Temporary victory? US court blocks National Archives from sharing Trump records with riots panel

In August 2018, Mark Lantis’ mother dropped him off at a trailhead at Yellowstone National Park to search for the buried treasure of an eccentric millionaire. But after going off trail and getting lost in the Wyoming backcountry, Lantis ended up in need of a helicopter airlift.

He ultimately did not find the treasure, but he was charged with reckless disorderly conduct. After a hearing before a magistrate judge in 2019, Lantis was convicted and sentenced to five years of unsupervised probation. He was also banned for five years from Yellowstone National Park and ordered to pay a $2,880 fine to cover the cost of the rescue.

Lantis, a former oil field worker in his 40s, appealed the verdict in U.S. District Court in Wyoming by arguing that the legal definition of recklessness did not apply to his case. When that court upheld the ruling, he appealed to the 10th U.S. Circuit Court of Appeals. Last week, the appellate court also upheld his conviction, concluding that Lantis “consciously disregarded a known risk” when he decided to search for the treasure buried by the millionaire, Forrest Fenn.

“I’m going to keep fighting, I’ll tell you that,” Lantis said in an interview Thursday. Lantis, who is unemployed and has been represented by public defenders since the start of the case, said that he was aware that to keep fighting the charge might cost him legal fees, but that he hoped another public defender would be assigned to the case.

In his 2010 memoir, “The Thrill of the Chase,” Fenn, an adventure-loving art dealer and antique collector from New Mexico, said he had hidden a bronze chest filled with gold nuggets and jewels in the Rocky Mountains at 5,000 feet above sea level. He encouraged people to find it, and thousands tried. At least two people died in the process.

Treasure hunting poses a specific risk by causing people to become myopic and less aware, said Chris Boyer, executive director of the National Association for Search and Rescue, a nonprofit organization.

“Whenever there’s a reward at the end of a journey like this, it certainly focuses people, right? And it doesn’t focus them the right way sometimes,” Boyer said. “They can conveniently ignore problems, thinking that the benefit outweighs what they’re doing.”

As stated in the decision from the appeals court, Lantis planned for a one-day excursion on the Mount Holmes Trail, a strenuous hike in Yellowstone National Park. He wore a T-shirt, jeans, a light windbreaker and tennis shoes. Lantis carried a small backpack, water, bear spray, a cellphone, a walkie-talkie and a hand-held GPS. He packed no food.

During his hike, Lantis noticed bear fur and droppings. When he got to the base of Mount Holmes, he decided to head back. He thought that going off trail would help avoid bears and be a faster route.

It wasn’t. Lantis ended up spending the night by the mountain. He maintains that he was “not lost” but that “it basically just took longer.”

At some point after leaving the trail, Lantis called his sister to say that he would not make it out of the park before nightfall. He spent the night “wet, cold, scared,” Lantis said in the appeal.

The next day, concerned about her son, Lantis’ mother contacted a Yellowstone park ranger. The ranger contacted Lantis and asked him to call 911 to get a better fix on his location and since Lantis’ cellphone battery was low. Lantis’ GPS system “wasn’t detailed” enough to help, he said.

Lantis was 8 miles from Mount Holmes in extremely rugged country seldom visited by park personnel and home to bears, mountain lions and wolves. The ranger was in contact with Lantis throughout the day, according to the appeal, and directed him where to walk so that he would eventually intersect with a marked trail. Court documents say the ranger was “encouraging him and trying to guide him out of the backcountry.”

By that evening, Lantis said in the interview, he needed help but only because the ranger sent him through rugged bear country. It was too late in the day for anyone to hike in and rescue Lantis before dark, so the ranger organized a helicopter rescue.

According to an appellate docket provided by Lantis’ lawyer, the ranger asked a private film crew in the area to rescue Lantis because helicopters normally used for rescue operations were unavailable to reach Lantis before dark. The park paid the company for the cost of the rescue.

Once Lantis reached safety, the ranger issued him a citation for disorderly conduct alleging that he “knowingly or recklessly created a risk of public alarm, nuisance, jeopardy.”

Charging for rescues is rare, although an increasing number of states have adopted laws or are exploring legislation that would allow them to reimburse the cost of rescues in cases of recklessness. In Lantis’ situation, the use of a helicopter made his rescue more expensive, said Boyer, who was not involved in the case.

