Serbian tennis star Novak Djokovic arrives in Dubai following deportation from Australia

All athletes who wish to compete in France will have to be vaccinated against Covid-19, government sources told AFP on Monday.

This appears to contradict what Sports Minister Roxana Maracineanu said last week, that certain events like the French Open had a special exemption, when asked whether Novak Djokovic could play in the tournament.

For ordinary citizens entering France, it is not obligatory to be vaccinated but will be for those wishing to enter an establishment which has a public attendance (ERP).

Major events like the French Open previously permitted non-vaccinated athletes to compete as they operated a health bubble round the tournament.

The first major event to be directly affected would be the upcoming Six Nations rugby championship when France will host Italy (Feb 6), Ireland (Feb 12) and England (March 19).

This measure would dash 34-year-old Djokovic's hopes of defending the title and potentially an unprecedented 21st Grand Slam singles crown.

Rafael Nadal could move one ahead of him and Roger Federer if he wins the Australian Open.

Covid vaccination required for athletes competing in France, says government source

Australian Prime Minister Scott Morrison has left the door open for Novak Djokovic to compete at next year`s Australian Open despite the tennis superstar facing an automatic three-year ban from entering the country.

The world number one player left Australia late on Sunday after the Federal Court upheld a government decision to cancel his visa, capping days of drama over the country`s COVID-19 entry rules and his unvaccinated status.

Under immigration law, Djokovic cannot be granted another visa for three years unless Australia`s immigration minister accepts there are compelling or compassionate reasons.

"I`m not going to precondition any of that or say anything that would not enable the minister to make the various calls he has to make," Morrison told 2GB radio on Monday as Djokovic was en route to Dubai.

"It does go over a three-year period, but there is the opportunity for (a person) to return in the right circumstances, and that will be considered at the time."

The unanimous ruling by a three-judge Federal Court bench dealt a final blow to Djokovic`s hopes of chasing a record 21st Grand Slam win at the Australian Open, which starts on Monday, dismaying his family and supporters.

In a rollercoaster ride, the world`s top men`s player was first detained by immigration authorities on Jan. 6, ordered released by a court on Jan. 10 and then detained again on Saturday pending Sunday`s court hearing. Djokovic, 34, said he was extremely disappointed by the ruling but he respected the court`s decision.

"I am uncomfortable that the focus of the past weeks has been on me and I hope that we can all now focus on the game and the tournament I love," Djokovic said in a statement before flying out of Melbourne.
The player was filmed by Reuters wearing a mask and taking selfies with fans at the arrival gate in Dubai as he waited for his entourage to follow him off the plane.

Djokovic was escorted by airline staff on a terminal buggy to the departure gate for a flight a few hours later to Belgrade. He checked in alone for the six-hour flight.
The saga caused a row between Canberra and Belgrade, with Serbian Prime Minister Ana Brnabic calling the court decision "scandalous".

Australian Foreign Minister Marise Payne said on Monday that she and Morrison had been in touch with Brnabic during the legal process last week.

"I am absolutely confident that the very positive relationship, bilateral relationship between Australia and Serbia will continue on the strong footing that it currently enjoys," Payne told reporters.

Immigration Minister Alex Hawke had said Djokovic could be a threat to public order because his presence would encourage anti-vaccination sentiment amidst Australia`s worst coronavirus outbreak.
The Federal Court judges noted their ruling was based on the lawfulness and legality of the minister`s decision but did not address "the merits or wisdom" of the decision. They have yet to release the full reasoning behind their decision.

POLITICAL TOUCHSTONE

The Serbian tennis player`s visa troubles fuelled global debate over the rights of people who decline to get vaccinated as governments take measures to protect people from the two-year pandemic.

Djokovic had been granted a visa to enter Australia, with a COVID-19 infection on Dec. 16 providing the basis for a medical exemption from Australia`s requirements that all visitors be vaccinated. The exemption was organised via Tennis Australia and the Victoria state government.

That exemption prompted widespread anger in Australia, which has undergone some of the world`s toughest COVID-19 lockdowns and where more than 90% of adults are vaccinated.

The controversy became a political touchstone for Morrison as he prepares for an election due by May, amid wrangling over responsibility between his centre-right federal coalition government and the centre-left Victoria state government.

Morrison on Monday defended his handling of the situation and differentiated Djokovic`s case from vaccine sceptics within his own government.

"If you’re someone coming from overseas, and there are conditions for you to enter this country, then you have to comply with them," he said. "This is about someone who sought to come to Australia and not comply with the entry rules at our border."

The men`s tennis governing body ATP said the decision "marks the end of a deeply regrettable series of events", adding it respected the decision, a comment echoed by Tennis Australia.

On the tennis circuit, fellow players have become impatient for the media circus to end.
"The situation has not been good all round for anyone. It feels everything here happened extremely last minute and that`s why it became such a mess," said former world number one Andy Murray.

Can Novak Djokovic return to take part in Australian Open next year? PM Scott Morrison has answer

Rafael Nadal launched his bid for a record 21st Grand Slam title Monday in blistering fashion -- a far cry from his "ugly" predicament one month ago and recent injury problems.

Nadal, the only Australian Open champion in the men's draw after nine-time winner Novak Djokovic's banishment on the eve of the tournament, was all guns blazing in a spectacular first-round win on Rod Laver Arena.

The Spanish sixth seed, who beat Roger Federer for the 2009 Australian title and is vying with Djokovic and Federer to reach a record 21st Grand Slam crown, bludgeoned American Marcos Giron 6-1, 6-4, 6-2.

In an impressive 1hr 49min performance, Nadal began with an ace and peppered the world number 66 Giron with 34 winners -- 14 of them with his famed forehand -- and won 84 percent of his first serves.

It follows 35-year-old Nadal's 89th Tour title when the veteran great swept through the field last week to win a warm-up event at Melbourne Park, having had Covid only last month and suffered a foot injury in 2021.

"Twelve events in two years are not many," Nadal said, reflecting on an injury-marred couple of years.

"If we add that I was not able to practise very often, too, it's a really tough one.

"But here I am. I am super happy about all the work that we have done to try to be back. We are here enjoying the tennis, and that's it. We're going to keep trying hard.

