Nepal President Bidya Devi Bhandari called on parties to form a new majority government by Thursday after Prime Minister KP Sharma Oli lost a trust vote in the parliament.

"President Bidya Devi Bhandari has decided to invite parties to form a majority government pursuant to Article 76 (2) of the Constitution of Nepal," a statement issued by the President’s Office said.

She has asked all the parties to stake their claim by Thursday 9:00 PM.

Bhandari’s announcement to form a government came after Oli failed a vote of confidence in the Parliament with 93 votes in favor while 124 against the motion. Oli fell short of 43 votes to reach the 136-mark and win the vote of confidence. The session was attended by 232 lawmakers.

Three opposition leaders, Sher Bahadur Deuba (Nepali Congress), Pushpa Kamal Dahal-Prachanda (CPN-Maoist Centre) and a faction of Janata Samajbadi Party led by Upendra Yadav had called on President to initiate government formation procedure, soon after the commencement of a special session of the parliament on Monday.

Nepali Congress has 61 lawmakers while CPN-Maoist Centre has 49 members in the Parliament. Only 17 of the total 32 lawmakers of Upendra Yadav faction are in support of Congress-led government.

Nepali Congress will still require 10 more votes to form a coalition government.

Nepal Workers and Peasants Party, Rastriya Prajatantra Party and Rastriya Janamorcha Party each have one seat in the parliament and neither of them have announced their support to either party as of yet.

Meanwhile, Janata Samajbadi Party leader Mahantha Thakur has refused to be part of the new government formation.

In a statement, Thakur said that his party's priority is getting its agendas addressed rather than government formation or being part of any government.

With Oli failing the trust vote, the president needs to invoke Article 76 (2) to form a new government. It says in cases where no party has a clear majority in the House, the president shall appoint as the prime minister a member of the House who can command the majority with the support of two or more parties in the House of Representatives.

The House speaker Agni Sapkota had informed Monday's parliamentary meeting that the next session would be held on Thursday.

While addressing the Parliament, Oli had said, "It was unfortunate that a government that tirelessly worked for the country's development and nation-building was being targeted for narrow and partisan interests."

The prime minister also said that the government wanted to give its attention to the COVID-19 pandemic but was "facing difficulties".

Opposition leaders, including Deuba and Prachanda, Yadav blamed Oli for his failure to tackle the surge in COVID-19 cases over the last few weeks.

A section of Oli's party, Nepal Communist Party-Unified Marxist-Leninist led by former Prime Minister Madhav Kumar Nepal is not happy with Oli since the formation of this government in 2017, accusing him of working unilaterally as head of the government and the party.

The political crisis in the country deepened after a Supreme Court verdict rejecting the 2018 unification between the then CPN-UML and the CPN-Maoist Centre and effectively reviving the two parties on March 7.

In the 271-member House of Representatives, the CPN-UML has 121 seats, the Nepali Congress 63, the CPN-Maoist Centre of former PM Pushpa Kamal Dahal 49, the Janata Samajbadi Party 34, and smaller parties four seats.

Nepal law minister Lila Nath Shrestha confident PM Oli will win the trust vote

Nepal's Prime Minister KP Sharma Oli will seek a vote of confidence from Parliament. Oli who is facing a crisis inside his own party is set to seek trust of vote on May 10 in his bid to stay in power.

Nepal PM KP Sharma Oli to seek vote of confidence on May 10

Nepal`s Prime Minister K.P. Sharma Oli, who is facing a crisis inside his own party, is to seek a vote of confidence on May 10.

The decision was taken as Oli was increasingly facing non-cooperation from one section of his own Nepal Communist Party-Unified Marxist-Leninist and the Nepal Communist Party-Maoist Centre has threatened to pull out from the government.

A section of Oli`s own party led by former Prime Minister Madhav Kumar Nepal is not happy with Oli, who is also the party Chairman, since the formation of this government some three years back, accusing him of working unilaterally as head of the government and the party.

In the midst of this confusion, the Prime Minister has decided to seek a vote of confidence and decided to summon the house on May 10 for the purpose, Agriculture and Livestock Minister, Padma Kumari Aryal told IANS.

If Oli fails to garner a majority, then either he will dissolve the house and declare the elections or will seek support from other parties to run the government for the remaining two years.

The rift between Oli and Nepal widened after Oli dissolved the Parliament on December 10. However in February, Nepal`s Supreme Court reinstated the Parliament but relations between Oli and Nepal soured further after Oli suspended him and some other senior party leaders close to him for six months.

The Nepal faction is also creating parallel party structures after animosity grew with Oli. After facing non-cooperation from within the party, now the Prime Minister has decided to seek a vote of confidence, the minister said.

