UK court allows Vijay Mallya to appeal against extradition order

<a href="https://www.wionews.com/india-news/the-royal-courts-of-justice-in-london-approves-vijay-mallyas-plea-to-appeal-against-extradition-case-232488">Beleaguered liquor baron Vijay Mallya</a> on Tuesday said that he was "glad" after a court here permitted him to appeal against the UK Home Secretary's order to extradite him to India to face trial in alleged fraud and money laundering charges involving Rs 9,000 crore.

"I am glad. I won on the prima facie. The division bench felt that (Westminster) magistrate's decision is appealable. It means the most to me," a confident Mallya told media persons.

Mallya, however, reiterated his offer to the consortium of Indian banks to return their money.

"I still want the banks to take all the money. All they have to do is to leave me in peace," he said.

A two-member bench of Justices George Leggatt and Andrew Popplewell of the Administrative Court division of the Royal Courts of Justice granted him permission to appeal against the order signed off by Home Secretary Sajid Javid.

While Clare Montgomery represented Mallya, there was no representation from the Home Secretary and the Crown Prosecution Service (CPS) to argue for the government of India.

Mallya's counsel Montgomery told the court that her client would not receive a fair trial in India, be subjected to a "trial by media, and the judicial process would be coloured by political bias; the prison conditions in India would breach his basic human rights."

Seeking the court's permission to appeal against the order, Mallya's counsel also said that the Indian government did not have a prima facie case against him.

While rejecting the first four of the arguments, the court agreed that India still has to do more to prove a prima facie case against the accused.

Montgomery said that the order of Westminster Court Judge Emma Arbuthnot was erroneous in sending his case to Home Secretary Sajid Javid to order his extradition.

"The Government of India submitted fabricated e-mails (evidence) to the court. Instead of questioning the mail's authenticity, the judge took it as evidence.

The e-mails were presented as statements of the witnesses," she told the court.

Montgomery said that British law requires every document produced in the court to be backed by proof of its origination.

"In the face of it, there is no evidence against Mallya," she submitted.

She also told the court that Mallya was not just charged because he is an economic offender but because of his political views too.

The businessman's counsel also argued that Kingfisher Airline made its financial position very clear as against Judge Arbuthnots'&nbsp;ruling that Mallya and the defunct airline misrepresented its financial situation to the consortium of banks.

The 63-year-old former Kingfisher Airlines chief lost a "leave to appeal" in the UK High Court on paper on April 5 against the extradition order, leading to an oral hearing of his renewal application.

On April 11, he applied for an oral hearing to argue his case, which had been listed in a four-hour slot on Tuesday.

Mallya came with his son Siddharth and girlfriend and former Kingfisher Airline hostess Pinki Lalwani to the court.

Mallya, who flew out from India in March 2016, has been living in the United Kingdom since then.

The Patiala House Court in New Delhi had already declared Mallya a proclaimed offender for evading summons in January 2018. The court had also issued an open-ended non-bailable warrant against him for evading summons and law of the land in 2017.&nbsp;

The rejection of Mallya`s appeal is seen as a positive development for authorities in India who have been pushing for the extradition of the businessman who faces charges of loan frauds, money laundering and other economic offences.

The liquor&nbsp;baron has repeatedly argued that he has the assets to pay off his "debts but the government won't allow the use of these assets to clear the debts."

He had fought extradition on the grounds that Indian jails weren’t safe and that he was being made a scapegoat for India’s banks being stuck with massive bad loans given to companies.

'I am here to watch the game', says Vijay Mallya spotted at Oval for INDvAUS World Cup encounter

Embattled liquor tycoon Vijay Mallya has been allocated July 2 as the date for a brief hearing to convince a High Court judge that he should be given permission to proceed to a full-blown appeal process against his extradition to India to face alleged fraud and money laundering charges amounting to Rs 9,000 crores.

The 63-year-old former Kingfisher Airlines boss had filed the "renewal application" earlier this month after he failed in his first written attempt seeking leave to appeal in the High Court. The renewal involves a short oral hearing before a High Court judge, now scheduled for July 2, where his lawyers will further plead his case against being extradited to India.

"A date for the oral consideration has been set for July 2," a UK court official said on Friday.

UK home secretary Sajid Javid had signed off on a Westminster Magistrates' Court order for Mallya to be extradited to face the Indian courts back in February.&nbsp;

Mallya then filed an application for permission to appeal against that decision in the High Court, which was refused by Justice William Davis, giving him a week to apply for ?oral consideration? via a renewal application.&nbsp;

"Once a renewal application is made, it will be listed before a High Court judge and dealt with at a hearing," said a UK Judiciary spokesperson.

On July 2, Mallya's legal team and the Crown Prosecution Service (CPS)&nbsp;arguing on behalf of the Indian government&nbsp;will go head to head to reiterate factors for and against the businessman's extradition to Arthur Road Jail in Mumbai. A High Court judge must now decide following the "oral consideration"&nbsp;if Mallya's appeal can proceed to a full hearing.&nbsp;

It will mark one of the final stages of the appeals process in the UK as the chances of permission to appeal to the Supreme Court are unlikely if permission to appeal is denied at the High Court stage.&nbsp;

Mallya would have the option to approach the European Court of Human Rights (ECHR) based in Strasbourg, France, to argue against his extradition to India on human rights grounds by trying to prove a real threat of harm or torture.