"I need time on the Tour to try and recover the level that I need to fight for the things that I want and be healthy.

"If that happens, I hope to keep having chances to keep going and fight for the things."

Warhorse Nadal ended his season in August because of his foot, then contracted Covid-19 in December, saying it left him "very sick".

"I tell you one thing, the knees have been better than ever after that period of time. But the foot was worse than ever for the last year and a half," he said.

Aus Open: Rafael Nadal makes stunning start in his quest to win a record 21st Grand Slam

World number one Novak Djokovic will play the late match of the evening session at Rod Laver Arena against fellow Serb Miomir Kecmanovic when the Australian Open starts on Monday, pending a court decision.

Defending champion Djokovic is appealing the cancellation of his visa by Australia`s Immigration Minister Alex Hawke at the Federal Court, which may release a decision later on Sunday as to whether the Serb can remain in the country.

Hawke used discretionary powers to cancel the Serb`s visa for a second time on the grounds he was a threat to public order because his presence would encourage anti-vaccination sentiment.

Should the court rule against Djokovic, his place in the draw will be taken by a lucky loser from qualifying.

Djokovic`s match will follow home favourite Ash Barty`s opener against Ukraine`s Lesia Tsurenko on Rod Laver Arena`s centre court, according to the order of play released on Sunday.

Women`s defending champion Naomi Osaka will play unseeded Colombian Camila Osorio in the second match of the day session at Rod Laver Arena, before former men`s Rafa Nadal takes to the court against American Marcos Giron.

Third seed and Olympic champion Alexander Zverev will meet fellow German Daniel Altmaier in the first evening match at Margaret Court Arena, the second showcourt at Melbourne Park.

Novak Djokovic to play first round match in Australian Open pending court decision

Serbia`s premier on Sunday denounced as "scandalous" Australia`s decision to deport tennis superstar Novak Djokovic over his decision not to be vaccinated against COVID-19, and the Serbian president said he would always be welcome in his homeland.

A unanimous ruling by a three-judge bench rejecting Djokovic`s appeal against the cancellation of his visa dealt a final blow to his hopes of chasing a record 21st Grand Slam win at the Australian Open.

"I think the court decision is scandalous...I find it unbelievable that we have two completely contradictory court decisions within the span of just a few days," Serbian Prime Minister Ana Brnabic told reporters in Belgrade.

"I am disappointed...I think it demonstrated how the rule of law is functioning or better to say not functioning in some other countries. In any case, I can hardly wait to see Novak Djokovic in our own country, in Serbia."

Novak Djokovic deported: How entire Australian Open visa saga unfolded

Tennis superstar Novak Djokovic boarded a plane to leave Australia on Sunday after the Federal Court upheld a government decision to cancel his visa on the grounds that his decision not to be vaccinated against COVID-19 posed a risk to the country.

The unanimous ruling by a three-judge bench dealt a final blow to Djokovic`s hopes of chasing a record 21st Grand Slam win at the Australian Open, after a rollercoaster ride.

The Serbian player boarded an Emirates flight bound from Melbourne to Dubai on Sunday evening just hours after the ruling, a Reuters witness said. The flight was due to take off at 10:30 p.m. (1130 GMT)

The flight capped a journey that began when Djokovic, the world`s top men`s player, was first detained by immigration authorities on Jan. 6, ordered released by a court on Jan. 10 and then detained on Saturday again.

Djokovic said after the ruling he was extremely disappointed as it meant he could not take part in the tournament, which starts on Monday.

"I respect the Court’s ruling and I will cooperate with the relevant authorities in relation to my departure from the country," he said in a statement, and wished the tournament well.

Djokovic, 34, had appealed against Immigration Minister Alex Hawke`s use of discretionary powers to cancel his visa. The minister had said Djokovic could be a threat to public order because his presence would encourage anti-vaccination sentiment amidst

Australia`s worst outbreak of the virus.
Chief Justice James Allsop said the court ruling was based on the lawfulness and legality of the minister`s decision in the context of the three grounds of appeal Djokovic`s legal team lodged.

"It is no part of the function of the court to decide upon the merits or wisdom of the decision," Allsop said, adding that the three judges were unanimous in their ruling. Full reasoning behind the ruling would be released in coming days, he said.
It was not immediately clear when Djokovic would leave the country.

The player`s visa saga has dominated headlines around the world and fuelled a debate over the rights of people who opt to remain unvaccinated as governments take measures to protect their people from the two-year coronavirus pandemic.
The controversy became a political touchstone for Prime Minister Scott Morrison as he prepares for an election due by May. His government has faced criticism for its handling of Djokovic`s visa application.

Morrison welcomed the court`s ruling, saying the decision will help "keep our borders strong and keep Australians safe."
"It`s now time to get on with the Australian Open and get back to enjoying tennis over the summer," he said in a statement.
Djokovic had been granted a visa to enter Australia, with a COVID-19 infection on Dec. 16 providing the basis for a medical exemption from Australia`s requirements that all visitors be vaccinated. The exemption was organised through Tennis Australia.

That exemption prompted widespread anger in Australia, which has undergone some the world`s toughest COVID-19 lockdowns and where more than 90% of adults are vaccinated. The government said recent infection alone did not meet its standards for an exemption.

But the player also had some support, especially in his native Serbia and from Serbians living in Australia.
Serbian prime Minister Ana Brnabic said on Sunday, "I think that the court decision is scandalous, I am disappointed, I think it demonstrated how the rule of law is functioning or better to say not functioning in some other countries."

In Melbourne, around 70 Djokovic fans, including young children, sang folk songs and chanted in the Federal Court plaza while they waited for the court’s ruling.
They gathered around a loudspeaker to hear the judge reading out the decision, but it took several minutes after the court adjourned before they worked out that Djokovic had lost. Two women were weeping, while others started up chants for a short while before the crowd dispersed.

In Serbia, people have vented their anger at the treatment of their sporting hero. President Aleksandar Vucic on Friday criticised Australia`s government for what he called the "harassing and bullying (of) ... the best tennis player ever."

