On the 13th anniversary of the dastardly 26/11 Mumbai terror attacks, India summoned a senior diplomat of the Pakistani High Commission and asked Islamabad to ensure expeditious trial in the case.

Around 166 people, including 25 foreigners, died in the attack carried out by 10 Pakistani militants associated with the terror group Lashkar-e-Tayyiba between November 26 and November 29.

In a note verbale handed over to the diplomat, the Ministry of External Affairs (MEA) also asked Pakistan to abide by its commitment to not allow territories under its control for terrorism against India.

“It is a matter of deep anguish that even after 13 years of this heinous terror attack, the families of 166 victims from 15 countries across the globe still await closure, with Pakistan showing little sincerity in bringing the perpetrators to justice," it said in a statement.

The MEA asserted that the terror attack was planned, executed and launched from Pakistan’s territory.

‘Even after 13 years’: India summons Pak diplomat over delay in justice to 26/11 victims

On November 26, 2008, India was rocked by a series of terrorist attacks when members of Lashkar-e-Taiba, a Pakistan-based terrorist organisation, carried out 12 coordinated shooting and bombing attacks in Mumbai. A total of 175 people died, including nine attackers and more than 300 were wounded during the attacks that lasted for four days as it ended on November 29 when India's National Security Guards (NSG) conducted Operation Black Tornado to kill the remaining terrorists. He was hanged in Pune's Yerwada jail in secret on November 21, 2012, after he had exhausted all legal remedies. The attacks drew global condemnation but many raised questions also over delayed response while tackling the deadly attacks. Even the High-Level Enquiry Committee (HLEC) on 26/11 pointed out lapses in the law enforcement agencies and suggested measures to prevent such events. But why was there a delay? Many would not know that a nine-member high-level team, required for taking key decisions during the attacks, was in Pakistan. The team comprised of officials from India's Home Ministry and other security agencies, led by no less than then Union Home Secretary Madhukar Gupta. RSN Singh, who is a former military intelligence officer and later served in the Research and Analysis Wing or R&AW, wrote in the Indian Defence Review that it was a "classic case of strategic deception by Pakistan". ALSO READ | Where Afghanistan's new Taliban leaders went to school The team had arrived in Islamabad on November 24, 2008 and was supposed to return two days later, i.e. November 26. However, the visit was extended by an extra day. The extra day was in Murree, which is a hill station, 60km northeast of Islamabad. Reports have even suggested that the team had no means of communication in that location. Key decision-makers, including the Union Home Secretary, the Joint Secretary, Internal Security, the Director, Internal Security, among others were said to be in Murree. Their designations and identities cannot be disclosed for reasons of security and secrecy. After media reports claimed Murree stay was a "party", former home secretary Madhukar Gupta, in 2016, rejected the charges of enjoying Pakistan's hospitality. In 2016, he had also said that they found the gesture of the Pakistan government odd, adding that their "duplicitous role was absolutely clear, it's not the first time". He had also told The Times of India that Pakistan had insisted they meet their Interior Minister and that's the reason for their extended stay. In retrospect, it leads us to suspect if the real motive was to delay or weaken the response of Indian security brass to the 26/11 strikes," a former bureaucrat had told The Times of India in 2016. However, Madhukar Gupta had dismissed reports that there was no television signal in Murree as he said that he had received a call from India about the attacks and immediately switched on the TV. He informed that he had contacted the senior leadership in India also. So many questions have been raised; why the visit was extended? Why the team was shifted to a hill station? Did Pakistan government officials know about attacks? Coincidence or conspiracy?

The Indian government will give time to the investors to exit from the unregulated cryptocurrency market if the law banning their trade is enacted, according to a newspaper report citing officials familiar with the development.

The Narendra Modi-led government has tabled the “Cryptocurrency and Regulation of Official Digital Currency Bill, 2021” for the upcoming winter session of Parliament.

The bill, once passed in the parliament, will “prohibit all private cryptocurrencies in India,” with “certain exceptions to promote the underlying technology of cryptocurrency and its uses”. The session is scheduled to start on November 29.

According to the Hindustan Times (HT), which cited two officials close to the development, the investors would be given a buffer time to liquidate their investments, but a tax would be levied on the disinvestment under the capital gains tax rule.

The capital gains tax is imposed on the profit from an investment when a sale of the capital asset takes place. Indian crypto investors may get exit time if govt bans trade, but with a rider: Report

A judgement by an Indian high court lowering the sentence of a man who is convicted of forcing a 10-year-old boy to perform oral sex has caused outrage across the country.

The Allahabad High Court in the northern Uttar Pradesh state had ruled that the man's offence did not fall under the stringent the Protection of Children from Sexual Offences (POCSO) Act’s definition of “aggravated penetrative sexual assault”, which carries a jail sentence of minimum 10 years.

Instead, the court said the offence should be viewed as “penetrative sexual assault" - a lesser offence that carries a minimum seven-year jail term.

Justice Anil Kumar Ojha of the Allahabad High Court passed his order on November 18, in which he upheld the conviction but questioned which section of POCSO would be applicable.

“Perusal of the record reveals that informant and victim have supported the prosecution story and the evidence of prosecution witnesses are cogent, trustworthy, credible and probable, hence, finding with regard to conviction is confirmed,” he said.

The order caused outrage across India with many calling the judgement regressive.

India's Foreign Secretary Harsh Vardhan Shringla, on Wednesday (November 24), said that India is assessing all the options in regard to the trade ties with China but only after ensuring that country's integrity and security remain intact.