Meanwhile, the businessman remains on bail on an extradition warrant executed by Scotland Yard in April 2017. At the end of a year-long extradition trial at Westminster Magistrates' Court in London last December, Judge Emma

Arbuthnot had ruled that the "flashy"&nbsp;billionaire had a "case to answer"&nbsp;in the Indian courts.&nbsp;

The court had also dismissed any bars to extradition on the grounds of the prison conditions under which the businessman would be held, as the judge accepted the Indian government's assurances that he would receive all necessary medical care at Barrack 12 in Mumbai's Arthur Road Jail.

Mallya's extradition: UK High Court to hear Vijay Mallya's plea on July 2

Embattled liquor tycoon Vijay Mallya told the Bombay High Court Wednesday that by declaring him a fugitive economic offender and allowing attachment of his assets, a special court had awarded him an "economic death penalty".

Mallya made the statement through his counsel Amit Desai before a bench of justices Ranjit More and Bharati Dangre, during arguments on his plea challenging several provisions of the Fugitive Economic Offenders Act that came into existence in August last year.

"My debts and the interest on such debts are mounting. I have assets to pay off these debts but the government won't allow the use of these assets to clear the debts. I have no control over my properties," the businessman said.

"This is an economic death penalty that has been awarded to me," he said.

Desai urged the court to pass an injunction against the proceedings related to confiscation of his assets across the country.

The bench, however, refused to grant any interim relief on the petition.

A special court here had in January declared Mallya a fugitive economic offender (FEO) under provisions of the Fugitive Economic Offenders Act.

Later, Mallya approached the high court, challenging the provisions of the act that permits, among other things, confiscation of assets and placing them under the control of the Union government.

He also filed another petition challenging the special court order that declared him an FEO which was being heard by another division bench of the high court.

Desai argued that the FEO Act was "draconian" and "unconstitutional" as it allowed the Centre to confiscate everything, irrespective of whether a property was bought from the proceeds of a crime or not.

Mallya's plea was opposed by the Enforcement Directorate's (ED) counsel D P Singh, who argued that the Act was not draconian at all.

"This act is not draconian. In fact, this act prohibits prosecuting agencies from acting on their own. For everything, including attachment of properties, we are supposed to get a court order that is passed only after hearing all sides," Singh said.

"This act is meant for Mallya-like people only. It is not ordinary legislation. The act has been constituted to bring back defaulters who have defaulted amounts of Rs 100 crore and above," the counsel said.

The court, too, noted that the legislation was a sound one and not draconian.

"We understand this legislation is a little harsh. But that is because it deals with draconian situations," the bench said.

It, however, issued a notice to the attorney general to respond to Mallya's plea challenging the act.&nbsp;

Embattled liquor tycoon<a href="https://www.wionews.com/india-news/uk-high-court-rejects-vijay-mallyas-appeal-against-the-extradition-order-208774"> Vijay Mallya </a>once again used social media to reiterate his offer to pay back the debt owed to public sector banks in India, targeting this time the State Bank of India (SBI) for allegedly wasting Indian taxpayers' money on expensive legal fees in the UK.

Days after a UK High Court judge refused to dismiss an interim order freezing nearly 260,000 pounds in one of his London bank accounts, the 63-year-old issued a string of statements on Twitter to allege that the SBI led a consortium of PSU banks were wrongly going after him in the UK courts.

"SBI Lawyers in UK making presentations on their accomplishments against me. Indian Taxpayers cost. Despite a full recovery in India confirmed by the Prime Minister himself,"&nbsp;he tweeted on Friday.

His statements were illustrated with a series of document screenshots showing TLT LLP, the banks' law firm, hailing its victory in the 1.142 billion pounds worldwide freezing order judgment in their favour last May.

"SBI UK Lawyers in self-promotion at Indian public cost. SBI must answer,"&nbsp;reads Mallya's tweet.

In his characteristic style, the media was once again at the receiving end of the former Kingfisher Airlines boss' social media comments.

He noted, "Whilst media love sensational headlines, why doesn't anybody ask the PSU State Bank of India under RTI [Right to Information] on how much they are spending on legal fees trying to recover money from me in the UK when I have offered 100 per cent payback in India.

"To substantiate my point, assets belonging to me in the UK were sold and the costs of sale were almost 50 per cent of value. The remaining assets yet to be sold won't cover legal costs. So what's this all about"&nbsp;To enrich UK Lawyers? SBI please answer."

On Thursday, Mallya had made another reference to Prime Minister Narendra Modi's interview from last month, in which he had claimed that the government had recovered assets worth Rs 14,000 crores related to the now-defunct airline's loan defaults.&nbsp;

Mallya is wanted in India on charges of fraud and money laundering amounting to an alleged Rs 9,000 crores.

The series of statements follow a ruling by Master David Cook, a judge in the Queen's Bench Division of the Royal Courts of Justice in London, earlier this week which went against Mallya. Master Cook ruled that an interim debt order in favour of SBI and other banks seeking access to funds in Mallya's ICICI UK bank account "should remain in force".&nbsp;

However, the application to make it final has been adjourned until after the hearing of Mallya's pending bankruptcy petition, expected by the end of this year.

