The Centre, however, opposed his claim and produced a medical report dated February 12 which said he was fit and had a sound mind.

A bench of Justices R Banumathi, Ashok Bhushan and A S Bopanna, which reserved its order on Sharma's plea challenging the rejection of his mercy petition by President said it will pronounce the verdict on Friday at 2 PM.

The top court also rejected Sharma's counsel A P Singh's request to peruse the original file of recommendation made by the Lieutenant Governor and Delhi home minister Satyendra Jain for rejection of his mercy petition.

"Though the Court has informed counsel that Home Minister of Government of NCT of Delhi and Lieutenant Governor have signed the proposal on the mercy petition, counsel insisted upon on looking into the original files. Request for perusal of the original files by learned counsel appearing for the petitioner-Vinay Sharma is declined," the bench said in its order.

Singh contended that signatures of Delhi home minister and LG were not obtained on the original files recommending rejection of mercy petition of Sharma.

Solicitor General Tushar Mehta, appearing for the Centre and NCT of Delhi, opposed the arguments of Singh and said that signatures were obtained on the original files and submitted the documents for the perusal of the court.

"The contention of Dr AP Singh, counsel appearing for the petitioner-Vinay Sharma, is that Home Minister of Government of NCT of Delhi and LG have not signed the recommendation rejecting the mercy petition of the petitioner and, therefore, counsel wanted to look into the original file and make submission on that aspect," said the bench.

It said, "The concerned files have been produced before us which we have perused and on perusal, it is seen that Home Minister of Government of NCT of Delhi and Lieutenant Governor have signed the same".

The bench after rejecting the request of Singh asked him to continue with his arguments while making him clear that judicial review of rejection of mercy petition by President has a very limited scope and the court has only to see whether there was the proper application of mind.

Singh said that all relevant materials were not before the President, who rejected the mercy petition within 48 hours of filing of the plea.

"The President did not consider that Sharma has been subjected to torture and ill-treatment in prison, as a result of which he experienced grave mental trauma and even developed mental illness for which he has received psychiatric treatment in prison," Singh said, adding that mental illness is one of the ground to commute his death sentence.

He said that Sharma was also kept in solitary confinement by the jail authorities and subjected in-human treatment, which was against the guidelines of apex court.

Singh argued that there was history of physical assaults on Sharma and his medical records establishes the fact that he was taken for psychiatric treatment several times.

Mehta opposed the arguments saying all due process of law was followed and read out the file noting made by Union home minister Amit Shah, on the recommendation sent to the President which said that his case fall in rarest of rare category and does not deserve clemency.

Mehta said that prison records suggest that he was not kept in solitary confinement.

The apex court had earlier dismissed a plea filed by Mukesh Kumar Singh, another death row convict in the case, challenging the rejection of his mercy petition by the President.

The trial court had on January 31 stayed "till further orders" execution of the four convicts in the case -- Mukesh Kumar Singh (32), Pawan Gupta (25), Vinay Kumar Sharma (26) and Akshay Kumar (31), who are lodged in Tihar Jail.

Pawan has not yet filed a curative petition -- the last and final legal remedy available to a person which is decided in-chamber. Pawan also has the option of filing a mercy plea.

The mercy petition of Akshay was also rejected by the President.

The 23-year-old physiotherapy intern, who came to be known as 'Nirbhaya' (fearless), was gang-raped and savagely assaulted on the night of December 16, 2012, in a moving bus in South Delhi. She died of her injuries a fortnight later in a Singapore hospital.

Six people including the four convicts, Ram Singh and a juvenile -- were named as accused.

The trial of the five adult men began in a special fast-track court in March 2013.

"Nation's patience has been tested enough" in the Nirbhaya case due to delay tactics of the four death row convicts, the Centre told the Supreme Court Friday and said the court would have to lay down law on whether condemned prisoners can be hanged separately or not.

The Centre has challenged in the top court the February 5 order of the Delhi High Court which had dismissed its plea against the trial court's order staying the execution of the death sentence and said that all the four convicts have to be executed together and not separately.

"This is a case where ultimately this bench will have to lay down the law. Nation's patience has been tested enough now," Solicitor General Tushar Mehta told a bench comprising Justices R Banumathi, Ashok Bhushan and A S Bopanna.

The bench, which said the plea filed by the Centre and the Delhi government would be heard on February 11, did not heed to Mehta's request to issue notices to the four convicts and said it would further delay the matter.

The bench told Mehta that it would hear him on February 11 and it may consider whether notice needed to be issued to these convicts.

Mehta told the bench that one of the convicts, Mukesh Kumar Singh, has exhausted all his remedies including the mercy plea and the challenge to its rejection by the President in the apex court.