Out of 121 seats, Oli has support of 86 lawmakers while the Nepal faction holds sway over 35. It is not sure whether the Nepal faction will cross the floor against his own party`s chairman. But the Nepal faction has been crossing the floors in some provinces, so it is likely to cross the floor or abstain from the trust vote, said party leaders.

Nepal PM Oli to seek vote of confidence on May 10

In a surprise and unexpected decision, Nepal's Supreme Court on Sunday annulled the unification of the ruling Nepal Communist Party's factions and paved the way for them to be divided into two separate parties.

Nepal: New twist as Supreme Court annuls ruling party

Nepal President Bidya Devi Bhandari on Monday summoned a session of the House of Representatives on March 7, days after the apex court reinstated the lower house in a landmark verdict that annulled embattled Prime Minister K P Sharma Oli's "unconstitutional" decision to dissolve it.

President Bhandari called for the commencement of House on the recommendation of Government of Nepal, in accordance with Article 93 (1) of the Constitution of Nepal, according to a notice issued by the President's Office on Monday.

As per the notice, the 275-member lower house will begin at 4:00 pm on the slated date.

The presidential order to summon the House meeting follows the Supreme Court's decision to overturn Prime Minister Oli's move to dissolve the House on December 20.

A five-member constitutional bench led by Chief Justice Cholendra Shumsher last week annulled the Oli government's "unconstitutional" decision to dissolve the lower house of Parliament.

The court had ordered the government to summon the House session within the next 13 days.

Nepal plunged into a political crisis on December 20 after President Bhandari dissolved the House and announced fresh elections on April 30 and May 10 at the recommendation of Prime Minister Oli, amidst a tussle for power within the ruling Nepal Communist Party (NCP).

Oli's move to dissolve the House sparked protests from a large section of the NCP led by his rival Pushpa Kamal Dahal 'Prachanda', also a co-chair of the ruling party.
As many as 13 writ petitions including the one by the ruling party's Chief Whip Dev Prasad Gurung were filed in the apex court seeking the restoration of the lower house parliament.

In its ruling, the apex court termed the dissolution of the House as "unconstitutional".

The ruling party suffered a vertical split following Oli's decision to dissolve the lower house.

Prime Minister Oli on Sunday challenged the splinter faction led by 'Prachanda' to remove him from the top post if he can.

"Remove me if you can. If I am ousted, I'll emerge victorious with a two-thirds majority in the next election," 69-year-old Oli said.

Prachanda has been making efforts to garner support from the opposition Nepali Congress and Janata Samajbadi parties in an apparent bid to oust Oli from power.

Oli's Press Advisor Surya Thapa last week said the prime minister will not resign immediately and implement the Supreme Court's verdict against him by facing Parliament.
Oli is under pressure to step down following the court verdict.

Nepal plunged into a political crisis on December 20 after President Bidya Devi Bhandari dissolved the House and announced fresh elections on April 30 and May 10 at the recommendation of Prime Minister Oli, amidst a tussle for power within the ruling Nepal Communist Party (NCP).

Oli's Press Advisor Surya Thapa said the prime minister, who turned 69 this week, intends to implement the verdict of the apex court after facing Parliament that is due to convene within two weeks.

"The Supreme Court's verdict is controversial, however, it should be accepted and implemented. Its effects will be seen in the future as the decision has not provided any solution to the political problems," Thapa said.

He claimed that the apex court's verdict will further fuel instability and pave way for power-play.

"The Prime Minister will face the House of Representatives to implement the verdict but will not tender his resignation as of now," Thapa was quoted as saying by The Himalayan Times.

Oli's Chief Advisor Bishnu Rimal, mirroring Thapa's sentiments, said that all will have to accept the court's decision. "However, it provides no solution to existing political complications," Rimal said.

Thapa’s reaction comes amid mounting pressure on the prime minister to step down following the court verdict.

A large section of the Nepalese media welcomed the Supreme Court's verdict that reinstated the dissolved House of Representatives. They hailed the decision, saying it has upheld democratic values and safeguarded the Constitution.

"By passing a judgment, the Supreme Court has once again stood by the people, and reestablished the notion of an independent judiciary,” wrote The Kathmandu Post in its editorial."

"Now the House has been reinstated and the politics will return to Parliament, the problems are not yet over. There are too many players in the House with no one controlling the majority and the risk of the dirty game of horse-trading could start soon," the daily warned.

Naya Patrika daily termed the ruling a “defeat for an autocratic ruler” and a “victory for democracy and a challenge for the future.”

