Meta's Muse agent has spent recent weeks being called a privacy and security nightmare. But the company's AI troubles do not begin or end with its new assistant. A quieter, older failure has been wrecking ordinary people's accounts for most of the year, and Meta still has not fixed it. The Purge Through 2026, large numbers of Facebook and Instagram users have reported being suddenly banned or suspended by Meta's automated enforcement systems — frequently flagged for child sexual exploitation, one of the gravest accusations a platform can make, with no specific content cited and no human explanation. For many, the loss is not trivial. These are small businesses whose customers live on Instagram, creators whose livelihoods vanished overnight, families who lost years of photos and messages. A Change.org petition over the wrongful bans gathered tens of thousands of signatures early in the year. Meta's own Oversight Board — the independent body the company created to check its decisions — sided with them. In June 2026, the board found that Meta's account deactivations lack due process and transparency, and that affected users are given thin support to appeal. It pressed Meta to explain what role AI actually plays in deciding these penalties. Reporting on the problem describes an especially damning detail: appeals are often reviewed by the same automated systems that made the original error, so the machine that wrongly banned you is also the one judging whether it was wrong. Non-English speakers appear to be hit disproportionately. Months Later, No Fix The striking thing is how little has changed since. Months after the board's ruling, and the best part of a year after the wrongful bans became a mass grievance, users are still reporting the same sudden, unexplained purges with the same dead-end appeals. Meta's public response has been thin — statements welcoming the board's review, little visible change on the ground. For a company that can build a personal AI agent and ship it worldwide in weeks, the inability, or unwillingness, to fix a system that is destroying innocent users' accounts is telling. Why This Is The Deeper Problem Muse's flaws are alarming, but they affect people who chose to install an experimental agent. The moderation purge affects anyone with a Facebook or Instagram account, whether they touch AI or not. It is the same underlying pattern: Meta deploying automated systems at enormous scale to make consequential decisions, without adequate human oversight or a working way to challenge them when they go wrong. With Muse, the machine acts on your behalf and oversteps. With moderation, the machine acts against you and will not listen. Both leave the user with little power and Meta with little accountability. The Fair Point In fairness, moderating billions of accounts is genuinely hard, and no human team could review every case. Enforcement against child exploitation, in particular, is supposed to err on the side of removal, because the cost of missing real abuse is horrific. Some wrongful bans are the unavoidable price of policing a platform at planetary scale, and Meta is not wrong to take the underlying harm seriously. But that is an argument for better appeals, not for abandoning the wrongly accused. The scandal is not that the AI makes mistakes; it is that when it brands an innocent person a child predator and erases their account, there is no human who will look at the case and fix it. Scale explains the errors. It does not excuse the absence of a remedy. What To Watch Whether Meta publishes a real response and timeline to its Oversight Board's recommendations, or lets them lapse. Whether a genuine human appeals route appears for wrongful bans. And whether regulators treat automated account deactivation — which can destroy a livelihood with no due process — as something that needs legal guardrails, the way other consequential automated decisions increasingly do.

Meta's Muse grabs headlines for security flaws, but its moderation AI has spent much of 2026 wrongly banning thousands of Facebook and Instagram accounts with no real appeal. Meta's own board demanded a fix in June. It hasn't come.

Meta's new Muse agent has dominated the headlines for its security flaws, but it is not the company's only AI problem. For much of 2026, Meta's automated moderation has been wrongly banning thousands of Facebook and Instagram accounts — often on false child-exploitation flags — with no real way to appeal. Meta's own Oversight Board demanded a fix in June. Months later, the purge has not stopped.

Meta built its fortune on consumer attention. It is now trying to build a second one on selling AI to businesses, and this week it showed how. The company said it is expanding its Muse AI agent to small businesses, and launched a Meta Enterprise Platform to sell its AI models, agents and infrastructure to companies. To lead it, Meta hired Chirantan 'CJ' Desai, the former chief executive of the database company MongoDB, as Chief Enterprise Platform Officer reporting to Mark Zuckerberg. The pitch is an agent that can help an owner run the business and find customers — reaching into storefront, accounting, scheduling and communication tools rather than answering questions in isolation. Why Meta Wants This The logic is about revenue that does not depend on advertising. Meta's business has rested overwhelmingly on ads. Hiring an enterprise-software veteran rather than promoting from within is a signal that Meta knows selling to businesses is a different discipline from winning consumers, and is buying that expertise. Meta wants people to access artificial intelligence without reaching for their phones. At Meta Connect 2026, Mark Zuckerberg introduced Muse Charm, a small, keychain-sized gadget designed to bring the company's Muse AI assistant into everyday life. The device can reportedly do everything the Muse app can do, from answering questions and identifying objects to finding products, booking tickets and sending emails. A fingerprint sensor activates the assistant, while a built-in camera lets users show it things around them. But there is a catch: Muse Charm is still in development, its price is unknown, and its always-connected camera and microphone raise important privacy questions.
What exactly can Meta Muse Charm do?
Muse Charm is designed to make AI assistance available without unlocking a phone or opening an app. Users press the device's fingerprint sensor to start prompting Meta's Muse assistant, which processes requests through the cloud. Its main capabilities include: Shop and book: Muse can find and buy products, book tickets and handle tasks across supported apps. Send emails: The assistant can perform actions in the background, rather than simply answering questions.Understand what you see: Its built-in camera can capture visual context, such as a poster, so users can ask questions about it. Answer everyday questions: It offers the capabilities of a conventional AI assistant, alongside more advanced automation. The key distinction is that Muse Charm is not a more powerful AI model. It is a dedicated way to access Meta's existing Muse assistant more quickly. Meta also offers Muse through an app, the web and WhatsApp in select regions. Smart glasses provide another hands-free access point.
When will Muse Charm launch and how much will it cost?
Meta has indicated that Muse Charm could arrive in time for the 2026 holiday season, potentially by late December. However, the device remains in development. Only functional prototypes have been shown, while its final materials and production design still need to be decided. Meta has not announced a price. For context, the company's smart glasses start at $249, but that does not establish what the Charm will cost. Its final price will depend on the hardware, production and commercial positioning. The central selling point is convenience: users can access Muse without taking out their phones. Whether that benefit is enough to persuade people to buy a separate gadget remains to be seen.
Meta Muse Charm privacy: What happens to your data?
The camera, microphone and access to connected apps could make Muse Charm useful, but they also raise questions about how much personal information Meta's AI can access.Muse can request access to sensitive information, including emails and payment details, to complete certain tasks. That makes safeguards particularly important for a device designed for quick, frequent use.Meta says Muse operates within an isolated virtual machine, which is intended to prevent the AI from accessing credit card details and other personal information directly. App integrations are opt-in, and users can disable access for individual apps. The company also says users can opt out of having their data used to train its AI models. These are Meta's stated safeguards, not an independent guarantee that every privacy risk has been eliminated. For consumers, the bigger question is whether the convenience of a dedicated AI keychain outweighs the concerns around sharing personal data with an always-connected assistant. Muse Charm's success may ultimately depend not just on what it can do, but on whether users trust Meta enough to let it do those things.

