India's fugitive businessman Vijay Mallya loses battle to keep central London home

The fugitive Kingfisher tycoon Vijay Mallya is facing the prospect of a humiliating eviction from the luxury Central London home he currently occupies after the UK High Court ruled against him in a dispute with the Swiss bank UBS.

Mallya held a mortgage obtained from UBS on the multi-million-pound property, located along Cornwall Terrace in one of the most sought after areas of the British capital, minutes from Regent`s Park and attractions such as Madame Tussaud`s wax museum.

It`s believed that Mallya has lived in the property along with his son Siddharth and his 95-year-old mother Lalitha.

A judge sitting in the chancery division of the High Court on Tuesday refused a request by Mallya`s lawyers for a stay on repaying the UBS loan after Mallya had failed to meet a previous repayment deadline in April 2020.

UBS, however, was unable to evict the Mallyas due to COVID regulations. Today`s ruling paves the way for UBS to repossess the property. It`s believed that Mallya and his family own numerous other properties in the UK and elsewhere, including a sprawling country home in Hertfordshire, north of London.

Mallya has been living in London since fleeing to the UK after being accused of a Rs 9,000 crore (1.4 billion US$) fraud relating to the collapse of Kingfisher Airlines. He has consistently denied the charges. He was ordered to be extradited by the UK High Court after hearings lasting three years. He remains on bail while the UK government considers what`s thought to be an asylum application

Vijay Mallya mocks banks for saying he still owes money, shares report

The London High Court declared fugitive Indian businessman Vijay Mallya bankrupt on July 26 in a major victory for Indian banks.

This will clear the way for a group of Indian banks led by the State Bank of India (SBI) to seek a worldwide freezing order to seize Vijay Mallya's Indian assets in order to recover debt owed by his now-defunct Kingfisher Airlines.

"As at 15:42 (UK time), I adjudicate Dr Mallya bankrupt," Chief Insolvencies and Companies Court (ICC) Judge Michael Briggs said in his ruling during a virtual hearing of the Chancery Division of the High Court in London.

The Indian banks, represented by the law firm TLT LLP and barrister Marcia Shekerdemian, had argued for the bankruptcy order to be granted in favour of the Indian banks.

Mallya reportedly attempted to appeal the High Court decision but was denied permission to do so.

An application by a lender consortium led by the SBI to alter their bankruptcy case in favour of surrendering their security over Mallya's assets in India was upheld by a UK court earlier this year in May.

Meanwhile, the 65-year-old businessman remains in the UK on bail pending the resolution of a "secret" court matter, believed to be related to an asylum application, in connection with unrelated extradition proceedings.

His lawyer, Philip Marshall, asked for a stay and a postponement of the ruling while legal challenges in India are still pending.

The judge, however, denied the requests, concluding that there was "insufficient proof" that the debt would be paid in full to the petitioners within a reasonable time.

Attaching ₹140 billion assets over ₹62 billion debt 'incredible': Mallya on being declared bankrupt

A court in the United Kingdom has declared Indian fugitive businessman Vijay Mallya bankrupt. This paves the way for a consortium of Indian banks, led by the State Bank of India, to recover debt from loans.

London court declares fugitive businessman Vijay Mallya bankrupt, Indian banks can realise debt

On Wednesday, the Debt Recovery Tribunal, on behalf of the consortium, sold the shares of United Breweries for Rs 5,824.50 crore. Further realisation of close to Rs 800 crore through share sale is expected by June 25.

Vijay Mallya & PNB cases: ED transfers $1.2 BN 'Fraud Money' to banks

&nbsp;About 40 per cent of the money lost by banks in alleged frauds perpetrated by fugitive businessmen Nirav Modi, Mehul Choksi and Vijay Mallya has been recovered so far, the Enforcement Directorate (ED) said after the sale of attached shares worth over Rs 5,800 crore on Wednesday.

According to the agency, the latest sale proceeds take the total value of recovery to Rs 9,041.5 crore, or 40 per cent of the over Rs 22,000 crore allegedly defrauded by the trio.

Commenting on the development, Union Finance Minister Nirmala Sitharaman tweeted, "Fugitives &amp; economic offenders will be actively pursued; their properties attached &amp; dues recovered."