During an interactive session organised by the Indian Chamber of Commerce, Shringla said, "Trade continues, there are investment ties that continue but all of this has to be examined very carefully and the government is examining all these options very, very carefully to ensure that our integrity and security remain intact."

However, the diplomat also explained why India is unable to conduct normal relations as China has maintained an aggressive posture and attempted multiple transgressions along the border in eastern Ladakh.

He said, "And as a result, we are not able to conduct normal relations. Having said that, of course, trade continues, import and export continues, China continues to be an economic partner," he said.

"But obviously we need to today evaluate whether we are over extended in terms of our supply chains, in terms of our investment tie-ups, in terms of the technology that we get," he said.

"We need to examine all of those very carefully to see that it is in keeping with our larger strategic and security interests and that obviously, as we move forward, our own economy grows, our own interactions grow," Shringla said adding that India needs to ensure that it is not vulnerable in any way.

On the origin of bilateral ties, the foreign secretary said the objective of India restarting the relations with China in 1988 was to allow normal business to be conducted without the border issue coming in the way of the relationship.

"In other words, we would have trade, commercial ties, scientific and technological ties, people-to-people contacts but we would isolate the border issues that would be discussed separately through the special representatives of both countries," he said.

"But of course, that was predicated on peace and tranquillity being maintained in the border areas," he added.

In a bid to reassure Americans angry about inflation and goods shortages as they prepare for Thanksgiving -- and to lift his poll ratings -- President Joe Biden on Tuesday tapped the US strategic oil reserves.

Biden announced this coordinated plan to release 50 million barrels of crude from the country's oil reserves onto the market, hoping to ease the growing discontent about inflation and fuel costs.

The White House said that following weeks of negotiations, "this release will be taken in parallel with other major energy consuming nations, including China, India, Japan, Republic of Korea and the United Kingdom."

Even as the US economy bounces back from the COVID-19 lockdowns, supply chain disruptions and inflation are stirring fears as the holiday season begins with Thanksgiving on Thursday.

"Moms and dads are worried asking will there be enough food we can afford to buy for the holidays? Will we be able to get Christmas presents to the kids on time?" Biden said, acknowledging that for many the price rises are "painful."

Critics, however, accuse him of failing to grasp the challenge.

The president pushed back on critics by noting that the two biggest trading ports, both located in southern California, were now working 24/7, as opposed to just 40 hours a week.

A cemetery in Xinjiang which houses the tombstones of over 100 Chinese soldiers who died during the 1962 Sino-India war and in the Galwan Valley clash last year has been designated as “patriotic education base”.

According to a report published by the PLA portal, the Kangxiwar Martyrs’ Cemetery— located 4,280 metres, or more than 14,000 feet, above sea level in the Karakorum mountains— is currently undergoing large-scale renovation after it was designated “education base” by the Xinjiang government in September.

The cemetery is reportedly the first such “patriotic education base” in connection with Sino-India military history.

According to the PLA portal, the renovation work would be completed by November next year.

The move by the government base comes in the backdrop of the arrest of a Chinese travel blogger who managed to enter the site in July and clicked selfies, triggering a backlash in the country.

On November 15, the blogger was jailed for seven months after he was accused of “dishonouring the dead soldiers”.

The Kangxiwar Martyrs’ Cemetery located in the Xinjiang Uighur Autonomous Region (XUAR), is China’s highest cemetery.

Located some 100km from a stretch of the disputed Sino-India border, it was built in 1965 to commemorate PLA soldiers killed in the 1962 India-China war.

Currently, it houses gravestones in memory of 108 Chinese troops, including four who China acknowledged were killed in Galwan Valley in June 2020 during the border clash with Indian soldiers. The remains of many have also been moved to the deceased’s hometowns.

In the Galwan clash, over 20 Indian soldiers were killed, while the Chinese officials have only acknowledged the death of four soldiers, various US reports and Indian agencies speculated the toll figure could be in the mid-30s.

The clash was triggered when China unilaterally attempted to change the status quo on the borders.

(With inputs from agencies)

India reported 7,579 new coronavirus infections on Tuesday, the smallest rise in one-and-a-half-years despite huge festival gatherings in recent weeks, thanks to rising vaccinations and antibodies from prior infections.

The country of 1.35 billion celebrated Durga Puja in October and Diwali this month, during which millions of people shopped, travelled and met family, mostly without masks.

Mask-wearing is nearly non-existent outside the big cities.

"Even after Diwali, we are not seeing a surge," said M.D. Gupte, a former director of the state-run National Institute of Epidemiology, attributing it mainly to the presence of antibodies in a huge majority of Indians through natural infection.

"I think we are much safer now."

Government surveys have estimated that nearly 70% of Indians had been naturally infected by July, following a record rise in infections and deaths in April and May.So far, 81% of India`s 944 million adults have received at least one dose of vaccine and 43% have had two doses. Vaccination for people under 18 has not yet begun.

India has reported a total of 34.5 million COVID-19 cases, second only to the tally in the United States. India`s COVID deaths rose by 236 in the past 24 hours to 466,147.

Daily testing has also fallen, dipping below 1 million on Monday compared with a capacity of more than 2 million.

In a significant break from protocol, Indian Defence Minister Rajnath Singh on Monday visited the Bangladesh high commission in Delhi on the occasion of the Armed Forces Day of Bangladesh.

He was accompanied by Chief of Defence Staff Bipin Rawat, Indian Army chief General MM Naravane, Air Chief Marshal Vivek Ram Chaudhari and Navy Chief Admiral Karambir Singh.