Vucic said on Sunday he had spoken to the player after the court decision. "I told him we cannot wait to see him," he told reporters. "I told him he is always welcome in Serbia."

(1130 GMT) The flight capped a journey that began when Djokovic, the world`s top men`s player, was first detained by immigration authorities on Jan. 6, ordered released by a court on Jan. 10 and then detained on Saturday again. Djokovic said after the ruling he was extremely disappointed as it meant he could not take part in the tournament, which starts on Monday. Djokovic, 34, had appealed against Immigration Minister Alex Hawke`s use of discretionary powers to cancel his visa. The minister had said Djokovic could be a threat to public order because his presence would encourage anti-vaccination sentiment amidst Australia`s worst outbreak of the virus. World No. 1 Novak Djokovic: 'Extremely Disappointed' over losing legal battle against deportation

A court decision to uphold the cancellation of Novak Djokovic`s visa on Sunday has shaken up the Australian Open draw on the eve of the tournament, handing a boost to his rivals and adding intrigue to the race for the Grand Slam titles record.

The world number one had been favourite to win a 10th title at Melbourne Park and claim a 21st Grand Slam crown but the Serb now faces being deported from Australia.

Russian second seed Daniil Medvedev will now likely be the bookmakers` favourite when the tournament begins on Monday, ahead of third seed Alexander Zverev.

Sixth seed Rafa Nadal, who shares the men`s Grand Slam record of 20 with Djokovic and the absent Roger Federer, could strike a blow in the major title race.

Nadal, the 2009 champion and a four-times finalist in Melbourne, would have had to face Djokovic in the semi-finals if the draw progressed according to seeding.

The top quarter of the draw has now been thrown wide open, with Djokovic set to be replaced by a `lucky loser` from the qualifying phase and with seventh-seeded Italian Matteo Berrettini left as the highest seed in the section.

The lucky loser will play Serbian Miomir Kecmanovic on Monday in the first round in place of Djokovic.
Rubbing salt into the wound, Djokovic`s withdrawal could also mean losing his world number one ranking if Medvedev or Zverev claim his title at Melbourne Park.

Longer term, Djokovic`s visa cancellation could further harm his chances of adding to his Grand Slam silverware, with the Australian government capable of imposing a three-year entry ban on the Serb.

His travel to other countries could also be affected, with most requiring visa applicants to disclose if they have ever been deported or had a visa rejected or cancelled.

Should Djokovic choose to remain unvaccinated for COVID-19, his entry into other Grand Slams may also be affected as authorities tighten travel and border restrictions in the third year of a pandemic that has killed more than 5 million people.

Novak Djokovic's court defeat to shake up Australian Open draw

Australia: Federal court unanimously reject Novak Djokovic's appeal

Tennis star Novak Djokovic's dream of participating in the upcoming Australian Open 2022 was left shattered on Sunday (January 16) as he lost a court appeal against the Australian government's decision to re-cancel his visa. The decision means Djokovic's visa stands cancelled and he is to be deported from Australia.

Djokovic had arrived in Melbourne in the first week of February with a medical exemption for being unvaccinated against COVID-19 as he looked forward to defending his Australian Open title. However, the nine-time Australian Open champion was sent into detention and his visa was cancelled after it was adjudged that he didn't satisfy the required conditions for being granted an exemption.

Djokovic won the legal battle against the Australian government to get his via reinstated and come out of detention to start his preparations for the tournament. However, his visa was re-cancelled earlier this week after Australia's Immigration Minister Alex Hawke exercised his personal power in the matter.

Djokovic's lawyers once again appealed against his visa cancellation as deportation threats loomed large over his Australian Open future. However, the Serbian tennis star's application was dismissed by Chief Justice James Allsop in a Federal court hearing on Sunday.

"The orders of the court are that the amended application be dismissed with costs", said Chief Justice Allsop while announcing the decision, which was taken unanimously among three judges and the reasons will be published in the coming days.

The government's lawyer on Sunday's hearing argued that Djokovic's continued presence in Australia risked triggering anti-vaccination sentiments among people at the time when the country is facing the worst wave of COVID-19 since the pandemic first made its presence felt in 2020.

Djokovic's name was included in the Australian Open draw and he was set to face fellow Serb Miomir Kecmanovic in his first-round match. Ahead of the start of the season`s first Grand Slam on Monday, Nadal at Melbourne Park in his pre-event press conference said: "Australian Open will be a great Australian Open with or without him."

Currently, nine-time Australian Open champion Novak Djokovic is still in the draw to defend his title in Melbourne after the Serbian`s visa was cancelled on Friday by Hawke, the Australian Minister for Immigration, Citizenship, Migrant Services, and Multicultural Affairs. Djokovic is placed against compatriot Miomir Kecmanovic in the opening round.

When asked about how different AO 2022 would look with Djokovic in the draw and without him, Rafa said: "I tell you one thing, it`s very clear that Novak Djokovic is one of the best players of the history, without a doubt."

No one, even Roger, Novak, myself, Bjorn Borg, who was amazing at his times, tennis keep going. Australian Open is much more important than any player. If he`s playing finally, okay. Australian Open will be great with or without Novak Djokovic: Rafael Nadal on visa controversy

Novak Djokovic won his first legal round against Australian authorities who want to deport him. But the world tennis No. 1 now faces a formidable challenge on Sunday in his second round as he takes on what some describe as the God-like powers of the immigration minister on questions of visas and public interest.

Djokovic won his court appeal this week against a border official's decision to cancel his visa. He won over procedural errors related to Australia's confusing COVID-19 vaccination regulations.

Immigration Minister Alex Hawke's intervention on Friday to cancel the visa a second time for what Djokovic's lawyers describe as ?radically different? reasons pits Djokovic against Australian politics and the law.

WHAT ARE THE MINISTER'S POWERS?

Hawke has a personal power to cancel Djokovic's visa under Section 133C of the Migration Act 1958.
Hawke needed to be satisfied that Djokovic's presence in Australia maybe, or would or might be, a risk to the health, safety or good order of the Australian community.

The minister also needed to be satisfied that ordering Djokovic's deportation would be in the public interest, a term which has no legal definition.

