitting of polluting fuels like coal and gas is contributing to a global crisis including, “heat, drought, wildfires, air pollution, violent storms, loss of wildlife, watching glaciers melt.”&nbsp;

The lawyer for the plaintiffs also went on to argue that because of these effects, the young people he represents are disproportionately suffering psychologically and healthily. Speaking on behalf of the plaintiffs, Sullivan said they felt a sense of “betrayal,” with some expressing reluctance to have their own children because they fear the world they would grow up in.

He also claimed that the state had pursued a ruinous energy policy which led to the release of 166 million tonnes of carbon dioxide into the atmosphere annually, which is equivalent to the emissions of countries like Argentina, the Netherlands, or Pakistan.

<h2>Montana youth testify in court</h2>

One of the plaintiffs, a 19-year-old Montana resident, Grace Gibson-Snyder told the court that the smoke from wildfires which have worsened due to climate change and became a “defining experience” of her playing soccer in high school.&nbsp;

She spoke about how her hometown Missoula was regularly shrouded in smoke which forced cancellations of soccer practices and kept her teammates with asthma away from the field. “It’s not pleasant,” said the 19-year-old, as quoted by The Associated Press. She added, “It’s so uncomfortable as you’re breathing deeper and deeper.”

Meanwhile, the 22-year-old lead plaintiff Rikki Held also spoke about how climate change has affected the conditions on her family’s ranch in eastern Montana. Droughts have left “skinny cows and dead cattle” while wildfires make ash fall from the sky, said Held, speaking about the wildfires in 2021.&nbsp;

She said that wildfires had burned some 70 miles (113 kilometres) of power lines in her town which led to a month-long power cut and choked the air “all summer”. The incident also triggered mass evacuations and impacted the family’s motel business.&nbsp;

However, she remains optimistic. “We have the technology and knowledge, we just need empathy and willingness to do the right thing,” said Held. Notably, the trial is expected to see testimonies from all but the four youngest plaintiffs.&nbsp;

The youngest plaintiff was two years old when the lawsuit was filed. Nathaniel K., a Montana resident, now five years old, according to his parents suffers from respiratory issues whose health is also threatened by wildfires which have been made worse due to climate change.&nbsp;

<h2>'Minuscule': US state of&nbsp;Montana about its carbon emissions</h2>

Montana Assistant Attorney General Michael Russell said that the state produces “minuscule” emissions and that the harms alleged by the plaintiffs can’t be traced to specific actions by state officials.

“Climate change is a global issue that effectively relegates Montana’s role to that of a spectator,” said Russell. He also said the trial “will hear lots of emotion, lots of assumptions, accusations... and notably fear about what the future may hold, including sweeping and dramatic assertions of doom that awaits us all,” but the reality is “far more boring” than what the youth have claimed.&nbsp;

According to Russell, Montana’s greenhouse gas emissions are decreasing and the plaintiffs are not challenging policies that would, if invalidated, meaningfully change the state’s impact on the climate.&nbsp;

The constitutional provision that the case is centred around is a part of the Montana Environmental Policy Act, which Russell has said is a “procedural” law which requires environmental reviews of any big projects in the state but does not mandate specific outcomes.

<h2>What do we know about the lawsuit?</h2>

The landmark trial that began on Monday is being closely watched since it could potentially set a legal precedent in climate change-related lawsuits. This comes as while there are several constitutional climate cases filed on behalf of youth plaintiffs across the US it is the first case to head to trial.

The case, Held v. Montana, was first filed in 2020 by plaintiffs who were aged between two and 18, at the time, and it finally went to trial three years later. The lawsuit has sought to declare that the state’s policies violate their rights and hope to set a legal precedent, as per their lawyers, which would encourage lawmakers to take action to fight climate change.&nbsp;

The lawsuit claims the government’s “systemic authorization, permitting, encouragement and facilitation” of fossil fuel use is exacerbating the climate crisis. Meanwhile, the US state has repeatedly sought to delay or dismiss the case calling it “meritless” and a publicity stunt aimed at “shutting down responsible energy development in our state.”

The state had also argued that the issue would best be addressed through the political process and not the courts. Notably, plaintiffs had originally sought an injunction which would force the state to develop a remedial plan or policies to reduce emissions, however, their bid was rejected by Judge Seely in 2021.&nbsp;

Judge Seeley said that she could rule that the US state’s climate change exception in its environmental law is at odds with its constitution but cannot tell the legislature how to remedy the violation. Therefore, the plaintiffs are now seeking financial compensation, but rather a declaration that their rights are being violated.

