Delhi Election 2020: PM Modi urges people to go out & vote

Delhi Chief Minister Arvind Kejriwal on Tuesday dared the rival BJP to declare its chief ministerial candidate for the Delhi Assembly and said that it's the right of the Delhi's voters to choose their chief minister and not that of Union Home Minister Amit Shah who wants city voters to give him a "blank cheque".

He said that if the BJP does not declare its chief ministerial candidate, the votes given to the party will "go into a pit".

"People of Delhi are demanding from BJP to reveal its chief ministerial candidate. People want to know who they are voting for. If they do not reveal their CM candidate, then the votes of the people are going into a pit," Kejriwal said while speaking to ANI.

"In a democracy, the people choose their chief minister and not anyone else. The people should have the right to choose who they want as their chief minister. Amit Shah is asking people of Delhi to give him a blank cheque so he can fill in the name of the chief minister," the Delhi Chief Minister added.

Kejriwal said that he is ready to debate with BJP's chief ministerial candidate.

"If BJP declares its chief ministerial candidate, I am willing to participate in a debate with that person. (Union Home Minister) Amit Shah is asking people to vote for the BJP so that he can choose the chief minister," Kejriwal said.

On Tuesday, AAP also released its manifesto for the upcoming assembly polls, which are scheduled to be held on February 8. The counting of votes will take place on February 11.

"Religion must be restricted to spheres which legitimately appear in the religion, and the rest of life must be regulated, unified and modified in such a manner that we may evolve, as early as possible a strong and consolidated nation. Our first problem and the most important one is to produce national unity in this country. We think we have got national unity but there are many factors -and important factors - which still offer serious danger to our national consolidation, and it is very necessary that the whole of our life, so far as it is restricted to secular spheres, must be unified in such a way that as early as possible, we may be able to say, "Well, we are not merely a nation because we say so, but also in effect, by the way, we live, by our personal law, we are a strong and consolidated nation"- These were the words of &nbsp;K.M.Munshi, a distinguished member of Constituent Assembly of India and a leader who campaigned for eliminating caste-based discrimination, promoted women’s education and widow remarriages while addressing the Constituent Assembly debate on the issue of Uniform Civil Code.

According to the Directive Principles of the State Policy in the Constitution of India, “The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India.”

It was the vision of leaders like Munshi, Hansa Mehta, Alladi Krishnaswami Ayyar, Rajkumari Amrit Kaur and Dr BR Ambedkar who keeping in mind the intricacies, variation and dimension of our nation saw the Uniform Civil Code as part of the state’s responsibility’ to establish a single Indian identity instead of multiple religious identities.

The Constituent Assembly sat for the first time on December 9, 1946 and completed its task of framing the Indian Constitution in 2 years and 11 months. The Constituent Assembly had 11 sessions and sat for a total of 165 days. On November 26, the Constituent Assembly adopted the Constitution of India which came into force on January 26, 1950.

Uniform Civil Code was debated on December 23, 1948, wherein the Muslim members opposed it and moved amendments to keep personal laws out of the Constitution’s scope and introduce a provision that operationalised the Uniform Civil Code (UCC) only with the prior assent of the community.

In their opinion, the Uniform Civil Code violated freedom of religion and would create disharmony within the Muslim community and will be an interference in personal law without the approval of religious communities.

Members in favour argued that the UCC was important to uphold the unity of the country and the Constitution’s secular credentials.

Alladi Krishnaswami Aiyar was of the opinion that differential systems contribute to the differences among peoples of India. He said that by not having Uniform Civil Code we were departing from the goal where we wanted the whole of India to be welded and united together as a single nation. His assertion was that without uniformity in civil code, this country will be kept up always as a series of competing communities.

KM Munshi pointed out that even if this clause (Uniform Civil Code) is not put in, it did not mean that Parliament in future would have no right to enact a Uniform Civil Code and stated that Article 19, accepted by the House unanimously, permitted legislation covering secular activities. “The whole object of this Article is that as and when the Parliament thinks proper or rather when the majority in the Parliament thinks proper an attempt may be made to unify the personal law of the country.”