Unlike the decision of a government underling, the rules of natural justice do not apply to a minister's decision. That means the minister did not have to tell Djokovic he was planning to deport him.

Hawke could have canceled Djokovic's visa in secret and then notified the Serbian tennis star days later that he had to go. Had the Australian Border Force come to detain Djokovic, they would legally have had to reveal only then that he had no visa.

Under Section 133F of the Act, Djokovic could have then requested the minister reverse his decision, but the only realistic option would have been to appeal it in court.

HOW DOES THE MINISTER EXERCISE HIS POWER?

In Djokovic' s case, Australian government lawyers warned him that the minister was planning to intervene on Monday when a judge reinstated his visa. The star athlete's high profile might have encouraged the government to appear even handed.

Djokovic's lawyers provided evidence for why he was entitled to keep his visa and be allowed to defend his Australian Open title in the days before the minister acted.

While Hawke has sweeping discretion to define public interest in canceling a visa, he must also be thoughtful and detailed in his reasoning.

These decisions aren't straightforward. There is case law which compels a minister when exercising this power personally to have active intellectual engagement with the materials and with the decision, immigration lawyer Kian Bone said.

It's not something that he (Hawke) can have a one-liner saying: Dear Mr. Djokovic, your visa is canceled.' He can't have a bureaucrat or a staffer write a decision for him, look at it for two minutes and sign off on it, Bone added.

HOW DO YOU OVERTURN A MINISTER'S DECISON?

Because the minister's power is so broad and discretionary, grounds for appeal are potentially fewer than they are for a decision of a public servant acting on a minister's authority. But courts have overturned ministers' decisions in the past.

The immigration minister's powers are among the broadest provided under Australian law, said Greg Barns, a lawyer experienced in visa cases.

One of the criticisms of this particular power is that it is so broad and it's effectively allowing the minister to play God with someone's life, Barns said.

It's inevitable that political considerations would form part of the decision because that concept of public interest is so broad that it allows a minister to effectively take into account political considerations, even though theoretically that ought not be done,? Barnes added.

Political considerations are heightened for Prime Minister Scott Morrison's conservative coalition with an election due by May at the latest.

Although Australia has one of the highest rates of COVID-19 vaccination in the world, the government is concerned by Djokovic's popularity among those who are opposed to vaccine mandates or skeptical of the vaccines' efficacy.

Djokovic's lawyers don't accept that those sentiments are a legitimate reason to deny the sporting star an attempt at a record 21 Grand Slam titles.

The minister only considers the potential for exciting anti-vax sentiment in the event that he's present at the Australian Open, Djokovic's lawyer Nick Wood told a court on Friday.
Hawke's reasons do not take into account the potential impact on those attitudes if Djokovic is forcibly removed, Wood said.

The minister gives no consideration whatsoever to what effect that may have on anti-vax sentiment and indeed on public order, Wood said. That seems patently irrational.

Read Also | Novak Djokovic back in detention as Australia cancels visa again One of the criticisms of this particular power is that it is so broad and it's effectively allowing the minister to play God with someone's life, Barns said.

How Novak Djokovic plans to fight deportation in court ahead of Australian Open

Emma Raducanu has struggled to live up to sky-high expectations since winning her maiden Grand Slam at Flushing Meadows last year but the Briton says she is not worried about her poor form and will play without pressure at the Australian Open.

Raducanu, who faces American Sloane Stephens in the first round at Melbourne Park, became the first qualifier to win a Grand Slam in the Open era when she defeated Leylah Fernandez in New York last September.

But she struggled to get close to that form in subsequent tournaments with a series of early exits prompting criticism, while testing positive for COVID-19 at Christmas also impacted her preparations for the new season.
"I feel, because of the last few months I`ve had, maybe I haven`t played as much as I would have liked to and trained so much," said Raducanu, who is ranked 17th in Melbourne.

"I feel like there`s actually no pressure on me. I`m just happy to be here and have a swing. I had to jump a few hurdles to play here, so (I) just want to go out there and have fun and enjoy on the court."

The 19-year-old played her first match of the year in Sydney last Tuesday and lost 6-0 6-1 to Kazakh Elena Rybakina, a defeat she put down to rustiness rather than any lingering effects of COVID-19.

Raducanu has been handed a tough opening round draw against 2017 U.S. Open winner Stephens, who is ranked 65th in the world but has been as high as number three.

"I watched Sloane win the U.S. Open," said Raducanu.
"I hit with her last year actually. Great opponent. Obviously you don`t win a Grand Slam without being very capable.
"I think it`s going to be a tough match for sure. I`m going to go out there and enjoy the match because just playing in this Grand Slam, I had to work so hard to be here."

No pressure, Emma Raducanu ready to have a swing at Australian Open

Ahead of the marquee tournament, the nine-time Australian Open champion Djokovic landed in Melbourne, on January 4, with a medical exemption for Covid-19 vaccination. For the unversed, ATP had made it clear that all players need to be fully vaccinated to take part in the Aus Open. The Serbian, however, got an exemption from the Victorian government before travelling Down Under.

On his arrival, Djokovic was taken aback with his exemption being tarnished and his visa getting cancelled. As a result, he was sent to a detention center, i.e. an immigration hotel in Melbourne, for four days before his lawyers managed to free him as Australian Judge Anthony Kelly ordered his release, on January 10, with immediate effect.

Djokovic's Aus Open saga didn't die down there itself. As the Australian Immigration Minister Alex Hawke comprises discretionary personal powers to revoke anyone's visa on various grounds, he did the same for the Serbian on Friday (January 14). "Today I exercised my power... to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so," the Immigration Minister said in a statement.

On the other hand, Australian Prime Minister Scott Morrison said that the decision followed "careful consideration".

Amid all this, the 34-year-old Djokovic admitted to have breached Covid protocols as he went ahead with an interview to a French-newspaper L'equipe's journalist despite a positive report with regard to the infection in December, 2021.

In addition, Djokovic shifted the blame on his agent for incorrectly filling details in his travel form on arrival Down Under (he also acknowledged that his travel declaration form contained falsehoods about his whereabouts the 14 days preceding his flight to Australia).