The European Union's Court of Justice on Monday ruled that the controversial judicial reform, which was introduced by Poland in 2019 and is related to the disciplinary procedures for judges, stands in violation of the EU law.&nbsp;

"Rule of law: the Polish justice reform of December 2019 infringes EU law" because it undermines the impartiality and independence of judges, said the Luxembourg-based court in its verdict.&nbsp;

"The value of the rule of law is an integral part of the very identity of the European Union," the court stated.

The ruling was immediately appreciated by Brussels which said that the judgement "settles the matter for good".&nbsp;

"Today is an important day for the restoration of an independent justice in Poland," said EU Justice Commissioner Didier Reynders. "After today's decision, the law on the judiciary will need to be adapted accordingly... I urge the Polish authorities to comply fully with the judgement," he added.&nbsp;

<h2>Poland calls EU court "corrupt"</h2>

The Court of Justice of the European Union was denounced by Polish Justice Minister Zbigniew Ziobro on Monday as "corrupt". Poland rejected the ruling that considered the Polish judicial reform as a violation of the EU law.

The Luxembourg-based court's verdict "was not written by judges but politicians because it constitutes a clear violation of European treaties," Ziobro said, adding that "the European Union's top court is corrupt".

The governing conservatives of Poland have shared tense relations with Brussels since they came to power in 2015 over claims that Warsaw is not being able to completely uphold EU laws, especially with regard to the judiciary.&nbsp;

In 2021, Poland was slapped with a fine of one million euros per day by the Luxembourg court for not suspending its contested disciplinary chamber of the Supreme Court.

The fines imposed on the country total more than 550 million euros ($590 million).&nbsp;

EU Court rules that Polish judicial reform is in violation of EU law, Poland rejects verdict

LOS ANGELES, May 30 (Reuters) - A California appeals court overruled Governor Gavin Newsom on Tuesday to find Leslie Van Houten, one of Charles Manson's murderous "family" of followers, entitled to parole after more than 50 years in prison for her part in the cult's 1969 killing spree.

Van Houten, 73, the youngest of Manson's devotees, has been recommended for early release by the state parole board on five occasions since 2016, but was denied three times by Newsom and twice by his predecessor, fellow Democrat Jerry Brown.

The 2-to-1 decision from a three-member panel of the state's 2nd District Court of Appeal sided with the Board of Parole Hearings' findings that Van Houten, who was 19 when the murders were committed, has been rehabilitated and no longer poses a danger to society.

The governor could appeal the decision to the California Supreme Court.

In his most recent rejection of her parole in 2022, Newsom cited supposed inconsistencies between Van Houten's statements then and at the time of the murders, which he said suggested "gaps in Ms. Van Houten's insight or candor, or both."

But in granting her petition, the appellate judges wrote that Newsom's conclusion "fails to account for the decades of therapy, self-help programming, and reflection Van Houten has undergone in the past 50 years."

It marks the first time a court has overruled a governor's denial of parole to a Manson follower, according to the Los Angeles Times.

Manson, who died in prison in 2017 at age 83, directed his mostly young and female followers to murder seven people, including actress Sharon Tate, in August 1969 in what prosecutors said was part of a plan to incite a race war.

California appeals court deems Manson follower Van Houten entitled to parole

In a divorce case, India's Allahabad High Court observed that if a spouse denies having sexual intercourse with their partner for a long period without any valid reason, then the act amounts to mental cruelty.

The court observed that the appellant Ravindra Pratap Yadav had alleged his wife Asha Devi "had no respect for marital bond, denied to discharge obligation of marital liability", which resulted in a "complete breakdown" of their marriage.

Yadav had filed a petition challenging the Varanasi family court's 2005 order which had dismissed his divorce plea, citing Section 13 Hindu Marriage Act, 1955.

The High Court had stated that a "hyper-technical approach" was adopted by the lower court and dismissed Yadav's case.&nbsp;

<h2>Couple granted divorce by Panchayat</h2>

The divorce case was filed by Ravindra Pratap Yadav on the ground that a mutually agreed divorce had already been finalised in the community Panchayat.

He had further alleged mental cruelty, "denying to co-habit and discharge the obligation of marital life" and added that the married couple was living separately for a good amount of time.

As per Yadav, the couple had married in May 1979 and the behaviour of his wife changed after some time and she was unwilling to cohabit with him.

Later, his wife started living at her parents' house. However, after six months of marriage, Yadav claimed that he made efforts to convince his wife and bring her back, however, she refused.

