Two individuals from Uganda are currently facing severe legal repercussions due to charges of "aggravated homosexuality," an offense that carries the death penalty under the country's recently enacted controversial anti-gay laws. The law has already sparked international outrage and drawn attention to the significant human rights concerns surrounding them.

One of the two cases involves a 20-year-old man residing in the Soroti district of eastern Uganda. He was charged on August 18 after being accused of engaging in "unlawful sexual intercourse" with a 41-year-old man who has a disability.

The spokesperson for the Director of Public Prosecutions, Jacqueline Okui, confirmed these charges.&nbsp;Last month in the Jinja district of eastern Uganda, another individual was accused of "aggravated homosexuality." The allegation was that this person engaged in a "sexual act with a child aged 12 of the same sex," as per Okui.

<h2>'Aggravated homosexuality'</h2>

"Aggravated homosexuality," as defined by the contentious legislation, encompasses a range of activities including incest, sexual relations with children, individuals with disabilities, and the elderly.

The law, which was signed in May, not only outlaws same-sex marriages in Uganda but also imposes life imprisonment for engaging in same-sex acts.

The accused individuals are currently in pre-trial remand and are expected to appear in court in September. While Uganda has not carried out an execution for decades, the potential for the death penalty in these cases has raised concerns about the harshness of the penalties associated with the law.

Uganda charges two men with 'aggravated homosexuality' under controversial anti-gay laws

Ugandan prosecutors have charged a man with "aggravated homosexuality," potentially a capital offense under new controversial anti-gay legislation, an official said Monday.

The World Bank said on Tuesday (August 8) that it was pausing new public finance projects in Uganda over the government's adoption of a widely criticised bill that criminalises same-sex conduct.

The World Bank said on Tuesday (August 8) that it was pausing new public finance projects in Uganda over the government's adoption of a widely criticised bill that criminalises same-sex conduct. In a statement, the World Bank said that Uganda's Anti-Homosexuality Act fundamentally contradicts the global development lender's core values. No new public financing would be presented to the bank's board of directors for approval for the time being, the statement added. "Our goal is to protect sexual and gender minorities from discrimination and exclusion in the projects we finance," the statement also said, adding it was in discussion with the Ugandan authorities over the issue. What is Uganda's Anti-Homosexuality Act? In May, Ugandan President Yoweri Museveni signed the Anti-Homosexuality Act of 2023- which criminalises same-sex conduct, including potentially a death penalty for those convicted of “aggravated homosexuality." The act calls for life imprisonment for anyone convicted of homosexuality. Same-sex relations have been illegal in Uganda but the new act goes further. According to Human Rights Watch (HRW), the act violates "multiple fundamental rights guaranteed under Uganda’s constitution and breaks commitments made by the government as a signatory to a number of international human rights agreements." United States President Joe Biden, meanwhile, called Kampala's decision "a tragic violation" of human rights and said Washington would evaluate the implications of the law "on all aspects of US engagement with Uganda." "We are considering additional steps, including the application of sanctions and restriction of entry into the United States against anyone involved in serious human rights abuses or corruption," President said on May 29. In a joint statement, the American flagship HIV/AIDS programme PEPFAR, the Global Fund to Fight AIDS, Tuberculosis and Malaria, and the Joint United Nations Programme on HIV/AIDS (UNAIDS) said the law put Uganda’s anti-HIV fight "in grave jeopardy." World Bank's decision follows pressure from rights groups, US Congress The World Bank's decision to halt new loans for Uganda came after pressure from human rights organisations and members of the US Congress to take a tougher line with Kampala over the act. In late July, several members of the US Congress called on World Bank President Ajay Banga to "immediately postpone and suspend all current and future lending to Uganda" until the law was struck down. Following the passage of the act, the US State Department updated its travel advisory, telling citizens to "reconsider travel to Uganda due to crime, terrorism, and anti-LGBTQI+ legislation." According to the Mayor of Mpondwe-Lhubiriha, Selevest Mapoze, the victims included students, a guard, and two members of the local community who were fatally attacked outside the school. The rebels set fire to a dormitory, causing some students to suffer fatal burns, while others were shot or brutally hacked with machetes.

