Now, one of the main reasons which disproportionately affects Indians is the nationality-based green card caps. As per US law, no country can get more than 7% of all green cards in a single year. Thus, a small country like Iceland and a large country like India face the same 7% cap. With only around one hundred forty thousand green cards available annually, very few Indians end up acquiring permanent residence. If we look at the overall figures, close to a million Indians are still waiting for a green card. They account for 79% of all the people across the globe who are awaiting permanent residence. According to the NGO, the green card backlog for Indians has grown by 19% since 2020. Now, this comes amid the Trump administration tightening restrictions for even legal immigrants. Last week, it paused all US immigrant visa applications and even cancelled pre-scheduled interviews. According to reports, this was done to ensure in-depth training of all consular officers. This is not all. The US Department of Homeland Security has proposed imposing a fee of over one hundred thousand US dollars on H-1b petitions. This would considerably increase the cost of employing foreign professionals in US. This is particularly significant for Indians who accounted for 71% of H-1b beneficiaries in 2024.

Indian nationals in the US waiting for employment-based green cards could face increased scrutiny from September 18, when new US Citizenship and Immigration Services (USCIS) guidance on the “public charge” rule takes effect. The change matters particularly for Indians who have spent years in the employment-based green card backlog and are now preparing to file Form I-485, the application used to adjust status to permanent residence.Under the revised guidance, USCIS officers will assess an applicant’s circumstances as a whole, looking at factors including age, health, family situation, assets, financial resources, education and skills. Officers may also seek evidence of future employment, including job offers and expected wages.According to USCIS, “The updated guidance aligns with Congressional intent that aliens in the US be self-sufficient and not dependent on taxpayer-funded government benefits.”Employment-based applicants could be particularly affected after years in the backlog. However, routine H-1B petitions, including extensions, amendments and changes of employer, as well as H-4 extensions and changes of status, are not covered by the public charge ground. Also read | US may force more visa applicants to make social media accounts public under Trump's new planThe policy has also raised concerns among Indian professionals following a wave of layoffs. A layoff alone does not make someone a public charge, but an officer could examine previous employment, wages, education, skills, job prospects, household income and assets. The revised guidance also broadens the benefits USCIS can consider. Benefits such as SNAP, housing assistance, CHIP and regular Medicaid, which were excluded under the Biden-era framework, may now be considered for benefits received from September 18, 2026.Still, receiving such assistance does not automatically make an applicant inadmissible. USCIS will make a case-by-case assessment. The rule could particularly affect elderly parents with health problems whose sponsors may struggle to meet the new requirements. In some cases, USCIS may allow applicants deemed inadmissible solely on public-charge grounds to post a financial bond. If the bond conditions are met, the green card application could still be approved.

Federal agencies, including ICE (Immigration and Customs Enforcement), are now arresting individuals, particularly spouses of US citizens, during routine Green Card interviews at USCIS offices in San Diego, according to several media reports. Immigration lawyers have shared that their clients are being handcuffed and arrested during these interviews despite having followed all required procedures to apply for permanent residency. An attorney Saman Nasseri said that ICE has recently been arresting people who have overstayed their visas during these interviews. He said that several of his clients were arrested without prior criminal history or arrests. "None of my clients have any arrests or criminal history. These are cases where individuals entered the country legally, but their visas have expired. All of them are married to US citizens and are going through the normal immigration process," Nasseri was quoted as saying to The New York Times.
ICE arrests in San Diego
Another immigration attorney, Habib Hasbini, confirmed similar incidents and suggested that the arrests appear to be limited to the San Diego USCIS office so far. "The first incident occurred on November 12, just before a memo from ICE was issued. Hasbini also urged people with upcoming Green Card interviews to attend them but advised them to be prepared for the possibility of arrest. The Trump administration has announced major changes to US work visa renewal policies, a move expected to affect thousands of foreign professionals, especially Indian nationals working in the country. Under the new Department of Homeland Security (DHS) regulation, foreign workers will no longer be allowed to continue working if their employment authorisation document (EAD) expires before their renewal application is approved. The policy takes effect on October 30, 2025. Previously, foreign professionals could keep working after submitting timely renewal applications, even if their work permits expired during processing. The new rule eliminates this automatic extension, which has long been a safeguard against administrative delays. The DHS said that the change aims to ensure “proper vetting and screening” of applicants before granting renewed employment authorisation. However, critics warn it could leave thousands temporarily unemployed due to long USCIS processing times. Also Read: 'Would love to go home if...': Ousted Bangladesh PM Sheikh Hasina confirms she is in Delhi "This IFR (Interim final rule) amends DHS regulations to end the practice of automatically extending the validity of employment authorisation documents (Forms I-766 or EADs) for aliens who have timely filed an application to renew their EAD in certain employment authorisation categories," a statement of the Department of Homeland Security said. “The purpose of this change is to prioritize the proper vetting and screening of aliens before granting a new period of employment authorisation and/or a new EAD,” it added. Those most affected include students on Optional Practical Training (OPT) under F-1 visas, H-4 visa holders who are spouses of H-1B professionals, and individuals awaiting permanent residency (green cards). The rule follows the administration’s controversial proposal to impose a $100,000 fee for H-1B visa applications. Justifying the move, DHS cited national security concerns following a June 2025 attack in Boulder, Colorado involving an asylum applicant whose work permit had been automatically extended. Due to lengthy green card backlogs, Indian nationals face some of the longest waiting periods, requiring repeated renewals to maintain legal employment. The USCIS now advises filing EAD renewals up to 180 days before expiration to reduce the risk of losing work authorisation.