Bangladesh’s Armed Forces Day is observed every November 21. It was on this day in 1971 that the Battle of Garibpur began, in which Indian and Bangladeshi liberation forces came together against the Pakistani forces.

This year marks 50th anniversary of Bangladesh’s war of liberation that resulted in the emergence of the modern state of Bangladesh. The year is being celebrated both in India and Bangladesh.

Paying tributes to the “sacrifices made by the brave soldiers of the Indian Armed Forces, who stood steadfast with their Bangladeshi brothers and sisters”, the defence minister said, "The extraordinary leadership in India rose to the occasion against all odds and limitations in 1971, in support of a struggling nation fighting against the injustice and unspeakable atrocities perpetrated by the Pakistani Army."

The defence minister highlighted that “Indian Armed Forces and paramilitary forces worked together with the courageous Muktijoddhas (the fighters of the 1971 Bangladesh Liberation War) in their valiant struggle. In the course of the conflict, more than 1,650 brave Indian soldiers made the supreme sacrifice".

“I am glad that the cooperation between the Armed Forces of both countries is steadily progressing, by way of several activities - defence dialogue, staff talks, joint training, exercise and high-level exchanges. Defence cooperation between India and Bangladesh has increased with New Delhi extending USD 500 million Defence Line of Credit to further consolidate ties,” Singh said.

A tri-service contingent from Bangladesh Armed Forces participated at the Republic Day Parade in New Delhi this year. Similarly, a marching tri-service contingent of 122 members from India is expected to participate at the Victory Day Parade in Dhaka on 16 December 2021.

Earlier in March this year, Indian Prime Minister Narendra Modi visited Dhaka to mark the 50 years of Bangladesh’s Independence.

Sun is hot, really hot. The surface of the sun is burning at more than 5000 degrees Celsius. At the core, it is even hotter. But group of Indian astronomers have now found stars that are hotter than the Sun.

These stars, eight in all, belong to a rare class called 'MRPs' or Main-sequence Radio Pulse emitters. The Pune-based astronomers have discovered the stars by using Giant Metrewave Radio Telescope (GMRT) located near Pune.

The group of scientists, led by astronomers from the Pune-based National Centre for Radio Astrophysics (NCRA), discovered the rare class of radio stars that are hotter than the Sun with unusually strong magnetic fields and much stronger stellar wind, it said. In a press release, the NCRA said the team had also discovered three more such stars in the past using the GMRT. Thus, of the total 15 MRPs known so far, 11 were discovered with the GMRT, of which eight were discovered in 2021 alone, thanks to the wide bandwidth and high sensitivity of the upgraded GMRT, the release said. "These discoveries are the fruits of an ongoing survey with the GMRT, which was launched specifically for the purpose of solving the mystery of MRPs," it said.

The success of the GMRT programme has revolutionised the notion about this class of stars, and has opened up a new window to study their exotic magnetospheres, the NCRA said.

The MRPs are stars hotter than the Sun with unusually strong magnetic fields, and much stronger stellar wind. Due to this, they emit bright radio pulses like a lighthouse, the research outfit said. Though the first MRP was discovered in 2000, it was only due to the high sensitivity of the upgraded GMRT (uGMRT) that the number of such stars known have increased multiple times in recent years, with 11 of the 15 discovered using the high-tech telescope, the NCRA said.

The success of the survey with the uGMRT suggest that the current notion that MRPs are rare objects may not be correct. Rather, they are probably more common, but are difficult to detect, it said. This is due to the fact that the radio pulses are visible only at certain times, and the phenomenon is mostly observable at low radio frequencies, the release said.

"This is the frequency range where the uGMRT stands out as the most sensitive telescope in the world. The high sensitivity of the uGMRT and its ability to make high resolution images were instrumental in enabling the recovery of the pulsed signal from the different types of radiation coming from the sky.

"This, combined with a strategic observation campaign, allowed the astronomers to overcome the difficulties, and reveal the true nature of these objects," the release said.

Despite repeated pleadings and warnings from government agencies and experts, people continue to take cybersecurity and cyber theft lightly.

According to a new research report by NordPass, the most commonly used password around the globe numeric passwords are 123456, 123456789, 111111, and 12345—which would take only a second to crack the code.

Simple passwords such as qwerty, password, dragon, and money were also found to be used commonly, the report states.

In fact, ‘password’ was the second-most preferred one in Australia, the United States and Canada. The most commonly used password in the US and Russia is ‘123456’.

The situation is similar in India as well. Among the widely used passwords include—“password”, 12345, 123456, 123456789, 12345678, india123, 1234567890, 1234567, qwerty, abc123, iloveyou, xxx, ‘krishna’ and ‘omsairam among others.

All of which takes less than a minute for a hacker to figure it out, except for india123, which takes around 17 minutes to be cracked, according to NordPass.

The report further notes that a majority of people around the world use their own names as passwords.

The list of passwords was compiled from 50 countries in partnership with independent researchers specialising in research of cybersecurity incidents. They evaluated a 4TB database for the analysis.

"It's important to understand that passwords are the gateway to our digital lives, and with us spending more and more time online, it's becoming enormously important to take better care of our cybersecurity," said NordPass CEO Jonas Karklys in a statement.

"Unfortunately, passwords keep getting weaker, and people still don't maintain proper password hygiene," he said.

In its advisory, NordPass says that one can secure their account by using complex passwords—with combinations of upper and lowercase letters, numbers and symbols— and updating them regularly.

Do you know what is the most commonly used password around the globe?