In July 1994, the village held a panchayat where the parties reached an agreement and mutually got divorced. The petitioner added that he was paying alimony of Rs 22,000 ($266) to his wife.

However, when Yadav demanded a decree of divorce based on mental cruelty, divorce agreement and desertion, his wife did not turn up in court.

“Undoubtedly, not allowing a spouse for a long time, to have sexual intercourse by his or her partner, without sufficient reason, itself amounts to mental cruelty to such spouse...Since there is no acceptable view in which a spouse can be compelled to resume life with the consort, nothing is given by trying to keep the parties tied forever to a marriage than that has ceased to in fact," stated Bench of Justices Suneet Kumar and Rajendra Kumar-IV said.

However, the jury did not find her guilty of sexually abusing a third sister, Nicole Meyer.

Leifer, aged 56, pleaded not guilty to more than two dozen charges against her and spent years battling extradition from Israel.

However, in 2021, her extradition to Australia was ordered by an Israeli judge.&nbsp;

Victoria's County Court, during the six-week trial, heard evidence that Leifer was among the revered figures at Adass Israel School in Melbourne, where the three sisters were studying.

They stated that the sisters were abused by the former headmistress in the school's locked classrooms, in school camps, and at the home of the head teacher.

The jury said that the sexual abuse continued after the sisters graduated and came back to the school as student teachers.&nbsp;

"When we look back at the journey that it took, everything that happened in Israel, it was so unbelievable that we get to this time and we have: she's guilty, she's guilty; that can't be taken away, she is guilty," Erlich said while speaking to the reporters outside a Melbourne court, flanked by her sisters.

Prosecutor Justin Lewis argued that Malka Leifer had shown "a tendency to have a sexual interest in girls". He said that she misused her position and also that the sisters' "vulnerability (and) their ignorance in sexual matters".

Defence barrister Ian Hill said that the allegations against Leifer were false and questioned the witnesses' reliability.&nbsp;

Court finds Israeli headmistress Malka Leifer guilty of sexual assault

A Muslim man was convicted and sentenced to death by an anti-terrorism court in northwest Pakistan after he faced an accusation of sharing a blasphemous post in a WhatsApp group.

In Pakistan, where the majority population is Muslim, blasphemy remains a hugely sensitive issue as even allegations which are unproven can stir mobs and lead to violence.

The court convicted Syed Muhammad Zeeshan under the Prevention of Electronic Crimes Act and Anti-Terrorist Act in Peshawar on Friday.

“Accused Syed Muhammad Zeeshan, son of Syed Zakaullah in custody has been convicted and sentenced after being found guilty,” read the court order, according to the AFP.

Zeeshan, who lives in the country's northwest city of Mardan, was also slapped with a fine of Rs1.2 million ($4,300) and given 23 years of rigorous imprisonment. The man has the right to appeal against the court order.

Two years ago, an application was filed by Muhammad Saeed, who resides in Talagang, Punjab province, with the Federal Investigation Agency in which he accused Zeeshan of sharing blasphemous posts in a WhatsApp group, said Saeed’s counsel Ibrar Hussain while speaking to the AFP.

The “FIA had confiscated Zeeshan’s cellphone and its forensic examination proved him guilty”, he added. Although the laws of Pakistan prohibiting blasphemy may carry a potential death sentence, it has never been enforced so far for the crime.

Pakistan: Anti-terrorism court pronounces death sentence to Muslim man over blasphemous WhatsApp post

The top administrative court of France on Monday asked the government to impose a ban on fishing in different parts of the Atlantic to save dolphins after hundreds of them recently washed up dead on the coast.&nbsp;

The step taken by the State Council, which is the highest court in matters of government, comes days after a report from an oceanographic institute surfaced stating that around 910 dolphins had washed up on the Atlantic coast in France since the start of the winter.

In a single week, around 400 marine mammals were discovered stranded along the coast which the Pelagis oceanographic observatory called an "unprecedented" number in its report. The observatory is based in the western city of La Rochelle.&nbsp;

A legal complaint was filed by various environmental NGOs, including Sea Shepherd, against the government over the deaths of dolphins and porpoises. The organisations claimed that the government was not taking adequate measures to protect the species which are facing the threat of disappearance from parts of the Bay of Biscay along the Atlantic coast.

Many of the dolphins discovered had consistent injuries which they had suffered from boat engines, nets and other fishing equipment.&nbsp;

Many dolphins died in February and March when they generally move closer to the coast in search of food and have higher chances of encountering fishing operations.