Thus, Djokovic has dug his own grave in many ways ahead of the Aus Open. As the entire saga continues to get complicated with each passing day, with the star player set to take his fight against deportation from Australia to a Federal Court on January 15 (Saturday), here's reliving some big controversies surrounding the Serbian:

1)Hitting female line judge

During the 2020 US Open, Djokovic was disqualified after hitting a female line judge in frustration during his fourth-round match versus Spain's Pablo Busta.

The Serbian did so after a fall and dropping a serve to trail 5-6. While it wasn't intentional, Djokovic's fate was sealed under the Grand Slam rules. After the incident, Djokovic had said in a statement, "This whole situation has left me really sad and empty. I checked on the linesperson and the tournament told me that thank God she is feeling OK. I'm extremely sorry to have caused her such stress. So unintended. So wrong."

4) Exaggerating injuries and taking medical breaks

Djokovic has been accused of taking unnecessary medical breaks and exaggerating injuries whenever the going gets tough for him during a game. In 2008 US Open, he took two medical timeouts during his five-set thrilling win over Tommy Robredo, upsetting the Spaniard.

On the other hand, Djokovic didn't hesitate in breaking the flow of the game once again during his 2020 French Open quarter-final clash versus Carreon Busta.

Back then, Busta had stated, "Every time a match gets complicated he asks for medical assistance."

Novak Djokovic: Serbia's pride and controversy's favourite child

Unvaccinated tennis star Novak Djokovic won the right to take his fight against deportation from Australia to a Federal Court on Saturday after the government cancelled his visa for the second time over COVID-19 entry regulations.

The government undertook not to deport him until the case was over, although the world`s number one player was nevertheless ordered to return to pre-deportation detention at 8 a.m. (2100 GMT Friday).

His legal team submitted their appeal late at night - less than three hours after Immigration Minister Alex Hawke used discretionary powers to revoke the visa - in the hope that he can still begin the defence of his Australian Open title on Monday.
They said they would argue that Djokovic`s deportation could be just as much of a threat to public health, by fanning anti-vaccine sentiment, as letting him stay and exempting him from Australia`s requirement that all visitors must be vaccinated.

While Prime Minister Scott Morrison`s government has won support at home for its tough stance on border security during the pandemic, it has not escaped criticism for the seemingly inconsistent handling of Djokovic`s visa application.
The 34-year-old Serbian, bidding for a record 21st Grand Slam title, had been told on arrival on Jan. 5 that the medical exemption that enabled him to travel was invalid.

He spent several days in immigration detention, in a hotel also used for asylum-seekers, before that decision was revoked on procedural grounds.
Hawke said on Friday that he had now exercised his prerogative to cancel the visa "on health and good order grounds, on the basis that it was in the public interest to do so".

`PROTECTING BORDERS`

He said he had considered information from Djokovic and the authorities, and that the government was "firmly committed to protecting Australia`s borders, particularly in relation to the COVID-19 pandemic".
Judge Anthony Kelly, who revoked the first cancellation, said the government had agreed not to deport Djokovic before the case concluded, and that the player could leave detention to meet his lawyers and attend hearings.

Although Djokovic has publicly opposed compulsory vaccination, he has not campaigned against vaccination in general.
The controversy has nonetheless intensified a global debate over the rights of the unvaccinated, and become a tricky political issue for Morrison as he prepares for an election due by May.
"Australians have made many sacrifices during this pandemic, and they rightly expect the result of those sacrifices to be protected," Morrison said in a statement.

"This is what the minister is doing in taking this action today. Our strong border protection policies have kept Australians safe."
Australia has endured some of the world`s longest lockdowns, and has seen a runaway Omicron outbreak bring nearly a million cases in the last two weeks.
More than 90% of Australian adults are vaccinated, and an online poll by the News Corp media group found that 83% favoured deportation for Djokovic.

His cause was not helped by an incorrect entry declaration, where a box was ticked stating he had not travelled abroad in the two weeks before leaving for Australia. In fact, he had travelled between Spain and Serbia.
Djokovic blamed the error on his agent and acknowledged he also should not have done an interview and photoshoot for a French newspaper on Dec. 18 while infected with COVID-19.
The player has, however, been hailed as a hero by anti-vaccination campaigners, and last September more than 200 people were arrested during sometimes violent protests in Melbourne against a lockdown imposed to contain the spread of COVID-19.

`PATENTLY IRRATIONAL`

Djokovic`s legal team said the government was arguing that letting him stay in Australia would incite others to refuse vaccination.
One of his lawyers told the court that this was "patently irrational" because Hawke was ignoring the effect that forcibly removing "this high profile, legally compliant, negligible risk, medical contradicted player" might have on anti-vax sentiment and on public order.
Djokovic had looked relaxed as he practised serves and returns with his entourage on an empty court at Melbourne Park on Friday, occasionally resting to wipe sweat from his face.

He was included in the draw as top seed and due to face fellow Serb Miomir Kecmanovic on Monday.
Greek world number four Stefanos Tsitsipas, speaking before Hawke`s decision, said Djokovic was "playing by his own rules" and making vaccinated players "look like fools".

In Belgrade, some already appeared resigned to Djokovic missing the tournament.
"He is a role model to all of us, but rules must clearly be set," Milan Majstorovic told Reuters TV. "I am unsure how big the involvement of the politics is in that."
Another passer-by, Ana Bojic, said: "He can either vaccinate to remain world number one - or he can be stubborn and end his career."

World No. 1 Novak Djokovic appeal to be heard on Saturday as Australia cancels Serbian's visa again

Is it fair to treat world no.1 Novak Djokovic like a common criminal when ATP made clear that he has done nothing wrong and followed the rules made for players entering Australia? WION speaks with Nandan Bal, Indian Tennis Coach for more perspective.

Not kicking him whilst he's down, says Andy Murray on Novak Djokovic's Australian Open saga

Lawyers for Australian Immigration Minister Alex Hawke have agreed to not deport World number one men`s singles tennis player Novak Djokovic from Australia.

The lawyers have agreed to not deport Djokovic until the court proceedings are underway on his matter or till the issue is not transferred to another court, reported The Sydney Morning Herald.

