&nbsp;Harvey Weinstein’s lawyer said Saturday that the onetime movie mogul has been hospitalized for a battery of tests after his return to New York City following an appeals court ruling nullifying his 2020 rape conviction.

Attorney Arthur Aidala said Weinstein was moved to Bellevue Hospital in Manhattan after his arrival on Friday to city jails.

“They examined him and sent him to Bellevue. It seems like he needs a lot of help, physically. He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a train wreck health-wise,” Aidala said.

A message left with the hospital was not immediately returned Saturday.

Frank Dwyer, a spokesperson with the New York City Department of Correction, said only that Weinstein remains in custody at Bellevue. Thomas Mailey, a spokesperson for the state Department of Corrections and Community Supervision, said Weinstein was turned over to the city’s Department of Correction pursuant to the appeals ruling. Weinstein had been housed at the Mohawk Correctional Facility, about 100 miles (160 kilometres) northwest of Albany.

On Thursday, the New York Court of Appeals vacated his conviction after concluding that a trial judge permitted jurors to see and hear too much evidence not directly related to the charges he faced. It also erased his 23-year prison sentence and ordered a retrial.

Prosecutors said they intend to retry him on charges that he forcibly performed oral sex on a TV and film production assistant in 2006 and raped an aspiring actor in 2013.

Weinstein remained in custody after the appeals ruling because he was convicted in Los Angeles in 2022 of another rape and was sentenced to 16 years in prison.

For some time, Weinstein has been ailing with a variety of afflictions, including cardiac issues, diabetes, sleep apnea and eye problems.

Aidala said he spoke to Weinstein on Friday afternoon after he was in transit to New York City from an upstate jail less than 24 hours after the appeals ruling, which was released Thursday morning.

He said his client’s ailments are physical, adding that mentally he is “sharp as a tack. Feet are firmly planted on the ground.”

The lawyer said it usually takes state corrections and prisons officials a week or two to arrange to transport a prisoner.

“He was not treated well. They refused to give him even a sip of water, no food, no bathroom break,” Aidala said. “He’s a 72-year-old sickly man.”

Mailey, the state corrections spokesperson, had no comment when Aidala’s remarks about Weinstein’s treatment were read to him over the phone.

Aidala said he was told that Bellevue doctors planned to run a lot of tests on Weinstein before he can be returned to the Rikers Island jail complex.

The lawyer said he’s scheduled to meet with Weinstein on Monday. He added that he plans to tell a judge when Weinstein goes to court on Wednesday in Manhattan that a retrial should occur after Labor Day.

She said, "His selfish, disgusting actions have greatly impacted my life. There is no prison sentence long enough to undo the damage."

The producer's attorneys said that they will appeal the Los Angeles verdict, which came with his conviction by a jury in December last year.

The trial went on for a month and the deliberations were held for about nine days. And, in the end, the 12-member jury found Weinstein guilty of three counts,&nbsp;forcible rape, forcible oral copulation and penetration by a foreign object, against Jane Doe 1.

However, the jury acquitted Weinstein of another sexual assault charge related to a different Jane Doe accuser as they couldn’t reach an agreement on three other counts.&nbsp;

This is Weinstein's second conviction since #MeToo movement spread like wildfire in the United States. He is already serving a 23-year prison sentence after being convicted of sex crimes by a New York City court in 2020.

Jennifer Siebel Newsom, who&nbsp;testified against Weinstein and disclosed that she was harassed by the producer,&nbsp;shared a statement on Twitter in response to the verdict. The tweet read, "Harvey Weinstein will never be able to rape another woman. He will spend the rest of his life behind bars where he belongs. Harvey Weinstein is a serial predator and what he did was rape."

"Throughout the trial, Weinstein’s lawyers used sexism, misogyny, and bullying tactics to intimate, demean and ridicule us survivors,"&nbsp;Jennifer added. "This trail was a stark reminder that we as a society have work to do. To all survivors out there — I see you, I hear you, and I stand with you."

Lauren O’Connor, who penned the leaked 2015 memo addressed to her colleagues that brought Weinstein’s toxic behaviour to light and eventually helped take him down, spoke to The Hollywood Reporter.

She said, “The women who came forward and took the stand are immeasurably brave, and while it is disappointing he was not convicted on all counts, I am grateful for the verdict — he cannot hurt people anymore.”

