<p>The juvenile jurisprudence in India seemed to have come of age with the decision of trying the 16 years old perpetrator of the murder in Ryan International School in Gurugram as an adult in view of the original juvenile legislation being replaced by Juvenile Justice (Care and Protection of Children) Act, 2015 (The Act). The new Act lowered the age of adult criminal liability from 18 to 16 with certain conditions. This was the result of an outcry in the wake of infamous Nirbhaya gang-rape and murder case in 2012, where the most brutal of the accused was treated as a juvenile despite he was just a little under 18 years. The government did get up, took notice and made some amendments as stated above but the concept does need a deeper analysis.&nbsp;</p>

<p>One of the arguments advanced in support of keeping the juvenile law as invasive as possible is that, till the age of 18 (now 16), the mental faculty of the child is not developed enough so as to be able to understand the nature and consequences of the action. But it is to be understood that this assertion was justified at the time when the technology was not as advanced and surrounding societal circumstances were conducive. In the present scenario, technology has provided every information at the fingertips of an individual and, as such, the child is able to imbibe that much earlier than what he would have been able to, a few decades ago. In terms of society, the prevalent hostile environment has also caused the children of a reasonable age to experience the same and start responding to it at a much younger age.</p>

<p>The system needs to be receptive to the environment and change its perception according to the need of the hour. The brain is only an organ of the body but the mind is referred to as the ability of an individual to be aware of things, to think and to feel. That ability differs from person to person depending upon the circumstances that child is surrounded by. As a reference, a child who is exposed to a greater degree of public interaction would end up being more street smart as compared to a child of the same age who lives in the protective environment of the household.&nbsp;</p>

<p>The Act has, for the purpose of the application, classified the offences in three categories:<br />
Firstly, petty - which include the offences with a maximum punishment up to 3 years.&nbsp;Secondly, serious - which include the offences for which punishment is between 3 to 7 years.&nbsp;Thirdly, heinous - which include the offences for which minimum punishment is 7 years or more.&nbsp;</p>

<p>It is to be noted that, except heinous offences, for all other offences, the juvenile will not be trialled as an adult but would receive the institutional care for a maximum period of three years. Even for heinous offences, the minor accused, aged more than 16, would be presented before the Juvenile Justice Board and the Board will decide as to whether to send the child for trial as an adult or to send the accused to rehabilitation centre based upon the mental and physical ability of the child.&nbsp;</p>

<p>The present form of the statute, although better than before, still leaves a lot wanting and is just not sufficient to rein in the growing menace of juvenile crimes when even the serious offences are considered to have been committed without knowing the consequences of the action. It is reiterated that mental ability is an abstract principle and it changes with the circumstances. Criminal law provides two major touchstones to determine criminal liability i.e. a guilty mind and a criminal act in pursuance thereof. &nbsp;</p>

<p>There are certain offences where, irrespective of age, if committed, the guilt of the individual automatically follows. We cannot forget the Guwahati molestation case where a young lady was sexually assaulted for about 40 minutes in full public view. One of the perpetrators there was a juvenile. Unfortunately, even after the present amendment, this sinister offence would not make the accused liable to be trialled as an adult since the punishment for the same is a maximum term of five years. No stretch of the imagination could justify the argument that the juvenile there was not aware of his actions.</p>

<p>The changing paradigm of society makes it imperative to have the focus more on the offence rather than the offender, especially for the offences which inherently call for a punitive action. The rights of a victim cannot be brushed aside merely because they are in dispute with the age of the offender. It is hoped that coming years would bring with them a tilt towards reality rather than abstraction.&nbsp;</p>

Pradyuman murder: Pradyuman's father to challenge bail to Pinto family

<p>The SIT officers of Gurgaon police, who investigated Ryan International School student Pradyuman Thakur&#39;s murder case before it was handed over the Central Bureau of Investigation (CBI), have now come under CBI&#39;s scanner as their call records and bank details are being scrutinized.&nbsp;&nbsp;&nbsp;</p>

<p>After taking over the probe, the CBI arrested a class 11 student in connection with the murder and ordered an inquiry into the &#39;botched-up probe&#39;&nbsp;by the SIT members of the Gurgaon police.</p>

<p>Reports say that the SIT members would&nbsp;be soon served legal notices which will prevent them fleeing the city.&nbsp;</p>

<p>Ashok Kumar, the school bus conductor, was arrested on September 8, the same day as the murder. Gurgaon police concluded that the conductor tried to sexually assault&nbsp;Pradyuman and when he resisted he killed him. The botched-up investigation by the Gurgaon police since have been laid bare.&nbsp; &nbsp;</p>

<p>In a very unexpected turn of event, the CBI today as taken into custody another student of the school who happened to have discovered Pradyuman&#39;s body. The accused is 16 years old and a student of class XI.&nbsp;</p>