The raid, carried out by approximately five attackers around 11:30 p.m., left the school engulfed in flames. Responding to the scene, soldiers from a nearby brigade discovered the horrifying sight of the school compound filled with the lifeless bodies of students. Military spokesman Brig. Felix Kulayigye confirmed the recovery of 47 bodies, with eight other individuals injured and receiving treatment at a local hospital. Ugandan troops are currently in pursuit of the perpetrators and working to rescue the abducted students, who were forced to carry looted food toward Congo's Virunga National Park.

Deadly attack by ISIS allies at Ugandan school claims at least 41 lives, including students

Ugandan police said Monday that 20 people had been arrested for suspected collaboration with the notorious militia group blamed for last week's grisly attack on a school near the border with the Democratic Republic of Congo.

"Twenty arrests have been made of suspected collaborators, suspected ADF collaborators," police spokesman Fred Enanga told a press conference, referring to the Allied Democratic Forces (ADF) based in the DRC.

He said in a separate statement that those arrested included the head teacher and the director of the Lhubiriha Secondary School in Mpondwe, western Uganda, which came under attack late on Friday.

In June 1998, 80 students were burnt to death in their dormitories in an ADF attack on Kichwamba Technical Institute near the border of DR Congo. More than 100 students were abducted. Uganda and DR Congo launched a joint offensive in 2021 to drive the ADF out of their Congolese strongholds, but the measures have so far failed to end the group's attacks. In March this year, the United States announced a reward of up to $5 million for information leading to the capture of the ADF's leader. Uganda: 25 students killed in overnight militant attack

The United States said it has updated its travel warning for Uganda following the adoption of draconian anti-gay legislation last month, a move Kampala branded "blackmail".

President Yoweri Museveni signed the bill into law on May 29, triggering outrage among human rights groups, the United Nations and LGBTQ activists as well as Western powers.

"Reconsider travel to Uganda due to crime, terrorism, and anti-LGBTQI+ legislation," the US State Department said in a new advisory issued late Monday.

It said the Anti-Homosexuality Act "raises the risk that LGBTQI+ persons, and those perceived to be LGBTQI+, could be prosecuted and subjected to life imprisonment or death based on provisions in the law".

The law – considered one of the harshest of its kind in the world – contains provisions making "aggravated homosexuality" a capital offence and penalties for consensual same-sex relations of up to life in prison.

"LGBTQI+ persons, or persons perceived to be LGBTQI+, could face harassment, imprisonment, blackmail, and violence," the State Department said, warning also of the risk of attacks by "vigilantes".

"Be mindful that any public identification with the LGBTQI+ community, as either a member or supporter, could be grounds for prosecution, and that even private consensual same-sex relations are illegal."

Uganda's Information Minister Chris Baryomunsi told AFP the updated travel advisory "was expected and we are not surprised".&nbsp;

"However, (the) US should understand that Uganda is a sovereign state which legislates for its people, not for the Western world," he added.&nbsp;

"They can issue travel advisories as it is within their rights but should be reminded blackmail has no place in (the) modern world."&nbsp;

In May, US President Joe Biden called for the immediate repeal of the measures he slammed as "a tragic violation of universal human rights", and threatened to cut aid and investment in the East African country.

But earlier this month Museveni defied international calls to rescind the law, saying "no one will move us".

The legislation has broad support in the conservative majority Christian country, where lawmakers have defended the measures as a necessary bulwark against Western immorality.

US updates Uganda travel warning over anti-gay law

The Archbishop of Canterbury, Justin Welby, has made a resolute appeal to the Anglican Church of Uganda to denounce the newly enacted anti-LGBT law in the country. The Archbishop emphasised that Anglicans worldwide should not endorse legislation that contradicts the fundamental Christian principles taught in the Gospel.

<h2>Uganda's anti-LGBT law</h2>

The law, which was approved by President Yoweri Museveni in May, imposes severe penalties for engaging in same-sex relationships.&nbsp;

In Uganda, gay sex is now punishable by life imprisonment. Additionally, "aggravated homosexuality," which includes the transmission of HIV, carries the death penalty.&nbsp;

The introduction of this legislation has sparked widespread concern and condemnation from human rights activists and organizations globally.

