On Monday (13 May), 96 seats in nine states and one Union Territory (UT) voted in India's fourth round of the Lok Sabha elections. According to reports, some electors in Maharashtra's Pune, including the old and children, have claimed that they were unable to exercise their right to vote because their names were not on the voters' list. Air Chief Marshal Pradeep Vasant Naik, Air Force chief Air Chief, claimed that the name of his wife Madhubala was removed from the voters' list. He informed PTI that he, his wife, and their son went to polling booth 26 on Sampling School Baner Road in Pune to cast their votes. He told PTI, “My 72-year-old wife’s name was found deleted from the voters’ list. When we brought this to the attention of the official there, he said that there was nothing he could do to help.” “We had the necessary slips given by the local corporator with us when we reached the polling centre. But it was of no use as my wife’s name was not there on the list,” he said. Other Pune voters have also voiced concerns along these lines. Reports of names being omitted from the electoral list have surfaced before, though. However, why is this taking place? What causes the name of a voter to disappear from the electoral list? Here are the reasons behind name missing and what you should do if your name is missing. Why isn't your name on the voters' list? According to the Indian Express report, between 23 January and 15 April this year, 2.39 lakh names were added and 17,749 voters were removed from the electoral records by Pune election officials. This followed an exercise in October by the district election administration to rationalise voting stations. According to Indian Express, election officers stated that this was necessary due to the maximum number of votes that one electronic voting machine (EVM) can register. According to the Election Commission of India (ECI), a single EVM can hold up to 2,000 votes but is often certified to retain 1,500 votes. Also read: BJP's Madhavi Latha sparks row after her video of asking burqa-clad women to show face for ID check goes viral “Names have not been deleted. Instead, they might have been shifted from one booth to another. In case the voter is not able to find their names in the list – it would be advisable to check in the nearby booths. Deletion of names is an extreme exercise and is rarely done so,” an officer told Indian Express. Conditions for deleting names from voters' list The four conditions for deleting a name are death, a specific individual being missing, duplication, and transfers. If a voter's name appears twice or is not located during a door-to-door survey, the names are deleted. Before deleting names, a list of recommendations and complaints is saved for future reference. The purpose of this effort is to guarantee that every qualified voter may exercise their right and to sanitise the list. What can you do if your name is deleted from the voters' list? You cannot vote in this year's Lok Sabha Elections if your name has been deleted but you can fill Form 8 and immediately register for the Vidhan Sabha elections to be held later this year.

Lost in the polls: Excluded from the voters’ list? What to do when your name vanishes?

Following a night of interrogation, a 64-year-old businessman challenged his arrest by the central agency during odd hours. The Supreme Court demanded the Enforcement Directorate's (ED) answer to his plea. The petitioner was also granted permission to move the vacation benches for bail by a bench consisting of Justices Hrishikesh Roy and Prashant Kumar Mishra. "Give notice, with a three-week return period. Dasti notice on the Standing Counsel through the Central Agency Section, in addition," the order said. A 64-year-old businessman named Ram Issrani filed a plea with the court accusing the ED of unlawfully detaining him in connection with an alleged bank fraud case. He stated that he was forced to wait in the ED's office on August 7 and 8, 2018, following that from 10:30 pm to 3:00 am, his statement was recorded. He said that he was kept awake for 20 hours in all and that he was detained on August 8 at 5:30 am. The Bombay High Court declined to invalidate the arrest and remand, leading to the instant appeal. Also read: What is the Enforcement Directorate? What are its recent high profile cases? Though the High Court refused to overturn the arrest, it did object to the central agency recording testimonies of witnesses and accused at unusual hours, which resulted in sleep deprivation. The Court had instructed the ED to publish a circular or instructions about when to record statements after a summons for interrogation is sent out. It reaffirmed that, because it was considered a judicial procedure, an investigation conducted by ED personnel was conducted on a different basis than an inquiry conducted in accordance with the Code of Criminal Procedure. It was brought up before the Supreme Court that the petitioner was not brought before a magistrate right away after being taken into custody. Senior Advocate Kapil Sibal, together with Advocates Vijay Agarwal, Mahesh Agarwal, Ankur Saigal, Kajal Dalal, and EC Agrawala, represented the businessman before the Supreme Court. The Enforcement Directorate (ED) on Friday filed a new chargesheet in the Delhi excise policy case, listing K Kavitha, the leader of Bharat Rashtra Samithi (BRS) and the daughter of former Telangana chief minister K Chandrasekhar Rao, among other alleged associates.