Ambassador of France to India Emmanuel Lenain has said that all contracted Rafales to be delivered to India by April 2022. France and India have formed key partnerships in defense. Speaking to our principal diplomatic correspondent, Sidhant Sibal on board the French Navy ship Chevalier Paul he said, "We feel that we are country of the region... we feel we are India's neighbour... we have territories in the region". He also spoke on the AUKUS pact, calling it a "surprise and major disappointment" and was "a major breach of trust". The AUKUS pact between Australia, US, UK allows Canberra to acquire nuclear submarines even as the previous deal with France was called off.

WION: How do you see Indo-French Relationship? The two heads met recently on the sidelines of G20 in Rome.

Emmanuel Lenain: All along since past two years, we have been talking over phone due to Covid crisis. There is an exceptional level of trust and confidence between the two leaders. They share the same aspiration for strategic autonomy for their country.

WION: Defence has become a key pillar in this relationship. In fact, it's also being said that France might replace Russia when it comes to India's defence relationship. How do you see this relationship prospering & the two countries engaging in future?

Emmanuel Lenain: I would say it's nothing new. We have been cooperating for decades now. First jet aircrafts were supplied in 1950s k/a 'TOOFANI' and since then, we have been cooperating on Jaguar, Mirage 2000 and now Rafale.

Same goes for navy, we have had outstanding cooperation. Varuna Naval Exercise was held recently. La Pérouse was in April this year along with QUAD countries.

WION: How do you see arrival of Chevalier Paul in Mumbai?

Emmanuel Lenain: It's a nice symbol of our joint commitment to ensure security and freedom of navigation in the Indo-Pacific. We want to do more in this regard. This isn't a pure visit by a ship of the French Navy.

It was also the occasion to have two-day exercise where we have been texting planes from both countries (16 of them), testing the ability of India and its capability to resist an attack from the air successfully. I think it's been very encouraging to see it.

WION: Can you give us details about the Rafale jet arrival in India.

Emmanuel Lenain: Most of them have arrived and it’s a matter of pride for us. Despite all the hardship of last two years during the COVID-19 crisis, we have been able to deliver on time. In France, teams have been working extra shifts to be able to fulfill the commitment. As of today, 30 have been delivered to India. So, we are on time and we are going to reach the target of having all the 36 delivered by April of next year.

WION: You are among the first countries to have come out with a statement on the vision regarding Indo-Pacific Region. What kind of role can the French play in the region?

Emmanuel Lenain: We feel that we are a country of the region. We feel we are India's neighbour. We have territories in the region with substantial area and withholding two million French people. We have second Economic Zone worldwide, which is something very important. We also have 7,000 troops in the region and ships ensuring freedom of navigation.

So, we see we have a very big role to play in the region. We have a role alone as well as with European partners as you may have seen we have been a driving force to craft European Indo-Pacific Strategy, which has been very recently announced and which is going to be our common framework for the future.

It's a very broad and ambitious strategy. Obviously on military aspects as well as everything pertaining to infrastructure, connectivity, etc, I think how we have to deal with the global strategy.

WION: What do you think about impact of AUKUS with regard to trilateral talked about, India-France-Australia?

Emmanuel Lenain: AUKUS was a surprise and major disappointment. It will take some time to draw the consequences of the pact. It's not a commercial issue as you know. It's a major breach of trust between allies and that's something which is very important.

Now, our commitment to security in Indo-Pacific is total. It doesn't change it and on contrary, it may increase it. We know we are on the same page and we have partners like India and we also want to speed up because we share the same vision.

We don't want any other country to provide us our security. We want our means, our autonomy. We are a sovereign country and want to decide our own future.

We believe in global strategy and don't believe in purely military confrontation block against block strategy. We think many countries in the region share same feeling that this would increase tension in the region. We don’t want to see it.

We feel that strategy must be a holistic one that we need not only to build some military assets but also provide alternative and positive ones. Countries in the region want to develop, which is legitimate. They want to build infrastructure, roads, ports, means to finance them. We want to be there with India to provide this alternative and have more global strategy with India and our European partners.

WION: What about counterterrorism?

Emmanuel Lenain: Our cooperation on counterterrorism is very strong. Both nations have been a victim of it. It's a very operational cooperation. Our agencies share inputs, intelligence through best practices. Our elite teams are working together with Black Cats and NSGs. We are also working on multilateral framework in UNSC and India's presence in UNSC this year is very important.

We are proponent of the idea and we would like to see India getting a permanent seat in UNSC. Our cooperation has made it possible to enlist terrorists like Massoud Azhar in sanctions list. It's also true that we want to tackle the roots of terrorism like attacking on the financing of terrorism. India has accepted to host the next summit or conference on 'No Money Against Terror', which is the process started by France three years ago.

WION: Can we see some high-level engagement in physical terms?

Emmanuel Lenain: The two leaders are very eager to meet in person to have a substantive discussion. In the near future, this can take place. I won't be surprised.

India and China will hold the the14th round of talks on resolving the eastern Ladakh border standoff on Thursday.

The talks will be held under the Working Mechanism for Consultation and Coordination on India-China Border Affairs (WMCC).

There are three major friction points between India and China: Pangong lake, Gogra point and Hot Springs area.

The two sides completed the disengagement process on the north and south banks of the Pangong lake in February and in the Gogra area in August.

According to reports, the 14th round of talks is likely to focus on disengagement from the Hot Springs area and Depsang plains.

The last round of military talks on October 10 ended in a stalemate. At that meeting, India said the Chinese were not being accommodative.