The treasure hunt was less of an issue than Lantis’ apparent lack of preparedness, Boyer said.

“It’s OK to push your skill set or your knowledge set,” he said. “It’s not OK to push your luck.”

Boyer’s organization does not endorse charging for rescues because, he says, people should not have to weigh the potential cost if they need to call for help. Boyer worries that a fine as hefty as the one Lantis incurred will discourage people in similar situations from seeking rescue.

Fenn’s treasure was found by Jack Stuef, a 32-year-old medical student from Michigan, in June 2020.

Fenn died in September 2020 at age 90. His grandson revealed Stuef’s identity as the finder of the treasure three months after his grandfather’s death.

Fenn announced before his death that someone had found the bronze chest filled with gold and jewels. Writing on his website, he said that the treasure “was under a canopy of stars in the lush, forested vegetation of the Rocky Mountains and had not moved from the spot where I hid it more than 10 years ago.” He did not provide the precise location.

A small chunk of moon seems to be tracking the Earth’s orbit around the Sun, as per astronomers.

Although relatively little known till now, the asteroid, which is named Kamo`oalewa, was discovered in 2016.

According to the new observations, it could be a fragment from the moon, which was thrown into space by a collision several years ago.

One of Earth’s quasi-satellites, Kamo`oalewa belongs to a category of asteroid that orbits the Sun. It also remains relatively close to the planet, 9m miles away in this case.

It has the size of a ferris wheel. It is also about 4m times fainter than the faintest star, which can be seen with the naked eye.

So, to make its clear observations, powerful telescopes are needed.

A court determined that the defendant named only as ‘Sandor Cs’, due to strict privacy laws, lied down purposely in front of a moving train to pocket cash in 2014. He has been using prosthetic limbs and has remained wheelchair-bound since then. Hungarian village of Nyircsaszari’s 54-year-old resident claimed to have climbed onto the tracks so a train would run over his legs. The Pest Central District Court gave the ruling on Tuesday (November 9), almost seven years after the incident. He claimed to have taken the policies on financial advice that returns are better on insurance policies. After the incident, his wife applied for the payouts but the insurance companies did not give money by saying that they suspected he had inflicted the injury on himself. (With inputs from agencies)

In what can be called a blessing for several Indian-Americans, the United States has finally agreed to provide automatic work authorisation permits to the spouses of numerous H-1B visa holders.

On behalf of immigrant spouses, the American Immigration Lawyers' Association had filed a lawsuit. In this case, the settlement has been reached by the Department of Homeland Security, reported PTI.

Now, the spouses of H-1B and L-2 visa holders will no longer have to apply for work authorisation or need an employment authorisation document as proof to work in the country.

Jon Wasden from the association said, "This (H-4 visa holders) is a group that always met the regulatory test for automatic extension of EADs (employment authorisation documents), but the agency previously prohibited them from that benefit and forced them to wait for reauthorisation. People were suffering. They were losing their high-paying jobs for absolutely no legitimate reason causing harm to them and US businesses."

In Gaelic, “Glasgow” translates to “dear green place,” a nod to the parks, gardens and flourishing green spaces throughout the city. But according to Chris Mitchell, who was a garbage collector there for more than two decades, the only thing flourishing in Glasgow these days is “a mountain of waste.”

As diplomats at the U.N. climate summit in Glasgow this week preach about the need to curb both greenhouse gas emissions and mass consumption to protect the planet, the reality of today’s throwaway society can be seen just a short way from the conference’s doorstep.

Outside the gleaming center of Scotland’s largest city, dumpsters and trash cans are overflowing. The city’s rat population has surged, with four garbage workers hospitalized because of attacks over the past five months. And litter is strewn across streets.

Mitchell, a senior official for the GMB Scotland trade union, which represents the city’s 1,000 garbage collectors among other workers, said they staged an eight-day strike that ended on Monday because they were tired of poor working conditions, lack of respect from management and low wages. It is a cry that has been echoed throughout Britain, the United States and other parts of the world, where essential workers who carried communities through the worst of the pandemic are saying they will no longer stand for being overworked and underpaid.

“We kept people safe,” said Mitchell, 45, who started working as a garbage collector when he was 16. “We cared for the most vulnerable. We cared for the elderly.” He appreciated the nightly clap for key workers during the pandemic. But now that coronavirus cases have subsided from peak levels, he feels the government has “abandoned low paid workers who have saved this nation.”