<h2>Concerns raised by Archbishop Justin Welby</h2>

Expressing his deep concern, Archbishop Justin Welby wrote a letter to Archbishop Stephen Kaziimba, the Primate of Uganda, expressing his "grief and dismay" regarding the stance of the Church.&nbsp;

He emphasised that no province within the Anglican Communion should support such discriminatory laws, as they contradict the resolutions, teachings, and the very essence of the Gospel shared by Anglicans worldwide.

"There is no justification for any province of the Anglican Communion to support such laws: not in our resolutions, not in our teachings, and not in the Gospel we share."

Archbishop Welby acknowledged the historical context of colonial rule in Uganda and reassured that his appeal was not an attempt to impose Western values on the Ugandan Anglican community.&nbsp;

Instead, he emphasised that his intention was to remind "them of the commitments we have made as Anglicans to treat every person with the care and respect they deserve as children of God."

As per Reuters, the Archbishop had previously expressed gratitude for the anti-gay law's enactment, claiming that homosexuality was being imposed on Uganda by "foreign actors... who disguise themselves as human rights activists".&nbsp;

He argued that such acts went against the religious and cultural beliefs of the Ugandan population.

In April, GAFCON had even announced a loss of confidence in Archbishop Welby due to his support for the blessing of same-sex unions in churches.&nbsp;

<h2>What is the new law about?</h2>

The bill, Anti-Homosexuality Act 2023, which was recently signed into law, was introduced in Uganda’s parliament&nbsp;earlier this year. The death penalty for “aggravated homosexuality” includes sex with a minor, people who are HIV positive, and incest.&nbsp;

Additionally, anyone engaging in gay sex, if convicted, could face life imprisonment and a person caught trying to commit same-sex acts could face up to 10 years in prison. The law also stipulates a 20-year sentence for anyone “promoting” homosexuality.&nbsp;

It also calls for what it terms “rehabilitation” for gay offenders which could hint at the widely discredited conversion therapy. Meanwhile, a minor convicted of an offence involving same-sex relations can be imprisoned for not more than three years.&nbsp;

If legal entities, such as media and non-governmental organisations (NGOs), are found “knowingly” promoting homosexuality, they will be fined and also face potential suspension.&nbsp;

<h2>Museveni has ‘answered the cries of our people’</h2>

The announcement of the signing of the bill was made by Ugandan Parliament Speaker Anita Annet Among who said Museveni has “answered the cries of our people.” She also took to Twitter and wrote, “I thank His Excellency, the president, for his steadfast action in the interest of Uganda.”

She added, “With a lot of humility, I thank my colleagues the Members of Parliament for withstanding all the pressure from bullies and doomsday conspiracy theorists in the interest of the country.”&nbsp;

A report by the Associated Press has also attributed the rise in anti-gay sentiment in Uganda to news coverage of alleged sodomy cases&nbsp;in boarding schools.&nbsp;One of the cases includes a parent accusing a teacher of abusing her son who is in a prestigious school for boys.&nbsp;

LGBTQ rights activists have called the bill unnecessary considering homosexuality in Uganda has long been illegal in line with a colonial-era law which criminalises sexual activity “against the order of nature.” The violation of this&nbsp;law&nbsp;carries a punishment of life imprisonment.

<h2>International criticism and condemnation&nbsp;</h2>

Notably, the bill’s sponsor Asuman Basalirwa told reporters that the Ugandan Parliament speaker’s visa to the United States was cancelled after the law was signed. This comes after the White House condemned the bill after it was first passed back in March. Amnesty International has described the legislation as “draconian and overly broad.”

On Monday, the United Nations Human Rights Office said it was “appalled that the draconian and discriminatory anti-gay bill is now law,” and called the legislation “a recipe for systematic violations of the rights” of LGBTQ people and others. The European Parliament has also condemned the law with MEPs describing it as “horrific”.&nbsp;

In a joint statement, on Monday, PEPFAR, the US flagship HIV/AIDS programme and leaders of the UNAIDS programme, said that the law will put Uganda’s anti-HIV fight “in grave jeopardy,” and that they were “deeply concerned about the harmful impact” of the legislation on public health.&nbsp;

The statement also noted that the "stigma and discrimination associated with the passage of the Act have already led to reduced access to prevention as well as treatment services"&nbsp;for LGBTQ people, and it will “obstruct health education and the outreach that can help end AIDS as a public health threat.”