Djokovic`s visa was cancelled on Friday by Hawke, the Australian Minister for Immigration, Citizenship, Migrant Services, and Multicultural Affairs.

"Today I exercised my power under section 133C(3) of the Migration Act to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so," minister in an official statement said.

"This decision followed orders by the Federal Circuit and Family Court on January 10, 2022, quashing a prior cancellation decision on procedural fairness grounds. In making this decision, I carefully considered information provided to me by the Department of Home Affairs, the Australian Border Force and Mr Djokovic."

"The Morrison Government is firmly committed to protecting Australia`s borders, particularly in relation to the COVID-19 pandemic. I thank the officers of the Department of Home Affairs and the Australian Border Force who work every day to serve Australia`s interests in increasingly challenging operational environments," the statement added.

Djokovic`s visa was initially cancelled upon arrival after hours of interrogation by Border Force officials. Then on Monday, judge Anthony Kelly of the Federal Circuit and Family Court of Australia quashed the cancellation of Djokovic`s visa after tennis player spent five days detained in an immigration hotel.

Notably, world number one men`s singles tennis player Djokovic on Wednesday admitted that he conducted an in-person media interview and photoshoot in December despite knowing the fact that he was COVID-19 positive.

Novak Djokovic won't be deported from Australia on Friday, says Immigration Minister Alex Hawke

Unvaccinated tennis star Novak Djokovic on Friday asked an Australian court to block his deportation ahead of the Australian Open after the government cancelled his visa for the second time over COVID-19 entry regulations.

Djokovic`s lawyers submitted their request for an injunction late at night, less than three hours after Immigration Minister Alex Hawke used discretionary powers to revoke the visa.

The world tennis number one, bidding for a record 21st Grand Slam trophy in defending his Australian title, had been told on arrival on Jan. 5 that his visa, granted on the basis of a medical exemption from a vaccination requirement for visitors, was invalid.

He spent several days in immigration detention before that decision was revoked on procedural grounds. His lawyers said the government had told them Djokovic would not be taken back into detention on Friday night.
The Age newspaper reported that the 34-year-old Serbian had been summoned to appear before immigration officials on Saturday.

Hawke said in a statement that he had "exercised my power under Section 133C(3) of the Migration Act to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so".

Under Section 133C, Djokovic would not be able to secure a visa to Australia for three years, except in compelling circumstances. The player`s legal team said Hawke had argued that allowing Djokovic to stay would excite anti-vaccination sentiment.

Although Djokovic has publicly opposed compulsory vaccination, he has not campaigned against vaccination in general, and his lawyers called Hawke`s decision "patently irrational". They said they hoped their challenge could be heard by Sunday, the day before the tournament starts.

The controversy has intensified a global debate over the rights of the unvaccinated, and become a tricky political issue for Prime Minister Scott Morrison as he campaigns for an election due by May.

While Morrison`s government has won support at home for its tough stance on border security during the pandemic, it has not escaped criticism for the seemingly inconsistent handling of Djokovic`s visa application

"Australians have made many sacrifices during this pandemic, and they rightly expect the result of those sacrifices to be protected," Morrison said in a statement.

"This is what the minister is doing in taking this action today. Our strong border protection policies have kept Australians safe," he said, adding he would be making no further comment in view of expected legal proceedings.
Djokovic was included in the draw as top seed and was due to face fellow Serb Miomir Kecmanovic for his opening match next week.

Looking relaxed, he had practised his serves and returns with his entourage on an empty court at Melbourne Park earlier on Friday, occasionally resting to wipe sweat from his face.

Hawke said he had carefully considered information from Djokovic and Australian authorities, adding the government was "firmly committed to protecting Australia`s borders, particularly in relation to the COVID-19 pandemic".

Australia has endured some of the world`s longest lockdowns, has a 90% vaccination rate among adults, and has seen a runaway Omicron outbreak bring nearly a million cases in the last two weeks.

Greek world number four Stefanos Tsitsipas, speaking before Hawke`s decision, said Djokovic was "playing by his own rules" and making vaccinated players "look like fools".

British tennis star Andy Murray told reporters at the Sydney Classic tournament that the situation was "Not great for the tennis, not great for the Australian Open, not great for Novak".

An online poll by the News Corp media group found that 83% favoured deportation for Djokovic. "Scott Morrison made the rational decision to send the wealthy tennis star home after calculating the enormous political cost of giving him special treatment," wrote David Crowe, chief political correspondent for the Sydney Morning Herald and Age newspapers.

Opposition Labor leader Anthony Albanese said: "It should never have come to this ... how is it that that visa was granted in the first place if he wasn`t eligible because he wasn`t fully vaccinated?"

Anti-vaxxers have hailed Djokovic as a hero while his family and the Serbian government have portrayed him as a victim of persecution.

In Belgrade, some appeared resigned to Djokovic missing the tournament.

"He is a role model to all of us, but rules must clearly be set," Milan Majstorovic told Reuters TV. "I am unsure how big the involvement of the politics is in that."

Djokovic`s cause was not helped by a wrong entry declaration, where a box was ticked stating he had not travelled abroad in the two weeks before leaving for Australia.

In fact, he had travelled between Spain and Serbia. Djokovic blamed the error on his agent and acknowledged he also should not have done an interview and photoshoot for a French newspaper on Dec. 18 while infected with COVID-19.

Novak Djokovic tries to avert deportation after Australia cancels visa again

Novak Djokovic had his first training session at the Rod Laver Arena on Tuesday as he aims to bag his record 21st Grand Slam. Djokovic has had an eventful last few days in Australia as he finally managed to return to the court after winning a court case against the Australian government's decision to cancel his visa upon his arrival in the country.

Djokovic had landed in Australia last week with a 'medical exemption' to take part in the Australian Open despite not revealing his status of COVID-19 vaccination. He was later detained by the border officials and sent to a detention hotel in Melbourne after it was deemed that he didn't qualify for an exemption.

While he had the option to take a flight back home, Djokovic decided to stay back and fight a legal battle. He won the court case on Monday after Judge Anthony Kelly ordered the visa cancellation decision be overturned and the tennis star to be released from detention from immediate effect.