The funds held in the account "258,559.79 pounds"&nbsp;will meanwhile remain frozen as part of the worldwide freezing order in favour of the Indian banks last year.

Mallya's lawyers had argued for the dismissal of the interim order on a number of grounds, including a claim that it was a "deliberate ploy"&nbsp;to prevent Mallya "reasonable"&nbsp;court-sanctioned living expenses.&nbsp;

However, the judge rejected the assertion and noted that the Indian banks are within their rights to discover the true extent of Mallya's assets in order to recover the estimated 1.142 billion pounds owed to them, arising from proceedings in the Bangalore Debt Recovery Tribunal (DRT) against Kingfisher Airlines and others.&nbsp;

The DRT case was registered in the UK under the Foreign Judgments (Reciprocal Enforcement) Act 1933 and went in favour of the Indian banks in an appeal in May 2018.

The banks "SBI, Bank of Baroda, Corporation Bank, Federal Bank Ltd, IDBI Bank, Indian Overseas Bank, Jammu &amp; Kashmir Bank, Punjab &amp; Sind Bank, Punjab National Bank, State Bank of Mysore, UCO Bank, United Bank of India and JM Financial Asset Reconstruction Co. Pvt Ltd"&nbsp;have since also filed a bankruptcy petition against Mallya, which is being challenged by the former Kingfisher Airlines boss and is expected to come up for hearing around December this year.

TLT LLP, the law firm acting for the Indian banks, has been pursuing a series of court orders in the UK courts as part of efforts to enforce last year's High Court judgment in favour of the banks.

Meanwhile, Mallya remains on bail after his extradition was signed off by UK home secretary Sajid Javid in February and is seeking leave to appeal against that order in the UK High Court. An oral hearing on his appeal renewal application is expected in the coming weeks.

Vijay Mallya appeals another hearing in an open Court

In a big blow to <a href="https://www.wionews.com/india-news/nirav-modi-vijay-mallya-to-share-same-jail-cell-in-mumbais-arthur-road-jail-judge-ask-prosecution-206649">Vijay Mallya</a>, London’s High Court has rejected <a href="https://www.wionews.com/india-news/vijay-mallya-tells-bombay-hc-confiscating-properties-draconian-not-help-creditors-207234">fugitive liquor baron</a>'s application for permission to appeal against the extradition order against him.&nbsp;

Mallya, 63, had filed the application in the High Court after UK's home secretary Sajid Javid signed off on a Westminster Magistrates' Court order for his extradition to face the Indian courts back in February.

"The application for permission to appeal was refused by Mr Justice William Davis on 05/04/2019," said a spokesperson for the UK judiciary.&nbsp;

"The appellant (Mallya) has five business days to apply for oral consideration. If a renewal application is made, it will be listed before a High Court judge and dealt with at a hearing."

The application seeking “leave to appeal” had been passed on to a single judge, who was to make a decision on the basis of papers submitted as part of the application. Now that the “judge on papers” application has been rejected by Judge Davis, Mallya has the option to submit for a “renewal”.

The renewal process will lead to a brief oral hearing during which Mallya's legal team and the Crown Prosecution Service (CPS) on behalf of the Indian government will renew their respective claims for and against an appeal for a judge to determine if it can proceed to a full hearing.

Mallya has lived in the UK since March 2016 and remains on bail on an extradition warrant executed by Scotland Yard in April 2017.

In her verdict at the end of a year-long extradition trial in December last year, Judge Emma Arbuthnot had ruled that the "flashy" billionaire had a "case to answer" in the Indian courts.

WION Gravitas: Vijay Mallya borrows money from girlfriend, children for living expenses

Fugitive businessman Vijay Mallya Monday told the Bombay High Court that confiscation of his properties under the newly-enacted Fugitive Economic Offenders Act (FEOA) was draconian and it will not help the creditors.&nbsp;

Mallya had last month approached the high court challenging a January 5 order of a special Prevention of Money Laundering Act (PMLA) court declaring him a fugitive economic offender under the FEO Act.

As per provisions of the Act, once a person is declared a fugitive, his properties can be confiscated by the prosecuting agency, Enforcement Directorate (ED). Mallya’s counsel Amit Desai on Monday told a division bench of Justices I A Mahanty and A M Badar that the ED confiscating the properties will not help the creditors.

“Confiscating is draconian. The need of the hour is to deal with the banks and creditors. Mallya does not want the properties to be returned to him. We are only saying that confiscation by the government is not going to solve the problems of the banks and creditors,” Desai said. The ED, while opposing the petition, argued that the object of the Act was to ensure the return of a person who is evading arrest in India.

“These proceedings are to ensure that these persons who commit fraud and leave the country are brought back. The moment Mallya returns to India, the provisions of this Act and the process initiated under it shall become null and void,” ED said. The bench has posted the petition for further hearing on April 24.

However, the next hearing on ED’s application before the special court, seeking permission to start confiscation proceedings, is scheduled for April 8.

Patiala House Court on March 19 had ordered attachment of Vijay Mallya`s properties in Bengaluru under section 83 in The Code of Criminal Procedure in connection with a FERA (Foreign Exchange Regulation Act) violation case.

The same court had already declared Mallya a proclaimed offender for evading summons in January 2018. The court had also issued an open-ended non-bailable warrant against him for evading summons and law of the land in 2017.