<div class="videoWrapper trancodeVideo"><iframe allowfullscreen="" autoplay="1" class="includeVideo" frameborder="0" height="350" src="https://www.wionews.com/videos/uk-judge-denies-for-more-funds-for-legal-charges-to-indian-fugitive-vijay-mallya-387657/embed" style="width:100%;max-width:560px;" width="560"></iframe></div>

The three, who fled overseas as a probe against them gathered pace, are being investigated by central investigative agencies such as the ED and the Central Bureau of Investigation (CBI) after they were alleged to have cheated banks, and these frauds have been categorised as among the country's biggest criminal loan heist till date.

The central agency gave the low-down on these two cases, the estimated Rs 13,000 crore fraud allegedly carried out by diamond trader Nirav Modi, his uncle Mehul Choksi and others in the Brady House branch of PNB in Mumbai and the about Rs 9,000 crore Kingfisher Airlines fraud triggered by Mallya, in a statement issued here.

It said the three "defrauded" public sector banks by siphoning off the funds through their companies which resulted in a total loss of over Rs 22,000 crore or $ 2,20,000 Million (Rs 22,585.83 crore in definite numbers) to a clutch of banks.

Asked for a comment, Choksi's lawyer Vijay Aggarwal told PTI, "The ED has indeed attached assets much more than the money due to the banks."

The ED, empowered to probe such cases under criminal sections of the Prevention of Money Laundering Act (PMLA), went on to attach and seize total assets worth Rs 18,170.02 crore in these two cases that included Rs 969 crore worth of properties "located" abroad.

"The quantum of the attached and seized assets represent 80.45 per cent of the total bank loss of Rs 22,585.83 crore," the ED said.

On Wednesday, out of these attached assets, the Debts Recovery Tribunal (DRT) on behalf of an SBI-led consortium that lent money to Mallya sold fresh shares worth Rs 5,824.50 crore of United Breweries Limited (UBL), the agency said.

The DRT action came after the ED transferred the shares worth about Rs 6,624 crore of UBL attached by it to the SBI-led consortium on the directions of a special PMLA court that is hearing these cases in Mumbai.

"Further realisation of Rs 800 crore by sale of these shares is expected by June 25," it added.

The banks have earlier "recovered" Rs 1,357 crore by a similar sale of shares in the case against Mallya and his now-defunct Kingfisher Airlines, the ED said.

Another Rs 1,060 crore worth of assets were "restituted" to the banks earlier in the probe against Nirav Modi, they said.

As of date, the ED said, assets worth Rs 9,041.5 crore, "representing 40 per cent of the total loss to the banks, have been handed over to public sector banks."

"Thus, the banks shall be realising total amount of Rs 9,041.5 crore through sale of a part of assets attached/seized by ED under the PMLA," it said.

In addition, official sources said, Rs 329.67 crore has been realised in the government exchequer after Modi's assets were confiscated in July last year after the 50-year-old diamantaire was declared a fugitive economic offender by a special court in Mumbai.

The ED said the probe has "irrevocably proved" that the three used dummy entities controlled by them for rotation and siphoning off the funds provided by the banks.

"The investigators had to pierce through the multi-layered corporate veil to find these assets that were held in exclusive possession."

"It was a myriad web of domestic and international transactions and stashing of assets abroad," a senior officer said.
The ED also got repatriated to the country assets like gold and diamond jewellery (of Modi and Choksi firms) from abroad to ensure they are not disposed off and are available to the banks and the government exchequer for seizure.

The agency said, "a substantial part of these assets were held in the names of dummy entities, trusts, third persons, relatives of these accused and these entities were proxy of the three accused to hold these assets."

It said the extradition of Mallya (65) "has been ordered by the Westminster Magistrates Court and confirmed by the UK High Court."

Enforcement Directorate says 40% loss in PNB, Mallya bank fraud cases recovered

Vijay Mallya on Wednesday lost an appeal to gain access to court-held funds to cover his costs for legal proceedings in India, as a High Court judge in London concluded that the 65-year-old businessman sought 750,000 pounds but there is not enough evidence to support the demand being made.

