Some relief for Imran from Islamabad High Court

In a relief to embattled Imran Khan, a top Pakistani court on Tuesday overturned the ruling of a sessions court and declared the Toshakhana corruption case against the former prime minister inadmissible. Pakistan Tehreek-e-Insaf (PTI) Chairman Khan, 70, was indicted in the Toshakhana case on May 10 by Additional Sessions Judge Humayun Dilawar, who rejected objections about the admissibility of the case.

Pak court declares Toshakhana case against Khan inadmissible

In a major relief for Imran Khan, the Islamabad High Court (IHC) on Tuesday declared “void” the sessions court's verdict in the Toshakhana case against the Pakistan Tehreek-e-Insaf (PTI) chairman.

Chief Justice Amir Farooq said that the Toshakhana case against Khan was inadmissible and returned the matter to the trial court, ordering that the PTI's counsel arguments be heard again and reconsidered.

The verdict came a day after the PTI chief urged the court that Justice Farooq be recused from the bench.

“The application in question shall be deemed to be pending and decided afresh by the learned trial court within seven days from the receipt of this judgment, keeping in view the law in question and observations made above,” the court order reads, according to Dawn.com.

On May 10, the 70-year-old embattled leader was indicted by Additional Sessions Judge Humayun Dilawar, who rejected objections about the admissibility of the case.

The PTI chief then sought IHC’s attention which had stayed criminal proceedings on the case till June 8.

The petition filed by Khan objected to filing a complaint after a specified period. His lawyer, Khawaja Haris, maintained that a complaint could only be filed within four months of submitting the return.

Following the verdict, Khan’s lawyer, Gohar Khan told reporters outside the court that the case was dismissed due to a lack of grounds to maintain it.

“The reference filed by the ECP against the PTI chief in October 2022 has been dismissed due to lack of grounds for maintaining it.”

Toshakhana case

The case, filed by the ruling party lawmakers, is based on a reference filed by the Election Commission of Pakistan (ECP), alleging that Khan “deliberately concealed” details of the gifts he retained from the Toshaskhana — a repository where presents handed to government officials from foreign officials are kept — during his time as the prime minister and proceeds from their reported sales.

On October 21, 2022, the ECP concluded that the former premier had indeed made “false statements and incorrect declarations” regarding the gifts.

Khan was accused of misusing his 2018 to 2022 premiership to buy and sell gifts in state possession that were received during visits abroad and worth more than Rs140 million ($635,000).

Helped Imran Khan to become PM but regretted it: Ex-Pak captain Miandad

As the IMF agreed a three billion dollar deal to avert an impending economic catastrophe in the area, Pakistan has gained a much-needed lifeline. This IMF investment is a ray of hope for Pakistan's beleaguered economy, which has been suffering from a severe balance of payments problem and declining foreign reserves that have brought it perilously near to default. Pakistan's prime minister expressed gratitude to China and other friends for their assistance.

In Pakistan, a member of the six-judge bench hearing pleas challenging the trials of civilians in the military courts has urged the Chief Justice, Umar Ata Bandial to reconsider the reconstitution of the bench.

Brutal military trials of civilians in Pakistan

During a press conference, on Monday (June 26), Inter-Services Public Relations (ISPR) Director General (DG) Major-General Ahmed Sharif said that the Pakistan military had dismissed one officer with the rank of a Lieutenant general and several others for not protecting the military installations during the May 9 riots.

Speaking about the violence that broke out following the arrest of Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan, he also said it was “undoubtedly” a conspiracy against the country which had been planned months in advance. Furthermore, he also said that more than 100 people are being tried in military courts over the violence that broke out.

‘Facts’ about the May 9 riot

At the beginning of the press conference, Sharif said the purpose of this address was to provide “facts” regarding the events of May 9, adding, “The incident of May 9 is extremely disappointing, condemnable and a black chapter in the history of our country.”

He added, “The events of May 9 have proven that what enemies couldn’t do in 76 years, a bunch of miscreants and their facilitators did." It was “undoubtedly a conspiracy against Pakistan”.

Sharif further said that the ongoing probe into the riots has found evidence that the protests were “being planned for the past several months.” The chief military spokesperson added, “Under this planning, first a conducive environment was created and people were instigated and provoked against the army.”

Notably, the country’s army remains Pakistan’s most powerful institution, having reportedly ruled it directly for nearly half of its 75-year history through three coups. However, on May 9 protesters also attacked the army installations across the country, in a somewhat unprecedented move.

“Then, in this connection, a narrative based on lies and exaggeration was spread on social media inside and outside the country,” said Sharif, adding that the Pakistan army has found evidence against them.

Nearly 100 soldiers lost their lives

The military spokesperson said that as many as 95 officers and jawans (soldiers) lost their lives due to the violence. He added, “However, the successful war against terrorism will continue until all terrorists are eliminated.”

Pakistan army’s ‘self-accountability process’

During the press conference, the chief military spokesperson also said that the army has completed its process of “self-accountability…without any discrimination” and went on to detail the outcomes of the two comprehensive inquiries, led by the Pakistan army’s major generals over the violent events that took place at army garrisons on May 9.

The spokesperson said that military trials are being heard in the Supreme Court. “The military courts did not come into existence after May 9, they were already present and functioning. The civil courts have transferred these cases to the military courts after checking evidence and as per the law.”

He said that the hearings under the Army Act were going on in military courts where the “trial of 102 miscreants is underway and this process will continue”.

He also said that disciplinary proceedings were initiated against “those who failed to keep the security and honour of garrisons, military installations, Jinnah House and General Headquarters intact.”

In line with this, three officers, including a lieutenant-general, have been dismissed and “strict disciplinary proceedings” against three major generals and seven brigadiers have been completed so far.