“The Indian side made constructive suggestions for resolving the remaining areas, but the Chinese side was not agreeable and also could not provide any forward-looking proposals. The meeting thus did not result in resolution of the remaining areas,’’ the MEA had then said in a statement.

The stand-off between India and China erupted on May 5 last year following a violent clash in the Pangong lake area between both the country’s soldiers.

Both sides had then amassed troops at the border anticipating further clashes. The stalemate ensued for several months, until it was decided to disengage at the border.

Each side currently has around 50,000 to 60,000 troops along the LAC.

Did Lord Mountbatten, the last viceroy of India, influence the India-Pakistan partition?

The allegation was raised by a British author before a tribunal in London which is hearing a case against the UK government whether to fully disclose the remaining confidential diaries and correspondence of Lord and Lady Mountbatten, according to media reports.

Clara Hamer, representing British author Andrew Lownie, who is seeking full disclosure of the confidential papers, told the First-Tier Tribunal (Information Rights) that Mountbatten’s diary revealed that he met British judge Sir Cyril Radcliffe, who headed the Boundary Commission to demarcate the India-Pakistan border, and Christopher Beaumont, its secretary, on July 12, 1947.

They wanted to know whether that particular information, which might hint at Mountbatten’s role in the partition, was deliberately redacted by the British government when the author sought the release of documents citing the Freedom of Information clause.

They further alleged that the UK government opted to withhold that information as it might jeopardise their relationship with India.

Hamer also questioned why Mountbatten’s diary entry from August 6, 1947 — one week before the Independence — has also been redacted.

The confidential Mountbatten dairies are currently placed at the University of Southampton’s archival section named Broadlands Archive.

In 2011, the university purchased the diaries from the Mountbatten family, using public funds of over 2.8 million pounds and with the intention of making the papers widely available.

However, the university then referred some of the correspondence to the Cabinet Office.

In 2019, the Information Commissioner's Office (ICO) had found in favour of Lownie and ordered the release of the entire Broadlands Archive - which also includes “letters from Lady Mountbatten to Jawaharlal Nehru, the first Prime Minister of the newly independent India (33 files, 1948-60), along with copies of his letters to her.”

The University of Southampton had explained in response at the time that the correspondence between Lady Mountbatten and Nehru remained in private ownership and is "confidential but the University has a future interest in it".

That decision of the ICO has since been appealed, which is now being heard in the First-Tier Tribunal this week.

Maldives on Wednesday issued a statement denouncing attempts to spread false information about India using so-called 'India out' slogan on social media. Maldives government said that false allegations regarding ties with one of the country`s key bilateral partners are misguided and unsubstantiated.

"The Government firmly believes that these views are not the sentiments of the general public, but rather that of a small group of individuals with the objective of tarnishing the country`s long-standing cordial ties with India," said the statement of the Government of Maldives.

The statement made a mention of strong bond the two countries shared

"The strong bilateral relationship between the Maldives and India is based on shared historical and cultural ties, matched by dynamic people to people contact. India has always been the Maldives` closest ally and trusted neighbour, extending constant and consistent support to the people of Maldives on all fronts," it said.

The statement also laid emphasis on maritime security that is aimed at strengthening the strategic partnership between the two countries and ensuring the safety and stability of the Indian Ocean region.

"Support provided by India, on areas such as search and rescue capabilities, casualty evacuation, coastal surveillance, and maritime reconnaissance, directly benefit the Maldivian people. The Government of Maldives has also established partnerships with other countries in similar areas of cooperation, to enhance technical and strategic capacities," said the statement.

The Maldives also reiterated the gratitude of the Government and the people of the Maldives for the countless assistance provided by India over the years, particularly, on instances such as the 1988 mercenary attack on the country, the 2004 Asian Tsunami, the 2015 Male` water crisis and during the ongoing COVID-19 pandemic.

Soon, India will get its first openly gay person as a judge of a high court.

According to reports, the Supreme Court collegium has recommended the elevation of senior advocate Saurabh Kirpal as a judge in the Delhi high court.

If the recommendation is approved by the central government, Kirpal will be the first openly gay judge of a constitutional court in India.

“The Supreme Court Collegium, in its meeting held on 11th November, 2021, has approved the proposal for elevation of Shri Saurabh Kirpal, advocate, as judge in the Delhi High Court,” read the collegium’s resolution stated.

49-year-old Kripal has been an advocate for LGBTQ rights in India. He was the lawyer for Navtej Singh Johar and Ritu Dalmia, the two petitioners who fought against the removal of Section 377 of the Indian Penal Code which criminalises homosexuality.

It was in this landmark case that the Supreme Court decriminalised homosexuality in India in 2018.

However, this is not the first time that he was recommended for the judge post. Earlier in 2017, the intelligence officials were tasked to carry out mandatory background check on him after his name was recommended.

But his elevation was deferred after the officials came out with an adverse report in 2018 and 2019, suggesting Kirpal’s partner, who is a foreign national, might pose a security risk.

In March 2021, former Chief Justice of India (CJI) Bobde, writing to the Union government, sought additional information and more clarity on its reservations over his elevation.

But the government reiterated its apprehensions against his partner in April.

Later that time, Kirpal was designated as a senior advocate by the Delhi high court after all 31 judges of the high court unanimously endorsed his designation.

Following the recommendations by the judges of Delhi high court, the current CJI justice Ramana and the four other most senior judges of the collegium, after consulting the other judges in the top court, decided to send Kirpal’s name for appointment as a judge in the Delhi high court.

India likely to get first openly gay person as judge of high court

India’s Bimal Patel, who has been elected to the UN’s International Law Commission, has called for regional voices from Africa and Asia in the international law-making process.