The mercy pleas of Akshay Kumar and Vinay Kumar Sharma have already been dismissed, he said, adding that the fourth convict Pawan Gupta has neither filed a curative petition nor a mercy plea.

"Pawan has chosen not to file a curative or a mercy petition. The question is, is the authority required to wait endlessly," Mehta said, adding, can a "calculated design" of one convict to delay the matter create uncertainty over the execution of other convicts.

Mehta said, in this case, there may be a situation where one convict "sits tight for five years" and the others then approach the apex court seeking commutation of the death penalty on the ground of delay in execution.

"The high court has granted them (convicts) one week time to avail all their remedies. This amply protects you," the bench said, adding, "No one can be compelled to take remedies."

While explaining the sequence of events, Mehta said the trial court had suspended the death warrants of the convicts.

To this, the bench said, "That was done as mercy petition of Vinay was pending then".

When the bench said it would hear the matter on February 11, Mehta urged the court to issue a notice to the four convicts and said, "Let them come to this court on Monday and say what they intend to do."

"Issuance of notice will not harm them. The high court had also issued notices to them. The court can have the benefit of their assistance on the issue. As an institution we are answerable to the society," he said, adding that the court can allow them to serve the copy of plea to the four convicts in jail itself.

To this, the bench said issuing notices to the convicts at this stage will further delay the matter.

"We want to hear you on merits," the bench told Mehta, who said he can argue on the merits "right now" but it would be better if convicts are represented in the court through their lawyers during the arguments.

"By the order of the high court, they (convicts) can take some steps," the bench said.

"In the impugned order, the Delhi High Court has granted one week time to the convicts to take steps if they wish to make any type of objections before any institutions/ authorities available under the law. Since one week time has been granted to the convicts which expires on February 11, list the matter on February 11 at 2 PM," the bench said.

Nirbhaya convict to challenge SC order dismissing juvenility plea

The dismissal of the curative petition of Akshay Thakur by the Supreme Court has brought the convicts closer to their execution and now without any delay, they should be hanged on February 1, said Nirbhaya's mother Asha Devi on Thursday.

"They have moved a step forward towards their execution. Now, nothing is left to provide them as they were given all the time. All that is left is to hang them. Now, they should be hanged without any delay," Devi told ANI.

"It's not only me but everyone has understood that they are trying to delay the execution. They have made a mockery of the system. I still hope that they will be hanged on February 1 and will continue with the fight," she added.

Expressing happiness over the Supreme Court's decision, Nirbhaya's father Badrinath Singh said, "I welcome the decision of the top court. There is, of course, a delay in the process but we are not disappointed. We hope they will be hanged soon."

Another Nirbhaya convict files mercy plea with President

Mukesh Kumar Singh, one of the death row convicts in the 2012-gangrape and murder case, on Saturday moved Supreme Court challenging the rejection of his mercy petition by the President.

The government also wanted the court to direct that a death row convict can only file a mercy plea within seven days of receiving the death warrant; while the state governments and authorities should issue death warrant within seven days of the mercy plea being rejected.

"If the convict of death sentence wants to file mercy petition, it would be mandatory for a convict of death sentence to do so only within a period of seven days from the date of receipt of death warrant issued by the competent court", the government stated in the plea.

The four convicts, Vinay, Akshay, Pawan, and Mukesh were sentenced for the death penalty for brutally raping a 23-year woman while she was moving in a bus in the national capital region. They were to be executed on January 22 at 7 am but in a Delhi court judgment the execution was rescheduled on February 1 at 6 am.

Ministry of Home Affairs had sent Singh's mercy petition to Rashtrapati Bhavan on Thursday night, sources said.

The Supreme Court had earlier dismissed curative petitions of the two convicts - Vinay Sharma and Mukesh Singh - who had appealed the death sentence.

On Wednesday, Delhi High Court refused to set aside the trial court order which issued a death warrant to Nirbhaya case convicts.

The court asked convict Mukesh's counsel to approach the trial court and apprise the court about the pending mercy plea.

The government in its argument had said they <a href="https://www.wionews.com/india-news/high-court-backs-death-warrant-against-nirbhaya-case-convicts-delhi-govt-says-cannot-be-hanged-on-jan-22-due-to-pending-plea-274422">cannot be hanged on January 22</a> since mercy petition filed by Mukesh Singh was pending and that it was bound by law to wait before moving ahead with the death warrant.&nbsp;

"It can only take place 14 days after the mercy plea is rejected as we are bound by the rule which says that a notice of 14 days must be provided to the convicts after the rejection of mercy plea," advocate Rahul Mehra appearing for Tihar Jail authorities, said.

He further stated that the fate of a death convict comes to finality only after his mercy plea is rejected by the President.

