'India’s students deserve better': Cockroach Janata Party revives petition targeting Edu Minister Dharmendra Pradhan

The Supreme Court of India on Monday (May 25) expressed disappointment over the cancellation of the NEET-UG 2026 due to paper leak, saying that it was “sad” that no lessons have been learned from previous such instances. This came as the top court heard a plea seeking the replacement of the National Testing Agency with an autonomous body for conducting the medical entrance exam in the country. The Federation of All India Medical Association (FAIMA) had moved the court challenging the alleged “systemic failure” by the NTA in conducting the exam. The court has sought a reply from the Centre, the Education Ministry, and the NTA over the matter.A bench of Justices PS Narasimha and Alok Aradhe ordered that a copy of all petitions should be served to Solicitor General Tushar Mehta. The court has also asked the NTA to file an affidavit by Thursday (May 28) on compliance with the directions issued by the court in 2024 on measures to strengthen the NEET mechanism.“We are so sad, they (NTA) haven’t learnt their lessons. We passed an order directing the constitution of a committee to give recommendations, which was accepted,” Justice Narasimha said.The court ordered, “We direct the NTA to file an affidavit indicating the position as regard to the monitoring committee constituted on 14 November, 2024. We also direct Dr K Radhakrishnan, the former chairman, to file an affidavit indicating the steps taken to ensure the compliance given by the High Powered Committtee that has given its report. The affidavit shall be filed within 3 days.”In the petition, FAIMA asked the court to direct the Centre to replace the NTA with a “more robust, technologically advanced, and autonomous body” for conducting NEET entrance exams. The plea was filed days after the NTA cancelled NEET-UG 2026, which was conducted on May 3, following an alleged paper leak. According to reports, “guess papers” circulating on WhatsApp and Telegram matched more than 100 questions in the actual question paper. The investigation has been handed over to the CBI.The plea further requested the formation of a high-powered monitoring committee headed by a retired Supreme Court judge, with a cybersecurity expert and a forensic scientist as members, to oversee the re-conduct of NEET-UG 2026 until a new independent examination authority is established.It also sought directions for re-conducting NEET-UG 2026 under the supervision of a judicially appointed high-powered committee, with the examination process to proceed only after the proposed interim oversight panel verifies and certifies the security of the revised system.Additionally, the petition called for the digital locking of question papers and a shift to a Computer-Based Test (CBT) format to remove risks associated with the physical handling and transportation of exam papers.Meanwhile, the court directed the National Testing Agency (NTA) to submit a counter-affidavit and instructed the chairman of the monitoring committee to ensure compliance with its directions. The matter has now been scheduled for a hearing on Friday (May 29).

The court ordered, “We direct the NTA to file an affidavit indicating the position as regard to the monitoring committee constituted on 14 November, 2024. We also direct Dr K Radhakrishnan, the former chairman, to file an affidavit indicating the steps taken to ensure the compliance given by the High Powered Committtee that has given its report. The plea further requested the formation of a high-powered monitoring committee headed by a retired Supreme Court judge, with a cybersecurity expert and a forensic scientist as members, to oversee the re-conduct of NEET-UG 2026 until a new independent examination authority is established. It also sought directions for re-conducting NEET-UG 2026 under the supervision of a judicially appointed high-powered committee, with the examination process to proceed only after the proposed interim oversight panel verifies and certifies the security of the revised system. Additionally, the petition called for the digital locking of question papers and a shift to a Computer-Based Test (CBT) format to remove risks associated with the physical handling and transportation of exam papers. Meanwhile, the court directed the National Testing Agency (NTA) to submit a counter-affidavit and instructed the chairman of the monitoring committee to ensure compliance with its directions. The matter has now been scheduled for a hearing on Friday (May 29).

The Central Bureau of Investigation informed a Delhi court on Thursday (May 14) that the leaked NEET-UG 2026 question paper was traced back to a source within the National Testing Agency (NTA). The revelation was recorded in an order passed by Special Judge Ajay Kumar Gupta of the Rouse Avenue Courts while granting seven-day CBI custody of five accused in the case. According to the court order, the accused Shubham Khairnar had obtained the said paper from another person from Pune, who had obtained the same from his NTA source. The CBI told the court it is now attempting to identify the NTA officials and other government personnel allegedly involved in leaking the examination paper.&nbsp;The case emerged after NEET-UG 2026 was cancelled on May 12, just nine days after more than 2.27 million candidates appeared for the medical entrance examination across 551 cities nationwide. Central agencies had confirmed that the question paper had been compromised. In its remand application, the CBI said that a PDF containing nearly 500-600 questions was circulating on Telegram as early as April 29, four days before the examination. Investigators later found that 180 of those questions were ‘precisely identical’ to the actual NEET-UG paper. The Economic Offences Unit (EOU) of Bihar Police revealed that medical aspirants had paid INR 30,00,000 to 50,00,000 each to brokers to obtain question papers before the May 5 examination.

Later, the EOU seized various documents, including bank cheques and candidate roll codes, from the accused.

“The most recent trigger for bringing the anti-cheating law is the NEET-UG paper leak. The state government was left embarrassed because of the involvement of the Nalanda solver gang. Earlier this year, there had been cancellation of teachers recruitment examination in the wake of a paper leak,” a Bihar government spokesperson was quoted as saying by local media.