UK: Judge denies for more funds 'for legal charges' to Indian fugitive Vijay Mallya

A consortium of Indian banks led by the State Bank of India (SBI) on Tuesday moved a step closer in their attempt to recover debt from loans paid out to Vijay Mallya's now-defunct Kingfisher Airlines after the High Court in London upheld an application to amend their bankruptcy petition, in favour of waiving their security over the businessman's assets in India.&nbsp;

Chief Insolvencies and Companies Court (ICC) Judge Michael Briggs handed down his judgment in favour of the banks to declare there is no public policy that prevents a waiver of security rights, as argued by Mallya's lawyers.&nbsp;

At a virtual hearing, July 26 was set as the date for final arguments for and against granting a bankruptcy order against Mallya after the banks accused him of trying to kick matters into the long grass and called on the bankruptcy petition to be brought to its inevitable end.&nbsp;

“I order that permission be given to amend the petition to read as follows: The Petitioners (banks) having the right to enforce any security held are willing, in the event of a bankruptcy order being made, to give up any such security for the benefit of all the bankrupt's creditors,” Justice Briggs' judgment reads.&nbsp;

"There is nothing in the statutory provisions that prevent the Petitioners from giving up security," he notes.&nbsp;

Mallya's barrister, Philip Marshall, had referenced witness statements of retired Indian judges in previous hearings to reiterate that there is public interest under Indian law by virtue of the banks being nationalised.&nbsp;

However, Justice Briggs found no impediment to the creditors relinquishing their security under Indian law because of the engagement of a principle concerning public interest and favoured the submissions made by retired Indian Supreme Court judge Gopala Gowda at a hearing in December 2020 in this regard.&nbsp;

“In my judgment the simple stance taken by Justice Gowda that Section 47 PIA 1920 is evidence of the ability of a secured creditor to relinquish the creditor's security is to be preferred," the ruling notes.&nbsp;

The Indian banks, represented by the law firm TLT LLP and barrister Marcia Shekerdemian, were also granted costs in totality for the petition hearings, as the ‘overall successful' party in the case.&nbsp;

"Dr Mallya should have been extradited by now. He was refused permission to go to the Supreme Court in May last year," Shekerdemian pointed out, in reference to one of Mallya's defence planks that the cases against him are 'politically motivated'.&nbsp;

The 65-year-old businessman remains on bail in the UK while a 'confidential' legal matter, believed to be related to an asylum application, is resolved in connection with the unrelated extradition proceedings. &nbsp;

A consortium of Indian banks led by the State Bank of India (SBI) on Tuesday moved a step closer in their attempt to recover debt from loans paid out to Vijay Mallya's now-defunct Kingfisher Airlines after the High Court in London upheld an application to amend their bankruptcy petition, in favour of waiving their security over the businessman's assets in India.

Chief Insolvencies and Companies Court (ICC) Judge Michael Briggs handed down his judgment in favour of the banks to declare there is no public policy that prevents a waiver of security rights, as argued by Mallya's lawyers. At a virtual hearing, July 26 was set as the date for final arguments for and against granting a bankruptcy order against Mallya after the banks accused him of trying to kick matters into the long grass and called on the bankruptcy petition to be brought to its inevitable end. “I order that permission be given to amend the petition to read as follows: The Petitioners (banks) having the right to enforce any security held are willing, in the event of a bankruptcy order being made, to give up any such security for the benefit of all the bankrupt's creditors,” Justice Briggs' judgment reads. The Supreme Court's division bench comprising Justices U U Lalit and Ashok Bhushan rejected the petition and said "We do not find any merits. Review petition dismissed".

Mallya, who is accused in a bank loan default case of over ₹9,000 crores involving his Kingfisher Airlines and is presently in the UK, had reportedly sought asylum in the country after having lost extradition proceedings.

In June, the apex court had asked its registry as to why Mallya's review petition had not been listed before the court concerned in the last three years. Highlighting that UK govt does understand the "importance" of Vijay Mallya case, the new British High Commission to India Sir Philip Barton has said," criminals can’t escape justice after crossing national borders"

Sir Philip Barton said, "The UK, UK govt, and these are calls who are independent of govt, absolutely clear around roles in preventing people from avoiding justice by moving countries. We are determined to play our part. In any case, to make sure we are working together to make sure criminals can't escape justice when crossing national borders."

