US: Montana's transgender lawmaker Zooey Zephyr loses legal bid to rejoin House floor

Montana on Friday (April 29) has become the latest American state to ban or restrict gender-affirming medical care for transgender kids. The ban is set to take effect on October 1. According to a report by the news agency Associated Press, Montana is one of at least 15 states to ban such medical care despite protests from the families of transgender kids that the care is important.

“I know that this is an unconstitutional bill. It is as cruel as it is unconstitutional. And it will go down in the courts,” Zephyr said. On Monday, the lawmaker stood defiantly on the House floor with her microphone raised as protesters shouted “Let her speak,” disrupting House proceedings for at least half an hour.

As per the new law, health professionals who provide care banned by the measure could have their medical licences suspended for at least a year. US: Montana becomes latest state to ban gender-affirming medical care for transgender kids

Gone are the days when conversations in the US centred around topics like murders, sexual assault, etc. These days, bathrooms, or more specifically bathrooms for transgender people, have become the topic of debate, and the latest state to join this debate is Kansas.

Overriding the state's governor Laura Kelly's veto, the state legislature on Thursday enacted what may be the nation's most sweeping transgender bathroom law.

With this law, Kansas has joined at least eight other states in preventing trans people from using bathrooms associated with their gender identities, as opposed to the gender assigned at birth. The state even went one step ahead, imposing restrictions on locker rooms, prisons, domestic violence shelters and rape crisis centres.

The Kansas law, according to a report in The Guardian, stands out from other states' laws by legally distinguishing between male and female based on the sex designated at birth. It states that "distinctions between the sexes" in bathrooms and other areas serve "the important governmental objectives" of protecting people's "health, safety and privacy."

However, it is still not clear how the new law will be enforced.

The recent legislation in Kansas defines "sex" as the biological gender one is assigned at birth, which can only be male or female. However, it does provide some exemptions for intersex individuals if their condition is recognised as a disability under US law. Additionally, the law establishes clear-cut definitions for males and females based on their reproductive anatomy.

The bathroom wars: How it all started

Before Kansas, North Dakota enacted a law prohibiting transgender children and adults from using restrooms, locker rooms, or shower facilities in state-operated universities and correctional institutions.

North Carolina, in 2016, set the ball rolling by becoming the first US state to pass a bill barring transgender people from using bathrooms consistent with their gender identities.

Today, the following states have such laws: North Carolina, Idaho, Iowa, Alabama, Oklahoma, Tennessee, Arkansas, and Kansas.

Why bathrooms?

The battle, as per Vox, began in Houston, Texas in 2014.

Back then, the Houston Equal Rights Ordinance (HERO) was passed by the city council.

It aimed to prohibit discrimination against individuals based on several characteristics - notably sexual orientation and gender identity - in the workplace, housing, and public places such as restaurants, hotels, and other venues that cater to the public. This local ordinance was created to address a deficiency in the laws of Texas due to which LGBTQ people are typically not covered by state and federal anti-discrimination legislation.

Nevertheless, conservatives ended up utilising it as a means to an end.

What do conservatives have against HERO?

They argued that businesses should be allowed to discriminate against LGBTQ people who go against their religious values.

In 2015, after lengthy legal battles, they even managed to get a referendum on HERO. Results predicted that while 45 per cent of adults in Houston would vote for HERO, 36 per cent would vote against it; the remaining said they were unsure.

But in spite of this, ultimately, HERO got rejected.

How was HERO rejected?

Conservatives used fear-mongering tactics related to bathrooms to sway public opinion against the HERO law, which would have allowed transgender individuals to use bathrooms corresponding to the gender they identify with, rather than assigned at birth. They claimed that if the law passed, men would disguise themselves as transgender women to enter women's bathrooms and sexually assault them.

So, despite initially being popular in polls, the HERO law was rejected by voters in November due to the successful fear tactics employed by ceonservatives.

Since then, bathrooms have become the crude tool conservatives used to ban anti-discrimination measures in different states.

Would a law like HERO actually increase incidents of sexual assault?

In two separate investigations conducted some years ago, Media Matters confirmed with experts and officials in 12 states and 17 school districts with protections for trans people that they had seen no increases in sex crimes after they enacted anti-discrimination policies.