Amidst the paper leak controversy, the Bihar Public Service Commission Mains examination 2022 was also postponed owing to allegations of paper leak. The constable examination 2022 was also cancelled later on.

Dr. Anuradha, a dentist from New Delhi, says that in her preparatory days, "the competition was not this high, and thus the pressures were not this intense."

Being a doctor is a matter of great pride in India. "Doctor bhagwaan hai" (Doctor is God) is a phrase all Indians have heard in their childhoods, from mothers and grandmothers.

<h2>Future Gloomy or Drab?&nbsp;</h2>

With the paper leak and the additional pressure that it has put on the doctors of tomorrow, the future looks gloomy at best.

But will the clouds clear?

"I hope that one day we will be able to have a medical system that caters to every strata of society, which it is not able to do today. The poor and rich should be treated equally," says Dr. Anuradha when asked about the future of the profession.&nbsp;

Shraddha Khullar says, "My hope is that we start treating doctors as human beings and not mere machines who are meant to work round the clock without any breaks."

You can be noble if you want to be, but the lure of money is too great for some, and thus they follow unethical means and charge unnecessarily." A doctor-to-be, Shraddha Khullar agrees. She says, "Medicine will always be a noble profession because it is meant to help people (literally and figuratively)." Future Gloomy or Drab? With the paper leak and the additional pressure that it has put on the doctors of tomorrow, the future looks gloomy at best. But will the clouds clear? "I hope that one day we will be able to have a medical system that caters to every strata of society, which it is not able to do today. The poor and rich should be treated equally," says Dr. Anuradha when asked about the future of the profession. Shraddha Khullar says, "My hope is that we start treating doctors as human beings and not mere machines who are meant to work round the clock without any breaks." Supreme Court's observations came on a petition filed by an e-learning application that claimed "inconsistent" calculation of marks on the OMR sheets.&nbsp;

A vacation bench of Justices Manoj Misra and SVN Bhatti has sought a response from NTA by July 8. This is the day when the hearing of the matter, clubbed with other petitions in the controversy, will take place.

According to the petition, several students alleged that they did not receive OMR sheets in time. The bench has asked for the NTA's response on the time limit to raise the grievances related to the OMR sheets.

The student, identified as Anurag Yadav, disclosed to the police that he received the leaked question papers and answer sheets from his uncle Sikandar Yadavendu, who orchestrated the handover in Bihar, a report by Business Today said. The papers were handed to Yadav on the night of May 4, just before the scheduled NEET exam. Yadav confirmed the questions provided (in the leaked papers) matched those in the actual examination held at DY Patil school. The Business Today report said that the 22-year-old was a student of a prominent NEET exam coaching institute in Rajasthan's Kota. The disparities in scores An investigation revealed that Yadav scored 185 marks out of the total 720, with a percentile score of 54.84. A detailed look at his scores revealed a mismatch- showing an 85.8 percentile in Physics, 51 percentile in Biology, and only 5 percentile in Chemistry, suggesting an inadequate time to memorise answers for the Chemistry questions. Both Yadav and his uncle Yadavendu have been arrested by the police. "In exercise of the powers conferred under Section 6 of the Delhi Police Establishment Act, 1946 (Act 25 of 1946), the Governor of Bihar is pleased to give his assent to the Delhi Special Police Establishment, who have been entrusted with the exercise of powers and jurisdiction in the state and other places related to the case to investigate/supervise and investigate the FIR No. 5117081240358, dated 05.05.2024, registered at the Shashtri Nagar Police Station in Patna under sections 407, 408, 409, 120 of the IPC, which relate to irregularities in the NEET (UG) 2024 examination held on May 5, 2024," the notification said. The top court said that we cannot overlook the efforts of the children who have prepared for the exams.&nbsp;

"Just imagine a doctor treating who has passed like this and needs to be checked," the top court said.&nbsp;

 
The Supreme Court told the Centre and the NTA to approach challenges regarding NEET-UG as opportunities for improvement, not hostile legal battles. The judges further emphasised the importance of acknowledging and rectifying any errors made during the exam's administration.

The top court further told the NTA, "You are conducting the examination and you must act fair. If there is a mistake, say yes, this is a mistake, and this is the action we are going to take. At least that motivates confidence in your performance."

The Supreme Court is hearing a batch of petitions&nbsp;which allege&nbsp;paper leaks, awarding grace marks and a significant increase in high scorers.&nbsp;

Notably, on June 14, the top court issued notices to the Centre and the NTA on a plea requesting for CBI investigation into the accusation of paper leak.&nbsp;

The NTA, meanwhile, said it wanted to withdraw three other petitions, which were seeking transfer of cases from high courts to the top court, as they pertained to grant of grace marks to 1,563 candidates on account of loss of time during the examination on May 5.

The counsel for the NTA said the issue has been settled and that he will be intimating the high court about the decision to cancel the compensatory marks given to 1,536 candidates and the consequential June 13 order of the top court.

Amid a raging row over the NEET-UG examination, the Centre and the NTA on Thursday told the Supreme Court they have cancelled the grace marks given to 1,563 candidates who took the examination for admission to MBBS and other such courses.

They will have the option to either take a re-test or forgo the compensatory marks awarded to them for loss of time, the centre had said.

The examination was held on May 5 across 4,750 centres and around 24 lakh candidates took it.

The results were expected to be declared on June 14 but were announced on June 4, apparently because the evaluation of the answer sheets got completed earlier.