Adding, “I do understand, and UK govt understands the importance of the case."

On both extradition of the fugitive and his reported asylum plea, the envoy said, he has "nothing to say" given it’s an ongoing process. New Delhi has been in touch with UK side for his "early" extradition.

Vijay Mallya's leave to appeal against extradition in UK Supreme Court was rejected earlier this year ago leaving no further legal remedy in the country.

It now up to the UK home secretary Priti Patel to give a final go-ahead by signing on the extradition papers. Mallya had committed a fraud of Rs 9,000 crore on a consortium of Indian banks. India had requested UK govt not to consider fugitive businessman Vijay Mallya's request.

Ministry of External Affairs spokesperson Anurag Srivastava few weeks ago said, “we have requested the UK side not consider his asylum if requested by him" because there appear to be "no ground for his persecution" in India. &nbsp;

The envoy also responded to a question on the India China situation at the Line of Actual Control (LAC) saying, London has seen "progress" and "commitments during SR level talks are welcome. It is encouraging. There is de-escalation, tensions seem to ease. Hope we won't see a change in that”.

On the current London- Beijing tiff, over China-backed national security law for Hong Kong, the envoy said, ‘We don't have a border with China, we do have responsibility for Hong Kong. The new security law is a violation of the UK-China declaration. We also have concerns about Uighurs in Xinjiang."

The UK handed over Hong Kong to China in 1997 after the end of the 99-year lease.

Criminals can’t escape justice after crossing national borders, says UK envoy on Vijay Mallya

The Supreme Court has directed its registry to explain why the petition filed by businessman Vijay Mallya, who has sought review of its 2017 order holding him guilty of contempt of court for transferring USD 40 million to his children, was not listed before the concerned court for last three years.

A bench of Justices U U Lalit and Ashok Bhushan, which took up Mallya's review petition in-chamber on June 16, directed the apex court registry to furnish all the details including names of officials who had dealt with the file concerning the review petition for last three years.

"According to the record, placed before us, the review petition was not listed before the court for last three years.

"Before we deal with the submissions raised in the review petition, we direct the registry to explain why the review petition was not listed before the concerned court for last three years," the bench said in its June 16 order which was uploaded on the apex court website on Friday.

Taking strong note of the undue delay in listing of the review petition, the bench asked the registry to furnish explanation within two weeks.

"The review petition shall, thereafter, be considered on merits," the bench said in its order, adding, "As per office report on limitation the review petition was filed in time."

Mallya had filed the petition seeking review of the apex court's May 9, 2017 order by which he was held guilty of contempt of court for transferring USD 40 million to his children in violation of the court's order.

Mallya, who is an accused in a bank loan default case of over Rs 9,000 crore involving his defunct Kingfisher Airlines, is presently in the United Kingdom.

The apex court's 2017 order had come on a plea by consortium of banks led by the State Bank of India (SBI), which had said that Mallya had allegedly transferred USD 40 million received from British firm Diageo, to his children in "flagrant violation" of various judicial orders.

The apex court had earlier asked Mallya about the "truthfulness" of his disclosure of assets and the transfer of money to his children.

It was dealing with pleas of lending banks seeking contempt action and a direction to Mallya to deposit USD 40 million received from offshore firm Diageo respectively.

The banks had then alleged that Mallya concealed the facts and diverted the money to his son Siddharth Mallya and daughters Leanna Mallya and Tanya Mallya in "flagrant violation" of the orders passed by the Karnataka High Court.

Prior to that, the apex court had rapped Mallya for not making full disclosure of his overseas properties and had asked him to do so within a month.

Mallya had last month lost his application seeking leave to appeal his extradition to India in the UK Supreme Court, setting a 28-day clock on his removal from the UK.

The UK top court's decision marks a big legal setback to the 64-year-old flamboyant businessman, who had earlier lost his High Court appeal against an extradition order to India on charges of alleged fraud and money laundering related to unrecovered loans to his now-defunct Kingfisher Airlines.