As per the case registered by the Enforcement Directorate, Mallya had allegedly paid US $200,000 to a British firm and some European countries for displaying the logo of his now defunct Kingfisher airline in Formula One World Championships in London in 1996, 1997, and 1998.

The investigating agency also claimed that the money was paid without prior approval from the Reserve Bank of India (RBI) in violation of the FERA norms.

Govt has recovered more than what I allegedly owe the Banks: Vijay Mallya

There were some light-hearted moments at the UK court Friday when Judge Emma Arbuthnot hearing the second bail plea of Nirav Modi asked the prosecution whether the fugitive diamantaire would be lodged in the same jail cell along with Vijay Mallya if he is also extradited to India.

The 48-year-old diamond merchant is wanted in India for alleged "high value and sophisticated" fraud and money laundering amounting to $2 billion.

At the very start of the hearing, Westminster Magistrates Court Chief Magistrate Arbuthnot said she was getting a sense of "deja vu", in reference to her having ordered the extradition of Mallya in December last year.

"Do we know which part of India he [Modi] is being sought in," the judge asked, to try and establish which jail Modi is likely to be held in.

She was told by the Crown Prosecution Service (CPS), arguing on behalf of the Indian government, that it would be an extradition to Mumbai and that he may, in fact, be held in the same Arthur Road Jail as that prepared for liquor tycoon Mallya, to which the judge said in a light-hearted vein that it could even be the same cell as we know "there is space" from the previous video submitted during the Mallya extradition trial.

India has informed the UK court that Mallya will be lodged in one of the high-security barracks located in a two-storey building inside the prison complex.

Authorities at the Arthur Road prison in Mumbai have kept a high-security cell ready for Mallya if he is extradited from the UK in connection with loan default cases against him in India.

Mallya, wanted in India on charges of fraud and money laundering amounting to around Rs 9,000 crore, has filed his application in the UK High Court, seeking permission to appeal against an extradition order signed by the British Home Secretary.

If extradited, 62-year-old Mallya will be lodged in the prison complex, which also housed 26/11 Mumbai attack terrorist Mohammad Ajmal Kasab.

An official from the Union Ministry of Home Affairs earlier said Mumbai's Arthur Road Jail was one of the best in the country.

His comments came after Judge Arbuthnot asked Indian authorities to submit a video of the Arthur Road Jail cell where they plan to keep Mallya following his extradition.

The official said adequate medical facilities were available to treat prisoners in Arthur Road Jail, where Mallya would get full security cover as an undertrial prisoner and it was highly secured in accordance with international standards.

The central government has already conducted an assessment of security cover given to prisoners in the Arthur Road Jail and its findings conveyed to the UK court.

In another throwback to the Mallya trial, Nirav Modi's defence team, led by barrister Clare Montgomery raised the issue of the state of the paperwork submitted by the Indian authorities, claiming it "made her cry" at one stage.

The judge concurred with her and was very firm about proper indexing of all documents to be submitted to the court in relation to the case.

Nirav Modi & Vijay Mallya to share same jail cell in Mumbai's Arthur Road Jail: Judge ask prosecution

The stage is set for a busy period of Indian extradition-related activity in the UK courts as liquor baron Vijay Mallya’s High Court appeal moves forward for a judge’s verdict on paperwork and fugitive diamond merchant Nirav Modi returns to Westminster Magistrates’ Court here for a second bail hearing on Friday.&nbsp;

“All the papers have been received and are now awaiting allocation to a single judge who will decide, on the basis of those papers, if permission is given to go to a full hearing,” said a spokesperson for the UK judiciary, in reference to Mallya’s application seeking an appeal against his extradition ordered by the magistrates’ court and then signed off by UK home secretary Sajid Javid last month.

While there is no set timescale for the judge to pronounce a decision on whether Mallya will be granted an appeal in the UK High Court, a decision is likely within the next few weeks. The 62-year-old former Kingfisher Airlines boss, wanted in India on alleged fraud and money laundering charges amounting to about Rs 9,000 crore, took to social media yet again to claim unfair treatment in the context of struggling Indian airlines Jet Airways being thrown a lifeline by public sector banks.

In her ruling at the end of his extradition trial in December last year, Chief Magistrate Emma Arbuthnot had concluded that Mallya has a case to answer in the Indian courts over substantial “misrepresentations” of his financial dealings.&nbsp;

“There is clear evidence of dispersal and misapplication of the loan funds and I find a prima facie case that Dr Mallya was involved in a conspiracy to launder money,” she noted.

Now, the same judge is expected to preside over the next major Indian extradition trial to come before the Westminster Magistrates’ Court, that of diamantaire Modi – wanted for alleged “high value and sophisticated” fraud and money laundering amounting to USD 2 billion. “He is expected to be produced before the court for a second bail application hearing on March 29,” a court official said.

Meanwhile, the 48-year-old has been lodged in HMP Wandsworth prison in south-west London since last Wednesday, when a judge had declined his request for bail on the grounds that he posed a flight risk.

Describing him as the “opposite of a flight risk” during the first bail application hearing last week, Modi’s defence team had offered 500,000 pounds as security and also submitted to any stringent conditions that may be imposed upon their client.&nbsp; It remains to be seen how they would further bolster that offer in order to convince the judge to grant bail during the second hearing, following which the case will proceed to a series of case management hearings and setting of a trial date.