"If both the factions of the Communist Party of Nepal (CPN) could utilise the opportunity created by the House reinstatement in a constructive way, it would benefit all the party, the cadres and leaders of the party as well as the entire nation," the Annapurna Post said in its editorial.

"One should use conscience so that the country would not plunge into another political crisis and confrontation," it said.

Meanwhile, Vice-president of the CPN Bamdev Gautam, who has so far maintained a balance between Oli and his rivals Prachanda and Madhav Kumar Nepal, has urged the prime minister to step down.

"As the court verdict has proven that the PM's step was unconstitutional, he must resign immediately," Gautam said.

Bhim Rawal, the Sudurpaschim in-charge of the Dahal-Nepal faction of Nepal Communist Party (NCP), has said on Wednesday Oli should apologise to the people.

"KP Sharma Oli should personally apologise to the nation for dissolving the parliament. If he resigns from the post of Prime Minister on moral grounds and asks for forgiveness from NCP, then only can the party become positive towards him," The Himalayan Times quoted Rawal as saying.

His move to dissolve the 275-member House had sparked protests from a large section of the NCP led by Prachanda, also a co-chair of the ruling party.

Oli repeatedly defended his move to dissolve the House of Representatives, saying some leaders of his party were attempting to form a "parallel government".

As many as 13 writ petitions including the one by the ruling Nepal Communist Party's Chief Whip Dev Prasad Gurung were filed at the apex court seeking the restoration of the lower house parliament.

Just some days ago, Prime Minister Oli had warned of an impending protest if it was ordered for the parliament to be reinstated.

Nepal Supreme Court overturns Prime Minister KP Sharma Oli's House dissolution

Amid the ongoing political turmoil in the country, Nepal caretaker Prime Minister KP Sharma Oli on Thursday reached the country's Supreme Court to furnish written reply over the cases filed against him.

This comes as Nepal Supreme Court last month had summoned PM Oli in person within seven days with a written response on why he should not be punished for contempt of court.

“Single bench of Justice Manoj Kumar Sharma ordered PM Oli to appear before the court in the contempt of court cases over his comments over a senior advocate and subsequent comments about the sub-judicial case of house dissolution,” said Devendra Dhakal, assistant spokesperson, Supreme Court last month.

Earlier, two advocates had filed separate cases of 'Contempt of Court' against Oli last month over his remarks on the Parliament dissolution case, which is undergoing discussion at the court along with subsequent comment over a senior advocate.

Advocates Kumar Sharma Acharya and Kanchan Krishna Neupane filed the cases against Oli, who is functioning as a 'caretaker prime minister' after dissolving lower house and calling fresh elections, before schedule.

Advocates have claimed that Oli tried to influence the court and made disparaging remarks against legal practitioners. In an event on January 22, Oli during his address at a local gathering claimed that parliament dissolution has been made over time in Nepali history and there is no provision to restore the house.

While defending himself over the issue, which now is undergoing discussion at court, Oli took a jibe at a senior advocate and former chairman of Nepal Bar Association, Krishna Prasad Bhandari, calling him a 'grandfather' lawyer and asked petitioners not to trouble him.

Oli further attacked Bhandari calling his presence at the Supreme Court a 'farce'. The former chair and senior advocate, Krishna Prasad Bhandari, earlier in the week while taking part in the discussion had termed the latest move of Oli as unconstitutional.

The petitioners, who lodged a case against Oli in the Supreme Court, have claimed the statement by Oli has evoked Article 128 (4) of the constitution.

Over a dozen writ petitions have been lodged against Oli after he recommended the President to dissolve the lower house for failing to get an absolute majority in the parliament.

Defending his move to dissolve Parliament, Oli recently said some leaders tried to obstruct the functioning of his government and he had no other alternative other than seeking a fresh mandate.

?As some leaders tried to make Parliament defunct and obstruct the government's functioning, I was compelled to go for the fresh mandate. Such a situation was created in which the government was unable to move forward, which prompted us to go for elections,? he said on February 5.

Following the House dissolution, both the factions of the party, one led by Prachanda and the other by Oli have been staging public meetings and mass rallies across Nepal to show their strength.

Both Oli and the rival group claim to control the Nepal Communist Party and the issue is being disputed at the Election Commission. The rival faction even announced that it had ousted Oli from the party at a meeting last month.

Prachanda-led group announces fresh agitation against House dissolution in Nepal

Prominent Nepali Communist Prachanda, a leading opponent within the ruling party of Prime Minister K.P. Sharma Oli's decision to call for an early election, said on Wednesday the premier should resign and repent over the move.

Nepal was plunged into crisis on December 20 when Oli declared he could no longer work with rivals in his Nepal Communist Party (NCP), dissolved parliament and called for a fresh election more than a year ahead of schedule.

