<p>Ahead of Biden’s visit to the state on Wednesday (Aug 8), the FBI landed at Craig Robertson’s house around 6:15 am to serve arrest and search warrants for his residence&nbsp;in Provo, a city south of Salt Lake City.&nbsp;</p>

<p>The investigative officers said that Robertson, who is said to be in his 70s and an ardent Donald Trump supporter, owned “a sniper rifle” and several other firearms.</p>

<p>Robertson was booked on three charges, including threats against the president as well as influencing, impeding and retaliating against federal law enforcement officers by threat.</p>

<h2><strong>Ardent Trump supporter&nbsp;</strong>&nbsp;</h2>

<p>According to court documents, Robertson made references to “presidential assassination” on his Facebook post and threatened a prosecutor pursuing criminal charges against Donald Trump.</p>

<p>His latest Facebook post was on Monday (Aug 7) where he said that he heard Biden was coming to Utah and he was planning to dig out a camouflage suit and “clean the dust off the m24 sniper rifle”, according to court documents.</p>

<p>In another post, Robertson referred to himself as a “MAGA Trumper”, a reference to former US president Donald Trump’s “Make America Great Again” slogan.</p>

<p>Robertson also made threats to Vice President Kamala Harris and US Attorney General Merrick Garland.</p>

<p>CNN reported that Biden was briefed on the matter on Wednesday in New Mexico, where he delivered remarks on manufacturing before his scheduled travel to Salt Lake City.</p>

<p>“The FBI is reviewing an agent-involved shooting which occurred around 6,15 am&nbsp;on Wednesday, August 9, 2023, in Provo, Utah. The incident began when special agents attempted to serve arrest and search warrants at a residence. The subject is deceased,” an FBI spokesperson said in a statement to CNN.</p>

<p>However, the statement fails to mention how did the events lead up to the shooting and the eventual demise of Roberston.</p>

<p>The FBI spokesperson continued, “The FBI takes all shooting incidents involving our agents or task force members seriously. In accordance with FBI policy, the shooting incident is under review by the FBI’s Inspection Division.”</p>

Trump contends proposed evidence limits in 2020 election case, cites breach of free speech rights

<p>A US judge in New York dismissed Donald Trump’s counter-defamation suit against former magazine columnist E Jean Carroll, who recently won $5 million against the former president for battery and defamation.</p>

<p>The 77-year-old Republican leader and presidential hopeful had filed the lawsuit against Carroll in June for continuing to claim publicly that he had raped her even though the jury did not find him guilty.</p>

<p>Carroll said “Oh yes, he did; oh yes, he did” during an interview with CNN when she was asked about the jury’s finding that he had not raped her.</p>

<p>District Judge Lewis Kaplan on Monday (Aug 7) said he did not find the writer’s statements malicious saying that Trump’s defamation claim must be dismissed because Carroll’s statements were at least “substantially true.”</p>

<h2><strong>No merit in Trump's counterclaim&nbsp;</strong></h2>

<p>The judge noted that the jury indeed found Trump liable for sexually abusing Carroll during an encounter in the dressing room of a New York City department store in the mid-1990s.</p>

<p>The judge did not find any merit in Trump's counterclaim, which sought unspecified compensatory and punitive damages, as well as several of Trump's defences against a separate pending defamation lawsuit brought by the 79-year-old writer.</p>

<p>&nbsp;“Indeed, the jury’s verdict in Carroll II establishes, as against Mr Trump, the fact that Mr Trump ‘raped her’, albeit digitally rather than with his penis. Thus, it establishes against him the substantial truth of Carroll’s ‘rape’ accusations,” the judge wrote.</p>

<p>"We strongly disagree with the flawed decision and will be filing an appeal shortly,” Trump attorney Alina Habba said.</p>

<h2><strong>Another trial awaits Trump in January&nbsp;</strong></h2>

<p>Meanwhile, Trump is all set to face trial in January for another defamation claim brought by Carroll in 2019 for statements he made while he was president.</p>

<p>Carroll has sought new damages after Trump called her a "whack job" on CNN the day after the civil trial verdict.</p>

<p>That case was tied up in legal issues while the lawsuit brought under the Adult Survivors Act (known as Carroll II) went to trial in May, resulting in the $5 million award.</p>

<p>The January trial would focus on how much damages would Trump be liable to pay her. The former president’s attorneys have been seeking a cap on damages to avoid double counting from the jury’s verdict in the ASA case.</p>

<p>Welcoming the verdict, Carroll’s attorney, Roberta Kaplan said, “We are pleased that the court dismissed Donald Trump’s counterclaim.”</p>