On the question of it being tyrannical, Munshi pointed out, ‘’Nowhere in advanced Muslim countries the personal laws of minorities has been recognised as so sacrosanct as to prevent the enactment of a Civil Code. Take for instance Turkey or Egypt, no minority in these countries is permitted to have such rights. Munshi further said that when you want to consolidate a community, you have to take into consideration the benefit which may accrue to the whole community and not to the customs of a part of it. It is not, therefore, correct to say that such an act is the tyranny of the majority. If you will look at the countries in Europe which have a Civil Code, everyone who goes there from any part of the world has to submit to the Civil Code. It is not felt to be tyrannical to the minority.

The point, however, is this, whether we are going to consolidate and unify our personal law in such a way that the way of life of the whole country may in course of time be unified and secular. If, however, the religious practices in the past have been so construed as to cover the whole field of life, we have reached a point when we must put our foot down and say that these matters are not a religion, they are purely matters for secular legislation. This is what is emphasised by this article.”

BR Ambedkar made a &nbsp;point that it will not be the first time that Muslims will be governed by a law other than their own. He said, “My honourable friends have forgotten, that, apart from the North-West Frontier Province, up till 1937 in the rest of India, in various parts, such as the United Provinces, the Central Provinces and Bombay, the Muslims to a large extent were governed by the Hindu Law in the matter of succession”.

Hansa Mehta, the member of the Fundamental rights sub-committee, the advisory committee and the provincial constitutional committee, made a significant contribution to the Constituent Assembly debates in trying to make the Uniform Civil Code (UCC) a justiciable part of the constitution. According to her, personal laws were dividing the nation. “It is therefore very essential if we want to build up one nation to have one Civil Code.”

She opined that last rulers (British) created religious and communal minorities in order to help their policy of divide and rule and that policy led to the partition of this country. She said, “We do not want any more partitions. What do the minorities want? What can be their claims? The Constitution guarantees equal protection of the law, equality of status, equality of opportunity; the Constitution guarantees religious rights. What more can the Minorities ask for? If they want privileges, that is not in the spirit of democracy. They cannot ask for privileges”.

Time to honour commitment on Uniform Civil Code

Union Home Minister Amit Shah on Thursday said if a competition to make false promises is held in the country, Delhi Chief Minister Arvind Kejriwal will win the first prize. He also alleged that the AAP leader had forgotten the promises he had made to the people of Delhi.

“If there is a competition in the country of making false promises, Kejriwal would get the first prize. I have come to remind you that you forgot the promises you made, but neither the people of Delhi nor BJP workers have forgotten,” Shah said.

The Union minister was addressing a public meeting in West Delhi’s Matiala constituency ahead of the assembly polls here on February 8. “You became CM with the help of Anna Hazare but couldn’t bring a law for Lokpal and when Modi ji brought it you didn’t implement it here,” he said.

For four and a half years the chief minister kept saying Prime Minister Narendra Modi did not let him work so development could not be done in Delhi, Shah said. “Now, you (Kejriwal) are saying that you developed Delhi in five years so ‘lage raho Kejriwal’,” he added.

Give PM Modi a chance to transform Delhi into a front-ranking world capital: Amit Shah

Amid the countrywide demonstrations against the <a href="https://www.wionews.com/india-news/citizenship-amendment-act-is-wrong-and-should-be-denounced-says-canadian-leader-jagmeet-singh-270270">Citizenship Amendment ACT</a> (CAA), Union&nbsp;Home Minister Amit Shah on Tuesday asserted that the law will not be scrapped irrespective of the protests.

While addressing a rally, Shah said, "I declare here in Lucknow, that whoever wants to protest against CAA is free to do so but this law will not be rolled back."

