<p>The Delhi High Court issued notice to the Centre, Election Commission of India (ECI), and 26 political parties on a Public Interest Litigation (PIL) seeking a directive to opposition political parties to restrict the use of the acronym I.N.D.I.A. (Indian National Developmental Inclusive Alliance) for their political alliance.&nbsp;</p>

<p>On Friday, the bench of Justice Satish Chander Sharma and Justice Amit Mahajan sought the response of the Centre through the Ministry of Home Affairs (MHA), the Ministry of Information and Broadcasting, and the Election Commission of India (ECI) and listed the matter for hearing on October 31, 2023.</p>

<p>"It has to be heard. It requires hearing. Notice issued," the bench said.</p>

<p>However, it refused to pass any interim order and also said that no order can be passed without hearing the respondents.</p>

<p>"We can't pass any order like this. Let the response of the other side come. We will definitely look into it," the bench said.</p>

<p>Petitioner Girish Bharadwaj, through his Advocate Vaibhav Singh, said that many political parties were using the Indian flag as a symbol for their alliance as a strategy to attract and gain the sympathy and votes of the citizens of the country. He further stated that this move could also be directed towards giving a nudge that may instigate political hatred triggering violence in the country.</p>

<p>The petition also stated that these political parties, during their meeting in Bengaluru,&nbsp; declared that they will contest the elections together in the year 2024 against the ruling Bharatiya Janata Party (BJP)-led National Democratic Alliance (NDA).</p>

<p>"By dragging the name of our nation, Mr. (Rahul) Gandhi very cunningly presented the name of their alliance as the name of our nation and tried to show that the NDA/ BJP and Hon'ble Prime Minister Mr. (Narendra) Modi is in conflict with our own nation, that is, INDIA and this attempt of Mr. Gandhi had created confusion in the mind of common people that the upcoming general election of 2024 will be a fight between political parties or between alliance and our country."</p>

<p>"That by creating this confusion, the respondent political parties want to take undue advantage in the name of our country," the plea said.</p>

<p class="MsoNormal">In its verdict, the apex court said, “There is no doubt that utterances are not in good taste, person in public life is expected to exercise caution while making public speeches.” The court accepted his affidavit in the contempt petition and observed that Gandhi ought to have been more careful.<o:p></o:p></p>

<p class="MsoNormal">Supreme Court said that the trial court judge did not give any reason for imposing the maximum sentence on Gandhi and added that the order of conviction needs to be stayed pending final adjudication.<o:p></o:p></p>

<p class="MsoNormal">Granting relief to the Congress leader, Supreme Court said that the ramifications of the order given by the trial court are wide. “Not only was Gandhi’s right to continue in public life affected but also that of the electorate who elected him,” said the court.</p>

<p class="MsoNormal">Senior advocate Abhishek Manu Singhvi, who was representing Rahul Gandhi in the court, said that the comments of the former Congress president on the “Modi surname” were not an offence against society, reported news agency ANI.<o:p></o:p></p>

<p class="MsoNormal">“First of all, Purnesh Modi’s (complainant) original surname is not Modi…He changed his surname… Not a single of the persons Gandhi had named during his speech have sued. Interestingly, everybody who is aggrieved in this very ‘small’ community in 13 crores, only people suing are BJP office-holders,” said senior advocate Abhishek Singhvi, as quoted by legal website Live Law.<o:p></o:p></p>

<p class="MsoNormal">“The judge treats this as a serious offence involving a moral turpitude. This is a non-cognisable, bailable, and compoundable offence. The offence was not against society, not kidnapping, rape, or murder. How can this become an offence involving moral turpitude?” Singhvi quizzed.</p>

<p class="MsoNormal">The Supreme Court stated that it wanted to know why Gandhi was given the maximum sentence. “Had the judge given a sentence of 1 year and 11 months, then he (Rahul Gandhi) would not have been disqualified,” the Supreme Court stated.</p>

<p>Congress general secretary Priyanka Gandhi Vadra, hailing the decision of Supreme Court, cited&nbsp;Gautam Buddha's quote&nbsp;which said “Truth cannot be long hidden”.</p>

This week’s news is that laptop imports are getting costlier because India wants to encourage their domestic manufacturing. India wants to gain from the fact that multinational giants are aiming to diversify capabilities in other countries because Beijing now poses both economic and military threats to the West.<o:p></o:p></p>

<p class="MsoNormal">However, I learnt recently that China is unfairly dumping an increasing number of low-cost/low-quality goods into India, often unchecked -- and sometimes deliberately overlooked by authorities -- because the trouble of reducing imports is probably more than the advantage of a "Make In India" gain.<o:p></o:p></p>

<p class="MsoNormal">The World Trade Organisation refers to dumping, in general, as a situation where the price of a product sold in the importing country is less than the price in the market from where it is exported. This is often done to hoodwink competition into death or cash in on a consumption need in the importer market.</p>