In parts of the city, trash is now collected only once every three weeks, down from once every two weeks about a year ago. That means garbage collectors, many of whom make less than 20,000 British pounds ($27,000) a year, have to carry heavier loads up and down steps.

On top of the less frequent collections, volumes of trash per household climbed over the past two years, a reflection of increased spending on takeout and online deliveries, according to Mitchell.

“The pandemic has created waste upon waste upon waste,” he said.

The city of about 635,000 has urged residents to reduce their waste to help protect the environment, but garbage collectors like Jack McGowan, 26, say that reducing collections is not an effective way to achieve that.

“The bins are always like that,” he said Wednesday, gesturing to several overflowing dumpsters behind a block of apartments in Scotstoun, an area west of the Glasgow city center. “We need better pay. Respect as well.”

McGowan said he lives with his mother because he cannot afford a mortgage on his salary of 19,000 pounds a year.

He said he had already seen four rats jump out of trash cans that morning alone.

Glasgow promotes its recycling program and efforts to become more environmentally friendly. But McGowan said he saw examples every day of people putting nonrecyclable trash in recycling bins.

Garbage collectors said they were likely to strike again in the run-up to Christmas if they do not get pay rises. In a statement, the Glasgow City Council said that the leader of the council had already had extensive conversations with the union and that the “door remains open to all trade union colleagues.”

Fiona Ross, a council spokeswoman, said she could not go into further detail because talks were continuing.

Meanwhile, the delegates inside the COP26 summit in Glasgow say they are making some progress toward an agreement to avert catastrophic levels of climate change.

On Wednesday, the United States and China issued a joint statement in which they pledged to do more to cut emissions this decade and in which China committed for the first time to address emissions from methane. Separately, the United Nations climate agency released a draft of an accord that urged nations “to accelerate the phasing out” of greenhouse gas emissions.

But outside the climate talks, there is a mounting frustration over the disconnect between policymakers and those most affected by climate change. There have been daily protests organized by youth activists, who say that pledges by countries that they will commit to goals that are decades away is not enough.

“Nobody really wants to incur the cost of preventing climate change today,” said Sayantan Ghosal, an economics professor at the University of Glasgow’s business school. “They’re willing to do it tomorrow, but they’re not willing to do it today.”

There has also been a gap between world leaders and business executives on the one hand, who have talked this week about the urgent need for a transition to clean energy, and the working class people on the other who will be most affected by the rising costs associated with that transition.

Many of the lowest paid workers in society, including garbage collectors, are more worried about increasing prices of food, rent and energy than about increasing temperatures. They often do not have the flexibility to spend more on food and clothing that are more sustainable.

As the U.S. economy picks up again, after a lull during the pandemic, people are quitting their jobs in record numbers, according to data from the U.S. Department of Labor. There are 5 million fewer people working than before the pandemic began, and employers have struggled to find enough health care workers, waiters, truck drivers and butchers.

This has given employees newfound leverage and power.

The number of workers on strike in the United States increased in October to more than 25,000, versus an average of about 10,000 in the previous three months, according to data collected by the School of Industrial and Labor Relations at Cornell University.

The shortages have disrupted Britain, which has struggled to find workers to make up for the thousands of European workers who left in five years since Britain voted to leave the European Union.

Mitchell, the senior union official, said that 20 drivers had left the garbage collection team in recent weeks for other truck driving jobs that are offering better pay.

Peter Welsh, a union spokesman, said Scotland needed to invest in the workers who will help deliver a transition to a greener economy.

“There are huge, huge challenges that I don’t quite think mainstream politics have begun to grasp and understand,” he said.

If a new study could be believed, Moon's surface has enough oxygen to keep billions of people alive for around 100,000 years.

Moon's regolith is made up of approximately 45 per cent oxygen. The regolith is easily accessible on the surface of the satellite.

Around one cubic meter of lunar regolith contains 1.4 tonnes of minerals on average. It includes about 630 kg oxygen.

As per NASA, humans need to breathe about 800 grams of oxygen in a day to survive. So, 630 kg oxygen can keep a person alive for around two years.

If the average depth of regolith on the Moon is about 10 meters, then all of the oxygen can be extracted from it. In a nutshell, the top 10 meters of the Moon's surface can provide enough oxygen to support 8 billion people on Earth for around 100,000 years.