Meta Muse Charm is more than a keychain: 5 things Zuckerberg's AI gadget can do

Meta CEO Mark Zuckerberg has unveiled Charm, a pocket-sized AI gadget designed to bring the company's Muse assistant into everyday life. Roughly the size of an Apple AirPods case, the device features a two-inch touchscreen and built-in 5G connectivity. The device is expected to ship in December 2026, ahead of the holiday season. Meta has not revealed its price. The announcement at Meta Connect in Menlo Park, California, marks a new step in the company's hardware ambitions. After building momentum with smart glasses, Meta is now exploring whether a dedicated AI device can change how people interact with technology.
What is Meta Charm and what can it do?
Meta Charm is a handheld device built around the company's Muse AI assistant. It is designed to keep AI accessible without requiring users to reach for their smartphones. The gadget packs Muse's real-time voice and avatar technology into a compact device that can fit on a keychain. "We pack the whole Muse experience, including the whole real-time voice and avatar stack, into something that fits on a keychain and is always available to talk to," Zuckerberg said at the event. Its two-inch touchscreen provides a visual interface, while 5G connectivity allows it to connect to mobile networks. However, Meta has not yet disclosed the device's complete specifications, battery life, supported applications or whether it will require a smartphone for initial setup. The company has also not confirmed how much Charm will cost, leaving questions about whether consumers will see it as an affordable accessory or another premium AI product.
Meta wants to move beyond smartphones
Charm arrives as technology companies explore devices that could eventually reduce people's dependence on smartphones. The industry is investing in AI-powered glasses, wearable pins and standalone assistants that can respond to voice commands and interact with users in real time. Meta has already found commercial momentum with its Ray-Ban smart glasses, developed with EssilorLuxottica. Charm extends that strategy by giving Muse a dedicated hardware platform beyond glasses. The company is also expanding Muse across its existing smart glasses, adding capabilities such as computer use and integrations with retailers including Walmart, Best Buy and Gap. Meta says Muse will become the primary interface for its glasses, allowing users to shop, make appointments and complete tasks through voice commands.
Can a tiny AI gadget replace your phone?
That remains the big question. Charm's compact design and always-available assistant could appeal to people who want quick access to AI without constantly using a phone screen. But a dedicated device must offer enough practical value to justify carrying another gadget, particularly when smartphones already provide voice assistants, internet access and AI applications. Meta has not demonstrated that Charm can replace a smartphone or confirmed whether it can independently handle everyday tasks beyond its Muse experience. The company is also expanding into other hardware categories, including lighter virtual-reality glasses and camera-free smart glasses designed to address privacy concerns. For now, Charm represents Meta's latest bet that AI assistants could become a central part of everyday computing. Whether consumers embrace a keychain-sized AI companion will depend on its price, capabilities and how useful it proves outside demonstrations.

A Portuguese digital rights group called D3 has taken Facebook, Instagram, TikTok and YouTube to court in Lisbon, accusing them of building features that hook users on purpose. Think infinite scrolling, autoplay videos, endless notifications and eerily personalized feeds that keep pulling people back in. The four lawsuits were quietly filed months ago and only came to light now, adding to a growing wave of legal pressure on social media's most addictive design tricks.

Meta has spent twenty years giving its products away and selling the attention they generate. It is now reported to be preparing a subscription that would cost up to $199.99 a month. What Hatch Is Hatch is a consumer AI agent platform, known by that name internally and derived from work on a system called OpenClaw. Reporting indicates it could launch in late August or early September. It would sit inside Instagram and WhatsApp rather than as a separate app, which matters — those two services reach billions of people who have never downloaded an AI product and never would. The agent has been trained to operate on external websites: DoorDash, Etsy, Reddit, Yelp and Outlook among them. Early prototypes reportedly include a customisable dashboard displaying tools the agents build, such as fitness trackers or a travel itinerary. A separate model, known internally as Watermelon, is expected in October. A caution on all of the above: this is reporting rather than announcement. Meta has not published pricing, a launch date or a feature list, and internal project names frequently change before anything ships. The Price Is The Story Meta's business has one shape and has had it since the beginning: the product is free, the user is the inventory, and advertisers pay. That model made the company one of the most profitable in history at a scale no subscription business has ever matched. Roughly three billion people use its services. Converting even a fraction of them to a paid tier would be a different company. $199.99 a month is not a fraction-of-users price. It is enterprise software pricing, aimed at people for whom an agent that handles bookings, orders and scheduling saves more than $200 of their time each month. That is a narrow, wealthy, mostly professional audience, and it is not the audience Meta has spent two decades assembling. Which suggests the tier is less about revenue than about establishing that AI capability is something people pay for — and about giving Mark Zuckerberg an answer to the question of how the company's enormous AI expenditure turns into money that does not depend on advertising. The Question Nobody Has Answered An agent that places orders on DoorDash and buys things on Etsy is acting on websites Meta does not own. Those companies have their own terms of service, their own economics and their own views about automated traffic. An agent completing a purchase looks different from a human doing it: it may not see the advertising, may not be influenced by the merchandising, and may treat the site as a database rather than a shop. Some platforms will welcome the orders. Others will see a competitor inserting itself between them and their customer, capturing the relationship and leaving them the fulfilment. That is the position hotels found themselves in with booking aggregators, and it took years and considerable litigation to settle. Whether Meta has agreements with the services Hatch operates on, or is simply automating a browser against them, is the single most consequential unanswered question about this product. The two are very different businesses with very different legal exposure. The Timing Is Not Comfortable Meta is currently on trial in Oakland, where twenty-nine states are asking a federal court to order it to strip design features out of Instagram and Facebook on the argument that they were built to be addictive to minors. Launching an agent embedded in those same apps, at a moment when a court is weighing whether their design is lawful, is a choice. It does not make the product wrong, and the trial concerns features rather than agents. But an AI system trained to act on a teenager's behalf across food delivery and shopping sites will attract exactly the scrutiny the company is already under. It also arrives days after an assessment that graded five frontier laboratories on their internal AI control practices, in which Meta finished last with an F, scoring zero on gated actions, zero on circuit breaking and zero on having a published plan for containing a model that escapes control. An agent with permission to spend money on external websites is precisely the deployment where gated actions and circuit breaking are the controls that matter. What To Watch Three things will determine whether this is significant or a footnote. Whether the price is real, or an anchor at the top of a range that mostly sells at $20. Whether the third-party services cooperate or resist. And whether an agent operating inside WhatsApp — an encrypted messaging service used by two billion people, many of them in India — raises questions about what the agent sees that the encryption was supposed to protect. That last one has not been asked much yet. It will be.