<p>“That means that the January 15th jury trial will be limited to a narrow set of issues and shouldn’t take very long to complete. E. Jean Carroll looks forward to obtaining additional compensatory and punitive damages based on the original defamatory statements Donald Trump made in 2019.”</p>

<p>A lawyer for former US president Donald Trump claimed that the actions the former commander-in-chief&nbsp;took after his loss in the 2020 US Presidential Election were "aspirational asks". John Lauro, the lawyer, defended Trump who is charged with defrauding the United States by attempting to overturn the election results.</p>

<p>"...Every single thing that President Trump is being prosecuted for involved aspirational asks -- asking state legislators, asking state governors, asking state electoral officials to do the right thing. In fact, even asking Vice President Pence was protected by free speech...," said Lauro. He was speaking to Fox News.</p>

<p>As it became clear that Trump would lose during the vote count, the then-president increasingly resorted to claims that the elections were rigged. He even called high-ranking state officials of some US states and repeatedly pressured them to change the outcome of the election in their states. The phone calls he made to state officials were widely broadcast in global media. State officials&nbsp;were heard&nbsp;expressing their inability to overturn results and Trump pressuring them nonetheless.</p>

<p>He is due to go on trial in New York in March next year over allegations that he misrepresented "hush money" payments to a porn star, and is scheduled to be tried in May over his handling of national security secrets.</p>

<p>On Thursday (Aug 3), the Republican arrived at Washington DC court for an in-person arraignment, which lasted for about half-an-hour.</p>

<p>Appearing before US Magistrate Judge Moxila Upadhyaya, Trump said, “Not guilty".</p>

<p>Magistrate Upadhyaya has scheduled the next hearing in the case for August 28 at 10 am (local time).</p>

<p>The federal charges are part of special counsel Jack Smith’s investigation into Trump's efforts to reverse the election leading up to the January 6, 2021 riot, in which his supporters stormed the US Capitol and sought to prevent a joint session of Congress from counting the electoral college votes to formalise the victory of Biden.</p>

<p>He was indicted with four charges: conspiracy to defraud the United States; conspiracy to obstruct an official proceeding; obstruction; and conspiracy against the right to vote and to have one’s vote counted.</p>

<h2><strong>'Sad day for America'</strong></h2>

<p>After the hearing, Trump was released without travel restrictions. One of his conditions of release is that he does not discuss the case with any witnesses unless accompanied by his lawyers.</p>

<p>After the conclusion of the hearing, Trump told the reporters at Reagan National Airport in Virginia, "This is a very sad day for America."</p>

<p>"This is a persecution of a political opponent. This was never supposed to happen in America," he said.</p>

<p>A judge in Georgia has rejected former US president Donald Trump’s motion to stop a criminal investigation into his efforts to subvert the 2020 presidential election in the state and dismiss Fulton County District Attorney Fani Willis.</p>

<p>Judge Robert McBurney, in his nine-page ruling on Monday (July 31), also rejected efforts by Cathy Latham, who served as one of the GOP fake electors in Georgia, to join Trump’s push.</p>

<h2><strong>Trump lacks legal standing&nbsp;</strong></h2>

<p>The judge said that both lacked legal standing to push for complete prohibition of investigation when the indictment proceedings haven’t even started yet.</p>

<p>“Having reviewed the pleadings, the Court now finds that neither Trump nor Latham enjoys standing to mount a challenge – at this pre-indictment phase of the proceedings – to the continued investigation into and potential prosecution of possible criminal interference in the 2020 general election in Georgia,” the judge wrote in the order, according to CNN.</p>

<p>Further, the order said that Trump's legal argument was "insufficient because, while being the subject (or even target) of a highly publicised criminal investigation is likely an unwelcome and unpleasant experience, no court ever has held that that status alone provides a basis for the courts to interfere with or halt the investigations."</p>

<h2><strong>Trump slammed&nbsp;</strong></h2>

<p>Judge McBurney also slammed Trump’s legal team over repeated efforts to remove Willis from the case in multiple jurisdictions.</p>

<p>"Perplexingly, prematurely, and with the standard pugnacity, Trump has filed not one but two mandamus actions against the District Attorney and this Court," he wrote.</p>

<p>“Put differently, the District Attorney’s Office has been doing a fairly routine – and legally unobjectionable – job of public relations in a case that is anything but routine.”</p>

<p>Trump’s legal team had urged the court earlier to junk all the evidence from the special purpose grand jury investigation and dismiss Willis, citing concerns about the constitutionality of special grand juries in the state and criticising public comments she has made about the case.</p>