Mallya has been based in the UK since March 2016 and remains on bail on an extradition warrant executed three years ago by Scotland Yard on April 18, 2017.

The 64-year-old businessman had 14 days to file this application to seek permission to move the higher court on the High Court judgment from April 20, which dismissed his appeal against a Westminster Magistrates' Court's extradition order certified by the UK Home Secretary.

Under the India-UK Extradition Treaty, the UK Home Office of minister Priti Patel is now expected to formally certify the court order for Vijay Mallya to be extradited to India within 28 days.

Earlier today, he&nbsp;asked the government to accept his offer to repay 100 percent of his loan dues and close the case against him.&nbsp;While congratulating the Indian government over the Rs 20 lakh crore economic package, Mallya lamented that his repeated offers to repay his dues have been ignored.

India wants to bring back&nbsp;over Rs 9,000 crore in loans Kingfisher took out from banks which the authorities argue he had no intention of repaying. Vijay Mallya denies the charges against him and is currently on bail.

UK High Court hears Vijay Mallya's appeal against extradition to India

The Royal Courts of Justice in London hears the appeal against a magistrates' court extradition order, signed off by former UK Home Secretary Sajid Javid in February last year.

UK High Court hears Vijay Mallya's appeal against extradition

Liquor baron Vijay Mallya on Tuesday <a href="https://www.wionews.com/india-news/latest-india-news-vijay-mallyas-appeal-against-extradition-to-india-to-be-heard-in-uk-high-court-280034">appeared before the Royal Courts of Justice</a> in the United Kingdom&nbsp;for his appeal against extradition to India to face fraud and money laundering charges amounting to Rs 9,000 crores, where his lawyers claimed "multiple errors" in a magistrates' court's order.

The 64-year-old former Kingfisher Airlines boss, who remains on bail since his arrest on an extradition warrant in April 2017, avoided the usual scrum of reporters at the court entrance and went in with his lawyers separately. "I'm just here to listen,"&nbsp;he said, when asked for a comment.

Justice Stephen Irwin and Justice Elisabeth Laing were told by Mallya's barrister that Chief Magistrate Emma Arbuthnot's verdict in favour of extradition in December 2018 was flawed and also questioned the admissibility of some witness statements submitted by the Indian government.

Clare Montgomery opened her arguments to try and establish that Mallya had no fraudulent intentions when he sought bank loans for his now-defunct Kingfisher Airlines because he is no "fly by night figure but an immensely wealthy man"&nbsp;who was not running any sort of "ponzi scheme"&nbsp;but a reputable airline, which fell into economic misfortune along with other Indian airlines.

In what she described as a "very dense case", which has proved extraordinarily difficult to manage as there are "any&nbsp;number of rabbit holes"&nbsp;to go down, Montgomery said, "She (Arbuthnot) did not look at all of the evidence because if she had, she would not have fallen into the multiple errors that permeate her judgment."

The hearing is scheduled for three days with Mallya's barrister to lay out her oral arguments, with the Crown Prosecution Service (CPS) on behalf of the Indian government set to counter on Wednesday. A verdict may be handed down at the end of the hearing on Thursday, but judgment could be delayed to a later date depending on how the hearing progresses.

Representatives from the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) were present in court as Montgomery once again sought to raise questions over whether the CBI behaved "properly in bringing charges" against Mallya under former Special Director Rakesh Asthana, who she said may have been guilty of "misconduct".

Judge Irwin intervened to question whether she could re-enter these pervious claims, which had already been rejected at the magistrates' court level and sought clarifications on where the law may have been wrongly applied by the Chief Magistrate.

Mallya had received permission to appeal against his extradition order signed off by former UK home secretary Sajid Javid last February only on one ground, which challenges the Indian government's prima facie case against him of fraudulent intentions in acquiring bank loans.

The High Court has already accepted Judge Arbuthnot's conclusions on all other aspects of the extradition case, including so-called "extraneous circumstances"&nbsp;of Mallya being pursued by the Indian authorities for political reasons of a clash between the ruling BJP and Opposition Congress party. Some of the other grounds invoked in last year's hearing claimed Mallya would not receive a fair trial in India, which was also dismissed as the judges upheld Arbuthnot's ruling on the matter that the wide media interest in the Mallya case would ensure justice.