Here is a timeline of the Australian Open visa saga involving Novak Djokovic:

How did Novak Djokovic land in trouble?

Djokovic, who had previously asserted that he is against mandatory COVID-19 vaccination, refused to reveal if he is vaccinated against the virus. However, the Serbian ace said last week that he was heading Down Under to play in the Australian Open after obtaining a 'medical exemption' from a panel of experts.

However, upon landing in Australia, his visa was revoked and Djokovic was sent into detention for failing to meet the criteria of an exemption. He spent five days in an immigration facility in Melbourne which his family alleged was in poor condition and inhumane.

What happened in the court case on Monday?

Djokovic's legal time filed a case against the decision by the Australian authorities to revoke his visa. In their court filings, Djokovic's lawyers revealed the tennis star had tested positive for COVID-19 in December last year due to which he was granted a 'medical exemption' as he was ineligible for vaccination for the next six months.

The lawyers also stated that Djokovic was sent a letter from Tennis Australia's chief medical officer on 30 December stating that he had been granted a medical exemption. Judge Anthony Kelly ordered the visa cancellation decision be overturned and granted him release from detention in Melbourne.

Can the Australian government re-cancel Novak Djokovic's visa?

While the judge ruled the decision in the tennis superstar's favour, Australia's Immigration Minister Alex Hawke has a discretionary personal power to cancel Djokovic’s visa. Hawke is reportedly considering exercising his power which might see Djokovic get deported out of Australia just a week ahead of the start of the Australian Open.

Can Novak Djokovic challenge the decision once again?

If the Australian Immigration minister decides to exercise his power and re-cancel Djokovic's visa, he will be once again sent into immigration detention. Djokovic can challenge the decision in the court as judge Kelly has already asked to be informed immediately if the matter is to be extended once again.

How Did Novak Djokovic react to his court win?

The world no.1 tennis player took to social media on Monday to share a picture from the Rod Laver Arena while expressing his desire to play in the Australian Open and defend his title. Djokovic, a nine-time Australian Open champion also thanked his fans and supporters.

"I'm pleased and grateful that the Judge overturned my visa cancellation. Despite all that has happened, I want to stay and try to compete @AustralianOpen," Djokovic said in a tweet.

"I remain focused on that. I flew here to play at one of the most important events we have in front of the amazing fans. For now I cannot say more but THANK YOU all for standing with me through all this and encouraging me to stay strong," he added.

On Wednesday (January 12), Djokovic also shared issued a clarification on 'misinformation' over his Dec 16 Covid-19 Test, travel declaration. He took to his official Instagram handle and shared a lengthy post saying, "I want to address the continuing misinformation about my activities and attendance at events in December in the lead up to my positive PCR COVID test result.

“This is misinformation which needs to be corrected, particularly in the interest of alleviating broader concern in the community about my presence in Australia, and to address matters which are very hurtful and concerning to my family,” Djokovic said in the statement.

“I want to emphasise that I have tried very hard to ensure the safety of everyone and my compliance with testing obligations.

“I attended a basketball game in Belgrade on 14 December after which it was reported that a number of people tested positive with COVID 19. Despite having no COVID symptoms, I took a rapid antigen test on 16 December which was negative, and out of an abundance of caution, also took an official and approved PCR test on that same day,” he explained.

Here is a timeline of the Australian Open visa saga involving Novak Djokovic: How did Novak Djokovic land in trouble? Djokovic, who had previously asserted that he is against mandatory COVID-19 vaccination, refused to reveal if he is vaccinated against the virus. However, the Serbian ace said last week that he was heading Down Under to play in the Australian Open after obtaining a 'medical exemption' from a panel of experts. However, upon landing in Australia, his visa was revoked and Djokovic was sent into detention for failing to meet the criteria of an exemption. He spent five days in an immigration facility in Melbourne which his family alleged was in poor condition and inhumane. Also Read: Did Novak Djokovic lie in Australian Open entry form? Tennis stars lands in trouble yet again What happened in the court case on Monday? After court battle, Novak Djokovic returns to court: Timeline of Australian Open saga

The Australian government`s decision to cancel Novak Djokovic`s visa for a second time on Friday will shake up the Australian Open draw and could hand "Big Three" rival Rafa Nadal a boost in the race for the Grand Slam record.

Top seed and defending champion Djokovic had been bracketed to play fellow Serbian Miomir Kecmanovic in the first round during the draw on Thursday.

However, unless Djokovic successfully overturns the government`s decision for a second time through the courts, his place at the top of the draw will be taken by Russian fifth seed Andrey Rublev.

The 17th seed Gael Monfils, who had been bracketed to play unseeded Argentine Federico Coria, will move into Rublev`s original slot and take on Italian Gianluca Mager in the first round.

Kazakh world number 35 Alexander Bublik, who had been drawn to play a qualifier, will now move into Monfils` initial spot and play Coria.

The vacant spot in the draw will be decided after qualifying. Djokovic`s withdrawal could mean he loses the world number one ranking if second seed Daniil Medvedev or third seed Alex Zverev win the tournament. It could also prove crucial in the all-time Grand Slam titles race, with Djokovic sharing the record of 20 championships with the absent Roger Federer and Nadal.

Sixth seed Nadal may be among the most pleased with Djokovic`s withdrawal. The Spanish great would have had to meet nine-times champion Djokovic in the semi-finals if the tournament progressed according to seeding.

Though a fine player, Rublev would seem a more manageable obstacle for Nadal, who won his sole Australian Open title in 2009 but made finals in 2012, 2014, 2017 and 2019.

Medvedev was rated second favourite by bookmakers behind Djokovic until the Serb`s visa cancellation. The Russian, who thrashed Djokovic in the U.S. Open final to win his maiden Grand Slam title, will likely be favourite when the tournament starts Monday.

Australian Open draw shaken up with World No. 1 Novak Djokovic's visa cancellation

In what comes as a huge blow to Novak Djokovic's chances of taking part in the upcoming Australian Open, his visa has been cancelled once again by Australia. Australia cancelled Djokovic's visa for the second time in a row on Friday over his fight to remain in the country and play in the Australian Open while being unvaccinated. The decision was taken by Australia's Immigration Minister Alex Hawke.