A former chief engineer of the Jharkhand rural development department, Virendra Ram, was arrested in February 2023 on suspicion of amassing wealth of over ₹100 crore ($11.97mn). ED informed a Ranchi court that a portion of the commission he allegedly earned was given to prominent bureaucrats and politicians.

“Ram played a pivotal role in managing tenders and allocation of work to private entities and the percentage of commission is distributed in a mechanised manner to higher-ups of government, including highly placed bureaucrats and politicians. Further, during [the] investigation, names of senior bureaucrats and politicians have emerged which is being investigated by ED,” the agency said in its remand note in February 2023.

Pratul Shahdeo, Bharatiya Janata Party’s Jharkhand spokesperson, had said on Monday, “Earlier ₹350 ($41.9mn) crore was recovered from Congress’s Rajya Sabha member Dheeraj Sahay, ₹20 crore ($2.39mn) from the mines secretary. Now recovery of ₹25 crore ($2.99mn) has been made from the servant of the minister’s OSD [officer on special duty]. It is a matter of probing from where the servant, who hardly gets ₹30000 monthly, got such a huge amount. I think it was black money kept to spend during the election.”

Alam has refuted any wrongdoing. He said that Lal, a government employee, had served as secretary to two former&nbsp;ministers&nbsp;also. “There are several government employees and we usually appoint personal secretaries based on experience. It is not right to comment on the raids before ED’s investigation is completed,” he added.

Congress leader Rahul Gandhi became&nbsp;the target of a complaint for filing&nbsp;his nomination from Uttar Pradesh's&nbsp;Rae Bareli constituency. The nationality of Rahul Gandhi&nbsp;and his recent conviction for defamation are&nbsp;questioned in the complaint.

<h2>Who filed the complaint against Rahul Gandhi's Rae Bareli nomination?</h2>

Advocate Ashok Pandey filed the complaint on behalf of Anirudh Pratap Singh. The attorney filed a complaint against Gandhi with the Rae Bareli Returning Officer, seeking the annulment of the Congress leader's candidacy on two grounds: his nationality and his conviction.

“First, Rahul Gandhi has been convicted for two years... He is ineligible to contest elections. Even though the Supreme Court has put a stay on Rahul Gandhi's conviction, it has not given any verdict like Afzal Ansari saying he can contest again... Since his stay on conviction does not involve permission to contest elections he should&nbsp;back off,” Pandey told ANI.

Janata Dal (Secular) MLA H D Revanna was booked on Thursday (May 3) by police for kidnapping an alleged victim of sexual abuse&nbsp;by his son&nbsp;Prajwal Revanna, who is the MP of Hassan and the candidate of the BJP-led NDA in this Lok Sabha election.

The politician was booked after a 20-year-old man filed a police complaint alleging that Revanna’s associate abducted his mother, who was among the many women featured in the alleged sex tapes of Revanna’s son, JD(S) MP Prajwal.

The police filed charges against Revanna and Satish Babanna, a resident of Krishnarajanagara taluk in Mysore district, under various sections of the Indian Penal Code, including those related to kidnapping.&nbsp;H D Revanna applied for anticipatory bail in the sexual harassment case just hours after the FIR was filed.

The incident, detailed in the first information report (FIR), happened on April 29. The woman had previously worked at Revanna’s residence and farmhouse in Holenarasipura for six years before quitting three years ago to work as a daily wager in her hometown.

<h2>What does the FIR say?</h2>

According to the FIR, a few days before the first phase of the Lok Sabha elections in Karnataka on April 26, Babanna visited the woman's residence and claimed that Revanna’s wife Bhavani required her assistance for some tasks.&nbsp;

Later, Babanna allegedly cautioned the family not to involve the police if they came to their residence and threatened them with legal action. On April 29, around 9 am, Babanna returned, warning the family that the woman would be implicated in a case if caught by the police. He then took her with him, stating that Revanna had summoned her, as detailed by the woman’s son in the FIR.