His legal team had also sought to challenge the Indian government's assurances that Mallya would be held in safe prison conditions at Barrack 12 in Arthur Road Jail in Mumbai, which was dismissed by the High Court.

At the end of a year-long extradition trial at Westminster Magistrates' Court in London in December 2018, Judge Arbuthnot had found "clear evidence of dispersal and misapplication of the loan funds"&nbsp;and accepted a prima facie case of fraud and a conspiracy to launder money against Mallya, as presented by the CPS on behalf of the Indian government.

Vijay Mallya's appeal against extradition to India to be heard in UK court

A British court on Monday ordered that a luxury yacht owned by Force India Limited be sold and its proceeds be used to pay back Qatar National Bank to enforce its mortgage on the vessel.

During court proceedings, brought by the bank in the Admiralty Division of the High Court in England, it had been claimed that <a href="https://www.wionews.com/india-news/supreme-court-adjourns-till-august-13-hearing-on-vijay-mallyas-plea-against-confiscation-of-properties-240124">liquor tycoon Vijay Mallya</a>'s son Siddharth Mallya was the ultimate beneficial owner of the yacht.

However, the bank said that without grappling with that issue, their claim was focused on recovering outstanding loan payments estimated at around Euro 6 million.

"Security for the loan,&nbsp;included a personal guarantee from Dr Mallya, an individual closely connected with the borrower,"&nbsp;notes the judgment handed down by Justice Nigel Teare in London on Monday.

"The sum claimed in this action in rem is Euro 5 million plus interest and the costs of 'collection' which the claimant is entitled to recover," it adds.

The judgment also takes note of the fact that the Defendant, listed as "the owner of the yacht Force India", chose not to appear at a scheduled trial earlier this month after its solicitors "came off the record" in November last.

The yacht itself remains under arrest in Southampton, a port on England's south coast, and court-appointed Admiralty Marshal Paul Farren will now proceed with organising the appraisement and sale of the vessel in order to recover the costs.

As part of the process, any other claimants to the proceeds of the sale will be given notice to register their claims within an advertised period of time over the next six-10 weeks.

A consortium of Indian banks, led by State Bank of India, are likely to be among those claimants as they pursue a separate bankruptcy order against Mallya over unpaid loans related to his now-defunct Kingfisher Airlines.

"The court order today means the yacht must be sold and large sums of money be paid to the claimant (Qatar National Bank)," said Gideon Shirazi, the barrister who appeared on behalf of Qatar National Bank.

The yacht, described as a 49.9-meter Mangusta 165 superyacht, was owned by a company related to Gizmo Invest SA, whose ultimate beneficial owner is claimed to be 64-year-old Mallya, and Force India's ultimate beneficial owner is said to be his son, Sidharth.

Shirazi told the judge on Monday that an allegation made by the defence that there had been "undue influence"&nbsp;involved in the mortgage process for the yacht was removed at a later stage in the court proceedings, causing significant extra costs to Qatar National Bank.

The judge agreed it had been a "striking allegation"&nbsp;and granted the claimant costs on an indemnity basis.

Mallya, meanwhile, remains on bail on a warrant executed by Scotland Yard in April 2017 pending a High Court appeal next month against his extradition order to India, signed off by former UK home secretary Sajid Javid last year.

The former Kingfisher Airlines boss had won a reprieve in July last year when a two-judge panel at the Royal Courts of Justice in London granted him permission to appeal against the extradition order of Westminster Magistrates' Court to face fraud and money laundering charges amounting to Rs 9,000 crores in India.&nbsp;

UK court orders sale of Force India yacht linked to Vijay Mallya

The Enforcement Directorate on Thursday told the Supreme Court that custodial interrogation of senior Congress leader <a href="https://www.wionews.com/india-news/inx-media-case-supreme-court-reserves-order-on-chidambarams-anticipatory-bail-plea-for-september-5-extends-interim-protection-from-ed-arrest-246406">P Chidambaram in the INX media case</a> is required as if his plea for anticipatory bail is given it would affect cases involving Vijay Mallya, Mehul Choksi, Nirav Modi and Zakir Naik.

