The bill, titled the 'Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) Bill 2024', was tabled in the house by the state Law Minister Moloy Ghatak.

The bill seeks capital punishment for those convicted of rape and if the victim dies or ends up in a vegetative state. Moreover, it provides for a life sentence without parole for those convicted of rape.

The state assembly was specially convened for two days starting September 2 in the wake of strong protests across the country.

The bill is aimed at amending the existing provisions under the Bharatiya Nyaya Sanhita 2023, Bharatiya Nagarik Suraksha Sanhita, 2023, and the Protection of Children from Sexual Offences Act, 2012, “in their application to the state of West Bengal to enhance punishment and to constitute the framework for…expeditious investigation and trial of the heinous act of violence against women and children.”

The bill also provides for setting up fast-track courts for rape cases.

“To expedite investigations and ensure swift justice for victims, this Bill proposes dedicated special courts and investigation teams. These specialised units will be equipped with the necessary resources and expertise to handle cases of rape of women and sexual offences against children efficiently, effectively and timely, thereby minimising the trauma experienced by victims and their families,” it states.

The main accused in the Kolkata rape and murder case, Sanjay Roy, is reportedly throwing tantrums over the meal served in jail. Roy is currently locked up in Presidency Correctional Home or Alipore Jail of Kolkata, where he has expressed anger over simple ‘roti-sabzi’ being served to him. He has demanded jail authorities provide him with egg chowmein. &nbsp;

Obviously, prison&nbsp;authorities haven’t met his demands citing rules that say all inmates must have the same food prepared in the jail kitchen. He was also reportedly severely reprimanded by the jail administration, after which he agreed to have roti-sabzi.

This made her&nbsp;father extremely worried. When he asked for further details, he was told, "The doctors will explain. Please come here quickly". The father asked the staffer to reveal his identity, to which she replied, “I am the assistant superintendent. I am not a doctor.”

The call reportedly ended abruptly amidst disruption.

Even though our feeds, newspapers, and television screens are full of protest visuals with people screaming for accountability, there have been multiple other sexual violence incidents against women historically from the ‘disadvantaged’ groups since August 9.&nbsp; 
&nbsp; 
A man allegedly sexually abused two four-year-olds at a private school in Maharashtra’s Badlapur. In another incident a&nbsp;man allegedly raped a friend’s three-year-old daughter in Valsad. While a&nbsp;shopkeeper from North India’s Meerut was arrested for allegedly raping six young boys.&nbsp; 
&nbsp; 
We are all familiar with the hush-hush stories of sexual violence in our families and communities. Most stories never see the light of day. 
&nbsp; 
The cases are countless, and the list from just the last few days is enough to overwhelm all of us.&nbsp; 
&nbsp; 
It appears that we have learnt nothing after decades of sexual violence and brutality running rampant. Even the Indian President, Droupadi Murmu, has said ‘Enough is enough’ and asked society to stop the horrors.&nbsp; 
&nbsp; 
But when we don’t listen to our conscience, will we listen to our president?&nbsp;

The onus of sexual violence is not on its victim but is symptomatic of a greater disease pervading society. One which objectifies the woman and sees her as a means to the patriarchal end, i.e., the man’s sexual release, consent be damned!

Not safe even after death 
&nbsp; 
In a shocking turn of events, the Kolkata rape and murder victim was not left in peace even after her brutal death. Her name is trending widely on social media, often by people demanding justice. But in a far more sinister turn of events, her name became the top search trend on various pornography websites. The victim’s morphed images were quick to be circulated in chatrooms frequented by men, with many commenting on her physicality. As if this was not sickening enough, the men of India proceeded to slut-shame not just the victim but compare her to their partners.&nbsp; 
&nbsp; 
This is beyond horrifying.&nbsp; 
&nbsp; 
Consider this: a man allegedly rapes a woman, brutally murders her, dumps her body to be found later, shows no apparent remorse for his acts, and instead of outrage, his fellow men are laughing off the incident and proceeding to look for pornography related to the incident.&nbsp; 
&nbsp; 
It is no longer about our “mothers, sisters, and daughters.” As a colleague aptly noted a quote from Bachi Karkaria’s column in the Times of India, 'women are just women, not male appendages.'

If we talk about how a man brutally raped and murdered a woman in Kolkata’ or how ‘the accused brutalised the victim’ we will be easing the pressure off women to prove their assault and place it on the accused, as it should be.&nbsp; 
&nbsp; 
If we were all a little more empathetic about how we talk about sexual violence, maybe it would not have taken so long for Malayalam cinema’s #MeToo movement to kickstart.&nbsp;

Demand for collective action&nbsp;

The call for stricter rape laws in the country has been an old one. Much before West Bengal’s ruling Trinamool Congress demanded stricter rape laws and conviction rates in the country, activists have been demanding harsher laws against sexual perpetrators and quick dispensation of justice. 
&nbsp; 
The repeated and long-drawn procedure of a rape trial is often taxing on both the survivor and their family, fuelling suspicion and a greater possibility of the court of public opinion to step in. The honourable courts’ wisdom must prevail regardless of public sentiment.&nbsp; 
&nbsp; 
Time to act has passed 
 
The time to act against sexual violence has passed long ago in India. It has now become the status quo. It is considered a default that women must protect themselves from men and that men will continue to assault them. A woman living in practically any part of the country is no longer safe, let alone other gender and sexual minorities. Women, men, children, and even animals are being raped with their autonomy brutally snatched by both the perpetrators and the court of public opinion.