Modi was arrested by the Scotland Yard officers from a bank in central London as he attempted to open a new bank account on March 19.

During his first court appearance a day after, it emerged that the diamantaire accused of defrauding India’s state-owned Punjab National Bank (PNB) via fraudulent Letters of Undertaking (LoUs) had been in possession of multiple passports since revoked by the Indian authorities.

While one passport is now in possession of the Metropolitan Police, a second expired passport is lying with the UK Home Office and a third with the UK’s Driving and Vehicle Licensing Authority (DVLA) for a driver’s licence. Besides the passports, Modi also possesses multiple residency cards, some of them expired but covering countries such as the UAE, Singapore and Hong Kong. His defence team tried to establish his very “visible” and “lawful” residence at his luxury Centre Point apartment in London’s West End, paying his local council tax and also using a National Insurance number, allocated to legal UK residents for purposes of work.

The Crown Prosecution Service (CPS), arguing on behalf of the Indian authorities, had challenged all claims to counter the first bail plea and pointed out that Modi had “deliberately evaded justice” and not returned to India despite a series of criminal summons issued by Indian courts. The CPS will now be joined by a joint Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) team that has arrived from India to assist with Modi’s extradition case.

Vijay Mallya appeal moves forward as Nirav Modi set for UK court hearing

Businessman Vijay Mallya on Tuesday urged Indian banks to "take his money" and save <a href="https://www.wionews.com/business-economy/naresh-goyal-quits-jet-airways-205510">cash-strapped Jet Airways</a>.

"I repeat once again that I have placed liquid assets before the Hon'ble Karnataka High Court to pay off the PSU Banks and all other creditors. Why do the Banks not take my money. It will help them to save Jet Airways if nothing else," the liquor baron tweeted.

Mallya, who is currently facing trial in a UK Court, went on to highlight the "double standards" of the NDA government, and questioned why public sector banks pitched in to save Jet Airways but let his company, Kingfisher Airlines, "fail ruthlessly."

"Happy to see that PSU Banks have bailed out Jet Airways saving jobs, connectivity and enterprise. Only wish the same was done for Kingfisher," he wrote on the micro-blogging site.

"I invested over 4000 crores into Kingfisher Airlines to save the Company and its employees. Not recognised and instead slammed in every possible way. The same PSU Banks let India's finest airline with the best employees and connectivity fail ruthlessly. Double standards under NDA," read another tweet.

Mallya also claimed that the media "decimated" him for writing to Prime Minister Narendra Modi while a BJP spokesman "eloquently read out" letters he wrote to former Prime Minister Manmohan Singh and alleged that PSU banks under the UPA government "wrongly supported" Kingfisher Airlines.

Jet Airways has been suffering bruising competition from low-cost airlines, fluctuating crude prices and a weak rupee.

The airline has over one billion dollars in debt and has to repay money to banks, lessors of planes and suppliers besides clearing pending salaries to its pilots.

Last week, State Bank of India (SBI) Chairman Rajnish Kumar had said that the resolution plan is almost ready and it will not involve a bailout for any individual.

At the same time, talks with Abu Dhabi-based airline Etihad to secure a rescue deal are still on, he said adding there is also a possibility of bringing in another investor.

"We believe Jet Airways is a good aviation property and it is in every body's interest that it continues to fly," Kumar had said on March 20.

The chairman of the airline, Naresh Goyal, stepped down on March 25, following which lenders agreed to pump in Rs 1500 crore to bail out the financially troubled airline.

Meanwhile, a Delhi court had, last week, ordered attachment of Mallya's properties in Bengaluru under section 83 of the Code of Criminal Procedure in connection with a FERA (Foreign Exchange Regulation Act) violation case, and fixed the next date of hearing as July 10.

Delhi court orders attachment of fugitive Mallya's properties

Embattled liquor baron Vijay Mallya, wanted in India on alleged fraud and money laundering charges amounting to an estimated Rs 9,000 crores, has <a href="http://www.wionews.com/india-news/mallya-prepares-for-lengthy-appeal-against-uk-governments-extradition-order-195448">filed his application in the UK High Court</a>, seeking permission to appeal against an extradition order signed by the British Home Secretary.

The 63-year-old businessman, who remains on bail on an extradition warrant in the UK, made the application in the Administrative Court division of the High Court on Thursday, 10 days after Home Secretary Sajid Javid signed off on the order triggering a 14-day window for his appeal application.

"The application has been sent for a judge on papers decision, which is expected any time between two to four weeks,"a UK court representative said.

A "judge on papers"&nbsp;decision will involve a High Court judge determining the merits of the application and if it is accepted, the case will proceed to a ?substantive hearing? in the next few months' time.

In the event that Mallya's application is rejected at this stage, he will have the option to submit a "renewal form".

The renewal process will lead to a 30-minute oral hearing during which Mallya's legal team and the Crown Prosecution Service (CPS) - on behalf of the Indian government - will renew their respective claims for and against an appeal for a judge to determine if it can proceed to a full hearing.

The process, to be heard in the Royal Courts of Justice in London, could take months as the listing of a hearing will depend on the availability of judges and other factors.

Following the outcome at the High Court level, both sides could apply for the right to appeal to the Supreme Court, which would involve at least another six weeks.