“While I was looking for my mother, on May 1, a couple of my friends asked about my mother featured in the alleged sex tapes of Prajwal. I called Satish over the phone to check the whereabouts of my mother and he said that a case had been registered against her and she had to get bail”,&nbsp;the FIR read.

Earlier, Prajwal was accused of sexually assaulting his house help and has fled the country. The state government has formed a Special Investigation Team (SIT) to investigate the matter. Explicit videos, reportedly featuring the 33-year-old MP began to circulate in Hassan recently.

According to the FIR, a few days before the first phase of the Lok Sabha elections in Karnataka on April 26, Babanna visited the woman's residence and claimed that Revanna’s wife Bhavani required her assistance for some tasks. I called Satish over the phone to check the whereabouts of my mother and he said that a case had been registered against her and she had to get bail”, the FIR read. Earlier, Prajwal was accused of sexually assaulting his house help and has fled the country. The state government has formed a Special Investigation Team (SIT) to investigate the matter. Explicit videos, reportedly featuring the 33-year-old MP began to circulate in Hassan recently.

In a significant ruling, the Supreme Court of India has laid down the essentials for a Hindu marriage to be legal under the Hindu Marriage Act of 1955.&nbsp;

As per a ruling made by the top court on April 19 (Friday), a Hindu marriage must be performed with traditional rites and ceremonies, such as 'saptapadi' (seven steps around the sacred fire commonly known as 'saath phera') for it to be valid.

"Where a Hindu marriage is not performed in accordance with the applicable rites or ceremonies such as saptapadi when included, the marriage will not be construed as a Hindu marriage," the court said.&nbsp;

<h2>Evidence of marriage</h2>

The bench said that evidence of these rituals is essential in case of any disputes.

"For a valid marriage under the Act, the requisite ceremonies have to be performed and there must be proof of performance of the said ceremony when an issue/controversy arise. Unless the parties have undergone such ceremony, there would be no Hindu marriage according to Section 7 of the Act and a mere issuance of a certificate by an entity in the absence of the requisite ceremonies having been performed, would neither confirm any marital status to the parties nor establish a marriage under Hindu law."

A bench of justices B.V. Nagarathna and Augustine George Masih also observed that registration of a Hindu marriage under Section 8 of the Hindu Marriage Act facilitates proof of the marriage.

However, they said it does not confer legitimacy if the marriage was not solemnised according to Section 7 of the Act, which specifies the requirements for a valid Hindu marriage ceremony.

"A certificate of marriage is a proof of validity of Hindu marriage only when such a marriage has taken place and not in a case where there is no marriage ceremony performed at all," said the court.

<h2>Hindu Marriage is sacred, not an event for 'song-dance, wining-dining'</h2>

These observations were made as India's highest court decided on a petition filed by a wife seeking transfer of divorce proceedings against her.

While the case was ongoing, the couple came to a mutual understanding, filing a joint application seeking a declaration that their marriage was invalid.

They contended that no marriage ceremony took place, as they did not observe any customs, rites, or rituals.

They also said that, due to "certain exigencies and pressures", they had to obtain a certificate of solemnisation from Vadik Jankalyan Samiti (Regd.).

Based on this, they had then sought registration under the Uttar Pradesh Registration Rule, 2017 and a "Certificate of Marriage" was issued by the Registrar of Marriages.

The top court, after noting that the marriage was not solemnised, declared that there was no valid marriage.

"A Hindu marriage is a samskara [culture] and a sacrament which has to be accorded its status as an institution of great value in Indian society. Therefore, we urge young men and women to think deeply about the institution of marriage even before they enter upon it and as to how sacred the said institution is, in Indian society."

"A marriage is not an event for 'song and dance' and 'wining and dining' or an occasion to demand and exchange dowry and gifts by undue pressure leading to possible initiation of criminal proceedings thereafter," said the court.