Supreme Court dismisses Nirbhaya convicts curative pleas

Tihar Jail authorities will conduct dummy execution of <a href="https://www.wionews.com/india-news/court-to-hear-plea-of-nirbhayas-parents-seeking-to-expedite-punishment-to-4-convicts-272716">Nirbhaya gang-rape</a> convicts in the coming days ahead of their execution on January 22.

Earlier, it was scheduled to be held today.

The dummy execution will be conducted in Jail 3, the place where they will be executed on January 22. "Tihar to conduct dummy execution in the coming days but not today. It will be done in jail 3, where the execution will take place," said Tihar Jail administration in a statement. At the time of the dummy execution, the executive engineer of PWD, superintendent, and other jail officials will be present, it said.

All four convicts in the Nirbhaya case will be executed on January 22 at 7 am in jail cell 3 in Tihar Jail, the same place where Afzal Guru, the terrorist convicted Parliament attack case, was hanged. The officials said they will be hanged together.

Earlier during proceedings, Senior advocate AP Singh, representing Akshay, told a newly-constituted bench headed by Justice R Banumathi that his client has been "falsely implicated" in the case and argued against the death penalty awarded to him.

"Death penalty is a primitive method of punishment. Execution kills the criminal not the crime. Use of the death penalty did not seem to have a deterrent effect on criminals and convicts," Singh contended. The counsel said that the victim died of septicaemia and drug overdose and wrong reports were made to falsely implicate his client. "The dying declaration was doubtful. This was tutored. This was not voluntary. She has not named Akshay as the accused who had committed the offence," he added. Solicitor General Tushar Mehta, appearing for the Delhi state, said that no mercy should be granted. "There are crimes where humanity is put to shame...crimes when God cries...there should be no mercy," he said. Akshay has moved the top court seeking review of its 2017 verdict which upheld the death penalty awarded to him and three others in the case.

The petition will now be placed before the Lieutenant-Governor of Delhi for consideration after which it will be sent to the Ministry of Home Affairs of the Central government.

While their prompt response in nabbing the perpetrators was lauded, they were also questioned for failing to provide adequate security for women in the capital city. Six years after the landmark case, Indo-Canadian filmmaker Richie Mehta recounts the entire incident in a new seven-part series called 'Delhi Crime' which tells the story from Delhi Police' perspective. Featuring Shefali Shah, Rasika Dugal, Adil Hussain, Rajesh Tailang and others the show is available on Netflix.&nbsp;

Shefali Shah, who plays DCP Vertika Chaturvedi in the show, says that she took exactly 3 minutes to say 'yes' to Mehta. Shah's character is shown to be in charge of the investigative team that eventually cracked the case and arrested the rapists. Considering the show is based on a real-life incident, Shah says that the team was aware that it had to be approached with sensitivity and a certain amount of responsibility. "When I heard what Richie had in mind, I knew he would treat this with great sensitivity. The incident shook and scarred all of us- something that we will never get over. But Richie wanted to tell what happened after that incident took place, the investigation that followed," said Shah while speaking to WION.&nbsp;

Calling her director 'benevolent', Shah said that he was clear that he did not want an actress onboard. "Richie was clear that he did not want an actress but a collaborator. He told me that 'I have written from a man's perspective. I need a woman, a voice to bring in the sensitivity.'" The actress said she tried to bring in her own interpretation as to how a female officer would deal with the situation. "We all worked very hard on the script and Rishi is quite open to opinions and suggestion. He is not at all rigid and I respect him a lot as a director."

To prep for her role, she did meet the lady officer on whom her character is based. Calling her inspirational, Shah said that she was kind enough to answer all her queries.&nbsp;

Did she ever get emotional or overwhelmed while filming the show? "I was overwhelmed throughout. I think playing Vertika has been the most emotionally consuming role for me. I get emotionally involved with all my characters but this one more so."

Shah also learned a lot from her character of Vertika. "She is emotional just like me but unlike me, she has to keep it under check. She cannot let her emotions cloud her investigations."&nbsp;

No one can ever fathom that such a thing can happen until it happens."

The show premiered at Sundance Film Festival where it received critical praises. "When we started filming, we did not know which OTT platform would pick it up. It was only after Sundance, that Netflix decided to release it. I think that way, I'd call the entire team very brave to have agreed to do such a project without knowing if it ever will get a release. I guess, we just wanted to tell an important story and rest worked out on its own."

The actress who rose to fame during her stint on Indian TV in the late 1990s and early 2000s, says that OTT platforms like Netflix have a huge reach which helps shows like 'Delhi Crime'. "There is scope for detailing when one is making a series for the web. Besides I can binge watch. I don't have to wait for another week to watch what happens next."

The actress also feels that the present times are far more open to women-centric content. "Be it films or web shows, I think stories with women-protagonists now are thought of more now that earlier."&nbsp;