Meta is preparing Hatch, a consumer AI agent inside Instagram and WhatsApp trained to act on DoorDash, Etsy, Reddit, Yelp and Outlook. Reporting points to a tier reaching $199.99 a month — the first time Meta would charge consumers directly.

It will be.

Meta is preparing to launch Hatch, a consumer AI agent platform built into Instagram and WhatsApp and trained to operate on outside services including DoorDash, Etsy, Reddit, Yelp and Outlook. Reporting indicates a tiered subscription reaching $199.99 a month for higher usage limits. It would be the first time Meta has charged consumers directly for a core product.

Meta wants $199.99 a month for an AI agent that orders your DoorDash

The money in Meta's settlement with American state attorneys general will be argued over for years. The product terms may matter more, and they are unusually specific. Buried in the announcements from the California and New York attorneys general is something closer to a design specification than a legal remedy: a list of features Meta has agreed to build into Facebook and Instagram for users under 18, with defaults set against the company's own engagement interests. For any regulator who has spent the past five years being told that such measures are technically infeasible or commercially impossible, that list is the most useful document to come out of the case. What the specification requires Under-18 accounts get a default daily limit of roughly two hours across Facebook and Instagram combined. California's summary notes the cap drops to one hour if other major platforms adopt comparable limits. Access is blocked entirely between midnight and 6 am. Push notifications are barred between 10 pm and 7 am, with California describing a further block during school hours. Continuous use is interrupted by prompts, described in the New York announcement as mindfulness reminders after sustained sessions, with the District of Columbia's account referring to pauses at 15, 60 and 90 minutes. Like and reaction counts are hidden for under-18 users. Cosmetic procedure filters are restricted for minors. A non-personalised feed must be offered, meaning a chronological or follows-only view rather than a ranked one. Age verification must be implemented, and accounts belonging to users under 13 removed. Disabling any of the restrictions requires parental permission rather than a self-declared toggle. Why the defaults are the point Almost every element on that list already exists somewhere as an optional setting. Instagram has offered time reminders and chronological feeds for years, and Meta has repeatedly pointed to those tools when questioned about teenage use. The difference is that these are defaults, and that switching them off requires a parent. Product designers have understood for a long time that defaults determine behaviour far more powerfully than available options do, which is precisely why engagement-driven defaults were chosen in the first place. The two-hour cap is the clearest case. A voluntary two-hour reminder is a nudge. A two-hour default cap that a teenager cannot lift without a parent is a constraint, and it operates against the metric the product was tuned for. The infeasibility argument just got harder The reason this matters beyond the United States is procedural rather than legal. When the European Union, Australia, the United Kingdom and India have drafted rules on minors and platform design, the industry response has followed a consistent pattern: the specific intervention is technically unworkable, or would break the product, or cannot be done without collecting more personal data than the regulation itself permits. Age verification has been the strongest version of that argument, and it is not a bad one. Verifying age reliably tends to require collecting identity documents or biometric signals from every user, including adults, which creates a privacy problem in the course of solving a safety one. That argument survives this settlement. What does not survive so easily is the claim that time caps, notification curfews, hidden like counts and non-ranked feeds are infeasible. Meta has now agreed to ship them. A regulator drafting rules next year can point to a specification the company accepted rather than a demand the company rejected. That is a materially different negotiating position. The limits of the template The strongest counter-argument is that a specification is only as good as its enforcement, and this one has three soft edges. The first is age verification. Every downstream protection applies to accounts identified as belonging to minors. If a teenager registers as an adult, none of it engages. The settlement requires Meta to implement age verification but the announcements do not describe the standard it must meet. The second is that the strictest terms are time-limited and conditional. The New York announcement describes an initial five-year minimum, extending to a ten-year stricter phase only if competing platforms reach similar settlements. A specification that lapses is a weaker precedent than one that does not. The third is that compliance can be narrow. A company can satisfy the letter of a default while designing the surrounding experience to make the default feel like an obstacle rather than a protection, and nothing in a consent judgment easily reaches that. There is also a substantive objection to the whole approach. Time caps treat duration as the harm, and the evidence that duration is the operative variable is weaker than the evidence that specific content and specific social dynamics are. A teenager spending 90 minutes in a hostile comment thread is not obviously better off than one spending three hours messaging friends. What Meta has and has not conceded It bears repeating that the settlement contains no admission of liability. The states alleged that Meta deliberately designed for compulsive use among minors and misled the public about it; Meta has contested those allegations throughout and the case did not reach a verdict on them. Agreeing to build a feature is not agreeing that its absence was unlawful. Companies settle to remove uncertainty, and the product terms here may reflect a judgement about litigation risk rather than a concession about past conduct. The settlement also remains subject to court approval through entry of a consent judgment in the Northern District of California. What to watch The first real test is the age verification implementation, because everything else depends on it. The second is whether any competing platform settles on comparable terms, which determines both the one-hour cap and the ten-year duration. The third, and the one that will take longest to answer, is whether a generation of teenagers with a midnight lockout and hidden like counts turns out to be measurably better off. The settlement assumes the answer is yes. It does not prove it.