However, that process is more complex as the UK High Court must certify that the appeal involves a point of law of general public importance, and either the High Court or the Supreme Court gives leave for the appeal to be made.

Mallya and his legal team have not made a renewed comment in relation to the appeal but soon after the UK home secretary had signed off on the Westminster Magistrates' Court order in favour of extradition on February 4, the businessman had taken to social media to confirm his plans to seek an appeal.

"After the decision was handed down on December 10, 2018 by the Westminster Magistrates Court, I stated my intention to appeal. I could not initiate the appeal process before a decision by the Home Secretary. Now I will initiate the appeal process," he said in a Twitter statement earlier this month.

The former boss of the now-defunct Kingfisher Airlines took to Twitter again this week to call on Prime Minister Modi to accept his settlement offer in relation to the airline's loan default.

"I respectfully ask why the Prime Minister is not instructing his Banks to take the money I have put on the table so he can at least claim credit for full recovery of public funds lent to Kingfisher," he said, adding that <a href="http://www.wionews.com/india-news/made-an-offer-to-settle-before-honorable-high-court-court-of-karnataka-vijay-mallya-197267">his offer to the Karnataka High Court</a> should not be dismissed as "frivolous"&nbsp;because it is a "perfectly tangible, sincere, honest and readily achievable offer".

Mallya has been based in the UK since March 2016 and remains on bail on an extradition warrant executed by Scotland Yard in April 2017.

In her verdict at the end of a year-long extradition trial in December last year, Judge Emma Arbuthnot had ruled that the "flashy"&nbsp;billionaire had a "case to answer"&nbsp;in the Indian courts.

The court had also dismissed any bars to extradition on the grounds of the prison conditions under which the businessman would be held, as the judge accepted the Indian government's assurances that he would receive all necessary medical care at Barrack 12 in Mumbai's Arthur Road Jail.

India and the UK have an Extradition Treaty signed in 1992 and in force since November 1993. So far only one successful extradition has taken place from the UK to India under the treaty - that of Samirbhai Vinubhai Patel, who was sent back to India in 2016 to face trial in connection with his involvement in the post-Godhra riots of 2002.&nbsp;

Vijay Mallya files for permission to appeal in UK High Court against extradition order

UK Home Secretary Sajid Javid has signed off on&nbsp;<a href="http://www.wionews.com/india-news/vijay-mallya-in-talks-to-return-to-india-voluntarily-154272">the order to extradite Vijay Mallya to India</a>.&nbsp;

A UK Home Office spokesperson confirmed to WION that "on 3 February, the Secretary of State, having carefully considered all relevant matters, signed the order for Vijay Mallya’s extradition to India."

Mallya is accused in India of fraud, money laundering and violating the Foreign Exchange Management Act (FEMA).&nbsp;

Mallya's extradition to India had been ordered by the Westminster Magistrates’ Court on December 10, 2018, after which the home&nbsp;secretary had two months to review and formally approve the extradition.

That deadline would have expired on February 10.&nbsp;

Mallya now has 14 days to appeal the Westminster Magistrates’ Court's verdict. On Monday, he said he would.&nbsp;

"After the decision was handed down on December 10, 2018 by the Westminster Magistrates Court, I stated my intention to appeal. I could not initiate the appeal process before a decision by the Home Secretary. Now I will initiate the appeal process," Mallya tweeted.&nbsp;

The Modi government has made the return of fugitive businessmen an election plank and over the last four years, 16 fugitives have been extradited to India.

In 2018, New Delhi brought back five fugitives. Of the five, three were Indian, one was Romanian, and one the <a href="http://www.wionews.com/india-news/agustawestland-vvip-chopper-scam-dubai-government-extradites-christian-michel-to-india-181488">British-born Christian James Michel</a>.

India has also been pressing the United Kingdom to extradite Nirav Modi.&nbsp;

Mallya added that the "banks have given an open licence to their lawyers in England to pursue multiple frivolous litigations against me."&nbsp;

"Who is accountable for spending public money on legal fees in such a brazen manner?" he then went on to ask.&nbsp;

"After the decision was handed down on December 10, 2018 by the Westminster Magistrates Court, I stated my intention to appeal. I could not initiate the appeal process before a decision by the Home Secretary. Now I will initiate the appeal process," Mallya tweeted. Mallya extradition case: The fugitive billionaire's UK properties, and how much they're worth

A defiant Vijay Mallya has confirmed his plans to initiate a lengthy <a href="http://www.wionews.com/india-news/uk-home-secretary-signs-order-to-extradite-vijay-mallya-to-india-195145">appeal process against the UK government's order to extradite him</a> to face charges of fraud and money laundering amounting to nearly Rs 9,000 crores in India.

The 63-year-old embattled liquor baron's extradition was approved by UK Home Secretary Sajid Javid on Sunday, boosting India's efforts to bring back the fugitive businessman.

Mallya has two weeks to lodge permission to appeal in the High Court after Javid signed off on his extradition order. Hours later, Mallya took to social media to confirm his plans to appeal against the decision.

"After the decision was handed down on December 10, 2018, by the Westminster Magistrates Court, I stated my intention to appeal. I could not initiate the appeal process before a decision by the Home Secretary. Now I will initiate the appeal process," Mallya said in a statement on Twitter.