Hawke had the choice of exercising his personal power to revoke Djokovic's visa once again after the tennis star had won a court case against the Australian government's decision to cancel his visa when he had first arrived in the country unvaccinated with a 'medical exemption' last week.

The Australian government has sought to deport Djokovic from the country over his COVID-19 vaccination status. Australian Immigration Minister Hawke said he took the decision on the basis of "health and good order grounds". The re-cancellation of the visa might see Djokovic get banned from being granted an Australian visa for as many as three years.

However, Djokovic has the right to relaunch a legal case against the Australian government's decision to ensure he gets to remain in the country and play in the Australian Open 2022. Djokovic has already been included as a top seed in the Australian Open draw and had been training at the Rod Laver Arena ahead of the start of the tournament on January 17.

The decision comes after it came to light that Djokovic had 'lied' in his travel declaration form about not travelling anywhere 14 days prior to his arrival in Australia. The tennis star had travelled to Spain from Serbia before heading Down Under.

However, Djokovic addressed the allegations of a false declaration and stated that it was a 'human error' made by his agent. Djokovic's visa had been revoked for the first time on January 6 when he arrived in Melbourne after the Australian border officials said the World no.1 men's tennis player had "failed to provide proper evidence" for a medical exemption.

He was later sent into detention and spent days in an immigration hotel in Melbourne before being released earlier this week after winning a court battle against the Australian government's decision to revoke his visa.

More trouble for controversy-hit Novak Djokovic as Australia cancels his visa for the 2nd time

World number one Novak Djokovic's new calendar year hasn't begun on the right note. The Serbian landed in Melbourne last week to take part in the Australian Open along with a medical exemption for Covid-19 vaccination, from the Victorian government. However, his visa wasn't cleared and his exemption was tarnished by the authorities at the airport as the 34-year-old was send to a detention centre, i.e. an immigration hotel in Melbourne, for four days.

On Monday (January 10), Djokovic won the court case against the Australian government as the Judge Anthony Kelly ordered the visa cancellation decision to be overturned and granted the Serbian's release from detention with immediate effect. In their court filings, the tennis star Djokovic's lawyers had mentioned that he had tested positive for COVID-19 in December 2021, hence, was granted a 'medical exemption' as the No. 1 ranked player was ineligible to get the jab for the next six months.

While Djokovic has started training in a bid for his 21st Grand Slam title during the forthcoming Australian Open, Immigration Minister Alex Hawke has a discretionary personal power which allows him to cancel the player's visa and get him deported out of the country. Hence, all is not over for the tennis superstar. In addition, Djokovic could face five-year jail term if he is found to have lied about his positive Covid test in Australia.

The Serbian sensationally admitted to lying on his entry declaration form and also interacted with others while knowingly infected with the deadly virus. In a sworn court affidavit relied upon by the Federal Circuit Court, Djokovic admitted of being aware of having the infection on 16 December. He said, "On 16 December 2021, I was tested and diagnosed with SARS-CoV-2 (Covid)."

However, Djokovic contradicted his own statements and later mentioned in a public statement he was aware of carrying the virus only on 17 December. Under Australia’s Crimes Act, providing misleading information to the court is a crime for which one can be punishable for five years in prison.

Taking his original statement into account, Djokovic, thus, admitted to have broken Serbia’s Covid protocols and was seen out and about despite being positive. For the unversed, the Serbian Prime Minister Ana Brnabic had told the BBC that roaming outside despite a positive report is a ‘clear breach’.

More trouble for the Serbian?

Per Article 248 - ‘Failure to Act Pursuant to Health Regulations During Epidemic’ - whoever doesn't adhere to the rules, he, or she, will face a maximum penalty of three years in prison. The findings have come forward following reports that the Australian Border Force is investigating Djokovic after concerns that the Serbian had incorrectly declared he had not travelled - and would not do so for 14 days - prior to his flight to Australia.

Recently, social media posts had made heads turn which appeared to show that Djokovic was in Belgrade on Christmas Day before flying Down Under -- from Spain -- on January 4. On Wednesday (January 12), the tennis star shared a lengthy post on his Instagram handle, where he shifted the blame of his agent who made a mistake in filling his travel form.

Djokovic wrote on his Instagram post, "My agent sincerely apologises for the administrative mistake in ticking the incorrect box about my previous travel before coming to Australia,” said Djokovic. “This was a human error and certainly not deliberate," he further added.

World No. 1 Novak Djokovic could face 5-year jail term if found guilty of lying about Covid positive test

Britain`s Andy Murray reached the Sydney Tennis Classic semi-finals after his opponent David Goffin was forced to retire in the middle of their last-eight match, here on Thursday.

Former World No 1 won the opening set 6-2 against the former world No 7 before Goffin pulled out of the match, just a game after receiving treatment to the back of his knee.

It is the first time that Murray has reached a tour-level semi-final since Antwerp in 2019. The Scot went on to win the title in Belgium three years ago, defeating former World No. 3 Stan Wawrinka in the final.

The wild card will now play American Reilly Opelka in the semi-finals following the fourth seed`s 7-6(4), 6-2 victory over countryman Brandon Nakashima in a 83-minute clash.

"It`s obviously been a while for me. I have been getting closer in the last few months, and my results would suggest that. So it`s good to get there this early in the season. Hopefully I can keep building from here and have a strong year," said Murray.

"I want to try and win tournaments again. That`s one of the reasons why I`m still playing, because I believe I can still do that. I`m a couple of matches away from winning another one and I`ll give it my best effort to do that," he added.

Meanwhile, top-seeded Russian Aslan Karatsev overcame Italy`s Lorenzo Sonego 6-2, 3-6, 6-2 to reach the semi-finals.

The World No 20, who was voted 2021 Most Improved Player of the Year, triumphed after two hours and 49 minutes in a hard-fought encounter.

Karatsev will now face Daniel Evans in the semis after the third seed edged American Maxime Cressy 6-4, 7-6(5) in one hour and 52 minute match. Evans won his first tour-level title in Australia last season at the Murray River Open in Melbourne.