"Prime Minister Narendra Modi has today granted an opportunity to the persecuted minorities from the neighbouring countries to start a new life," Shah also said, adding that it has "no provision for taking anyone's citizenship away"
&nbsp;&nbsp;
He further <a href="https://www.wionews.com/india-news/parties-rejected-by-people-are-spreading-misinformation-pm-modi-amid-citizenship-act-protests-275504">attacked opposition parties</a> and said, "Canards being spread against CAA by Congress, Samajwadi Party, Bahujan Samaaj Party and Trinamool Congress."

''I challenge Rahul Gandhi, Akhilesh Yadav, Mamata Bannerjee and Mayawati for a discussion on CAA with me in public forum,''&nbsp;Shah also said

"Congress has become blind due to vote bank politics," he said. He also blamed the Congress for Partition.

Addressing a rally in support of the CAA, Shah also declared that construction of a Ram temple "touching the skies" in Ayodhya and will begin within three months.

Shah drew a parallel between the opposition and Pakistan Prime Minister Imran Khan and said that they speak the same language.

"In effect, the opposition speaks the same language as Imran Khan. They ask for proof of surgical and airstrikes, they oppose abrogation of Art 370 in Jammu and Kashmir and they oppose the CAA," he said.

The Citizenship Amendment bill sailed through both houses of Parliament earlier this month and became a law after the getting assent of President Ram Nath Kovind. Since the enactment of the Act, anti-CAA protests have erupted in parts of the country during which several clashes between police and protesters have taken place.

The bill, now an Act, seeks to grant citizenship to Hindus, Sikhs, Jains, Parsis, Buddhists and Christians fleeing religious persecution from Pakistan, Afghanistan and Bangladesh who came to India on or before December 31, 2014.

The Act came into effect on January 10 despite the protests which are still underway in many parts of the country.&nbsp;

The Bru tribe, also known as the Reangs, has been central to the politics of Mizoram and Tripura for over two decades now.&nbsp;

Mizoram assembly election in 2018 was historic, momentous in a way because the displaced Brus - those still living in refugee camps in Tripura for over 21 years - crossed the state border to Kanhmun village in Mamit district of Mizoram, to vote in their homeland for the first time since 1997 -- until now they were made to vote at their shelter camps in Tripura.

The Brus, a total of over 30,000 people, had to flee Mamit, Kolasib and Lunglei districts of Mizoram around twenty-two years back due to a communal conflict with the Mizos.

The Mizos called the Brus not indigenous to the land, asking them to be stripped of their voting rights. The Young Mizo Association and Mizo Students’ Association wanted Brus to be removed from electoral rolls, calling them non-indigenous to Mizoram.

The Brus had to flee Mizoram after a Bru National Liberation Front (BNLF) militant allegedly killed a Mizo forest guard and the communal conflict intensified. The Bru National Union (BNU) demanded an independent tribal district. They claimed that many houses inhabited by Bru families were torched down while hundreds were killed and raped. As tensions escalated, over 32,000 Brus fled to Tripura and took shelter as refugees in camps.

For over two decades, the politics over Bru repatriation heated and mellowed down with fates of thousands of Brus in a limbo.

The repatriation process started in the year 2010 and failed over fresh communal dissent with only close to 8,000 repatriated. Former Union Home Minister Rajnath Singh had initiated a deal between the Centre, the Brus and the governments of Mizoram and Tripura. In July 2018, an agreement was signed, reinforcing the commitment to repatriate over 30,000 Brus to Mizoram, also laying down guidelines of the assistance to be given to the community.

As per the 2018 agreement, the Brus were promised Rs 1.5 lakh as housing assistance, Rs four lakh for sustenance, free ration for 2 years and Rs 5,000 per month.

However, the repatriation process was interrupted again with the Brus expressing dissatisfaction with the assistance package. Some demanded the release of cash assistance in advance when the Central government maintained that Rs four lakh will be provided only after three years of uninterrupted stay in Mizoram.&nbsp;

In November 2019, Tripura Chief Minister Biplab Kumar Deb had agreed to settle the refugees in Tripura.&nbsp;

On Thursday, finally, a deal was brokered between the Mizo and Tripura chief ministers, the Bru representatives and the Ministry of Home Affairs.&nbsp;

As per the agreement, over 30,000 Bru refugees will now be settled in Tripura. The central government has sanctioned Rs 600 crore package for the same.