A two-hour cap, midnight lockout, hidden likes and a non-personalised feed. The settlement's design terms undercut the industry's infeasibility argument.

The settlement assumes the answer is yes. It does not prove it.

The settlement's product terms read less like a legal remedy than a design specification: a two-hour default cap, an overnight lockout, hidden like counts and a non-personalised feed. Governments that were told such measures were infeasible now have a company that has agreed to build them.

Instagram will cut teenagers off at midnight! Regulators everywhere now have a template

Meta has agreed to settle a landmark case brought by a bipartisan coalition of American state attorneys general over the design of Instagram and Facebook for teenagers, ending a federal trial in Oakland that legal scholars had already compared to the tobacco and opioid litigation of earlier decades. The figure carried in most headlines is $17.1 billion. The figure Meta is actually committed to is $12.1 billion. That gap is not a discrepancy or a reporting error. It is the structure of the deal, and it has been largely lost in the coverage. How the number actually works According to the announcement from New York Attorney General Letitia James, Meta will pay at least $12.1 billion. The total rises towards $17.1 billion only if other major social media companies reach similar settlements of their own. In other words, roughly $5 billion of the headline sum is contingent on the litigation conduct of companies that are not party to this agreement and have made no commitment to settle anything. The same conditionality runs through the non-monetary terms. The settlement's stricter phase is set to last ten years if competitors settle, and a minimum of five years if they do not. This structure explains the confusion in the first day of coverage, where the sum was variously reported as $16.7 billion, $17 billion, $17.1 billion and $18 billion. Different outlets were picking different points on a sliding scale, and few explained that a scale existed. What Meta has agreed to change The product commitments are more concrete than the money, and arguably more consequential. Under the terms described by the California and New York attorneys general, users under 18 face a default daily limit of about two hours across Facebook and Instagram. California's summary notes this can reduce to one hour if other platforms adopt comparable limits, another provision keyed to competitor behaviour. Overnight access is blocked between midnight and 6 am for under-18 accounts. Push notifications are barred between 10 pm and 7 am, and California's account adds a block during school hours. Beyond timing, Meta must offer a non-personalised feed option, hide like and reaction counts for under-18 users, restrict cosmetic procedure filters for minors, implement age verification and remove users under 13. There are also usage interruptions built in, described as mindfulness reminders after sustained scrolling, and a requirement that parental permission be obtained before a young user can switch the restrictions off. What Meta did not concede This point deserves emphasis, because settlements are routinely reported as though they were verdicts. The agreement contains no admission of liability. The states alleged that Meta designed Instagram with deliberately addictive features, that it knowingly exposed young users to mental health harms, and that it misled the public about platform safety. Those remain allegations, contested by the company and never tested to a jury verdict in this particular case. The settlement is also not yet final. It is subject to court approval through entry of a consent judgment in the US District Court for the Northern District of California. Why the states settled anyway Twenty-nine states had taken Meta to trial before Judge Yvonne Gonzalez Rogers on 18 August, the first case in the sprawling federal social media litigation to reach a jury. Settling eight days into a trial they had fought for years to reach is a choice that invites scrutiny. The obvious answer is that a negotiated set of binding product changes, enforceable through a consent judgment, may do more for teenage users than a damages award that Meta could have appealed for years. Attorneys general also faced genuine trial risk. Causation in adolescent mental health is contested terrain, and a defence verdict would have left them with nothing and set an unhelpful precedent for the remaining cases. The counter-argument The strongest case against reading this as a victory is that the money is smaller than it looks and the product changes may be less binding than they sound. Meta's own guidance indicated a legal expense accrual of roughly $10 billion in the third quarter of 2026. Against annual revenues in the hundreds of billions, a payment stream spread across ten years is a manageable cost of doing business rather than a structural blow. On the product side, defaults can be complied with narrowly. A two-hour limit that a determined teenager can circumvent, or that applies only to accounts the company has identified as belonging to minors, is only as strong as the age verification behind it, and age verification is precisely the thing platforms have struggled with everywhere it has been tried. There is a further objection worth stating plainly. Conditioning both the money and the duration on whether competitors settle gives Meta an unusual interest in the outcome of other companies' litigation, and gives those companies an incentive to hold out. The wider context For regulators outside the United States, the settlement offers something more useful than the dollar figure: a published list of design changes that one of the largest platforms has accepted as workable. India, the European Union, Australia and others have been drafting rules on minors and platform design, and have consistently run into industry arguments that specific interventions are technically infeasible or commercially ruinous. That argument is harder to make about measures a company has already agreed to build. Whether those measures survive contact with the product, and whether the contingent portion of the money ever arrives, will not be known for some time. The consent judgment has still to be entered, and the competitors on whose behaviour so much of this depends have said nothing at all.

Meta's settlement with state attorneys general guarantees $12.1 billion. The rest arrives only if rival platforms settle too. The company admitted no liability.

After being sued by multiple U.S. states over its products fueling social media addiction, Meta announced a $18 billion settlement. In a big win for accountability, it has also decided to curb Instagram and Facebook use for teenagers. Now, it remains to be seen whether these curbs are extended to other countries like India.

Meta has agreed to pay $18 billion to settle claims brought by multiple U.S. states over allegations that its social media platforms used addictive features that negatively affected young users. The company denied any wrongdoing and said the settlement does not constitute an admission of liability. The agreement marks one of the largest settlements involving a major technology company and comes amid growing scrutiny of social media's impact on mental health and online safety.

Newly revealed internal planning documents have shed light on a sweeping, highly aggressive AI-driven restructuring initiative at Meta codenamed "Project OT" (Organization Transformation). Conceived by CEO Mark Zuckerberg and top executives during a leadership retreat, the strategy aimed to transition Meta into an "AI-native" organization by deploying autonomous AI agents to take over routine, daily workflows.

