A ten-year-old girl got justice after being sexually assaulted by her uncle more than two years back.

The court sentenced the uncle after looking at the sketches made by the girl indicating sexual abuse and emotional as well as mental trauma.

Apparently, the girl was given paper and crayons while waiting to keep her distracted. It was then that she drew an abandoned house, a girl holding balloons, and a dress lying beside her. She chose dull colours to fill the drawing. The sketch was used as an evidence to prove her allegations.

The girl was disowned by her drunkard father after her mother died in Kolkata.

She lived with her aunt in Delhi after that. It was during this time that her uncle, Akhter Ahmed, assaulted her a number of times.

She fled her home and was found in a bus in November 2014. She was provided with care and rehabilitation and was slowly getting over her disturbing past. In a medical test, it could be concluded that she had been possibly assaulted sexually. Members of HAQ Centre for Child Rights counselled her and she slowly revealed to them her afflictions, but it still took them time to piece together a description of Ahmed. When traced in June 2016, he claimed not guilty.

In the presence of the additional sessions judge Vinod Yadav, Ahmed's lawyer contested that the girl had been brainwashed into blaming him of rape and could not be considered 'competent witness'.

After comprehending the girl's sketch, the judge said "If the elements of this drawing are considered in the background of facts and circumstances of this case, then commission of sexual assault upon her by somebody in her house after undressing her, and it leaving an impression upon her mind, becomes evident. Therefore, I find the child victim to be a competent witness. Her so-called saviour had committed repeated sexual assault on her."

The court sentenced Ahmed of five years' jail term and a fine of Rs 10,000 on the grounds that the sexual abuse was not penetrative. A compensation of Rs 3 lakh in fixed deposits was also announced for the girl's welfare and rehabilitation. It also praised HAQ counsellors Pearl Messy and Uzma Parveen for providing the child with institutional care.

"The legal battle is over. The girl lives in a children's home and is attending regular school.
Imagine the response by any of the previous Indian governments on Kashmir if today's situation had come to pass.
But the dream went bust and the government was accused of not reaching out.
The Indian government on Wednesday scrapped its 92-year-old practice of presenting a separate Railway Budget.

The Railway Budget will be subsumed under the the annual General Budget, Indian finance minister Arun Jaitley said.

The upside of the amalgamation is that it will allow Indian Railways to save around Rs 10,000 crore every year for not paying the dividend it has to pay for gross budgetary support from the federal government. The dividend it has to pay is because it takes Rs 40,000 crore from the government to facilitate its overhead costs.

The other advantage of the merger is that the Railways' revenue deficit will be shifted to the finance ministry.

The merger will have political ramifications too. The powerful railway ministry is set to lose its sheen in the process, though the proposal for a merger was backed right from the start by the incumbent minister Suresh Prabhu.

Plus, there was always pressure on railway ministers to augment the rail network in the region they hail from. But that practice would possibly end as the consolidated budget is set to be announced by the finance minister.

However, the Indian Railways' "functional autonomy will continue to be maintained", finance minister Jaitley said.
Air pollution: India's national green tribunal favours committee for emergency action plan

A thick menacing grey haze blanketed the Indian capital today as pollution levels breached the safe limit by over 17 times at several places.

Traffic snarls in the millenium city of Gurugram draw India's attention

Thousands of Indians were left stranded on Thursday as major traffic gridlocks paralysed roads to a key business city near Indian capital city New Delhi and authorities struggled to get the situation under control.

Television images showed thousands of partially submerged cars stranded in miles-long jams on a key highway and link roads connecting New Delhi with the satellite town of Gurugram, formerly known as Gurgaon.

Office-goers and locals were pictured wading through knee-deep water after heavy monsoon rains deluged streets late Thursday.

Local authorities issued an order today asking people to avoid travelling to the area in northern Haryana state and shut schools for two days.

Dubbed "Millennium City", Gurgaon is home to scores of top multinational companies, expensive condominiums, a world-class golf course, top hospitals and gleaming shopping malls.

However, like many Indian cities, it lacks an efficient drainage system making it prone to flooding.

Massive traffic snarls have been reported from Bengaluru, Delhi, Mumbai and Gurugram amid downpour

Heavy rains have lashed large parts of India, bringing major metropolitan cities to a standstill. Vehicular movement remains affected in various parts of the southern city of Bengaluru due to heavy downpour. In the small hamlet Bilekahalli, boats are being used after torrential rain wreaked havoc. Arterial roads in the national capital Delhi as well as Mumbai, metropolitan city in western state of Maharashtra, also remain choked with traffic. Massive traffic jams have been reported on Western Express Highway in Andheri, a Mumbai suburb. Indian cities Delhi, Gurugram, Uttarakhand and Bengaluru massively affected by heavy downpour. Heavy rainfall triggers traffic jams, power cuts and waterlogging in the cities. Source: ANI, Dr. Amit Kapoor, Bengaluru, twitter Traffic snarls in the millenium city of Gurugram draw India's attention Thousands of Indians were left stranded on Thursday as major traffic gridlocks paralysed roads to a key business city near Indian capital city New Delhi and authorities struggled to get the situation under control. "People coming to Gurgaon from Delhi are advised to stay back today to avoid being stuck in traffic jams due to flooding on roads," Gurgaon police posted on Twitter. Twenty three-year-old Nirbhaya was brutally assaulted and gang-raped by six people in a moving bus in the capital city of New Delhi on the night of December 16, 2012 and thrown out of the vehicle. She died in a Singapore hospital on December 29.
A special bench of the Indian apex court hearing the plea of convicts awarded death in the case has decided to sit two hours beyond its working time to ensure speedy disposal of the case that has been pending in the court for more than two years.
The convicts Vinay Sharma (23), Akshay Thakur (31), Mukesh (29) and Pawan Gupta (22) were awarded death sentence by a trial court in September 2013 and six months later the Delhi High Court upheld their conviction and sentence. All the convicts then approached the Supreme Court which in 2014 had stayed their execution and the matter is pending in the top court since then.
The Delhi High Court had upheld their conviction and award of death penalty by terming the offence as 'extremely fiendish' and 'unparalleled in the history of criminal jurisprudence' and said the exemplary punishment was the need of the hour.
The Delhi High Court has said it was "unfortunate" that India was still following British era recruitment process and selecting police personnel on basis of only physical strength and fitness, and advised devising of a procedure which would include criteria like emotional maturity and psychological tests.

