Harvey Weinstein used his power and influence in Hollywood to rape women, leaving them terrified for their careers if they stood up to him, a court in Los Angeles heard Monday.

The movie mogul exploited both his physical size and his position as "king" of the film industry to attack his victims in hotel rooms, the prosecution said, as a two-month trial began to hear evidence.

"They feared that he could crush their careers if they reported what he had done," Deputy District Attorney Paul Thompson told the packed courtroom.

Thompson said jurors would hear from eight women who were sexually assaulted by the "Pulp Fiction" producer, who is credited with making the careers of some of the movie industry's biggest names, including Quentin Tarantino, Ben Affleck, Matt Damon and Gwyneth Paltrow.

"Each of these women came forward independent of each other, and none of them knew one another," he said.

The jury will hear testimony from these women, he said, including how they begged the now-70-year-old to stop, but that he persisted in raping them, forcing them to perform oral sex on him, or making them watch him masturbate.

Weinstein, who produced 'The English Patient' and 'Good Will Hunting',&nbsp;is already serving 23 years in jail in New York after being convicted there of a series of sex crimes.

He now faces 11 more charges, including sexual battery by restraint, forcible rape and forcible oral copulation against women in Beverly Hills and Los Angeles hotels between 2004 and 2013.

If convicted, Weinstein -- who has pleaded not guilty to all counts -- could be sentenced to more than 100 additional years behind bars.

Thompson played jurors a series of quotes from the alleged victims, describing Weinstein as "the most powerful person in the industry," and "the king."

"Part of me was thinking should I just make a run for it, but he's a big guy," one of the women told investigators.

"He's big. He’s broad. He’s overweight. He’s domineering," one said.

"I still wanted to work in Hollywood so I was afraid to do anything because of that," one woman said.

"I was scared that if I didn’t play nice something could happen in the room or out of the room because of his power in the industry," another woman said.

In common with most victims of sexual assault, the women in the case are being referred to as "Jane Doe," in order to preserve their anonymity, but one has been publicly identified as Jennifer Siebel Newsom, the wife of California governor Gavin Newsom.&nbsp;

Defending, Mark Werksman said the prosecution's case was one of quantity, not quality, and driven by emotion, not reason.

He said sex in Hollywood was a commodity, and that this was all exploded by the advent of the #MeToo movement.

"It was transactional sex. It may have been unpleasant, and embarrassing... but it was consensual.

"It was the casting couch. Everyone did it. He did it. They did it. Because each wanted something from another," Werksman said.

"Look at him. He’s not Brad Pitt or George Clooney. Do you think those beautiful women had sex with him because he’s hot? No. They did it because he was powerful."

The commission for agencies will also be capped at 20 per cent to ensure that models are not exploited. The bill, however, has received stiff resistance from groups such as&nbsp;Artist Management Association and American Association of Advertising Agencies (AAAA).

"Despite agencies being a middleman between a brand client and a creative management company, the bill imposed a blanket requirement that agencies render payment to creatives (hair stylists, makeup artists, casting directors, etc.) or their representative management companies no later than 30 days after the completion of services," AAAA argued in a statement released.&nbsp;

The proposed bill was introduced in the Spring session last month. it&nbsp;nearly passed both houses of the legislature, but lawmakers ran out of time for a final vote. Reportedly, the bill will be tabled once again in the 2023 legislative session that starts in January.&nbsp;

Five women, who will testify as Jane Does in court, filed complaints with charges&nbsp;of four counts of rape and seven other counts of sexual assault by Weinstein. He entered a not-guilty plea.

"The action comes after the Appellate Division, First Department court denied an appeal request in June after a five-judge panel said that trial Judge Jim Burke`s decisions were appropriate and did not call for overturning Weinstein`s conviction. But now, Weinstein will have another opportunity at arguing the judge made mistakes. Earlier, Harvey received a 23-year term for rape and sexual abuse. 
 
Adiala told Page Six, "This isn`t about whether [Weinstein] is innocent or guilty, but if he got a fair trial or not a fair trial. It`s about whether the trial judge followed the law". 
 
Page Six further reports that the defence claims that Harvey was never charged with the actions that Aidala said, "a number of witnesses testified to". 
 
She also added that during the jury selection process, one juror lied about having published a book about sexual predators. 
 
All paperwork from both sides will be submitted by early next year and oral arguments are likely to begin in spring next year.

New York Judge grants Harvey Weinstein right to appeal

The highest court in New York state let Harvey Weinstein to appeal his charges of rape and sexual assault on Wednesday (August 24), giving Weinstein a slim chance of receiving a new trial. The threshold for granting a new trial is high, but after speaking with his client in prison, Weinstein was "relieved by this decision," according to one of his attorneys, Arthur Aidala.

