INX media money laundering case: Karti Chidambaram sent to 5-day police custody

Senior Congress leader P Chidambaram's apprehension of continued harassment to him and his family members turned out to be true with CBI arresting his son Karti Chidambaram in connection with the probe into the grant of FIPB approval in INX Media case.

Chidambaram, who was closely monitoring the case of his son in the Supreme Court which was argued by his party colleague and senior advocate Kapil Sibal, had sprung a surprise last week by filing a petition on his own accusing the CBI and the ED of carrying out a political vendetta against him and his family.

In his petition, Chidambaram has sought the apex court's direction prohibiting the CBI and Enforcement Directorate (ED) from continuing their "illegal investigations" and from acting in any manner "causing repeated harassment" to him and his family members, including his son.

However, the CBI swung into action even before his petition could come up for hearing before the top court by arresting Karti today.

In his plea, Chidambaram, himself a senior advocate, has said that the position in the INX Media case was "worse" as, though the CBI had lodged an FIR in May 2017, the probe agencies have not filed any report "concluding that any criminal offence had been committed or that any proceeds of crime had arisen out of that criminal offence".

An FIR, filed by the CBI on May 15 last year, had alleged irregularities in the Foreign Investment Promotion Board (FIPB) clearance to INX Media for receiving overseas funds to the tune of Rs 305 crore in 2007 when Chidambaram was the Union finance minister.

While the CBI has alleged that Karti had received funds to the tune of Rs 10 lakh in the case, the ED has also registered a money laundering case in the matter.

Chidambaram, in his petition before the apex court, has said that his fundamental rights were being violated due to "illegal" investigations being carried out by the CBI and the ED and the central government has been "misusing" its probe agencies.

He has said that being the Finance Minister then, he had granted FIPB approvals in the INX Media case and the Aircel-Maxis case in the "normal course of official business". In discharge of his functions, he has "never allowed any member of his family, including his son, or any other person to interfere with or influence the conduct of official business".

Chidambaram has said that the CBI and ED cannot "harass" Karti and others, who were totally unconnected with the FIPB approval by issuing repeated summons to them.

"The petitioner (Chidambaram) feels sad that his son and his business friends are being targeted," the plea said, adding, "The entire investigation being conducted by the CBI and ED is a total farce and is being made only to malign the name of the petitioner and his son in the eyes of the public".

He has also sought the apex court's direction declaring that the proceedings emanating from FIR registered by CBI in the INX Media case as well as the "premature investigation" being conducted by the ED, were "without jurisdiction, an abuse of authority, and violative of Articles 14 (equality before law), 19 (freedom of speech and expression) and 21 (right to life and personal liberty) of the Constitution which inhere in the petitioner and the members of his family, and declare the said proceedings and investigations as null and void".

Senior Congress leader P Chidambaram has approached the Supreme Court seeking protection of his fundamental rights, including the right to privacy, amid summons to his son Karti Chidambaram and raids by the CBI and the ED in connection with cases related to Aircel-Maxis and INX Media.

Chidambaram, who is also a senior advocate, has claimed in his plea that as part of "political vendetta", the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) have made "vexatious" searches and issued the repeated summons in these cases.

"The writ petition is being filed to defend and protect the petitioner?s fundamental rights under Article 14 (equality before law), 19 (freedom of speech and expression) and 21 (right to life and personal liberty) of the Constitution and to defend his right to privacy and the right to live, along with members of his family, in dignity," the petition said.

"The CBI and the ED, as part of political vendetta, have made vexatious searches, issued repeated summons, unreasonably questioned persons for unconscionably long hours, unlawfully attached fixed deposits, maliciously leaked false information to the media and otherwise caused extreme harassment, anguish and humiliation to me and my son, and to other persons who are normal business and social friends of my son,? Chidambaram said.

The Congress leader said that both he and his son have categorically denied any wrongdoing in the Foreign Investment Promotion Board (FIPB) approvals in these cases.

"Every government officer who has been examined by the CBI/ED has categorically stated that the approvals granted in these two cases were entirely in order,? he said.

The former Union finance minister also said that he was the "real target" of these "motivated actions" of the CBI and the ED, but these agencies have not accused him or other public servants of any offence in these cases.

Chidambaram raised a legal issue asking whether without an FIR naming him or his son, the CBI or the ED could probe the alleged offences against them.

He sought the top court's direction to prohibit these two agencies from continuing with "illegal" probe and acting in any manner causing repeated harassment to him, his son and family members.

An FIR, filed by the CBI on May 15 last year, had alleged irregularities in the FIPB clearance to INX Media for receiving overseas funds to the tune of Rs 305 crore in 2007 when Chidambaram was the Union finance minister. The ED has also registered a money laundering case.

The CBI is also probing the alleged irregularities in grant of the FIPB clearance to the Aircel-Maxis deal in 2006.

The author has made these claims in her memoir, 'Life Among the Scorpions: Memoirs of an Indian Woman in Public Life'. The book hints at the links between Gandhi and the Tehelka news portal, particularly in the Tehelka sting 'Operation Westend.'

"I included the letter in my book to show the truth behind accusations against me that I met with wrong people and assured them of my help in exchange for money. The wrong people were fake.
Jaitly referred to the ongoing nine-year-long corruption case against her, wherein the Central Bureau of Investigation (CBI) filed a charge sheet alleging that she had accepted a bribe of Rs 2 lakh in 2001. She was alleged to have accepted the money in exchange for persuading former defence minister George Fernandes to award the contract of hand-held thermal imagers to a company named West End International.

The case was registered on the basis of a sting, 'Operation Westend,' conducted by news portal Tehelka in 2000, purportedly exposing alleged corruption in defence deals.