"What we find in India is that the only screening done is with respect to the moral character and integrity, physical strength and (that the person is) free from medical disease. No evaluation pertaining to the emotional maturity, ability to remain calm in emotionally charged situations, ability to handle difficult situations and be responsive and the ability of initiative in work is conducted," a bench of justices Pradeep Nandrajog and Pratibha Rani said.

The bench said it was "unfortunate" that India was "not marching ahead in the comity of nations", where psychological tests are also conducted to ascertain suitability of a candidate commensurate to the nature of job they are being inducted to.

It advised the Centre to devise a selection procedure under which those who are desirous of joining police forces would be tested with regard to not only their integrity, physical strength and fitness but also with respect to their emotional maturity, ability to be calm in charged situations, ability to exercise initiative in their work, dependability and good judgement.

The observations came on a man's plea challenging the order withdrawing his appointment to post of constable in the CISF on the ground that he was an accused in a criminal case, even though he was acquitted by the trial court.

It noted there were "no rules to guide the authorities in Delhi Police as to in what cases despite acquittal, the person can be kept out of service or can be deprived of employment".

With regard to the criteria of criminal background of a candidate, the court said it would be a violation of the Constitutional right of a person if "trivial offences" by him would justify the government "shutting its eyes and denying employment".

It said it was "high time" that the executive made a policy for not treating summary or ordinary conviction as a bar to entry or retention in government service, including the police force.

Noting that his acquittal was "honourable" as it came after the prosecution led all its evidence, the high court set aside his rejection and directed that he be inducted into service as a Constable with Central Industrial Security Force (CISF).

It also said that "he would be entitled to all benefits of seniority and continuity into service with effect from the date the person immediately beneath the petitioner in the empanelled list was made to join".
The 8x12-inch Swasthya Slate hooks up to Android phones and tablets, and is able to conduct 33 medical tests, including those for dengue, malaria, HIV, and even ECGs, in under a minute

Delhi's population of 10 million is served by 38 state-run hospitals. The job they do is admirable given the workload -- India's doctor to patient ratio is 1:1,700 -- a visit to one is not always a pleasant experience. Government-run hospitals tend to be a messy, chaotic affair. Madhuri, therefore, is fortunate. She has a fever and has been feeling nauseous but she will not have to make the trek to the nearest government hospital. She will instead go to her mohalla or neighbourhood clinic the first of which was set up by Delhi's Aam Aadmi Party (common man party) government in July 2015. At the clinic, Madhuri is taken to a doctor who gives her a physical check-up and then takes a blood sample to test for dengue fever. Madhuri's results come back in under a minute. In under a minute! How can that be possible? Even a private laboratory in Delhi takes at least a day to return test results. The miracle worker in this little two-room clinic in the Indian capital's Peeragarhi area is Swasthya Slate, a compact, 8x12-inch portable device that hooks up to Android phones and tablet computers and allows doctors to conduct as many as 33 diagnostic tests – including for malaria, dengue, hepatitis B, typhoid, and HIV. A blood or urine sample is placed on a disposable strip, inserted into the Slate, and in less than a minute the results show up on the doctor's tablet or phone. The Slate can also do an ECG and check blood pressure and heart rates. ((insert picture here of the Swasthya Slate) The Swasthya (means health in Hindi) Slate has been a hit so far with both doctors and patients. Each unit costs about Rs 40,000 or US$ 600. Aided by the Slate, a doctor is able to see and diagnose about 50 per cent more patients than he did before. “As many as 300 patients come to us a day. Earlier, I could diagnose about 100 of them. Today, over an eight-hour shift and with the help of the Slate, I can diagnose as many as 150," says Rather Basit Nazir, the government doctor who has been manning the Peeragarhi clinic. The next time those 150 patients come in, Nazir will have their medical history handy, for the Slate stores it in the cloud. “I have all his information handy before a patient gets to me. I don’t have to call him back with his test reports. That helps both us and the patient save time,” says Nazir. Which was exactly why Dr Kanav Kahol, a biomedical engineer and researcher at Arizona State University, invented the Slate – to speed up testing and to cut costs. The Slate also recommends what treatment and medication can be given to patients, says Dr Vijender Jeph, who heads business development for the Slate. Madhuri's test comes back positive. She does have dengue fever. Dr Basit checks his phone – to see what the Slate tells him about treatment – and writes out a prescription. As an added precaution, he also tests Madhuri's four-year-old son. His test has a negative report. The mohalla clinics have themselves been revolutionary. They were set up to pare down the overcrowding that government hospitals in India, especially in the bigger cities, are synonymous with and, of course, to provide affordable healthcare to people closer to their homes. Private hospitals in India tend to be good but expensive. The Delhi government had promised that a 100 clinics would come up by July. So far they have set up 22. "Plus, I never got free medicine there. Here I do. And the tests are so quick. I certainly hope my mohalla clinic stays. In fact, I hope they build all 100."