<p><strong>Lawyer Ashok GV</strong>: Section 15 (1) of the Juvenile Justice Act stipulates that where a child is in conflict with law (&ldquo;CICL&rdquo; for short), is alleged to have committed a heinous offence (including murder), the Juvenile Justice Board can initiate an inquiry to determine the physical and mental capacity of the CICL to commit such a crime, the CICL&rsquo;s ability to grasp the consequences of his actions and the circumstance and context to his actions. If the result of such assessment is that the CICL can be tried as an adult, the matter then goes before the adult justice system.&nbsp;</p>

<p>Though on paper this appears to be simple and straightforward, we lack the infrastructure and the human resources to mitigate bias and ensure a nuanced inquiry into the CICL&rsquo;s actions to determine culpability. Not only must this inquiry answer the above questions, but it must satisfy the test of reasonableness and application of mind which is a well-settled principle of law under Article 14 of the Constitution. The wisdom behind this power to try a CICL as an adult is heavily debated in Child Rights circles, and I myself believe that a CICL going into the adult justice system violates the reformative system of justice that Indian Criminal Law believes in.</p>

<p>In the Ryan International Murder case- the critical question as to whether the evidence available justifies the suspicions of the police or not is as yet unanswered.&nbsp;</p>

<p><strong>Lawyer Ashok GV</strong>: In a case of the nature involved in the Ryan International Murder case, there are two legal concepts that are relevant for discussion, viz., Culpable Homicide and Murder.&nbsp;</p>

<p>Both deal with one man killing another. But Murder is considered more serious than Culpable Homicide. In the U.S., these concepts are defined as murder in the first degree, second degree, manslaughter, etc.&nbsp;</p>

<p>I will try and simplify this as much as I can. If one man causes the death of another with the intention of causing such death, then it is murder. For it to qualify as murder, such causing of death must be premised on the knowledge of the offender that his actions will inflict bodily injury which will lead to death.&nbsp;</p>

<p>In other instances, the offender may not necessarily know that it may cause death. But if he knew what injury he wished to inflict, and such an injury in ordinary course will likely cause death, then also it is murder.&nbsp;</p>

<p>In the third instance, if the man inflicted harm which is intended to inflict a bodily injury which though ordinarily may not cause death, but with reference to the victim, due to some pre-existing condition in him which the offender knew, would lead to his death, then also it is murder.</p>

<p>In a sensational twist to the case, the agency announced yesterday that it had apprehended a senior student of Ryan International School on Tuesday night in connection with the murder of Pradhuman Thakur, rejecting the Gurugram police&#39;s theory that the killing was the handiwork of Ashok Kumar.</p>

<p>Gurgaon Police Commissioner Sandeep Khairwar declared in a press meet on September 10 that Ashok was the killer and that he had tried to sexually assault Pradhuman.</p>

<p>Khairwar also said during the investigation that the charge sheet would be filed in 7 days of the murder.</p>

<p>Amid protests by agitated parents, the principal of Gurugram&#39;s Ryan International School has been suspended after the alleged murder of a seven-year-old boy within the school premises on Friday.</p>

<p>The Central Board of Secondary Education (CBSE) has formed a two-member fact-finding committee - consisting of a school principal and a deputy commissioner -&nbsp;to probe the killing and sought a report from the school&nbsp;management within two days. The two-member panel has been asked to submit their report latest by October 16.</p>

<p>The panel will probe whether the death occurred due to negligence on the part of the school authorities and if the school had adopted all safety measures as per CBSE affiliation bye-laws. Its report will also dwell on whether the authorities reported the incident to police and the district education officer, besides the circumstances leading to the death of the student.</p>

<p>&quot;A two-member fact finding committee has been set up to enquire into the tragic murder of the student in the school premises. The school has also been asked to submit a report within two days along with the copy of the FIR,&quot; a senior board official said.</p>

Ryan International schoolboy death: Police say bus conductor killed him

<p>The body of a class 2 student has been found inside a toilet at Ryan International School in Bhondsi in Gurgaon.&nbsp;</p>

<p>The Indian Express said the seven-year-old boy has been identified as Pradhuman Thakur.&nbsp;</p>

<p>It added that a knife had been recovered from the scene of the crime.&nbsp;</p>

<p>News reports said the boy&#39;s throat had been slit, and that he was found dead a little after his father dropped him off at school.&nbsp;</p>

<p>&quot;It is a clear case of murder, don&#39;t know what happened but I am sure its murder,&quot; ANI reported the boy&#39;s father Varun Thakur as saying.&nbsp;</p>

<p>This is not the first death to take place at a Ryan International school.&nbsp;</p>

<p>On January 20 last year, six-year-old&nbsp;Devansh Kakrora of Ryan International School, Vasant Kunj died after he allegedly fell into a water tank.&nbsp;</p>

<p>In CCTV video footage, Divyansh was seen playing on the school playground a few minutes before his body was found in the water tank.</p>