Professor Patel, who is also the vice-chancellor of Rashtriya Raksha University, Gujarat, and a member of the 21st Law Commission of India, has been elected for 5 years, starting from January 1, 2023.

Speaking exclusively to WION's diplomatic correspondent Sidhant Sibal, Patel said, “Until and unless due importance to regional voices, be it, Africa, Asia, are not given in the international law making process, the laws can hardly have any appeal or the utility to the international community as a whole."

He got overwhelming support during the election, with 163 votes in 192 members present and voting. India topped in the Asia Pacific group.

International Law Commission, which holds its session in Geneva, has 34 member countries. The commission deals with the codification of international law. Laws like the Rome statute, and UNCLOS owe their origin to the proposals by the commission.

WION: Your first reaction to you being elected to the international law commission?

Patel: It is my great pleasure and honour. I thank our honourable PM (Modi), Home Minister (Amit Shah), External Affairs Minister (S Jaishankar) and the entire ministry for having faith in me and for their efforts in securing the highest votes for India for the term 2023-2027. It is a matter of great pride. I would like to live up to the expectations of the country with utmost sincerity, hard work and commitment.

WION: You met the leadership in Delhi. What was their message to you?

Patel: There is a huge revival and importance of international law. The international law is not just for development, but also for security, and in some cases important to the very survival of nation-states. So, international law has never received so much importance as of now especially in India, which is increasing its quality footprint in terms of brining a global voice, not just for India but also in similarly situated countries. To develop international law as a common language to resolve a number of problems and forge international cooperation and friendship, thereby the Ministry of External Affairs and the country is looking forward as to what international law has for the country and how international law can become a vehicle for cooperation and friendship.

WION: Can you tell us a bit about the importance of the commission?

Patel: International Law Commission (ILC) is a subsidiary organ of the United Nations General Assembly. Thirty-four members are elected every 5 years for a term 5-year term. The main aim of the commission is to study the codification of international law and progressive development of international law. The international law commission studies and proposes to the General Assembly and to the UN member states what the new legal instruments should look like--treaty, resolution or simply report. Depending on the requirement of the international community an independent expert body proposes to the UN member how legal instruments will directly benefit the member states in future while promoting UN charter and aims. The ILC holds great importance in international law making, execution and interpretation. By studying the concerns of member states, we bring the needs, interests and concerns to the ILC, and to UNGA. ILC is one of the prestigious and significant conventions. The UNCLOS, which we call as the constitution of the ocean, was very much the work of the International Law Commission.

WION: What does India brings to the table here at the ILC

Patel: India brings a unique perspective as one of the most important and principal legal systems. This combination of legal system and oldest civilization, if we look at the entire south Asian sub-continent, it brings the convention, the treaties and norms that evolved in practices and all the countries in South Asia hold importance in the international law making. I must emphasise that while I was interacting with delegates in New York for the elections, our honourable PM's vision of ‘Vasudhaiva Kutumbakam’ (whole world is one family) has been actualized by people at the International Law Commission. And PM's vision of ‘Sabka Sath Sabka Vikas’ (everyone's support, everyone's development), the pandemic has made us realise the importance of this mantra. I will try to put forward these mantras given PM at the ILC. Until and unless, due importance is not given to regional voices like Africa, Asia in the international law making process, international law can hardly ever have the appeal or the utility to the international community as a whole. Therefore, I believe international law has never received such an unprecedented importance, and as a member of ILC, I am duty-bound to bring the regional voices into the functioning of the International Law Commission.

WION: What is the future of international law, particularly in new sectors like cryptocurrency?

Patel: Yes, in all these newly emerging sectors, like cryptocurrency, it has direct importance. We are talking of an investor and the state’s arbitration powers. Like the pandemic, we never expected a medical health issue to occupy such an importance in the international legal community. The same is the case with cyber security and data privacy, the responsibility of international organizations is immense. So, these are the new areas where we believe international law can have a significant influence, similar to the ones like the WHO. We will be working with sector-specific organizations to make sure that sectoral inputs get fine-tuned and translated into the development of international legal product and guide the member states as to how they should conduct themselves in resolving or framing issues.

WION: What does India brings to the table here at the ILC Patel: India brings a unique perspective as one of the most important and principal legal systems.

Exclusive: Need Asian, African voices to be heard at international law making process, says Prof Bimal Patel

What is the cost of keeping a secret? The UK government is paying 600,000 pounds (around $800,000) for the same purpose.

The secret: Diaries of Lord Mountbatten and his wife Lady Mountbatten, and some correspondence between the two.

The UK government is trying to bury these papers, especially from the Partition years, and paying that amount in a court battle against British author Andrew Lownie, out of fear that it could damage the reputation of the British royal family, and jeopardise the relationships between UK, Pakistan and India.

Mountbatten was the great-grandson of Queen Victoria. He was a royalist and like every proud royalist, he went on to serve the Royal Navy.

He commanded the Navy during World War II and held various positions in the British Raj. He also became the last viceroy of India.

It was in Delhi in 1922 that Mountbatten met a young woman, Edwina. They then decided to get married, which allegedly had many ups and downs.

It was claimed that the two had affair with other people.

The Mountbatten couple’s marriage was no secret by the way. So, what is that the British government is trying to hide?

One of Lady Mountbatten’s close friends was Jawaharlal Nehru, India’s first prime minister.

In one of her letters to Nehru, to which WION has access, it was written, “I hate to see you driving away this morning. You left me with a strange sense of peace. Perhaps, I have brought you the same?”