The latest hearing in disgraced Hollywood mogul Harvey Weinstein`s sexual assault case was delayed recently due to flooding. According to Variety, a flood caused a lockdown at the Twin Towers Correctional Facility, the Los Angeles prison where the convicted rapist is currently behind bars. Mark Werksman, one of Weinstein`s attorneys, told members of the media who were sitting in the courtroom, "Just a routine delay."

Judge Lisa B. Lench stated that "It is my understanding that there was a flood at Twin Towers where Mr Weinstein is housed. It is now 9:40." Originally the hearing was scheduled to commence at 8:30 am. It was the latest court date, leading up to Weinstein`s long-awaited Los Angeles sexual assault and rape trial.

The hearing has now been pushed by Judge Lench to August 10 but first dealt with a few matters regarding the defence`s subpoenas to witnesses.

Variety reported that earlier this week, in another hearing for the case, Judge Lench ruled to limit the amount of information that could be obtained by Weinstein`s defence team for the upcoming trial. She approved the prosecution`s motion to quash subpoenas from four witnesses for their correspondence, including personal emails and texts dating as far back as 2004 with one of the alleged victims.

However, at that hearing, the judge said she wouldn`t prevent the defence from serving future subpoenas to victims and would not ask them to notify the prosecution in advance of their attempts to serve.

On Friday morning, discussions got a bit heated with the prosecution objecting to Weinstein`s attorney, Alan Jackson, who argued that the defence has the right to subpoena witnesses without giving advanced notice to the prosecution.

Weinstein is scheduled to go on trial on October 10 in LA. He faces 11 charges of rape and sexual assault from five women, reported Variety.

A New York appeals court on Thursday upheld Harvey Weinstein’s 2020 conviction on felony sex crimes, increasing the likelihood that the disgraced movie producer will serve a significant portion of his 23-year sentence.

Since last summer, Weinstein, 70, has been awaiting trial in Los Angeles, where he has been charged with several counts of forcible rape and forcible oral copulation, as well as other counts related to sex crimes. A trial date is expected to be set this month.

The New York decision had been hotly anticipated by the state’s legal community, particularly after oral arguments in December, when members of the five-judge panel that heard the case seemed sceptical of some decisions made by the trial judge.

But the decision Thursday was unanimous — and clear.

“We reject defendant’s arguments, and affirm the conviction in all respects,” wrote Judge Angela M. Mazzarelli, the opinion’s author.

An attorney for Weinstein said his legal team would ask New York’s highest court, the Court of Appeals, to review the affirmation. That court will not automatically take the case.

“We are obviously disappointed in the court’s decision and look forward to asking the Court of Appeals to review what we believe are substantial meritorious legal issues,” said the attorney, Barry Kamins. “Mr. Weinstein will continue to pursue all available legal remedies to establish that he did not receive a fair trial.”

Reports of Weinstein having sexually abused women appeared in The New York Times in the fall of 2017, leading dozens of others to speak about their own experiences and eventually igniting what became known as the #MeToo movement, a global repudiation of sexual misconduct by powerful men.

The Weinstein case led to a cascade of accusations against other prominent figures and widespread discussion about the ubiquity of sexual harassment and assault, and the harm such behaviour caused.

Less than a year later, Weinstein was indicted by Manhattan prosecutors and charged with sex crimes.

His trial began in January 2020, and late the following month, a jury found him guilty of two felonies: a criminal sexual act in the first degree and third-degree rape. He was acquitted of two charges of predatory sexual assault. In March, he was sentenced to 23 years in prison.

The former Manhattan district attorney who charged Weinstein, Cyrus Vance Jr., said Thursday that the decision of the appeals court was a “relief,” but added that he had always been confident in the strength of the evidence.

“The trial court issued balanced rulings and by any measure provided the defendant a fair trial,” Vance said. “Most of all, I am grateful that the appeals court credited the testimony of the women in framing its legal analysis.”

His successor, Alvin Bragg, added that the appeals court had upheld “a monumental conviction that changed the way prosecutors and courts approach complex prosecutions of sexual predators.”

Weinstein’s attorneys appealed his conviction in April 2021, arguing that three women who had accused Weinstein of sexual assaults for which he was not charged should never have been allowed to testify and that prosecutors had “tried Weinstein’s character not his conduct.”

But Mazzarelli said the women had provided “useful information” and that their accounts had been key in showing Weinstein’s pattern of behaviour. They demonstrated, she said, that Weinstein did not see his victims as “romantic partners or friends,” but that “his goal at all times was to position the women in such a way that he could have sex with them, and that whether the women consented or not was irrelevant to him.”

She said the witnesses had helped the jury understand the dynamic between Weinstein and his victims, particularly because the women whom he had been charged for assaulting had continued relationships with him afterward.