Once the application is made, the court will consider whether there are grounds for the appeal to be admitted and that in turn would trigger another set of hearings over the next few months in the Administrative Court, which is part of the UK High Court.

"It could take months for the case to be heard as the court gets very clogged up and the whole process could take up to five or six months," explained Sarosh Zaiwalla, Founder and Senior Partner of UK-based law firm Zaiwalla &amp; Co.

"The Crown Prosecution Service (arguing on behalf of the Indian government) could apply for an expedited appeal process but it is not common for this to be granted. You would have to show the need of urgency," he said.

Mallya has been based in the UK since March 2016 and remains on bail on an extradition warrant executed by Scotland Yard in April 2017.

In her verdict at the end of a year-long extradition trial in December last year, Judge Emma Arbuthnot ruled that the "flashy" former Kingfisher Airlines boss had a "case to answer" in the Indian courts.

She found there was "clear evidence of dispersal and misapplication of the loan funds" and accepted a prima facie case of fraud and a conspiracy to launder money against Mallya, as presented by the on behalf of the Indian authorities.

The court also dismissed any bars to extradition on the grounds of the prison conditions under which the businessman would be held, as the judge accepted the Indian government's assurances that he would receive all necessary medical care at Barrack 12 in Mumbai's Arthur Road Jail.

"There was no evidence which allowed me to find that if extradited Dr Mallya was at real risk of suffering a flagrant denial of justice," the verdict noted.

India and the UK have an Extradition Treaty signed in 1992 and in force since November 1993. So far only one successful extradition has taken place from the UK to India under the treaty that of Samirbhai Vinubhai Patel, who was sent back to India in 2016 to face trial in connection with his involvement in the post-Godhra riots of 2002.

As India falls under the Category 2 set of countries within the UK's Extradition Act 2003, any decision of the courts must be endorsed by the UK Home Secretary, who has the authority to order extradition. It is not uncommon for a higher court to give leave to appeal and then to overturn the verdict of a lower court.

In a related extradition case of alleged bookie Sanjeev Kumar Chawla wanted in India on match-fixing charges, the High Court had overturned an earlier Westminster Magistrates' Court ruling against his extradition to India due to human rights concerns related to Tihar Jail in Delhi where he was to be detained.

Under the legal process, the case was sent back to the magistrates' level where a District Judge overturned the previous ruling last month and found in favour of the Indian government.

Javid is also due to announce his decision on the extradition order of Chawla, a key accused in the cricket match-fixing scandal involving former South African captain Hansie Cronje in 2000, within the stipulated two-month period, which runs until early March.&nbsp;

Mallya prepares for lengthy appeal against UK government's extradition order

Vijay Mallya to challenge extradition order

The UK government <a href="http://www.wionews.com/india-news/uk-home-secretary-signs-order-to-extradite-vijay-mallya-to-india-195145">has approved Vijay Mallya's extradition to India</a>. The order for his extradition was signed on Sunday by UK Home Secretary Sajid Javid.&nbsp;

"On February 3 the Secretary of State, having carefully considered all relevant matters, signed the order for Vijay Mallya's extradition to India," a Home Office spokesperson said.

"Vijay Mallya is accused in India of conspiracy to defraud, making false representations and money laundering offences," the spokesperson added.

Mallya's extradition had been ordered on December 10, 2018 by the Westminster Magistrates’ Court. The home secretary then had two months to review the judgement.&nbsp;

That deadline would have ended on February 10.&nbsp;

Mallya is accused in India of fraud and money laundering. He had borrowed, for his now-defunct Kingfisher Airlines, a total to Rs 9,000 crore.&nbsp;

The money had been borrowed from a consortium of banks led by India's largest public-sector lender, the State Bank of India. Mallya is accused of siphoning off (part of) the money for personal and other uses.&nbsp;

An extradition warrant against Mallya was executed by Scotland Yard in April 2017.&nbsp;

While Mallya's legal team had argued in court that the default on the loans sought by the now-defunct airline were the result of business failure, the Crown Prosecution Service (CPS) had claimed fraudulent intentions by the businessman in seeking and then dispersing those loans.

Judge Arbuthnot, Chief Magistrate at Westminster Magistrates' Court, in her ruling delivered on December 10 at the end of a year-long trial, concluded there was a case to answer in the Indian courts over substantial "misrepresentations" by the "flashy billionaire" of his financial dealings.

"There is clear evidence of dispersal and misapplication of the loan funds and I find a prima facie case the Dr Mallya was involved in a conspiracy to launder money," she had said.

The judgment had also dismissed the defence team's attempt to challenge the case on human rights grounds by claiming that Barrack 12 of Arthur Road Jail in Mumbai, where the businessman is to be detained following his extradition, did not meet minimum requirements.&nbsp;

The UK court said it was satisfied with the various assurances provided by the Indian government, including a video of the jail cell, which had not only been recently redecorated but was also far larger than the minimum requirement threshold.

"I noted that he (Mallya) is taking a whole range of medications which the GoI (government of India) will ensure he has access to," the judge said.