“Life is a dreary business,” replied Nehru.

The Mountbatten papers are a treasure trove. There is history and reportedly a lot of scandals.

So, a few years back, when Lownie asked for unrestricted access to these papers, the government refused to oblige him.

But Lownie didn’t take no for an answer. He cited British’s Freedom of Information law and forced the government to release the Mountbatten papers, at least 99.8 per cent of them, while refusing to disclose the rest of them.

The unreleased papers reportedly document the years from 1947 and 1948, including the diaries of Lord and Lady Mountbatten and some correspondence between the two.

This couple had the habit of putting unfiltered thoughts to paper. Both maintained diaries, both poured their hearts out in letters.

This is what Lord Mountbatten wrote to his wife in 1942: “Edwina darlingest, I feel terribly having had to desert you twice during the most trying week of life. I am afraid, as I once told you before, you shouldn’t have married a sailor. I am not particularly fond of saying nice things and I can’t hope to compete with most of your other admirers. But this I felt that I must say that I thought you were really grand and very sweet & lovable.”

Mountbatten had overseen India’s partition. His diaries could reveal details that Britain is not comfortable sharing. They may have Mountbatten’s view of Nehru, Mohammed Ali Jinnah, Mahatma Gandhi and Sir Cyril Radcliffe, the man who drew the boundary between India and Pakistan.

Mountbatten, a very influential member of the Royal family, was a maternal uncle of Duke of Edinburgh Prince Philip.

He was like a father figure to the Prince of Wales, Prince Charles, the two were very close. Mountbatten is believed to have played a very big role in Prince Charles’ personal life, be it his affair with the then-girlfriend Camila Parker Bowles or his marriage with Diana.

The Royal Family lovingly called Mountbatten “Uncle Dicky”. They knew about his habit of maintaining a dairy. They too had their documents.

But who in the family would have thought that Uncle Dicky’s diary would once day start draining public coffers? So far, the UK govt has spent $800,000 in protecting them, trying to hide Mountbatten’s thoughts from the world.

Right now, a trial is underway in London which will determine whether all of the private diaries and letters of the should be released to the public despite concerns by the UK cabinet office.

Terrorists enjoy free pass in Pakistan, which has an established history and policy of actively supporting them and holds the ignoble record of hosting the largest number of militants proscribed by the UN Security Council, India has said, slamming Islamabad at the UN Security Council.

"I'm constrained to take the floor once again to respond to some frivolous remarks made by the representative of Pakistan earlier today," Counsellor in India's Permanent Mission to the UN Kajal Bhat said in the UN Security Council on Tuesday.

"This is not the first time the representative of Pakistan has misused platforms provided by the UN to propagate false and malicious propaganda against my country and seeking in vain to divert the world's attention from the sad state of his country where terrorists enjoy a free pass while the lives of ordinary people, especially those belonging to the minority communities are turned upside down," she said.

India's Deputy Permanent Representative to the UN Ambassador R Ravindra had already delivered the national statement at the UNSC open debate on 'Maintenance of International Peace and Security Through Preventive Diplomacy'.

Bhat took the floor to make a second statement in the Council after Pakistan's Ambassador to the UN Munir Akram raked the issue of Jammu and Kashmir in his remarks at the open debate.

"India desires normal neighbourly relations with all countries including Pakistan, and is committed to addressing outstanding issues, if any, bilaterally and peacefully in accordance with the Simla agreement and the Lahore declaration.

"However, any meaningful dialogue can be held only in an atmosphere free of terror, hostility and violence. The onus is on Pakistan to create such a conducive atmosphere. Till then India will continue to take firm and decisive steps to respond to cross-border terrorism," she said.

Bhat, who hails from Jammu and Kashmir, said in her remarks that UN member states are aware that Pakistan has an "established history and policy" of harbouring, aiding and actively supporting terrorists.

"This is a country which has been globally recognised as one openly supporting, training, financing and arming terrorists as a matter of state policy. It holds the ignoble record of hosting the largest number of terrorists proscribed by the UN Security Council," she said.

Categorically stating India's position, Bhat said the entire Union Territory of Jammu and Kashmir and Ladakh were, are and will always be an integral and inalienable part of India. "This includes the areas that are under the illegal occupation of Pakistan."

India called upon Pakistan to immediately vacate all areas under its illegal occupation.

COP26 climate meet ended with a deal that talks about a 'phase down' of coal. Several parties are contending that India was among those who sought a change from 'phase out' to 'phase down' of the controversial fuel. But is the criticism really justified?

The outcome of COP26 in Glasgow is the first one focused on coal, and not the entire gamut of fossil fuels. Basically the overt attention to coal hid the dependence of much of the developed world on the major cause of emissions: oil and gas.

At the crunch talks, it was China which was more insistent on removing the 'coal phase out' terminology. India's contention was that a focus only on phasing out coal, and not oil and gas, would affect development of countries like itself that depend on coal for fuel.

In fact, China's advocacy for 'phasing down' of coal came after it entered into a coal-related deal with US, just days ago.

The two countries had first used the term 'phase down' in their bilateral agreement adopted in the middle of COP26. The 'phase down' language has also been used in the joint statement released by both the countries earlier during the Glasgow talks.

Also, after the final COP26 text was adopted, US climate envoy John Kerry told a press conference. "You have to phase down coal before you can end coal.”

While it was US and China that had embraced the coinage 'coal phase down', India had different contention: that focus only on coal would disproportionately impact developing countries. It wanted all fossil fuels to be phased down. But such an equitable fossil fuel phaseout would have put the burden squarely on US and rich countries.