So far, the government of France has held back from imposing a ban on fishing and instead opted for solutions which can mitigate the impact of industrial fishing on dolphins like onboard cameras or loud sound equipment which can drive the dolphins away.

However, the State Council on Monday ruled that instruments of "acoustic deterrence" on fishing boats "do not guarantee a favourable state of conservation for small cetacean species" including porpoises and dolphins.

Both the species were facing the threat of extinction, "at least regionally", it said.

The court has given the time of six months to the government to establish the no-fishing zones and also asked it to increase the monitoring of dolphins' accidental capture which it said was still too approximate.

Ingrid Stitt, Minister for Early Childhood, also commented on the incident on Friday. She told reporters, "In 2023, it's extraordinary that this has happened. It's really disappointing." She added, "The message for Victorian women is we support you and your right to be able to care for your children." Stitt referred to breastfeeding as a 'celebration.'

In October 2021, 45 bottles of wine, including a 217-year-old Château d'Yquem worth $373,000, went missing from the Atrio hotel and restaurant in Cáceres. The Spanish police called the wine heist a meticulously planned theft. They called for an international search to track down the person responsible for the theft. Cut to nine months when they arrested two people in Croatia. However, they have not discovered the stolen wine yet. Cops have arrested Priscila Lara Guevara and Constantín Dumitru, a former Mexican beauty pageant and a Romanian-Dutch man. The court has sentenced them to four and a half years in prison for aggravated robbery by a court in the Extremadura region. The appealable sentence also ordered the pair to pay $800,000 in damages to insurers. ALSO READ | Declaration of war: North Korea warns US against shooting its missiles down How did the pair pull the 'wine heist?' The court released some documents on Monday. They describe the heist, mapped out months in advance, like a rip-off straight out of a movie. The pair visited the hotel three times consecutively. Later, the woman made a reservation using a fake Swiss passport. On the day of her stay, she arrived with a single backpack and an unregistered guest. However, they did not go straight to the room. They chose to tour the restaurant's precious wine cellar. At 2 AM, the woman ordered a salad. Initially, the receptionist resisted. He found it odd as they served a 14-course meal to the woman for dinner. But he gave in. While he was away from the reception, the man stole a key card from the reception. However, according to the court, the key card failed to open the door. So, the man called the woman from the cellar door and asked her to distract the receptionist again. The woman called reception, this time asking for dessert. The employee agreed to bring her some fruit. The man stole the master key card from reception. He entered the wine cellar and stuffed 45 bottles in three bags. The couple checked out from the hotel at 5 AM. According to the court documents, they placed hotel towels between them to prevent the bottles from clinking. An Iranian court on Tuesday sentenced death to an Iranian-German dual national who is accused of being the leader of a “terrorist” group behind a deadly 2008 mosque bombing.

“The Tehran Revolutionary Court sentenced Jamshid Sharmahd, the leader of the Tondar terrorist group, to death on the charge of corruption on earth through planning and directing terrorist acts,” the judiciary’s Mizan Online news agency reports.

According to reports, Sharmahd can appeal against his death sentence before the supreme court.

The 67-year-old, an Iranian-born German national and a US resident, was arrested in August 2020.&nbsp; The pro-monarchist terrorist group, Tondar, he is accused of leading has been conspiring to overthrow the Islamic Republic.

It was alleged that Tondar and Sharmahd "planned 23 terror attacks", of which "five were successful", including the 2008 bombing of a mosque in Shiraz that killed 14 people.

Tondar - which means "thunder" in Persian - is another name of the Kingdom Assembly of Iran (KAI), a little-known US-based opposition group that seeks to restore the monarchy overthrown in the 1979 Islamic Revolution.

At that time, the Iranian authorities had described his arrest as a "complex operation" without specifying how, where or when he was caught.

His family, however, claims that he was abducted by the Iranian security services in Dubai and then brought under duress to Iran.

"They kidnapped Jamshid Sharmahd and now they've sentenced him to death after a sham trial," said the head of the Norway-based Iran Human Rights (IHR) group Mahmood Amiry Moghaddam, reports AFP news agency.

Germany’s response

Germany's Foreign Minister Annalena Baerbock deplored the sentence handed out by the Tehran court, calling it "absolutely unacceptable".

"We call on Iran to remedy these shortcomings in the appeals process, correct the verdict accordingly and refrain from the death penalty," a statement said.

"Imposing the death penalty on Mr Sharmahd will provoke a strong reaction."

Tuesday’s sentence comes a month after Iran executed British-Iranian dual national Alireza Akbari, a former deputy Iranian defence minister who was convicted of spying for the UK.