"Bru refugees will get a 40 by 30 feet plot along with a fixed deposit of Rs 4 lakhs, cash assistance of Rs 5,000 per month for 2 years and free ration," Amit Shah announced today.&nbsp;

The chief ministers of Tripura and Mizoram welcomed the move.&nbsp;

Union Home Minister<a href="https://www.wionews.com/india-news/amit-shah-blames-aap-congress-for-recent-riots-272522"> Amit Shah</a> on Saturday reiterated that the <a href="https://www.wionews.com/opinions/caa-and-nrc-protests-addressing-concerns-of-protesters-a-must-for-government-268749">Citizenship Amendment&nbsp;Act</a> was enacted to give citizenship and not take it away, while also urging people to steer clear of opposition parties who are "spreading lies".

"No citizenship can be taken away by the Citizenship Amendment&nbsp;Act. It was only enacted to grant citizenship. The opposition parties are spreading lies. I only want people of <a href="https://www.wionews.com/photos/gujarats-contribution-to-india-600#gujarat-contributes-73-per-cent-to-the-national-gdp-60942">Gujarat</a> to stay away from such people," Shah said, pursuant to inaugurating VISWAS and Cyber Aashvast Project in Gujarat's Gandhinagar.

The newly-enacted law grants citizenship to Hindus, Sikhs, Jains, Parsis, Buddhists and Christians fleeing religious persecution from Pakistan, Afghanistan and Bangladesh and who came to India on or before December 31, 2014.

Protests have been happening across the country ever since the law received the presidential assent last month.

Citizenship Amendment Act will not take away citizenship: Amit Shah

After the Supreme Court on Friday directed the Jammu and Kashmir administration to review the restrictive orders imposed in the Union Territory within a week, Congress leader <a href="https://www.wionews.com/india-news/supreme-court-to-pass-order-on-plea-against-government-formation-in-maharashtra-264525">Kapil Sibal</a> on Friday questioned Home Minister <a href="https://www.wionews.com/india-news/jnu-row-protesters-in-mumbai-moved-from-gateway-of-india-to-azad-maidan-272640">Amit Shah</a>, asking what was the 'emergency' behind imposing Section 144 on August 4, 2019, and said that it cannot be used to 'suppress' the freedom of speech.

Addressing a press conference at the Congress headquarters, Sibal said, "I want to ask the Home Minister (Amit Shah) that what was the emergency on August 4? You cannot use <a href="https://www.wionews.com/india-news/uttar-pradesh-section-144-extended-for-security-in-ayodhya-till-25-february-270783">Section 144</a> to suppress freedom of speech. I want to tell the Home Minister, the government that if it will listen to the voice of people, it will always remain in governance."

The top court while hearing the petitions challenging restrictions in Jammu and Kashmir stated that the right to <a href="https://www.wionews.com/opinions/protests-in-the-times-of-internet-shutdowns-271396">access the internet</a> is a fundamental right under Article 19 of the Constitution of India.

"Today the Supreme Court has given a historic <a href="https://www.wionews.com/india-news/supreme-court-orders-review-on-all-restrictive-orders-in-jammu-and-kashmir-after-article-370-abrogation-273307">verdict</a> in the matter of Jammu and Kashmir, the citizens of the country were worried that the people do not know about the situation in Kashmir. No one was able to get out of the house, there was no communication, that is why we had filed a petition and stated that Section 144 should be reviewed," said Sibal.

"The court has clearly stated that whatever order regarding the imposition of Section 144, the Jammu and Kashmir administration should put in the <a href="https://www.wionews.com/india-news/envoys-term-srinagar-interaction-with-locals-positive-internet-restoration-peace-dominate-the-meet-273264">public domain</a> so that people can challenge it if they want to. Moreover, the decision to suspend internet services cannot be made for an indefinite time," he added.