There are, in total, three letters enclosed in the book. They are - a letter by Tehelka directors and a letter by Tehelka Financiers - First Global Directors addressed to Gandhi and the third letter from Gandhi to Chidambaram on behalf of Tehelka and its financiers. The book further hints that Sonia tried to convince Chidambaram to shield the Tehelka financiers.

"I positioned the letter in such a way to show that a letter was written to someone who is even above the prime minister, who then wrote to the finance minister relating their problem, and immediately the problem was solved. This is the reality unlike the allegations against me which are fake," Jaitly said, and added, "to save a person, who paid Tehelka to conduct a sting operation, there must be some connection."

The letter was written merely months after the UPA formed the government, and Sonia Gandhi declined the post of the prime minister, which was passed on to Dr Manmohan Singh.

They were so energetic. Was this the only work they had after coming in the Centre?"

Meanwhile, Congress leader Manish Tewari reacted to the entire controversy and said "Tehelka" was targeted by the NDA-BJP government for exposing the dirty dealings of their associates.

"In 2001, a news portal called Tehelka carried out a sting, in which they exposed the dirty dealings of a number of eminences associated with the NDA-BJP government, including the then BJP President Bangaru Laxman. He was caught on candid camera taking money for allegedly doing favours in a defence deal. Subsequently, the NDA-BJP govt came down like a tonne of bricks on that news portal," Tewari claimed.

The former Union Minister alleged that the news portal was hounded by the NDA government, due to which the UPA government was forced to intervene.

"It was the classical case of shooting the messenger rather than listening to the message. Exactly in the manner in which today the Enforcement Directorate, the Central Bureau of Investigation and the Income-Tax department is being abused by this government against its political opponents. In fact, a commissioner inquiry was constituted that got nowhere and on the other hand, a news organisation which had done its legitimate duty was hounded to the ground. Under those circumstances, an intervention with the right intent for the freedom of speech and expression was done at that point of time to ensure that vendetta and witch hunt comes to an end," Tewari said.

Madras HC stays lookout circular against Karti Chidambaram , four associates

The Central Bureau of Investigation has raided the Chennai homes of former union minister P Chidambaram and his son Karti Chidambaram.

Reports said the raids are linked to the allegation that a Karti Chidambaram company facilitated investment clearances for INX Media in 2008 for kickbacks.

Chidambaram denied the charges and said that FIPB approval was granted in "hundreds of cases."

He also accused the government of using investigating agencies to target his son and his friends to "silence" his voice against the government. He said there were no allegations against the five secretaries who constituted the FIPB, and the officials of the FIPB secretariat.

"All I will say is, I shall continue to speak and write," he said in a statement. "There is no allegation against me," he added.

"The government, using the CBI and other agencies, is targeting my son and his friends..The government's aim is to silence my voice and stop me from writing, as it has tried to do in the cases of leaders of opposition parties, journalists, columnists, NGOs and civil society organisations," the former finance minister said.

The CBI also searched the house of former media baron Peter Mukerjea -- who then owned INX Media -- in Mumbai as part of investigations over alleged favours granted in foreign investment clearance to the company.

Both Peter and his wife Indrani Mukerjea, founders of INX Media, are accused in the sensational Sheena Bora murder case and are lodged in jail in Mumbai. Some clues on the INX Media deal reportedly emerged from investigations into the Sheena Bora murder case when the financial transactions of the Mukerjeas were scrutinized.

The CBI conducted searches at 17 locations across the country, including New Delhi, Gurgaon, Chennai and Chidambaram's hometown of Karaikudi, as part of the probe.

Chidambaram denied the charges and said that FIPB approval was granted in 'hundreds of cases'

Chidambaram denied the charges and said that FIPB approval was granted in "hundreds of cases." He also accused the government of using investigating agencies to target his son and his friends to "silence" his voice against the government. Chidambaram raids: CBI also searches Peter Mukerjea's house

Former Indian finance minister P Chidambaram on Tuesday said it will take at least seven months for the government to replace the 500 and 1000 rupees banknotes that were ordered out of circulation on November 8.

"Take a simple arithmetic...they demonetised 2,200 (total volume) crore Rs 500 and Rs 1,000 notes. The capacity of all printing presses taken together is 300 crore notes (rpt) notes per month. So, even if you print note for note, it will take seven months. If you print smaller denominations notes like Rs 100 for Rs 500, it will take five times more time... Think somebody didn't think through... that's not unusual for government," Chidambaram said.

Speaking at a literature festival in Mumbai, Chidambaram said that the after-effects of the demonetisation decision will continue for a longer period than expected.

"You are seeing the first-order effects of withdrawing, sucking out 86 per cent of the currency in circulation from the market. The first order will continue for several weeks now. Then you will see the second-order effects."

The demonetised Rs 500 and Rs 1,000 notes accounted for over 86 per cent of the total Rs 16.24 lakh crore value of banknotes in circulation as on March 31, 2016, according to Reserve Bank of India's latest annual report.

The first order effects he explained could be seen in less consumption by people which meant that produce, especially perishable produce like vegetables, fruits, were not being sold.

The second oredr effects were already visible in places like Tirupur and Surat, where lay-offs and retrenchments have started, he said.

The 71-year-old politician further said the demonetisation move was not well thought out and wondered if the government had consulted its chief economic advisor before taking the decision.

"My suspicion is the only knowledgeable economist in the government, Dr Arvind Subramanian, was not consulted," he said.

He also said that it was too early to quantify the damage caused by the decision.

Chidambaram said that the 50 days that Prime Minister Narendra Modi had asked for the results of his initiative to show might ease the liquidity crisis for individual hands. He, however, said that it would not solve any other issues.

"The PM's time out for 50 days might ease the liquidity crisis at individual's hands, but it won't solve many other problems."