A 15-year-old New Jersey girl has voluntarily withdrawn her high-profile social media addiction lawsuit against Meta, Google and Snap. The case alleged that the platforms contributed to severe social media addiction and mental health harm. The companies said no financial settlement was paid, while the teenager said she wanted to move on with her life.

15-year-old teen drops test case against social media giants

A landmark trial began in August 2026 in a federal court in Oakland, California, where Meta Platforms is accused of deliberately designing Facebook and Instagram to hook young users. A bipartisan coalition of 29 U.S. states brought the suit, alleging the tech giant engineered addictive features that exploit adolescent psychology, causing severe youth mental health harms while prioritising corporate profit. Meta strongly rejects the allegations, claiming the lawsuit's mathematical financial demands are completely unsubstantiated.

What A Bellwether Actually Does When thousands of similar claims are filed against the same defendant, trying each one separately is impossible. American federal courts consolidate them for pre-trial purposes, and then try a small number of representative cases first. The purpose is price discovery. A bellwether verdict tells both sides what a jury and a judge, presented with this evidence, actually do with it. That answer converts thousands of theoretical claims into a number, and the number is what settlement negotiations run on. This is how mass tort litigation has resolved for decades — opioids, asbestos, talc, defective medical devices. Very few of those cases were ever tried. They were priced by the handful that were. Why This Particular One Went First The state attorney general claims were a sensible choice to lead, and the reasons are worth understanding. Government plaintiffs bring resources and investigative powers that individual families do not have. They can pursue documents at a scale a single litigant cannot fund, and their claims run on consumer protection statutes rather than on personal injury, which sidesteps the hardest problem in the entire litigation: proving that a specific platform caused a specific young person's specific harm. That causation question — whether social media use causes adolescent depression, or whether depressed adolescents use more social media — is genuinely contested in the research literature, and it is Meta's strongest ground. A consumer protection case largely avoids it. The states need to establish that the design was unfair or deceptive and that Meta knew, not that any individual child was injured in a medically demonstrable way. So the first case tried is the one framed to avoid the defendant's best argument. The cases behind it are not all built that way. Who Is In The Queue Two groups are waiting, and they want different things. 3,137 cases are waiting behind the Meta trial! This one sets the price

Almost every account of the trial that opened in Oakland this week has carried the same number: $1.4 trillion, a sum just short of Meta's entire market capitalisation. It is not what the states are asking for. It is a figure Meta's own lawyers put into the record. Where The Number Came From The $1.4 trillion is a theoretical maximum. It is what you get by taking the statutory penalty available per violation — $20,000 — and multiplying it across every alleged violation in every claim. Meta's legal team performed that calculation and presented it to argue that the potential exposure is vastly disproportionate to the conduct alleged. That is an ordinary and entirely legitimate defence move. Showing a court the absurd upper bound of a penalty formula is a standard way of arguing that the formula should not be applied mechanically. What is less ordinary is that the number then detached from its context and became the reported size of the states' demand. What The States Actually Want California Deputy Attorney General Megan O'Neill has put the figure at roughly $193 billion. The attorneys general have indicated to Judge Yvonne Gonzalez Rogers that $200 billion is the more realistic number. That is between a seventh and a fifth of the figure in circulation. It is still an enormous sum — larger than the annual GDP of most countries, and larger than any corporate penalty in American history by a wide margin. Nobody should mistake $193 billion for a modest ask. But the difference between $193 billion and $1.4 trillion is the difference between a penalty a company survives and one that ends it, and those are not the same story. Restitution Is Not Damages There is a further distinction that the headline figure obscures entirely. California Attorney General Rob Bonta has framed the case as being about restitution rather than damages. Those are different legal instruments with different logic. Damages compensate a victim for a loss suffered. Restitution strips a defendant of a gain wrongfully obtained. The measure is not what the children lost — which is unquantifiable and would be fiercely contested — but what Meta earned from the conduct alleged. That framing is strategically deliberate. It sidesteps the hardest evidentiary problem in the case, which is proving that a particular product feature caused a particular harm to a particular young person. Restitution asks a narrower question: did the company profit from practices that were unlawful. It also explains why the number is large. Meta's revenue from the relevant period, attributable to the relevant users, is not a small figure regardless of how conservatively it is calculated. Why An Inflated Number Helps The Defendant It is worth asking who benefits from the $1.4 trillion figure travelling as far as it has. A penalty large enough to destroy a company invites a court to flinch. Judges are conscious of proportionality, of the consequences of their orders, and of appellate review. A remedy that reads as annihilation is more likely to be reduced on appeal than one that reads as painful but survivable. There is a real argument, made by several observers of the case, that a claim framed at extinction scale is harder to win precisely because of its scale. If that is right, then a number originating with the defence and amplified in coverage is doing work for the defence. None of which requires anyone to have acted improperly. Meta's lawyers made a legitimate proportionality argument. Reporters picked up the largest number in the room, which is what reporting tends to do. The result is simply that the most-quoted fact about this trial is a defence exhibit. What To Watch Instead The money is not the part of this case most likely to change anything. The states are also seeking nationwide injunctive relief: orders requiring Meta to remove specific design features from Instagram and Facebook, and to delete algorithms trained on data collected from children under 13. Those remedies do not scale with a penalty formula and cannot be reduced to a headline figure. A fine, however large, is paid once and absorbed. An order to rebuild the recommendation systems and strip out the features that drive engagement changes what the product is. If this trial ends up mattering in five years, it will be because of what Judge Gonzalez Rogers ordered Meta to do, not because of what she ordered it to pay.

The $1.4 trillion sum reported everywhere in the Meta trial was produced by Meta's own lawyers as a theoretical maximum to argue disproportionality. The states have told the court they are seeking roughly $193 billion.

Coverage of the Meta trial has settled on $1.4 trillion, a sum just below the company's market capitalisation. That figure was produced by Meta's own lawyers as a theoretical maximum, to argue the exposure is disproportionate. What the states have told the court they are seeking is roughly $193 billion.