The top court said that Kashmir has seen a lot of violence and that it will try to maintain a balance between human rights and freedoms with the issue of security.
It also directed the Jammu and Kashmir administration to review the restrictive orders imposed in the region within a week. "The citizens should be provided highest security and liberty,' the apex court said.

The top court made observations and issued directions while pronouncing the verdict on a number of petitions challenging the restrictions and internet blockade imposed in <a href="https://www.wionews.com/india-news/jammu-kashmir-is-now-corruption-free-mukhtar-abbas-naqvi-273161">Jammu and Kashmir</a> after the abrogation of Article 370 in August last year.

The Supreme Court had on November 27 reserved the judgment on a batch of petitions challenging restrictions imposed on communication, media and telephone services in Jammu and Kashmir pursuant to revocation of Article 370.

The court heard the petitions filed by various petitioners including <a href="https://www.wionews.com/india-news/assams-aiudf-protests-against-citizenship-amendment-bill-in-delhi-267164">Ghulam Nabi Azad</a> and Kashmir Times editor Anuradha Bhasin.
.
The petitions were filed after the central government scrapped Article 370 in August and bifurcated Jammu and Kashmir into two Union Territories, Jammu and Kashmir, and Ladakh.

Following this, phone lines and the internet were blocked in the region. The government had, however, contended that it has progressively eased restrictions.

Speaking about the delegation of 15 <a href="https://www.wionews.com/india-news/around-15-foreign-envoys-to-tour-jammu-and-kashmir-on-thursday-eu-envoys-next-273050">foreign envoys</a>, who are on a two-day visit to Jammu and Kashmir, Sibal took a dig at Prime Minister Narendra Modi and raised a question about his 'attachment' with the foreigners.

"I want to ask the Prime Minister that why are you so attached to the foreign people and not the people of this country? Get open with the people of India too and get transparent. Let us also visit, why do you trust others and not us?" said Sibal.

A delegation of 15 foreign envoys, who are on a two-day visit to Jammu and Kashmir, met civil society representatives and community leaders in Jammu on Friday.
The delegation had arrived in Jammu and Kashmir on Thursday and met political leaders and senior Army officials in Srinagar.

After the Supreme Court on Friday directed the Jammu and Kashmir administration to review the restrictive orders imposed in the Union Territory within a week, Congress leader Kapil Sibal on Friday questioned Home Minister Amit Shah, asking what was the 'emergency' behind imposing Section 144 on August 4, 2019, and said that it cannot be used to 'suppress' the freedom of speech.

Addressing a press conference at the Congress headquarters, Sibal said, "I want to ask the Home Minister (Amit Shah) that what was the emergency on August 4? You cannot use Section 144 to suppress freedom of speech. I want to tell the Home Minister, the government that if it will listen to the voice of people, it will always remain in governance." The top court while hearing the petitions challenging restrictions in Jammu and Kashmir stated that the right to access the internet is a fundamental right under Article 19 of the Constitution of India. "Today the Supreme Court has given a historic verdict in the matter of Jammu and Kashmir, the citizens of the country were worried that the people do not know about the situation in Kashmir. No one was able to get out of the house, there was no communication, that is why we had filed a petition and stated that Section 144 should be reviewed," said Sibal. "The court has clearly stated that whatever order regarding the imposition of Section 144, the Jammu and Kashmir administration should put in the public domain so that people can challenge it if they want to. The top court made observations and issued directions while pronouncing the verdict on a number of petitions challenging the restrictions and internet blockade imposed in Jammu and Kashmir after the abrogation of Article 370 in August last year. The Supreme Court had on November 27 reserved the judgment on a batch of petitions challenging restrictions imposed on communication, media and telephone services in Jammu and Kashmir pursuant to revocation of Article 370. The court heard the petitions filed by various petitioners including Ghulam Nabi Azad and Kashmir Times editor Anuradha Bhasin. Speaking about the delegation of 15 foreign envoys, who are on a two-day visit to Jammu and Kashmir, Sibal took a dig at Prime Minister Narendra Modi and raised a question about his 'attachment' with the foreigners. Delhi deputy chief minister Manish Sisodia on Tuesday took a jibe at Home Minister Amit Shah over the installation of CCTVs in the national capital, reported news agency ANI.