<p class="MsoNormal">First of all, in a world where WTO monitors fair play, it is difficult for policy-makers and administrators to get sufficient, authentic data to prove that dumping is taking place so they can impose countervailing duties. This is further complicated by the fact that even when proven right, there is some cost-benefit analysis done by commerce and finance ministry officials in India that ends up with the Chinese getting away with pieces of India's economy, much like some placid lake land in Ladakh.</p>

<p class="MsoNormal">In an increasingly interconnected world where globalisation has been a theme for close to four decades, one cannot wake up suddenly to nationalistic instincts without realising that you have been sleeping with someone who may be occasionally, if not frequently, described as the enemy.<o:p></o:p></p>

<p class="MsoNormal">I call it the Bollywood Climax Syndrome. Often in old Hindi movies, there is a fight scene in which the screen hero is fighting the bad guy and his goons, but it turns out that the villain has captured close relatives (often the heroine or his mother) and is blackmailing the handsome good guy. Picture China like a bad guy fighting whom can pose at least temporary setbacks to the Indian economy's good guys.</p>

<p class="MsoNormal">I was recently sent reports by a think-tank, the Centre for Digital Economy Policy Research, that showed that the commerce ministry and sometimes its big brother, finance, have been rejecting legitimate anti-dumping claims. Intrigued, I spoke to my ministry sources and was told that this may indeed be true but the problem is not easy to navigate because downstream industries that use Chinese products as raw materials or inputs tend to suffer due to higher costs when anti-dumping duties are imposed. Many downstream industries tend to be small and medium enterprises (SMEs) that spin jobs in an economy that badly needs to create more jobs and also keep inflation low.<o:p></o:p></p>

The finance ministry has upheld a recommendation from the Directorate -General of Trade Remedies in the commerce ministry to impose an import duty on Chinese, Korean and Indonesian optical fibres after DGTR conducted investigations. But you know how it is. If the optic fibre lobby is powerful, the telecom service provider lobby is at least as powerful if not more -- as it is a more sentimental story when your Internet bills go up. Let us see how it goes.<o:p></o:p></p>

The government could with a workman-like approach to build a roadmap on how to go about taking on the Chinese dragon.<o:p></o:p></p>

<p class="MsoNormal">In Bollywood movies, there is always a smart manoevure by the hero or his associate to outwit the villain - and sometimes, there is a sacrifice made. That depends on the plot writers. But more often than not, there is a happy ending. What we need in the commerce and finance ministries are a bunch of options that they can borrow from Bollywood scriptwriters.<o:p></o:p></p>

<p class="MsoNormal">My easy guess: Try cushioning downstream industries with alternate incentives like cheaper finance or marketing support or higher depreciation or some direct tax benefit. It is a messy business involving too much data and detail. But you get the picture. The optic fibre story is hopefully a good beginning.<o:p></o:p>&nbsp;</p>

<p>Within the Asia Pacific basket, India has&nbsp;now replaced Japan as the primary 'overweight' market for Morgan Stanley.&nbsp;</p>

<p>“We upgrade India to overweight for secular leadership. We see a secular trend towards sustained superior USD Earnings Per Share&nbsp;growth versus Emerging Markets over the cycle," the note read. It added that&nbsp;a young demographic profile is supporting equity inflows into India.</p>

<p>The Morgan Stanley note added that India’s future resembles China’s history to a large extent. In comparison to India’s 6.5 per cent GDP growth, the brokerage anticipates China’s GDP to expand by only 3.9 per cent by the end of the decade.</p>

<p>"We think returning India to an 'overweight' rating and downgrading China to 'equal weight'&nbsp;is warranted," analysts said. They were referring to the Indian markets' outperformance over China as a sign of a structural breakout in favour of India.</p>

<p>Members of the so-called INDIA alliance wrote a letter to Speaker Om Birla to make it clear that they were not happy with the discussions to be held on the last three days of the ongoing monsoon session.</p>

<p>Outlook India quoted a senior INDIA alliance member as saying, “We told the Speaker that the government is using this opportunity to pass a number of bills and we want to participate in the discussion. If the no-confidence discussion takes place at the earliest, then we can participate in the discussion on the legislative agenda.”</p>

<h2><strong>No-confidence motion vs censure motion</strong></h2>

<p>According to media reports, opposition parties are considering moving either a no-confidence or censure motion in the upper house of the parliament or Rajya Sabha.&nbsp;</p>

<p>While a no-confidence is moved against the government or the Council of Ministers, a censure motion is regarded as a strong reprimand by the legislature and can be moved against both individuals and the Council of Ministers. Censure motion is also used to condemn certain policies or legislations introduced by the government.&nbsp;</p>