‘Time and time again, profits won.’ That was California Deputy Attorney General Megan O'Neill, opening the states' case against Meta in an Oakland federal court. Most of this trial will be about documents the company did not expect anyone outside it to read. The Ruling That Made It Possible Before any of this reached a jury, Meta fought to keep its internal research out of the case, and lost. A federal court held that the company could not invoke attorney-client privilege to withhold internal documents and research relating to teen harm. That ruling matters more than it sounds. Privilege protects communications made for the purpose of obtaining legal advice; it does not protect ordinary business records simply because a lawyer was copied in. Where a company routes internal research through counsel, the question a court has to answer is whether the work was genuinely legal advice or whether privilege was being used as a container. Meta's position did not survive that examination on these documents. The practical effect is that the states obtained material the company had classified as beyond reach, and it is now evidence. What The States Say It Shows The allegations drawn from that material fall into three groups. First, that Meta's own research identified harms to young users, and that this knowledge existed inside the company while its public position was that the evidence was unclear. Second, that executives made product decisions they understood would harm teenagers, and shelved proposed safeguards on the basis of what those safeguards would cost in engagement or revenue. This is the specific allegation behind O'Neill's line — not that Meta was careless, but that it weighed the two and chose. Third, and most serious in institutional terms, that the company misrepresented what it knew to the United States Senate. Unsealed filings have alleged Meta told the Senate Judiciary Committee it could not determine whether its platforms were linked to increased anxiety and depression among young users, while internal work bearing on that question existed. A bipartisan group of senators demanded documents from Mark Zuckerberg in 2023 after an unsealed filing raised that allegation. These remain allegations. None has been established by a court, and the trial exists to test them. Meta's Answer Paul Schmidt, arguing for Meta, told the court that the states have misrepresented the company's platforms and policies, and that their case was built by cherrypicking internal documents and comments. That defence deserves to be taken seriously rather than dismissed, because it describes a real feature of discovery in any large organisation. A company of Meta's size generates enormous volumes of internal debate. Researchers are paid to identify problems; product staff are paid to argue against changes they think are unwarranted; someone in a long email thread will always have written the sharpest possible version of the worst possible interpretation. Producing millions of documents and extracting the most damaging hundred is a legitimate description of how adversarial litigation works, and it is not the same thing as establishing what an institution decided. The counter-argument is equally real. Internal dissent only becomes evidence of corporate knowledge when it reached decision-makers and a decision followed. That is precisely what the states will attempt to show, and it is why the testimony matters as much as the paper. Why The Witnesses Matter More Than The Documents Mark Zuckerberg is expected to testify. So is Adam Mosseri, who runs Instagram. A document establishes that something was written. A witness under cross-examination establishes what was understood and what was done about it. The states' theory requires connecting research to a decision, and the only people who can confirm or deny that connection are the people who made the decisions. Meta's cherrypicking defence also creates an obligation. If the states' selection is unrepresentative, the natural way to demonstrate that is to put the fuller picture in front of the court — which means Meta's own witnesses walking through the same material and explaining what it actually meant. The Larger Point Whatever Judge Yvonne Gonzalez Rogers concludes, this trial is producing something that has not existed before: a tested public record of what one of the largest technology companies knew about its effect on young users, and when. Congressional hearings produced assertions. Journalism produced leaks. Neither carries the evidentiary weight of documents obtained under compulsion, authenticated in court, and put to the executives who wrote them, with cross-examination available to challenge every inference drawn from them. That record will outlast the verdict. It becomes available to every regulator, legislature and litigant anywhere in the world with an interest in what social media does to children. Meta spent years arguing this material was privileged. The reason that fight mattered is now becoming visible.

The states' case against Meta rests on the company's own internal research, which it tried to withhold under attorney-client privilege until a federal court refused. Meta now argues the states have cherrypicked what they found.

‘Time and time again, profits won.’ That was California Deputy Attorney General Megan O'Neill, opening the states' case against Meta in an Oakland federal court. It is a claim about intent, and intent is the hardest thing to prove against a corporation — unless the corporation wrote it down. The states say Meta did.

The states' case against Meta rests on the company's own internal research, and Meta spent years trying to keep it out of their hands. A federal court ruled it could not use attorney-client privilege to withhold documents about teen harm. Its lawyers now argue the states have cherrypicked what they found.