And while incidents of men sneaking into women's bathrooms have happened, they did not happen because of transgender protection laws.

In fact, in 2019, a team of researchers, including those from Harvard, found that "youth whose restroom/locker room use was restricted were more likely to experience sexual assault compared to those without restrictions."

As per research based on survey data of 3,700 American teens aged 13-17, around 36 per cent of transgender or gender-non-conforming students with restricted bathroom or locker room access reported being sexually assaulted in the 12 months period before the study. Among transgender boys, 26.5 per cent experienced sexual assault within the last year, while the percentage was 27.0 per cent for nonbinary youth assigned female at birth. Among transgender girls, the percentage was 18.5 per cent, and for nonbinary youth assigned male at birth, it was 17.6 per cent.

Overall, the scenario around transgender bathroom access remains complex and highly contested and is likely to continue to evolve in the coming years as the debate over LGBTQ rights and discrimination continues.

Explained: How bathrooms became the new battlefield for political war on gender

British Prime Minister Rishi Sunak believes 100 per cent of individuals who do not have penises are women. In an interview with the website ConservativeHome, Sunak was asked to lend his opinion after opposition leader Keir Starmer said 99.9 per cent of women haven't got a penis, when faced with questions on the ongoing transgender debate.

“Sir Keir said recently that ‘99 per cent of women of course haven’t got a penis’. What percentage would you put it at?” the interviewer asked Sunak.

The Tory leader laughed initially before saying he had a “slightly different point of view to him on this.”

“I’ve been very clear that when it comes...on this topic, I think the first,' said Sunak before he was cut short and asked, “Do you think it’s 100 per cent?”

To which Sunak replied in the affirmative before adding, “But I think the first thing to say is we should always have compassion and understanding and tolerance for those who are thinking about their gender. Of course we should, right? We’re a compassionate and understanding society and we’ll always remember that.”

Kerala's Padma Lakshmi registered as an advocate with the state's Bar Council, becoming the first transgender lawyer in the state. "I ignore all forms of negativity, be it people or their comments. I focus on the positive. I believe that is one of my advantages. If I focus on the negativity, I will have time only for that and will never move forward in life," she told PTI. P Rajeev, the state's industries minister, expressed his delight and posted a photo of the lawyer on his official Instagram handle. As per the minister's post, Padma Lakshmi was one of the more than 1,500 recent law graduates who received their bar enrolment certificates on Sunday at an event hosted by the Bar Council of India. Padma Lakshmi received her law degree from Ernakulam Government Law College, as per PTI reports. Rajeev applauded the young lawyer's perseverance in his Instagram post, noting that she had to navigate a society that was not quite supportive or kind to her. World’s first openly transgender MP, Georgina Beyer, dies in New Zealand at 65

On January 1, new textbooks were rolled out by the Bangladesh government for millions of schoolchildren between the age of 11 and 13 featuring a segment on transgenders.

The textbook contains images of transgenders in respectable jobs, including a beautician, a development worker and an elected mayor. The book narrates a fictional story of a child who transitions, takes a female name and goes to live with a transgender community.

The government recognised transgenders as a third gender in 2013, but they remain marginalised in a country where sexual activity between people of the same sex is illegal. Many transgenders live in poverty and have no opportunity for a proper education, much less a job. Many are forced to beg or engage in sex work to survive.

The creators of the book hope it will help nurture acceptance.

Muhammad Moshiuzzaman, a member of the National Curriculum and Textbook Board, said, “We have piloted it in very small areas, and we got a very positive result, response from our students, because it was a completely unknown matter to them. It is new knowledge for them and they accepted it very well.”

“We came to know about them by learning from the book, we think we should help them with their progress," said Fatiah Alam, 12, a student at Gomail High school on the outskirts of the capital Dhaka, one of the schools that uses the new textbook.

According to officials, there are about 10,000 'hijras' (transgenders) in Bangladesh but rights groups say the figure could be as high as 1.5 million in the country of 170 million people.

The textbook has not been welcomed by everyone. A large crowd of conservative Muslims angered by the inclusion of hijras recently held a protest at Dhaka’s main mosque calling for the textbook to be recalled.

Nevertheless, the transgender community and their supporters are hopeful that the textbooks will spread awareness and in turn help improve their status in society.