“But I think it is important to remember, the larger issues around understanding rape and consent are not solved because one bad man went to jail. There is still work to be done, and yesterday’s verdict demonstrates that,” Lauren added.&nbsp;

She said, "I’m thankful that it’s not a complete acquittal across the board. Our worst nightmare was that he would get acquitted in L.A. and use that to support his appeal in N.Y."

Chiu further shared, “I see desperate failings in the legal system,” before adding, “I feel that it’s very personal. My reaction was almost a visceral anger at how much these women had been put through to take the stand. The fact that the legal system puts such a burden on the witness, challenges the survivor’s credibility. It is a horrifying and brutal process. What sort of signal does that give women of the #MeToo movement who are really struggling? A staggering percentage of rape victims know they’re not going to be believed.”&nbsp;

Other high-profile accusers, actresses and activists, including Mira Sorvino, Amber Tamblyn and the organization Women in Film, also shared reactions on social media. &nbsp;

But the Oscar winner said Tuesday he would challenge the guilty verdicts.

"Harvey is obviously disappointed in the verdict. He knows what happened and what never did," Weinstein spokesperson, Juda Engelmayer, said in a statement to AFP.

"However, the account of Jane Doe #1 has a strong legal basis for an appeal, as the logistics of the time and location of the alleged incident make no sense.&nbsp;

"Harvey is grateful for the jury’s work on the other counts and he’s determined to continue his legal challenges in ultimately proving his innocence."

On Wednesday, the jurors asked to have a few testimonies read back to them, indicating that they are still sifting through the witnesses' allegations. Since the courtroom will be closed on Thursday and Friday, the testimonies are expected to be read on&nbsp;Monday.

Through the course of the deliberations, the jury asked one question. Judge Lisa B. Lench, however, has opted not to reveal the question&nbsp;to the media. It's difficult to decipher why the jury is taking so long to deliver the verdict since not a lot of information is out in public.&nbsp;

"The court is aware that there have been inquiries from the press regarding the contents of juror questions sent to the court," the judge said in a minute order Wednesday. "The contents of the communications reveal the deliberative process of the currently-deliberating jury. As such, the court believes it would be inappropriate to release to the press the contents of the communications prior to the discharge of the jury as it would impinge on the deliberative processes of the jury."

If convicted and found guilty, Weinstein could face up to 60 years to life in prison, in addition to&nbsp;the 23-year sentence he is already serving for a conviction in New York for rape and sexual assault against two women.

Weinstein was extradited to Los Angeles in 2021. Since then he has been held in a medical unit of the Twin Towers Correctional Facility.

Weinstein, now 70, is charged with seven sex-related counts involving four women, one of whom has been identified by her lawyer as Jennifer Siebel Newsom, wife of California Governor Gavin Newsom.

"It is time for the defendant's reign of terror to end," prosecutor Marlene Martinez told the jury in her closing argument on Thursday.

"It is time for the kingmaker to be brought to justice."

Weinstein, who was credited with making the careers of household names like Matt Damon, Ben Affleck and Gwyneth Paltrow, used his power to prey on and silence women, Martinez said.

The jury heard testimony from women who said they had been tricked into being alone with the "Shakespeare in Love" producer in his hotel room.

Several described how they had begged him to stop as he forced himself on them, made them perform oral sex on him, or watch him masturbate, sometimes as he groped them.

"We know the despicable behaviour the defendant engaged in," Martinez told the jury.

"He thought he was so powerful that people would... excuse his behavior."&nbsp;

"'That's just Harvey being Harvey. That's just Hollywood.&nbsp;And for so long that's what everyone did. Everyone just turned their heads."

Defending Weinstein, Alan Jackson told the jury the prosecution had failed to provide evidence that any of the sexual encounters were anything but consensual.

The entirety of the prosecution's case could be summed up with five words -- "Take my word for it," he said.

Two of the four women at the centre of the charges described encounters that never happened, he said.&nbsp;

The two others were women who knowingly engaged in transactional sex and now regretted it, Jackson said, part of what he called a "dogpile" on Weinstein in the wake of the explosion of the #MeToo movement.

Referring to Siebel Newsom, he said she "cannot square in her mind that she's a successful, well-educated, well-bred, refined woman who had consensual sex with Harvey Weinstein in exchange for opportunity and access.

"Regret is far from rape. You don't get to rewrite your own history no matter who you're married to."