“Our data shows that this law runs counter to the interests of economic progress and prosperity of all people in Uganda,” said Dominic Arnall, chief executive for Open For Business, a coalition of companies which includes tech giants like Google and Microsoft. He also said that the group was deeply disappointed by the signing of the bill.&nbsp;

US President Joe Biden

After the bill was signed said that the&nbsp;enactment of the anti-LGBTQ law is a "tragic violation of universal human rights". He added, "I join with people around the world - including many in Uganda - in calling for its immediate repeal." Biden&nbsp;also said that they are considering steps like additional sanctions&nbsp;and restriction of entry into the US "against anyone involved in serious human rights abuses or corruption".&nbsp;

United Kingdom government&nbsp;'appalled'

The&nbsp;British government said that they were "appalled" at the Ugandan government's new law. Andrew Mitchell, a minister in the foreign office department&nbsp;said it "undermines the protections and freedoms of all Ugandans enshrined in the Ugandan Constitution".&nbsp;

He also went on to describe the law "deeply discriminatory" and said it would "increase the risk of violence, discrimination and persecution, will set back the fight against HIV/AIDs, and will damage Uganda’s international reputation".&nbsp;

<h2>‘A dark day’ for LGBTQ community in Uganda</h2>

According to media reports, there is fear among Uganda’s LGBTQ community as many have closed down social media accounts and fled homes, while some are even planning to move abroad. Henry Mukiibi, an activist who assists LGBTQ Ugandans, told CNN that he is afraid of people taking the law into their own hands.&nbsp;

“I think this is so so horrible. We didn’t expect this – we thought he would be advised against it. We are going to be tortured. I am just scared now about what is next,” Mukiibi told CNN. He added, “People have been waiting for the bill to be signed and then they will work on us. We are going to die.”&nbsp;

“It’s a very dark and sad day for the LGBTIQ community, our allies and all of Uganda,” said Clare Byarugaba, a Ugandan rights activist, as per Reuters, after the bill was signed.&nbsp;

Africa's deputy director for Human Rights Watch,&nbsp;Ashwanee Budoo-Scholtz,&nbsp;told AFP that the legislation&nbsp;was “discriminatory and is a step in the wrong direction for the protection of human rights for all people in Uganda”.&nbsp;

Homosexuality is criminalised in more than 30 of Africa’s 54 countries as some people supposedly view it as a behaviour imported from abroad. There are also fears that this legislation could encourage lawmakers in neighbouring Kenya and Tanzania to take similar steps.&nbsp;

After the law was signed, a Kenyan Member of&nbsp;Parliament, George Kaluma,&nbsp;said, "Wow! What a leader we've in Africa! Congratulations Uganda! Kenya is following you in this endeavour to save humanity ... Perversion is treated, not normalized!"&nbsp;

The 78-year-old leader was seen signing the bill at his desk with a golden pen and has previously called homosexuality a “deviation from normal”. He also urged lawmakers to resist “imperialist” pressure amid international condemnation of the bill. Notably, a similar less restrictive anti-LGBTQ law was struck down by a court on procedural grounds.&nbsp;

Rights activists have the option of appealing the legislation before the constitutional court. The 2014 anti-LGBTQ law was also struck down by a domestic court&nbsp;after some countries in the West had taken measures including suspension of aid, imposed visa restrictions and curtailed security cooperation.