We as a society have missed the bus of gender equality so long ago that all women can do now is walk down the never-ending road to apparent justice, all alone.&nbsp; 
&nbsp; 
But wait, women cannot be ‘allowed’ to walk alone, right? What if they ‘tempt’ men into becoming monsters?&nbsp;

Kolkata rape-murder: RG Kar Hospital crime is a symptom of India’s collective shame

In a rare development, the President of India Droupadi Murmu&nbsp;spoke about the recent rape and murder of a trainee doctor at a Kolkata hospital, and expressed&nbsp;her ‘dismay and horror’. President Droupadi Murmu said, “Enough is enough”, as she highlighted the urgent need to step up societal overhaul to stop such crimes in future.

Murmu also threw her weight behind recent protests in support of the victims and called for swift justice.

"Even as students, doctors, and citizens were protesting in Kolkata, criminals remained on the prowl elsewhere," President Murmu told the news agency PTI.

She said that the society needed "honest and unbiased self-introspection" and required to ask itself "some difficult questions".

She also blamed such heinous crimes against women on&nbsp;"deplorable mindset" as most often women are seen as a "lesser human being, less powerful, less capable, and less intelligent".

In a bold statement, she stressed that Indian society suffers from "collective amnesia".&nbsp;

The suspension comes amid a probe by the Central Bureau of Investigation (CBI) into the rape and murder case from earlier this month.

"The IMA Bengal state branch as well as certain associations' of doctors also have demanded action citing the nature of disrepute brought by you to the profession on the whole," it added.

Furthermore, the IMA, a private, national voluntary organisation of physicians in India, said that it has "unanimously decided to suspend you forthwith from the membership of Indian Medical Association."

The TMC leader has reportedly submitted to the CBI documents related to the corruption. He claimed that junior doctors of the hospital had supplied all the information and documents related to Sandip's corruption.

In a significant development regarding the Kolkata doctor rape and murder case, the Central Bureau of Investigation (CBI) sought permission from a Kolkata Court on Tuesday to conduct a polygraph test on Anup Dutta, the Kolkata Police Assistant sub-inspector (ASI).&nbsp; The CBI was conducting the polygraph test on Wednesday at the time&nbsp;of filing of this story. As per PTI, Anup Dutta has close ties with the primary accused, Sanjay Roy, who was a police volunteer at a police post near the RG Kar Medical College and Hospital. This test will aid the CBI in finding whether Anup Dutta helped Roy or not. The ASI, Anup Dutta, is facing allegations that he helped the primary accused, Sanjay Roy, gain access to police headquarters and motorcycle, as he is not entitled to any of these services as a police volunteer.&nbsp;

Officials told PTI on Tuesday that Dutta was allegedly helping Roy, and the central agency is trying to find out whether Roy told Dutta about the crime and received any favours from him. The polygraph test will help the CBI to assess the inaccuracies and discrepancies in the statements of suspects.&nbsp;

Ahead of the 'Nabanno Abhijan' protest in Kolkata today (Aug 27), the city's police force has implemented extensive security measures to prevent potential violence.&nbsp;

Nabanno, the state secretariat, is the target of the protest and houses the offices of the Chief Minister and other key government officials.

It may be noted here, that the march to the state secretariat has been announced by an unregistered body claiming to be a students&nbsp;organisation, to demand justice for the rape and murder of the 31-year-old doctor at Kolkata's RG Kar Medical College on August 9.&nbsp;

In a major revelation in the Kolkata rape and murder case, main accused Sanjay Roy told West Bengal police that he stalked the victim at the chest medicine ward a day before he committed the gruesome crime. The CCTV footage from August 8 shows Roy staring at the 33-year-old victim and four other junior doctors at the chest ward.

As per reports, the doctor went to the seminal hall at 1:00 am (local time) on August 9 to sleep between her 36-hour-long shift. Roy was seen entering the premises at 4:00 am (local time).

The doctor was later found dead in the morning, raped and murdered.

News agency PTI reported that CBI was investigating the “broken bolt” on the seminar hall’s door. CBI is trying to find the answer to the question of&nbsp;how the offence was carried out without getting noticed by anybody.

CBI is also pursuing the angle that Roy may have sought a third person’s assistance to stand guard at the door.

“Interviews with doctors, interns, and junior doctors revealed that the door’s malfunction had been a known issue, which prevented the victim from locking the door that night,” one official was quoted as saying by the news agency.

“The tower bolt was broken, which caused the door to malfunction. We are probing whether anyone was stationed outside to act as a guard while the crime was committed,” the official said.

The top court also questioned the move of the state government in appointing the then principal, Sandip Kumar Ghosh, to another hospital immediately after his resignation from the R G Kar Medical College and Hospital.