India called out this inequity, and was soon branded "obstructionists."

The ground reality is that India is the only G20 country which is on track of achieving the goals fixed under Paris Agreement.

It has been India's insistence for years that reducing dependency on coal should take place in an equitable manner, taking into account role of developed nations that have already released huge amount of carbon because of their coal use in past decades, in fact most of the past two centuries.

Some rich countries have been using loopholes in global climate talks to retain the burden of action on developing nations.

As representatives of US, China, India and the European Union went in a huddle, language in the clause on 'phase out' of coal was amended to 'phase down'.

COP26: US, China promoted 'coal phase down' concept. Then why is India getting disproportionate blame for it?

COP26 climate summit’s president Alok Sharma asked India and China to “explain themselves to poor nations” after they watered down the clause on ending the usage of coal.

Sharma said he was “deeply frustrated” after India, backed by China and other coal-dependent developing nations, rejected a clause calling for a “phase out” of coal-fired power, and changed the text to “phase down”.

Sharma’s comments came after UN climate talks in Glasgow, Scotland, ended on Saturday with a deal that targeted fossil fuels for the first time.

“In terms of China and India, they will on this particular issue have to explain themselves,” Sharma told a news conference at Downing Street in London.

In an interview to the Guardian, Sharma later said that he had no choice but to accept the compromise, because “it was my view that otherwise we might end up with no deal at all. We would have lost two years of really hard work, and would have ended up with nothing to show for it for developing countries.”

British Prime Minister Boris Johnson, who was also present with Sharma at a news conference at Downing Street, said, “Whether the language was ‘phase down’ or ‘phase out’ doesn't seem to me as a speaker of English to make that much difference.”

“The direction of travel is pretty much the same,” he added.

Johnson said COP26 had delivered a mandate to cut the use of coal-powered generation that was backed up by real action from individual counties.

"When you add all that together, it is beyond question that Glasgow has sounded the death knell for coal power," he said at the press conference.

COP26 climate summit’s president Alok Sharma asked India and China to “explain themselves to poor nations” after they watered down the clause on ending the usage of coal.

We would have lost two years of really hard work, and would have ended up with nothing to show for it for developing countries.” British Prime Minister Boris Johnson, who was also present with Sharma at a news conference at Downing Street, said, “Whether the language was ‘phase down’ or ‘phase out’ doesn't seem to me as a speaker of English to make that much difference.” Also read | COP26: US, China promoted 'coal phase down' concept. Then why is India getting disproportionate blame for it? “The direction of travel is pretty much the same,” he added. Johnson said COP26 had delivered a mandate to cut the use of coal-powered generation that was backed up by real action from individual counties. "When you add all that together, it is beyond question that Glasgow has sounded the death knell for coal power," he said at the press conference. But he said his delight at the progress achieved was tinged by disappointment that the deal did not go further. "Sadly, that's the nature of diplomacy," he said. (With inputs from agencies)

COP26 president criticises India, China over coal use move

In a major push for a hands-on approach to governance, the Modi government is planning to rope in young professionals, seek suggestions from retiring officials and make the best use of technology for project monitoring, besides various other steps to be overseen by eight different groups comprising of members from the entire Council of Ministers, sources said.

The 77 ministers have been divided into eight groups to develop technology-based resources, create a pool of professionals for recruiting in their teams and other similar initiatives to be adopted in the offices of all ministers' offices to bring more transparency and further improve and efficiency of the Modi government, the sources said.

This exercise of dividing the ministers into eight groups was done following 'Chintan Shivirs' (brainstorming sessions) of the entire council that were chaired by Prime Minister Narendra Modi, with each meeting lasting for nearly five hours.

A total of five such sessions were held - one each on Personal Efficiency, Focused Implementation, Ministry Functioning and Stakeholder Engagement, Party Coordination and Effective Communication and the last one was on Parliamentary practices.

The last brainstorming meeting was also attended by the Lok Sabha Speaker Om Birla and Rajya Sabha Chairman M Venkaiah Naidu.

All these meetings primarily focused on improving the efficiency and the delivery system of the Modi government. The forming of groups is another step in that direction, broadly focusing on overall improvement in the governance by making ministers more hands-on approach, the sources said.

All the 77 ministers in the council are part of one of these eight groups, each comprising nine to ten ministers with one Union minister designated as a group coordinator, sources said.

Developing a portal in each minister's office that gives updates on the performance of the Centre's flagship schemes and policies, a dashboard for monitoring decisions made by the respective ministers and a system to schedule meetings and managing correspondence are among the tasks assigned to these groups.

They have also been asked to create profiles of all districts, states and ministries and develop stakeholder engagement programmes.

One of the groups has been assigned to set up a mechanism for creating a team of at least three young professionals with command over research, communication and other key areas, the sources said.

Similarly, a group has been assigned to create a portal that maintains feedback and experiences of the retiring employees, sources said.

Union Ministers Hardeep Singh Puri, Narendra Singh Tomar, Piyush Goyal, Dharmendra Pradhan, Smriti Irani, Anurag Thakur are among the ministers who are the coordinators of their respective groups, the sources said.

They have been given this responsibility so that they can share the good practices of their respective offices with other cabinet colleagues.

Most of the ministers who had given presentations during the Chintan Shivirs have been given the responsibility of coordinating their respective groups.

Meanwhile, for attending these brainstorming sessions, Union ministers on the instruction of Prime Minister Modi did carpooling with their cabinet colleagues from different ministries and hailing from different states.