"If our story catches people's attention and they keep our suffering in mind, that will be good for us. Those who learn more about us will hopefully understand and then work towards our development in the future," transgender community leader Jonak told Reuters at her office in Dhaka.

New school textbooks in Bangladesh feature transgender people

Mohan Bhagwat, the chief of the Rashtriya Swayamsevak Sangh (RSS)—a Hindu nationalist organisation considered to be the political and social guide to the ruling Bharatiya Janata Party (BJP)—struck a conciliatory note with regards to the LGBTQ community and transgender persons.

His comments came on Wednesday, days before the government is due to respond to the Supreme Court about petitions to legalise same-sex marriage.

In an interview with the Organiser, the English language mouthpiece of the RSS, Bhagwat said that LGBTQ people have the right to their own private and social space and added that the Hindu society generally doesn’t see them and the transgender as a problem.

"People with such proclivities have always been there; for as long as humans have existed... This is biological, a mode of life. We want them to have their own private space and to feel that they, too, are a part of the society. This is such a simple issue. We will have to promote this view because all other ways of resolving it will be futile," he said, suggesting that the Hindu organisation, which has been opposed to homosexuality and same-sex marriage, is softening its stand on the issue.
McLaughlin was in a relationship with a woman, Beverly Guenther before her transition into a transgender woman. Guardian reports that Judge Keith Kelly decided on Friday to halt the law until a legal challenge was settled after recently rejecting a request by Utah state prosecutors to dismiss the lawsuit. Watch | Gender bender: Sporting bodies review transgender policies as debate heats up Families of three transgender student-athletes in Utah filed the lawsuit in May challenging the ban, claiming it violates the Utah Constitution's protections of equal rights and due process. Similar lawsuits are underway in other states, including Idaho, West Virginia, and Indiana. As per Associated Press, Transgender girls will now face a state commission of political appointees that will decide if they are permitted to participate on a case-by-case basis rather than an overall prohibition. Also read | Inclusiveness or unfair advantage? Debate over trans athletes in sports intensifies The panel was established by Utah's Republican lawmakers in a bill approved earlier this year as a backup strategy to be used in the event that the law was to be declared unconstitutional. According to the law, the panel will be able to determine whether a trans girl would have an unfair advantage, they would do this by obtaining and evaluating the child's height and weight. The commission, which will meet soon, will be composed of a medical data statistician, a doctor with experience in gender identity healthcare, a sports physiologist, a mental health specialist, a collegiate athletic trainer, a representative of an athletic association, and a rotating member who is a coach or official in the sport at the centre of dispute in each case. Also read | Why are US states banning transgender women from sport? In recent days, the question of whether transgender females should be permitted to compete in female sports has become a controversial topic across the US. Republican lawmakers, citing an unfair competitive advantage have even taken to passing legislation stopping trans girls from playing sports. While those in favour of the ban cite an unfair advantage, proponents of transgender rights claim that the restrictions aren't simply for sports but also will serve as a vehicle for bullying and demeaning transgender children.
Taking a welcome step toward inclusivity and breaking the glass ceiling, India's civil aviation regulatory body, the Directorate General of Civil Aviation (DGCA) on Wednesday, for the first time, issued medical guidelines that will allow transgenders and non-binary individuals to fly aeroplanes in the country.

DGCA in its circular stated that transgender candidates, who have completed their hormone therapy for transition or have gone under the knife more than five years ago, will be able to fly the planes, after clearing mental health screening tests.

If the candidate manages to tick every single box in the evaluation, then only they will be declared fit and allowed to sit in the cockpits.

Furthermore, those on life-long hormone therapy will only be admitted if they can prove that they have reached a stable dose.

The Irish Rugby Football Union (IRFU) will ban transgender women from female contact rugby competitions for the upcoming season after carrying out a review of its transgender policy, the governing body said on Wednesday. The IRFU said the decision was based on medical and scientific evidence and is in line with World Rugby guidance. From this season, only players recorded as female at birth will be allowed to play contact rugby in the women`s category.

The change in policy will affect two registered players in the country. The IRFU said it has held discussions with them to provide options for remaining active in the sport, such as in tag or touch rugby, refereeing, coaching, and volunteering.