'Time and time again, profits won': The research Meta fought to keep sealed

The case against Meta that opened in Oakland this week rests, in its federal part, on a law written in 1998 that protects children under the age of 13. India's equivalent protects everyone under 18, requires a parent's verified consent before a company may process their data at all, and prohibits tracking, behavioural monitoring and targeted advertising directed at them. By the letter of the statute, India has already outlawed most of what twenty-nine American states are spending five weeks in court trying to establish. The Gap Between The Two Laws The Children's Online Privacy Protection Act sets its threshold at 13. Above that age, its protections stop. A 14-year-old in the United States is, for the purposes of that statute, an adult. That is why the states' complaint has two halves. The COPPA claim covers under-13s who were allowed onto Facebook and Instagram without parental consent. Everything concerning teenagers — the design features, the addictive mechanics, the mental health allegations — has to be brought under state consumer protection law instead, as unfair or deceptive practice. India's Digital Personal Data Protection Act does not have that gap. It defines a child as a person under 18. Processing their data requires verifiable parental consent, with the parent's identity and age validated against government-issued proof. And it bans, in terms, tracking, behavioural monitoring and targeted advertising aimed at children. The threshold is stricter than the European Union's, which sits between 13 and 16 depending on the member state, and considerably stricter than the American one. What That Would Mean If It Were Running Consider the features the American states are asking a court to order removed: engagement-optimised recommendation, ephemeral content, infinite scroll, autoplay, beauty filters. The mechanism underneath most of them is behavioural: the system observes what a user responds to and adjusts what it serves in order to extend attention. Applied to an Indian user under 18, that is behavioural monitoring of a child, which the DPDP Act prohibits without needing a court to find it addictive or harmful. The states in Oakland must prove that Meta's design was unfair or deceptive, that the company knew, and that harm followed. Under the Indian statute the question is narrower and far easier to answer: was the user a child, and was their behaviour monitored or used for targeting. That is the difference between a consumer protection theory and a bright-line rule. Why It Has Not Bitten The reason no Indian regulator is doing what four American attorneys general are doing is that the machinery has not been switched on. The Act passed in 2023. The rules that give it operational effect have moved slowly, and the hardest provision to implement is precisely the one that matters here: verifiable parental consent. Requiring a company to confirm that a consenting adult is genuinely the parent of a specific child, at national scale, without building a surveillance apparatus in the process, is a genuinely difficult problem, and it has not been solved anywhere in the world. In early 2026 the Ministry of Electronics and Information Technology held at least three private consultations with social media companies on whether age-based access controls are technically feasible. That is the state of play: a statute with real teeth, and a live conversation about whether the teeth can be fitted. There is a second constraint. Enforcement under the DPDP framework runs through a Data Protection Board rather than through litigation brought by state governments. India has no equivalent of an attorney general who can take a company to trial on behalf of a state and seek an order redesigning its product. The remedy structure is administrative, and administrative penalties are capped in ways that a court's equitable powers are not. The Pattern This Fits This is a recognisable shape in Indian technology regulation, and it appeared again only recently. The AI Governance Guidelines released by MeitY chose voluntary compliance, self-certification and regulatory sandboxes over binding mandates, and nine months later only one of the three institutions they proposed exists. The rules are drafted ambitiously and implemented cautiously. There are defensible reasons for that caution. Rules that cannot be complied with produce either mass technical non-compliance or an enforcement regime that lands arbitrarily. A government that legislates first and works out feasibility afterwards can find itself unable to act at all. But the cost is visible in exactly this comparison. The country with the weaker statute is the one currently extracting internal documents, putting Mark Zuckerberg on a witness stand, and asking a federal judge to order features deleted from an app worldwide. The country with the stronger statute is holding consultations. What Indian Readers Should Take From The Trial The Oakland proceedings will produce something India's framework has not yet generated: a public evidentiary record. Discovery in the American case has already forced out internal research Meta sought to withhold, after a federal court ruled the company could not use attorney-client privilege to keep documents about teen harm out of the states' hands. Zuckerberg and Instagram head Adam Mosseri are expected to testify under oath. Whatever the judgment, that record becomes available to every regulator on earth, including India's. It is the raw material a Data Protection Board would need, and it is being produced at American expense under an American statute that protects fewer children than the Indian one does. If India's rules are eventually enforced, the evidence for the first case is being generated right now, in a courtroom in California.

The federal case against Meta runs on COPPA, which protects under-13s. India's DPDP Act covers under-18s and bans tracking, behavioural monitoring and targeted ads aimed at children outright — but the enforcement machinery is not running.

The federal claim against Meta in Oakland runs on COPPA, which protects children under 13. India's Digital Personal Data Protection Act defines a child as anyone under 18, requires verifiable parental consent, and bans tracking, behavioural monitoring and targeted advertising aimed at them outright. On paper India is years ahead. In enforcement it is not.

India already banned what Meta is on trial for in America! It just isn't enforced yet

Eight jurors were selected in Oakland to hear the states' case against Meta. Whatever they conclude, it will not decide the case. The jury is advisory. Judge Yvonne Gonzalez Rogers will rule on liability, on penalties, and on every remedy sought — including whether Meta must strip features out of Instagram and destroy algorithms trained on children's data. She is required to consider what the jury finds. She is not required to follow it. This is an unusual arrangement and it changes how the next several weeks should be read. Why There Is A Jury At All The distinction turns on what the states are asking for. Claims for money damages generally carry a right to trial by jury. Claims in equity — orders compelling a defendant to do something or stop doing something — are decided by a judge. The states' case is built substantially on the second kind. They want injunctions: feature removals, algorithm deletion, age restrictions enforced nationwide. California's attorney general, Rob Bonta, has framed the case as being about restitution rather than damages, and that framing matters here. Restitution asks a court to strip a defendant of what it gained. It is an equitable remedy, and equitable remedies belong to the bench. A judge may still empanel an advisory jury on such claims. It is a discretionary tool, used when a court wants a community read on contested facts before ruling. The finding is consultative. What That Means In Practice Three consequences follow, and each one cuts against how this trial is likely to be covered. First, a reported jury verdict will not be the outcome. If the jury sides with the states and Gonzalez Rogers does not, her ruling governs. The reverse is equally true. Any headline announcing that Meta has won or lost because of what eight jurors concluded will be describing a recommendation. Second, the remedies were never in the jury's hands to begin with. The feature list — infinite scroll, autoplay, ephemeral content, beauty filters — and the demand that Meta delete models trained on under-13 data are equitable relief. Those were always going to be decided by one person. Third, the timeline is longer than the trial. A judge deciding liability and crafting nationwide injunctive relief does not rule from the bench when closing arguments end. Findings of fact and conclusions of law take time to write, particularly when the remedy involves ordering a company to redesign products used by billions. Who She Is Gonzalez Rogers has spent nearly two decades on the federal bench in the Northern District of California, the district where most of the significant American technology litigation lands. She presided over Epic Games' antitrust case against Apple — a bench trial, no jury, in which she ruled largely for Apple on the central antitrust questions while ordering Apple to change its anti-steering rules, and later found the company had not complied with that order. That history is instructive. It is a judge willing to reject a plaintiff's broad theory and still impose a targeted structural remedy on the defendant. That pattern, if it repeats, would be the outcome Meta should fear most: not a headline penalty, but a narrow, specific, enforceable order about how the product works. Meta Has Already Lost Ground The most concrete development in the case happened before the trial opened. Gonzalez Rogers granted the states partial summary judgment on certain notice and consent issues under the Children's Online Privacy Protection Act. Partial summary judgment means the court found there was no genuine dispute of material fact on those points and resolved them without trial. Meta therefore entered opening statements having already lost part of the federal claim. What remains on COPPA is narrower than what it faced a few months ago. A separate ruling went against the company on evidence. A federal court held that Meta could not use attorney-client privilege to withhold internal documents and research relating to teen harm — a significant setback, because privilege was the mechanism keeping some of the company's own research out of the states' hands. The Number Of People Deciding It is worth stating plainly what this case now rests on. Twenty-nine states brought it. Four are trying it. Roughly $193 billion is sought. Thousands of related cases are queued behind it. The features of an app used by billions are on the table, along with an order to destroy trained models. All of it will be decided by a single federal judge in Oakland, with eight jurors offering an opinion she may set aside. That is not a criticism of the procedure — equitable relief has always worked this way, and there is a reasonable argument that a remedy this technical is better crafted by one experienced judge than by a jury. But it is the fact that most coverage of the next several weeks will obscure, and it is the one that determines what actually happens to Instagram.