After Senior Advocate Kapil Sibal, representing the West Bengal government and Kolkata Police, argued that the police had adhered to all case registration guidelines, the Chief Justice of India, D Y Chandrachud, presiding over a bench that also included Justices J B Pardiwala and Manoj Misra, stated that this still did not explain the delayed filing of the FIR.

Referring the status report of the CBI, the CJI said “this doesn’t justify registration of your FIR at 11:45 at night, when the body was recovered soon after 9-9.30 am”.

The CJI further said, “What was the principal's role? The college principal should have immediately arrived on campus and ordered the filing of the FIR. Who was he in contact with? What were his connections? Why was he appointed as the principal of another college as soon as he resigned? What was the purpose? He is still under investigation."

Appearing for the CBI, Solicitor General Tushar Mehta said “our investigation itself is a challenge by itself because the scene of offence is altered”.

Sibal disagreed and said “nothing is altered, everything is videographed”.

Mehta replied and said, “Most shocking fact. The FIR is lodged after cremation, at 11.45 in the night. First, the parents are informed by the Deputy Superintendent that their daughter is not well. When they reach, they say she has committed suicide. Fortunately, the young doctors, the colleagues of the deceased, insisted that there should be videography. This is suggestive that even they were suspecting some cover-up.”

Sibal said, “This is entirely accusatory. I do not want to contradict my friend but the record will show what happened.”

The CJI too pointed out that only the postmortem was videographed.

The bench also inquired about the time at which the case of unnatural death was registered by the police. At one point, Justice Pardiwala said, “The entire procedure which your police have followed, it is something at least I have not come across in my 30 years…”.

Sibal asserted that the case of unnatural death was registered significantly earlier, on August 9 and that the confusion arose due to the terminology used by the police in the case diary.

Sibal said the protesters must follow the standard operating procedure and protest only in designated areas.

The CJI said, “We have not for a moment said that the provisions of law should not be compiled with. The only thing we said is stop arresting people who are protesting peacefully.”

He used to sell it to the people who were part of his additional security. It was then sent to Bangladesh," said the former deputy superintendent.

According to a report published by India Today, Akhtar Ali claimed that Ghosh took bribes from students to clear their&nbsp;examinations.

"Some students were deliberately made to fail. So that he could recover the money," he said and added that Ghosh&nbsp;also collected 20 per cent commission on each tender.

Ali said that he brought to the fore Ghosh's illegal activities in front of the state vigilance commission and as also part of the enquiry committee which was set up to investigate Ghosh.&nbsp;

"I have handed over to CBI all the documents given to me by the doctors of RG Kar Hospital...If before 23rd August a breakthrough is reached, then it is better as the arrested accused is presented before the court on that day, then the remand copy will indicate he was the lone culprit or not," said Ghosh.

A dental student has accused a doctor at the Postgraduate Institute of Medical Sciences in Rohtak of assaulting her, police said on Monday.

The police said the accused has been arrested after a case was registered.

Rohtak Police said an incident of assault on&nbsp;a BDS student at the PGIMS Rohtak campus was brought to their notice on Saturday night by PGIMS authorities, and acting swiftly on the information, senior police officers reached the medical institute and contacted the victim and her family.

In her complaint, the woman student alleged that on August 16, the accused kidnapped her from PGIMS, took her to Ambala and Chandigarh, and tortured and beat her, said police.

Police said an FIR was registered, and the accused was immediately arrested. The victim has been medically examined, and her statement has also been recorded before a judicial magistrate, they said.

Rohtak police said no evidence of sexual harassment has yet come to the fore in the girl's statement or during the investigation.

The accused doctor teaches anatomy at the medical college.

In a video, which she uploaded on social media, the victim showed injury marks as a result of the alleged assault.

She stated that she was a first-year student of BDS and alleged that she was tortured by the accused for seven months.

"He beats me, tortures me whenever I tell him that I don't want to be with him. He threatens that he will not mark my attendance in lectures and won't allow me to sit in exams," the woman student alleged in the video.

The accused is being interrogated thoroughly. An investigation is being done keeping every aspect in mind, Rohtak Deputy Superintendent of Police Virender Singh said in a statement.

He said that the BDS student complained about the assault on Saturday night.

"The police team and senior officers of PGIMS immediately reached the spot. The police immediately took cognisance of the matter, and an FIR was registered against the accused," he said.

"The girl appeared mentally unstable. There were no visible external injuries or bleeding, but we cannot confirm if there are any internal injuries. She was later sent to a welfare centre."

She underwent a medical examination and a report is awaited. Furthermore, the bus in which&nbsp;the heinous crime allegedly took place, plus another bus, have been sent to the Forensic Science Laboratory (FSL) for investigation.

SSP Singh told the press that a guard at a shop on platform number 1 of the bus terminus in Dehradun called 1098 after spotting the victim.

"The guard called 1098, but the girl did not tell her name and was only saying that she was from Patiala. She also said that she did not have parents. We were told that she seemed mentally disturbed," said SSP Singh.

During counselling, the girl told the police that she was from Moradabad, and was travelling from Delhi to Dehradun when the crime happened.

"The information about the place of incident is not clear, but she revealed that five people had raped her one by one," the police said.