Tens of thousands of people have since joined protests for or against the move.

"K.P.Oli if you want some political space, there is still time for you to resign and express repentance publicly," Prachanda told an anti-Oli rally.

Prachanda, a former prime minister who still goes by the nom de guerre he used while leading a decade-long Maoist insurgency that ended in 2006, said protests to oppose Oli's "unconstitutional" move would rage across Nepal.

"Oli is not interested in the election ... don't be misled by his talks about elections, they can't be held as planned," Prachanda told the cheering and whistle-blowing crowds, near Oli's office in the capital Kathmandu.

Oli blames Prachanda and other opponents in the party for a lack of cooperation he says has stymied effective government as the Himalayan nation seeks to navigate a pandemic-induced economic crisis.

The Supreme Court is hearing more than a dozen petitions challenging the dissolution of parliament. Judges are expected to give their verdict this month.

If the verdict is in Oli's favour then Nepal faces an election in two phases, on April 30 and May 10.

Last week, addressing a rally of supporters in Kathmandu, Oli said the dissolution of parliament was his prerogative and pledged that the vote would be held on schedule.

Nepal, a country of 30 million people, has seen vital remittances and tourism revenue hit by the COVID-19 pandemic, which has infected 272,349 people in the country, with 2,047 deaths.

Demonstrators in Nepal's capital Kathmandu on Monday (February 01) clashed with the police during protests against the dissolution of the Himalayan nation's parliament.

Demonstrators clash with police during protests against Oli in Nepal

A demonstration called by ex-Maoist rebels drew tens of thousands to the streets of Nepal's capital Friday to demand the reinstatement of parliament in the biggest show of force since it was dissolved.

Prime Minister KP Sharma Oli dismissed the legislature in December, accusing members of his own party -- including the former rebels -- of noncooperation, and called for new elections in April next year.

The move plunged Nepal into fresh political uncertainty after years of instability, short-lived governments and earthquakes that devastated the country in 2015.

Former Maoist commander Pushpa Kamal Dahal, who led the 1996-2006 insurgency that claimed thousands of lives, told demonstrators in Kathmandu that Oli was attempting to "derail the peace process."

"The elected parliament must be reinstated," he told the huge crowd, many waving red hammer and sickle flags.

Oli's government has also weathered accusations of corruption and criticism for its handling of the coronavirus pandemic.

But his decision to dissolve parliament came after months of clashes with Dahal, who helped Oli come to power when their political parties merged in 2018.

The pair had previously clashed over their power-sharing agreement and a lack of consultation.

Eyes are now on the country's Supreme Court which is hearing over a dozen writs challenging Oli's dissolution of parliament.

Nepal's top court began hearings on Wednesday on petitions challenging Prime Minister K.P. Sharma Oli's sudden decision to dissolve parliament, as protesters against his move marched nearby.

Oli, 68, has cited internal squabbling within his ruling Communist party and lack of political unity as reasons behind his Dec. 20 decision, which has triggered public outrage and has been labelled unconstitutional.

In their plea before the Supreme Court, politicians, activists and lawyers are questioning whether it is the legitimate right of the leader to dissolve the parliament and order fresh elections, 18 months before schedule.

The Nepal Communist Party, following the crisis, has broken into two factions, fighting for legitimacy and election sign, where the rival faction is led by Pushpa Kamal Dahal, who was the leader of the party during the civil war in the country that replaced the constitutional monarchy with democracy.

The Oli, 68, cited internal squabbling within his ruling Communist party and lack of political unity as reasons behind his December 20 decision.

His colleagues and opposition political parties have blamed Oli for derailing a stable government amid a pandemic that has triggered an economic downturn.

Seven ministers have quit Oli's government to oppose his move and protesters last month burnt effigies of him.

"The constitution duly defines and delimits the power of the prime minister," said Dinesh Tripathi, an independent petitioner.

"It does not give Oli the prerogative to cause an untimely death to parliament at his will," he said.

The five-member constitutional bench of the Supreme Court, including the chief justice, will hear at least 13 petitions questioning the rights of the prime minister.

Officials working with Oli said his move was in line with the constitution.

"We are fully prepared to face the challenge in the court," said Rajan Bhattarai, an aide to Oli.

If the court upholds Oli's move, Nepal will hold elections this summer. If not, parliament will be reinstated.

"If the verdict is in favour of the dissolution, there will be elections for a new parliament but we risk that in the near future, governments may not complete a full five-year term, as the prime minister could dissolve it anytime," said constitutional lawyer Bhimarjun Acharya.

"The country has been trapped into a tunnel of instability, as the dissolution was a blunder," Acharya added.