The jury in the Meta trial cannot decide anything! One judge will

The trial that opened in an Oakland federal courtroom on August 18 has been reported almost entirely through its money. The more consequential part of the case is a list of product features. Four states — California, Colorado, Kentucky and New Jersey — are trying the case on behalf of a coalition of 29. They are not only seeking penalties. They are asking a federal judge to order Meta to remove things from Instagram and Facebook, nationwide, and to destroy the systems built on data taken from children. The Feature List For the consumer protection claims, the states want Meta ordered to remove what they characterise as addictive design features. The list reported from the filings covers infinite scroll, autoplay, ephemeral content, beauty filters and engagement-optimised algorithms, alongside age restrictions the company would have to enforce. 'Ephemeral content' is the term that deserves attention. On Instagram, that is Stories — posts that vanish after 24 hours. Stories is not a peripheral feature. It sits at the top of the app, it is where a large share of daily posting happens, and it is one of the two formats that carry Instagram's advertising business. An order requiring its removal would not be a modification to Instagram. It would be a different product. Why Disappearing Posts Are In The Complaint The states' theory is that these features are not neutral conveniences but deliberate engineering against a young user's ability to stop. Infinite scroll removes the natural stopping point a page break used to provide. Autoplay starts the next video before a decision to watch it has been made. Beauty filters are alleged to drive appearance comparison in adolescents, particularly girls. Ephemeral content works differently, and the mechanism is time pressure. Content that expires in 24 hours creates a reason to return before it is gone. It converts absence into loss. Applied to a teenager whose social standing is mediated through the app, the argument runs, a disappearing post is an instrument for compelling daily attendance rather than a creative format. Meta's position is that these are ordinary product features used by billions of adults, and that the states have worked backwards from harm to design. The Larger Remedy The demand with the widest implications is not on the feature list at all. Under the federal Children's Online Privacy Protection Act, all 29 states allege Meta collected data from large numbers of under-13s who were permitted onto the platforms without parental consent. If the court finds that breach, the states want Meta to delete that data — and to delete the algorithms and models trained on it. That second half is the significant one. Deleting a database is an afternoon's work. Deleting every model trained on improperly collected data means unwinding years of recommendation systems and retraining them on a clean corpus, with no straightforward way to prove what was and was not contaminated. It is a remedy regulators have reached for before in smaller cases, and it is far more expensive to comply with than a fine. A penalty is paid once. An order to destroy the models is a rebuild of the product. The Allegations The states argue Meta designed Instagram and Facebook to be addictive to minors through algorithms encouraging compulsive use, knew from its own research that the platforms were harming young users, and publicly downplayed the risk while continuing to optimise for engagement. Kentucky's attorney general, Russell Coleman, has described it as the largest consumer protection lawsuit in United States history. California's attorney general, Rob Bonta, framed the case as being about restitution rather than damages — an important distinction, because restitution asks the court to strip a defendant of what it gained rather than to compensate for what victims lost. Meta's Answer Paul Schmidt, arguing for Meta, told the court the states had misrepresented the company's platforms and policies and built their case by cherrypicking internal documents and comments. The company points to Instagram Teen Accounts, introduced in 2024, which restrict who can contact under-age users, and to parental controls allowing time limits. Its broader argument is that the features at issue are used by adults worldwide without the harms alleged, and that correlation between adolescent distress and social media use has not been established as causation in the way the states require. Mark Zuckerberg is expected to testify, as is Adam Mosseri, who runs Instagram. The Number That Is Being Misreported Coverage has widely described the states as seeking $1.4 trillion, a figure just below Meta's market capitalisation. That is not the states' number. It is Meta's own calculation — the theoretical maximum produced by applying the $20,000 statutory penalty per alleged violation across every claim. Meta's lawyers put it forward to argue the exposure is vastly disproportionate. What the states have actually told the court is roughly $193 billion, according to California Deputy Attorney General Megan O'Neill, with the attorneys general indicating $200 billion as the more likely figure. That is still an enormous sum. But the difference between $193 billion and $1.4 trillion is the difference between a survivable penalty and an extinction event, and the larger number entered circulation because the defence found it useful. The Jury Does Not Decide Eight jurors were selected, and their role is advisory only. Judge Yvonne Gonzalez Rogers will decide liability, penalties and remedies herself. The jury's finding is consultative — she is required to consider it, not to follow it. This matters for how the case should be read. She has already granted the states partial summary judgment on certain COPPA notice and consent issues, which means Meta entered the trial having lost ground on the federal claim before opening statements. What Happens Next The trial is expected to run six to eight weeks, with a verdict anticipated around October. It is the first state attorney general bellwether drawn from 3,137 consolidated cases in the wider multidistrict litigation over social media and adolescent addiction, and the first of them to reach a jury. School districts and individual families are behind it in the queue. That is what gives this case weight beyond its own outcome. A bellwether exists to price the rest. Whatever Judge Gonzalez Rogers orders — on penalties, on features, on the algorithms — becomes the reference point for thousands of cases still waiting, and for every other platform whose product rests on the same design choices. Instagram Stories, on that reading, is not the target. A jury verdict reported as a win or loss for either side will not be the outcome. The first state attorneys general trial against Meta opened in Oakland on August 18. Meta is facing a major legal challenge in the U.S. as states accuse the company of putting children at risk through Facebook and Instagram. The allegations include hiding potential harms, improperly collecting and using children’s data, and designing platforms that allegedly keep young users engaged. Families are demanding greater accountability as the case could influence how Meta operates its social media platforms.