The civil society in Uganda, with the LGBTQ community, is ready to take this to the courts and challenge the law, Nicholas Opiyo, a prominent human rights lawyer told CNN. “Because this law is a deeply discriminatory and repressive law that doesn’t meet any international human rights and local standards.”&nbsp;

He also went on to describe the law "deeply discriminatory" and said it would "increase the risk of violence, discrimination and persecution, will set back the fight against HIV/AIDs, and will damage Uganda’s international reputation". ‘A dark day’ for LGBTQ community in Uganda According to media reports, there is fear among Uganda’s LGBTQ community as many have closed down social media accounts and fled homes, while some are even planning to move abroad. Henry Mukiibi, an activist who assists LGBTQ Ugandans, told CNN that he is afraid of people taking the law into their own hands. “I think this is so so horrible. We didn’t expect this – we thought he would be advised against it. We are going to be tortured. I am just scared now about what is next,” Mukiibi told CNN. He added, “People have been waiting for the bill to be signed and then they will work on us. We are going to die.” “It’s a very dark and sad day for the LGBTIQ community, our allies and all of Uganda,” said Clare Byarugaba, a Ugandan rights activist, as per Reuters, after the bill was signed. Africa's deputy director for Human Rights Watch, Ashwanee Budoo-Scholtz, told AFP that the legislation was “discriminatory and is a step in the wrong direction for the protection of human rights for all people in Uganda”. Homosexuality is criminalised in more than 30 of Africa’s 54 countries as some people supposedly view it as a behaviour imported from abroad. There are also fears that this legislation could encourage lawmakers in neighbouring Kenya and Tanzania to take similar steps. After the law was signed, a Kenyan Member of Parliament, George Kaluma, said, "Wow! What a leader we've in Africa! Congratulations Uganda! Kenya is following you in this endeavour to save humanity ... Perversion is treated, not normalized!" The 78-year-old leader was seen signing the bill at his desk with a golden pen and has previously called homosexuality a “deviation from normal”. He also urged lawmakers to resist “imperialist” pressure amid international condemnation of the bill. Notably, a similar less restrictive anti-LGBTQ law was struck down by a court on procedural grounds. Rights activists have the option of appealing the legislation before the constitutional court. The 2014 anti-LGBTQ law was also struck down by a domestic court after some countries in the West had taken measures including suspension of aid, imposed visa restrictions and curtailed security cooperation. The civil society in Uganda, with the LGBTQ community, is ready to take this to the courts and challenge the law, Nicholas Opiyo, a prominent human rights lawyer told CNN. “Because this law is a deeply discriminatory and repressive law that doesn’t meet any international human rights and local standards.” (With inputs from agencies) WATCH WION LIVE HERE You can now write for wionews.com and be a part of the community. Ugandan minister Charles Engola shot and killed by bodyguard: Reports

An investigation has revealed that the UK government has been supporting&nbsp;the funding of a virulently homophobic religious group in Uganda, whose leaders have sponsored a law that would make homosexuality a crime in the country.

The Institute for Journalism and Social Change (IJSC) found a "staggering" number of connections between anti-LGBTQ+ organisations in Uganda and foreign assistance donors, including the UK, after analysing official data provided to the International assistance Transparency Initiative (IATI), reported The Guardian.

In accordance with IATI remarks, the Inter-Religious Council of Uganda (IRCU), an interfaith organisation, has been a direct recipient of UK aid funds in its capacity as "implementing partner" of a scheme intended to realise the Foreign Office's "ambition for an open society in Uganda."

The Church of Uganda and numerous evangelical churches were among the IRCU members that signed a statement in February expressing "great concern" over "the growing spread of homosexuality" in Uganda and the impact of "the LGBTQ agenda" on children's well-being.

In an effort to broaden the nation's anti-gay laws, the anti-homosexuality bill 2023 was introduced into parliament two weeks later. Last month, the Ugandan parliament passed the bill with 387 of 389 MPs voting in favour.

The IRCU received financing from 2021 until earlier this year, according to the Foreign Office's (FCDO) confirmation. According to FCDO data, the organisation received $168,244&nbsp;as part of the Uganda-Open Society programme, which started in June 2021 and is scheduled to last until March 2024.

However, a spokesperson claimed that the UK made the decision to cease financing in February as a result of remarks made by the IRCU regarding the anti-homosexuality bill.

The proposed law, which Volker Türk, the UN human rights chief, called "probably among the worst of its kind in the world," stipulates death penalty and life in prison for homosexual acts, as well as up to 14 years in prison for "attempted" homosexuality and 20 years for "recruitment, promotion, and funding" of same-sex "activities."