Mallya now has 14 days to appeal against the Westminster Magistrates' Court's verdict. He has said he will.&nbsp;

If the appeal is allowed, the case will proceed to the UK High Court.&nbsp;

There is some limited recourse for the case to go on to a further level of the Supreme Court, but that is only possible if the High Court certifies that the appeal involves a point of law of general public importance, and either the High Court or the apex court gives leave for the appeal to be made.&nbsp;

UK judge had been critical of Indian banks in Mallya extradition case

The UK judge who ordered Vijay Mallya's extradition was extremely critical of some of the procedures followed by Indian banks who "waved through" the loans to the former Kingfisher Airlines boss.

Judge Emma Arbuthnot ruled that the 62-year-old businessman had a prima facie case of fraud and money laundering to answer and expressed her shock at the failure to obtain proper credit reports before certain loans were sanctioned by some of the Indian state-owned banks.

"There was a failure to ensure that the guarantees were formally taken when they should have been and a failure to investigate the representations that KFA (Kingfisher Airlines) made at various stages to obtain the loans," she said.&nbsp;

The judge described these as "continuing failures" by banks and said it remained unclear from the evidence before her if these were by design and with a hidden financial motive.

"Or it is a case of a bank who were <a href="http://www.wionews.com/india-news/vijay-mallya-embattled-fugitive-liquor-baron-who-was-once-member-of-parliament-and-king-of-good-times-195158">in the thrall of this glamorous, flashy, famous, bejewelled, bodyguarded, ostensibly billionaire playboy</a> who charmed and cajoled these bankers into losing their common sense and persuading them to put their own rules and regulations to one side," she said, in one of her most critical statements in the judgment.

"If the criteria for lending to KFA had been applied, if the background checks had been carried out, the loans should not have been granted," she noted.

In an indication that some bank employees may have been involved in a wider conspiracy, the judge concluded she did find a prima facie case of a conspiracy to defraud which involves not just the KFA executives but also some bankers at IDBI who were named in the Indian government case.

"Conspiracies are very rarely proved with direct evidence and there is none in this case but there is evidence that the GOI (government of India) relies on from which it says the court can draw inferences that the bankers were involved in a conspiracy with KFA," the judgment noted.&nbsp;

Mallya is on bail on an extradition warrant executed by Scotland Yard in April 2017 after the Indian authorities brought fraud and money laundering charges amounting to Rs 9,000 crores against the former Kingfisher Airlines boss.&nbsp;

The former Kingfisher Airlines' boss has earlier indicated that he intends to file an application to appeal against the Westminster Magistrates' Court verdict in favour of his extradition to India.

The businessman had told reporters soon after the ruling by Chief Magistrate Emma Arbuthnot in London in December 2018 that he would consider the verdict in detail and decide his next course of action. His legal team later confirmed that he will seek leave to appeal against the court order, news agency PTI reported.&nbsp;

While Mallya's legal team had argued in the UK court that the default on the loans sought by the now-defunct airline was the result of the business failure, the Crown Prosecution Service (CPS) had claimed fraudulent intentions by the businessman in seeking and then dispersing those loans.

Judge Arbuthnot, in her ruling delivered on December 10 at the end of a year-long trial, concluded there is a case to answer in the Indian courts over substantial "misrepresentations" by the "flashy billionaire" of his financial dealings.

"There is clear evidence of dispersal and misapplication of the loan funds and I find a prima facie case the Dr Mallya was involved in a conspiracy to launder money," she said.

The judgment had also dismissed the defence team's attempt to challenge the case on human rights grounds by claiming that Barrack 12 of Arthur Road Jail in Mumbai, where the businessman is to be detained following his extradition, did not meet the requirements.&nbsp;

The UK court said it was satisfied with the various assurances provided by the Indian government, including a video of the jail cell, which had not only been recently redecorated but was also far larger than the minimum required threshold.

Mallya's extradition to India had been ordered by the Westminster Magistrates’ Court on December 9, 2018, after which the home secretary had two months to review and formally approve the extradition.

That deadline would have expired on February 9. Mallya now has 14 days to appeal the home secretary's decision.&nbsp;

In January 2019, a Mumbai court declared embattled liquor baron <a href="http://www.wionews.com/business-economy/vijay-mallya-first-businessman-to-be-declared-fugitive-economic-offender-188409">Vijay Mallya a fugitive economic offender (FEO)</a> on a plea of the Enforcement Directorate.

A timeline of the Vijay Mallya extradition case

Fugitive liquor baron Vijay Mallya Friday claimed his group's properties worth over Rs 13,000 crore have been attached, more than the 'claimed' Rs 9,000 crore that he "ran away with" asking where is justice and how far will it go.

In a series of tweets, Mallya, who intends to appeal against a UK court's extradition verdict, also claimed that the banks to which he owes money "have given an open licence to their Lawyers in England to pursue multiple frivolous litigations against" him questioning the "brazen" spending of "public money on legal fees".

"Every morning I wake up to yet another attachment by the DRT (debt recovery tribunal) recovery officer. Value already crossed (Rs) 13,000 crore. Banks claim dues including all interest of (Rs) 9,000 crore which is subject to review. How far will this go and well beyond? Justified??", Mallya tweeted.

"Yet the narrative is that I ran away with the claimed amount of (Rs) 9000 crore causing loss to the public sector banks. Where is Justice or fair play?," he asked.

Mallya also claimed that the banks' lawyers in England have objected in writing to his paying "my legitimate tax dues to HMRC which I requested".