While he described the ranks of those facing the process of accountability, Sharif did not name them. “As of now, a granddaughter of a retired four-star general, son-in-law of a retired four-star star general, wife of a retired three-star general, and wife and son-in-law of a retired two-star general are facing this process of accountability due to irrefutable evidence.”

Pakistan trying 102 in military courts for violence following ex-PM Imran Khan's arrest: Army spokesman

Pakistan's economy is facing a severe crisis, with no signs of financial relief in sight. Prime Minister Shehbaz Sharif met with the IMF Chief during the Global Financial Summit in Paris, making a last effort to secure the release of $1.1 billion in funding. Political instability, devastating floods, and shrinking foreign exchange reserves have hindered the negotiations for a loan renewal.

Pakistan's economic crisis deepens

Pakistan introduced a number of changes to its fiscal 2024 budget on Saturday, said Finance Minister Ishaq Dar, in a last-ditch effort to clinch a stalled rescue package with the International Monetary Fund.

Pakistan's former prime minister Imran Khan mocked retired Pakistani army general Qamar Javed Bajwa, questioning the effectiveness of his "countless trips" to the United States while referring to a joint statement from the United States and India where Pakistan was strongly condemned for cross-border terrorism and the use of terrorist proxies.

This comes after the White House released a US-India joint statement with Indian Prime Minister Narendra Modi and US President Joe Biden calling upon Pakistan to take immediate action "to ensure that no territory under its control is used for launching terrorist attacks".

In a tweet Friday afternoon, the Pakistan Tehreek-e-Insaf leader wrote, "Gen Bajwa along with his PDM cronies claimed that I had isolated Pakistan internationally."

Here, Khan was referring to the Pakistan Democratic Movement (PDM), a coalition of several political parties, which brought together rivals Pakistan People’s Party (PPP) and Pakistan Muslim League (PML), to oust the former premier.

"The question we want to ask him and PDM is that after a year in government and countless trips of Pakistan's FM to the US, the joint India/US statement reduces Pakistan to a promoter of cross-border terrorism in India and nothing more," Khan added in his tweet.

Continuing his rhetoric of calling the ruling government an imported government working at the behest of the United States, Khan stated that the experiment of this government has rendered Pakistan irrelevant on the international stage.

"So now the imported govt experiment has not just made Pakistan irrelevant internationally but our democracy, rule of law and the entire economic and institutional structure is also collapsing right in front of our eyes."

Khan's same-old Kashmir narrative

Khan also mentioned the same-old narrative of human rights abuses in Kashmir, which India categorically denies. Khan said he was disappointed because the issue was not mentioned in the US-India joint statement.

Imran Khan mocks Pak govt as Modi-Biden statement highlights cross-border terrorism, use of terrorist proxies

Pakistan’s Chief Justice Umar Ata Bandial on Wednesday formed a nine-member bench to hear petitions against the trial of civilians before military courts under the Army Act for the May 9 violence, which erupted after former premier Imran Khan’s arrest in a corruption case.

The Lahore anti-terrorism court has issued a non-bailable warrant against the former Pakistani prime minister Imran Khan. This is the most recent of almost a hundred cases that have been filed against the former Pakistani prime minister, ranging from corruption to terrorism. A non-bailable warrant has also been issued.

In a recent interview with an American think tank, Pakistan’s former prime minister, Imran Khan revealed that ex-Army chief General Qamar Javed Bajwa “frequently” said that the army was not “equipped or prepared” for a war with India, as per the council's website. This comes months after the United Kingdom-based Pakistani media “UK44” reported that Bajwa told two senior journalists that Pakistan lacked the ammunition and economic strength to fight against India.

Opening for peace with India?

During an interview with Atlantic Council, a Washington-based think tank, Imran Khan said that there was an opening for peace with India even after the government had “unilaterally” scrapped Article 370 of the Constitution, which gives special status to Jammu and Kashmir, in August 2019.

“I tried my best before then to improve our relationship with India. In fact, my first statement was, ‘You come one step towards us, we’ll come two towards you,’” Khan told the Atlantic Council, on June 18.

The former Pakistan PM also went on to claim that there was a plan favoured by Bajwa which reportedly included normalising trade between the two countries before Indian Prime Minister Narendra Modi could visit Pakistan.

However, when asked about the reports, Khan told the American think tank, “I don’t remember the trade talks. All I know is that there was supposed to be a quid pro quo. India was supposed to give some concession, give some sort of a roadmap to Kashmir, and I was going to then host Prime Minister Modi in Pakistan. But it never materialised”.

“I tried everything, but I came across this brick wall,” said Khan.

What did Bajwa supposedly tell Pakistani journalists?

Earlier this year, ANI reported about the revelation, naming Pakistani journalists Hamid Mir and Naseem Zehra, who supposedly said that Pakistan lacked the firepower to face India. Mir told UK44 in an explosive interview that General Bajwa admitted that Pakistan “cannot go to war with India”. Mir said that General Bajwa told a conference of commanders that the “Pakistan Army is no match for the Indian Army.”

Mir claimed that since the Pakistan Army lacked options, Bajwa proposed to mend ways with India to have a normal relationship. He said that the two countries started working on a solution for Kashmir as Pakistan realised it lacked ammunition and economic strength to fight India.

The journalists claimed that General Bajwa in 2021 revealed that he held secret talks with India’s National Security Advisor Ajit Doval and that a visit by the Indian PM was planned to Pakistan soon after a ceasefire along the Line of Control with India was announced.

When asked about reports that emerged in April, the former Pakistan PM told the Washington-based think tank, “Even if that was the case, for an army chief to make these statement is so ridiculous.” He added, “I mean for an army chief, he is basically saying, ‘We are just too weak.’ You never make such a statement.”