"The IRFU is keenly aware that this is a sensitive and challenging area for those involved and the wider LGBT+ community and will continue to work with those impacted, providing support to ensure their ongoing involvement with the game," the statement read. Transgender players whose sex recorded at birth is female can continue to compete in the male category if they provide written consent and a risk assessment is carried out, the IRFU added.

'The Kite Runner' author Khaled Hosseini's daughter comes out as transgender, says 'never been prouder of her'

There was always a joke or two on how Chandler Bing's father was gay and a drag queen in Las Vegas in the hit sitcom 'Friends'. Years after the show aired its final episode, the co-creator, Marta Kauffman, apologised for misgendering Chandler Bing's transparent during the show's 10-year run.

While speaking to a news outlet, Kauffman said, "Pronouns were not yet something that I understood. So, we didn`t refer to that character as 'she.' That was a mistake."

She said she also regrets referring to the elder Bing character as a father rather than the mother. "We kept referring to her as Chandler's father, even though Chandler's father was trans," she told the outlet.

In the early seasons of the sitcom, references to Charles Bing, who also went by the name Helena Handbasket, were relegated mainly to one-liner jokes like one from the first season in 1995 when Chandler (Matthew Perry) said, "If I turn into my parents, I`ll either be an alcoholic blond chasing after 20-year-old boys, or I`ll end up like my mom."

In season seven, the character was finally revealed and was played by actress Kathreen Turner. Fans may recall how Chandler and Monica Geller (Courtney Cox) travelled to Las Vegas to meet his estranged parent at her drag revue and invite her to their wedding.

The show never actually used the word transgender, instead referring to Charles as gay and a drag performer who would also wear women's clothes outside of drag shows.

Kauffman said she recently fired someone for making a joke about a transgender camera person. "That just can't happen," she said. Kauffman also said she regrets not having enough diversity on the mostly White show, admitting she was "clearly part of systemic racism in our business."

Swimmer Lia Thomas had created history and stood smiling on the podium as she won the gold medal in the 500-yard freestyle event at the US collegiate championships to extend her dominance in the sport. It was arguably one of the proudest moments of her swimming career but the trans athlete was far from basking in the glory of her victory as her historic triumph sparked immense backlash on social media.

Thomas had become the first-ever transgender athlete to win a top-tier title at the National Collegiate Athletic Association (NCAA) in the US but her achievement was overshadowed by the raging debate about inclusiveness and fairness. Thomas is not the first transgender athlete to be dominating her sport in recent times.

Weightlifter Laurel Hubbard from New Zealand, who competed at the Tokyo Olympics, Thomas and British cyclist Emily Bridges are some trans athletes who have been great in their respective sports and have won medals across events. The question which arises is a simple yet sophisticated one - do they enjoy an unfair advantage competing in women's competitions?

Should transgender women be banned from competing in female categories? It has been regarded as one of the most sensitive issues in sports over the years and the emergence of the likes of Hubbard and Thomas has only added to the row. The debate remains centred around fairness and inclusion, whether it is right to let transgender athletes take part in women's competitions.

There is scientific evidence which proves even with a reduction in testosterone levels and hormonal therapy, Male-to-female transgender athletes retain physical advantages in their bodies which essentially makes it unfair for other women competing with them in their respective sports.

Boys undergo a massive transformation in regard to their bodies at the age of around 13-14 which results in changes in their heart, lung and the shape of the skeleton among others. They also witness a significant change in haemoglobin levels in their blood.

These factors are all imperative contributors when it comes to sporting performances and even after testosterone reduction from the body some biological differences are retained in trans athletes, who have transformed from male to female. But despite the scientific evidence, swimming's world governing body FINA's decision was met with criticism from many when it announced it will bar transgender athletes from taking part in elite women's competitions.

While announcing the decision, FINA President FINA President Husain Al-Musallam said it was a step that has not been taken before by any global sporting bodies and that he would like his organisation to lead the way. FINA also plans to launch an 'Open' category separately for trans athletes to ensure they can get a fair shot at competing in all elite events.

“The creation of an open category will mean that everybody has the opportunity to compete at an elite level. This has not been done before, so FINA will need to lead the way," the FINA president had said.

FINA's decision is a landmark one in the history of sports, forcing major sporting bodies to rethink their transgender policies. FIFA have already planned to review their existing framework for trans athletes while World Athletics - the global governing body for athletics also intends to rework its policies for transgenders.