Disputing the contention of Chidambaram's lawyers, the agency also argued that the offence of money laundering is against the society, nation and the economy.

"Money laundering is an offence against society, nation and economy. Economic offences are gravest offences irrespective of quantum of sentence," Solicitor General Tushar Mehta appearing for the probe agency told a Bench of Justice R Banumathi and Justice AS Bopanna.

Countering the arguments of Chidambaram's advocates Kapil Sibal and Abhishek Manu Singhvi that Prevention of Money Laundering Act (PMLA) offences with seven years of punishment is not a grave offence because as per the Code of Criminal Procedure grave offences entail death penalty and life, Mehta said money laundering offences are "grave".

"Chidambaram's counsels have argued that gravity of an offence is subjective. PMLA offences may not be grave for them but the Courts have consistently held that economic offences are grave in nature. Gravity is a relative concept. Quantum of punishment is not relevant. What's important is what will be the impact of your offence in society. Money laundering is an offence against the society, nation and economy. Economic offences are gravest offences irrespective of quantum of sentence," Mehta said.

The top court was hearing Chidambaram's plea against Delhi High Court's order denying anticipatory bail to him in a case being probed by the ED.

Mehta also objected to the proposition made by Chidambaram's counsel Kapil Sibal to confront him with evidence before presenting it in the court, saying it is "absurd" and would have "devastating results" and is "preposterous".

Whether the accused's reply was evasive or not is decided by investigating agency and not by the court, he added.

He said the ED has been investigating various sensitive and high profile cases under PMLA and if Chidambaram's plea is accepted it would affect cases against Vijay Mallya, Mehul Choksi, Neerav Modi, Zakir Naik, Sarada chit fund, terror funding and other cases.

Mehta also contended that if accused at large is confronted with the evidence collected, then the agency will have exposed its evidence and witnesses and it will give a chance to the accused to tamper with evidence and erase the money trail.

"The investigating agency has absolute discretion to what extent to reveal the evidence to the accused. It is best to confront the accused with evidence when he is in custody," Mehta told the court, adding that investigation is an art where the agency brings the accused to divulge details and not a mere question and answer format or an interview.

During the hearing, Mehta said if given an anticipatory bail, Chidambaram may erase the money trail, influence the witnesses and tamper with evidence.

"It's impossible to investigate when he's armed with anticipatory bail. It's ED's right and duty to unearth the truth. It would be difficult for the ED to catch him if he is under a protective umbrella and best way to elicit truth is when an accused is not under a protective umbrella," he said.

He also argued that the top court cannot be created as a regular court of appeal of the orders of the high courts, lower courts, and magistrate courts.

The apex court is "meant to lay down the law", Mehta said during the course of the proceedings in the High Court, a note was filed and it was examined by the Judge, adding that in the judgment it is said twice that the records have been examined to arrive at the conclusion.

"We are showing a document of evidence and they are saying don't show it to court before showing it to me. I want the court to look the material in my possession, including the statement of the accused, I have nothing to hide. I would insist that Court must look into the material available so that there is no iota of doubt about the material is cogent or not," Mehta said while concluding his arguments and added that he has documents in a sealed cover if the top court wanted to see.

In 2017, the Central Bureau of Investigation (CBI) had registered an FIR alleging irregularities in the Foreign Investment Promotion Board (FIPB) clearance was given to INX Media to the tune of Rs 305 crore in 2007 when Chidambaram was the Union finance minister.

Following the FIR filed by CBI, ED had filed a case of money laundering against him.&nbsp;

Following the FIR filed by CBI, ED had filed a case of money laundering against him.

The ED raids are based on a complaint of a whistleblower that Shashikant owns a company named Ultimate Branding Worldwide which is exporting

Kingfisher beer at a discounted price to a company Tammy International, allegedly owned by Shashikant's son-in-law.

This company, in turn, sells it at a premium to buyers in Singapore, UAE, and Malaysia.

According to the complaint, profit generated through this is allegedly being repatriated to Mallya through overlapping transactions to fund his daily maintenance and expenses.