Delhi deputy chief minister Manish Sisodia on Tuesday took a jibe at Home Minister Amit Shah over the installation of CCTVs in the national capital, reported news agency ANI. "Amit Shah is questioning where the CCTVs we promised. Well, I would like to assure you that you don`t have to look through `durbeen` (binocular) just raise your eyes and find it on every lane. You are also being recorded while doing door to door campaigns don`t worry," Sisodia was quoted as saying to reporters in Delhi. After the Election Commission announced the poll schedule for Delhi, Shah accused the AAP government of making empty promises. "In the last 60 months, the Aam Aadmi Party government made only promises and now in the last 3 months, the public development money was spent on advertisements for its announcements. People of Delhi are still looking for free wifi, 1.5 million CCTV cameras, new colleges and hospitals," Shah tweeted. Delhi, where 70 seats are at stake will go to polls on February 8 while the counting of votes will take place on February 11. In 2015 assembly polls, the AAP won 67 of 70 seats while the BJP could win only three seats. The Congress, which was in power for 15 years in between the years 1998 and 2013, failed to get any seat.

Just look up, you will find CCTVs on every lane: Sisodia to Shah

The Act grants Indian citizenship to Hindu, Christian, Sikh, Buddhist and Parsi refugees from Pakistan, Afghanistan, and Bangladesh, who entered India on or before December 31, 2014.

The opposition Congress has time and again criticised the amended law, deeming it discriminatory. While Rahul has termed it an attack on the poor, his sister Priyanka has dubbed the new law unconstitutional.

"They (AAP) promised that they will install 15 lakh CCTV cameras across the capital. So far, they have not fulfilled their promise. They also promised to make the contractual teachers and employees permanent. This task has also not been completed by them. And whatever development we want to bring in Delhi, Kejriwal is becoming an obstruction in that also. People of Delhi now know them properly," he said.

"I urge the people of Delhi to seek report of the work undertaken by the Arvind Kejriwal government while being in power for the past five years," the Union Minister said in his concluding remark.

Union Home Minister Amit Shah on Thursday said that no previous government thought about the people living in unauthorised colonies of the national capital, who were given the ownership right of their lands only recently by the BJP led Central government.

"Prime Minister Narendra Modi removed the hurdle of 13 legal procedures by one Cabinet note and gave ownership right to 40 lakh people living in unauthorised colonies of the national capital," said Shah while addressing a gathering.

The Union Cabinet last month approved the Bill to provide a legal framework to grant ownership rights to the people living in unauthorised colonies in the national capital.

"There are 1,731 unauthorised colonies in Delhi where over 40 lakh people are living. These people have been living here for several generations but no previous government thought about them or their welfare," said Shah.

The Union Home Minister said that Prime Minister Narendra Modi cares about those living in these areas.

"Prime Minister Modi said that a lot of poor people have been living in these areas for generations but cannot take loans or have the ownership of their properties, as these colonies are not authorised," said Shah.

The Home Minister also said that 4,526 houses will be provided to the poor people and 2,088 units have been provisioned for the people belonging to the economically weaker sections of the society in the city.

Accusing Delhi Chief Minister Arvind Kejriwal of stealing credit for the Central government's developmental works, Shah quipped that Kejriwal might try to take credit for this as well.

The National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Bill, 2019, was passed by Parliament on December 4.

The new legislation regarding the regularisation of unauthorised colonies recognises and confers rights of ownership or transfer or mortgage to the residents of such colonies on the basis of power of attorney, agreement of sale, will, possession letter, and other documents.&nbsp;