There remain concerns over transgender athletes enjoying advantages in terms of their aerobic and anaerobic capacity, physicality, stamina and overall strength when pitted against other women in the female category. Also Read: FINA bars transgenders athletes in women's competitions: Will other sporting bodies follow suit? Thus, FINA's move to bar transgenders from female events and open up a separate category for them has been welcomed by many. But it remains to be seen if the other global sporting bodies will follow their footsteps and make the difficult calls and tough decisions in ensuring the fine line between unfair advantage and inclusiveness is not damaged when it comes to gender identity in sports.

World swimming`s governing body FINA is setting up a working group to look into creating an `open category` to ensure inclusivity after voting to restrict transgender women from competing in elite women`s competition. But before the working group has even begun to consider exactly how an open category would work, the concept has already been dismissed by trans athletes.

Details of who would be eligible to compete in an `open category` and what events such a division would feature in have yet to emerge with FINA giving itself six months to formulate a plan. So far FINA has said that the open category would offer opportunities for athletes "without regard to their sex, their legal gender, or their gender identity".

But Veronica Ivy, trans cyclist and twice UCI Masters world champion, said the proposal was an "extreme indignity". "FINA`s choice to force trans women into an `open` category with cisgender men is an unethical non-starter," she told Reuters in an interview.

"It is the very definition of `separate but equal` and an extreme indignity to the women affected. Trans women are legally, socially, and medically women; we are legally, socially, and medically female. "We ought to race with women and international sports federations need to cease placing limits on who is `woman` or `female` enough," she said.

So far, the only idea floated for swimming has come from the World Swimming Coaches Association, which produced a position statement before FINA`s congress on Sunday. "Through a re-categorisation process, the sport of swimming should offer an alternative competitive model which would ensure inclusion and fairness," said the statement. Although they have not submitted a proposal to FINA, the statement suggests two options.

The first is to turn the men`s category into an `open category` alongside a protected `female category`. The alternative option is to have female and male categories and a third open category which would allow those not eligible or not willing to compete in the sex-based categories to enter races.

The coaches also suggested that the sport could create a Trans Division and possibly hold trans meetings.
"The Trans Females will race each other. The Trans Males will race each other. There is an argument that the Trans Males have been completely lost in this debate because they are uncompetitive in our current structure. This would also allow those of indeterminate gender to be factored into such a solution," said the statement. But Caitlyn Jenner, who announced her transition from Olympic gold medallist Bruce Jenner to Caitlyn in 2015, has questioned whether there are enough trans athletes to make such a system viable.

"They talk about having a different division for trans athletes, there aren`t enough trans athletes in the world to have another competition. Right now, I only know of one trans swimmer and that is Lia Thomas, there are just not enough people out there," she said. Jenner suggested FINA had used the idea of an open category as a "whitewash" to soften the impact of their vote for a restrictive move -- a move the American however supports.

Trans woman motor racing driver Charlie Martin is firmly against the idea. "It is not a solution to create an open category where trans women can be placed in limbo, effectively ending their professional careers and right to compete," she said.

The issue is likely to remain a contentious point of debate for some time however. On Thursday, Badminton`s governing body became the latest to undertake a review of its guidelines. FINA's 'Open category' proposal under scanner, faces questions over fairness and viability

Tennis great and gay rights trailblazer Martina Navratilova has slammed the International Olympic Committee (IOC) for its lack of leadership on the issue of the inclusion of transgender athletes in sport.
The issue was brought into focus by last weekend`s decision by swimming`s governing body FINA to ban athletes who have been through any part of male puberty from elite women`s competition.

IOC last year revised its guidelines on inclusion with a new framework advising that athletes should not be excluded from the competition on the grounds of "perceived" unfair advantage but leaving it up to sports federations to decide the rules.

Navratilova said that striking the balance between inclusion and fairness down to individual events was extremely complex and that the IOC had offloaded responsibility for the issue onto sometimes poorly funded federations.

"The IOC has completely punted," the 59-times Grand Slam champion told The Australian newspaper. "That `Oh, we will leave it up to the individual federations`. How can these individual federations within their country make their different rules? "They have to do the research and the implementation ... and it costs money to then figure it out, and it`s impossible."