The maximum sentence for anyone who declares themselves to be "a lesbian, gay, transgender, a queer, or any other sexual or gender identity that is contrary to the binary categories of male and female" is 10&nbsp;years in prison.

President Yoweri Museveni, who this month called homosexuality a "threat to the human race," declined to sign the bill into law and asked the parliament to have another look at it, leaving it in limbo.

The IRCU allegedly lost government funding from the Obama administration in 2014 as a result of the group's advocacy for the Anti-Homosexuality Act, the predecessor to the 2023 legislation that was eventually struck down by the constitutional court.

The UK's development minister, Andrew Mitchell, expressed the country's "deep disappointment" at the outcome after the 2023 law was overwhelmingly adopted by the Ugandan parliament.

An FCDO spokesperson who spoke to The guardian said,&nbsp;“The UK government has long been at the forefront of promoting LGBT+ rights internationally and is concerned by the increasing criminalisation of LGBT+ persons in Uganda which threatens minority rights and risks persecution.

Indian External Affairs Minister (EAM) Dr Jaishankar will be travelling to Uganda and Mozambique next week in an effort to strengthen India's growing engagement with Africa. This will be the first visit of the year from India to Africa by EAM and is expected to be full of outcomes and announcements. India has a long-standing relationship with Uganda and has provided significant support to the country's electricity infrastructure and agriculture sector. Additionally, India has announced a donation of vehicles to the Ugandan Peoples Defence Forces.

During his 2018 visit, PM addressed the Ugandan Parliament and outlined India’s approach to Africa and reiterated New Delhi's commitment to engage with the continent. It is estimated that at present, there are approx. 30,000 Indians/PIOs living in Uganda, of which the majority are Indian passport holders. The Indian community in Uganda, concentrated mainly in Kampala and Jinja, have presented the strongest and most durable economic and cultural links between the two countries.

In Mozambique, India's deepening economic interests in natural gas and coal industries have become the most significant driver of the bilateral relationship. Indian companies have invested heavily in Mozambique's energy resources, amounting to almost a quarter of India's total FDI in Africa. Prime Minister Modi's State Visit to Mozambique, which was his first destination in continental Africa, helped raise the level of the bilateral relationship.

The EAM's upcoming visit to Uganda and Mozambique reflects India's commitment to the African continent and highlights the country's growing economic and cultural ties to the region. The visit comes ahead of the EAM's trip to Latin America at the end of the month, where he will visit Panama, Guyana, Colombia, and the Dominican Republic to strengthen ties with the region.

EAM Jaishankar to travel to Uganda, Mozambique next week

Ugandan President Yoweri Museveni has called on African leaders to oppose "the promotion of homosexuality". This is being taken to be a hint that he will sign a controversial anti-LGBTQ+ bill passed by the country's parliament last month. Speaking on Sunday (April 2), Museveni said that homosexuality was "a big threat and danger to the procreation of human race (sic)"

The bill reportedly imposes death penalty for "aggravated homosexuality" while providing for life imprisonment for “recruitment, promotion and funding” of same-sex “activities”

The bill has attracted international criticism with the United Nation and the United States urging Uganda to take back the bill.

“Africa should provide the lead to save the world from this degeneration and decadence, which is really very dangerous for humanity. If people of opposite sex [sic] stop appreciating one another then how will the human race be propagated?” said Museveni on Sunday as quoted by The Guardian.

The bill that was passed last month makes it a crime to identify as LGBTQ. It also hands authorities broad powers to target gay Ugandans&nbsp;

More than 30 African countries, including Uganda, already ban same-sex relations. The new law appears to be the first to outlaw merely identifying as lesbian, gay, bisexual, transgender and queer (LGBTQ), according to rights group Human Rights Watch.

Supporters of the new law say it is needed to punish a broader array of LGBTQ activities, which they say threaten traditional values in the conservative and religious East African nation.

In addition to same-sex intercourse, the law bans promoting and abetting homosexuality as well as conspiracy to engage in homosexuality.

Violations under the law draw severe penalties, including death for so-called aggravated homosexuality and life in prison for gay sex. Aggravated homosexuality involves gay sex with people under the age of 18 or when the perpetrator is HIV positive, among other categories, according to the law.