In a conversation with WION, Neha Sonawane lawyer, founder - Vaakya&nbsp;Legal said, "Practice of Hinduism is not uniform and the customs differ as per caste culture, etc. On the one hand, we want uniformity in marriage laws for the protection of women and, on the other hand, reducing the importance of registration is counterproductive."

Sonawane argued that marriage registration "is the only step in Hindu law which could be said to be a commonality across castes, cultures etc. Registration of marriages not only serves as a better proof of marriage but also helps in controlling child marriage, and polygamy — marriages where the person married a second time without divorcing their first partner. It's essentially a constructive notice&nbsp;to&nbsp;the&nbsp;world."

"Having said that, the judgment is absolutely correct in noting that marriage is an important step and shouldn't be&nbsp;entered&nbsp;lightly," she concluded.&nbsp;

Last year, shocking images of the stripping and parading of two women in the eastern India state of Manipur came out and horrified the nation. Now, the chargesheet submitted by the Central Bureau of Investigation (CBI) about the incident has come out. The Indian Express reported on Tuesday (Apr 30), citing the chargesheet filed by the Central Bureau of Investigation (CBI), that before a crowd paraded the two women from the Kuki-Zomi group naked and assaulted them, they had sought refuge inside a police Gypsy parked beside the road. However, when they asked the police driver to start the vehicle, he stated there was "no key". Two other male victims were also in the police Gypsy. According to the chargesheet, all of the police officers present left from the spot as the mob pulled out the victims from the vehicle. According to the CBI investigation, the incident happened in Churachandpur on May 3. In October, a chargesheet was filed against six people and a juvenile at Guwahati's special court. The two ladies, one in her 20s and the other in her 40s were forced to walk nude towards a field by a group of men in a video that went viral in July. Two policemen along with a driver dressed in plain khaki uniform, were with them inside the police gypsy, and three to four policemen were outside. One male victim requested the policemen to start the vehicle, however, the driver of the police Gypsy replied, ‘there is no key’. They kept on begging the policemen repeatedly to help them and save a man being assaulted by the mob, but the ‘police did not help them’,” the CBI chargesheet reads. “…The driver of Gypsy suddenly drove and stopped the vehicle near the violent mob of around 1,000 people, and the male victim again requested the police to start the vehicle, but he was asked to keep silent. After some time, one police personnel came and told his colleagues that the man had stopped breathing. On hearing this, the male victim told the woman victim that his father was beaten to death,” it said. The CBI had opened a case in response to the Manipur government's request and the Centre's notice. The accused have been charged with multiple sections of the Indian Penal Code, including gangrape, murder, outraging the modesty of a woman, and criminal conspiracy. All the accused, Huirem Herodash Meitei (32), Arun Khundongbam alias Nanao (31), Ningombam Tomba Singh alias Tomthin (18), Pukhrihongbam Suranjoy Meitei (24), Nameirakpam Kiram Meitei (30), and a juvenile were apprehended by Manipur police, according to the chargesheet.

Doctors in the Indian state of West Bengal successfully performed surgery to remove the screw of a woman’s nose pin that had lodged into her lungs. The 35-year-old victim, Varsha, had accidentally inhaled the screw of her nose pin that she had been wearing since her wedding "16-17 years back". She said she was just talking when she "took a deep breath and inhaled it" around two months back. In March, Varsha had to consult a doctor after experiencing difficulty breathing, a cough and pneumonia. Later, a CT scan confirmed that the cause of the difficulty was a screw that had stuck in her lungs. A subsequent X-ray further confirmed its exact location. Also read: Experts say it is not necessary to take bath everyday Dr Debraj Jash, a pulmonologist at Kolkata's Medica Superspecialty Hospital, performed the surgery and removed the screw, in what he called an “extremely rare case”. "Sometimes we get cases where dry fruits or betel nuts have gone into people's lungs, but most such cases involve young children or elderly people above 80. A woman patient in her 30s is an exception," the doctor was quoted as saying by BBC. Before Jash, Varsha had approached another pulmonologist to seek relief but they failed to remove the screw even after sending a fibreoptic bronchoscope, a tiny camera with forceps, down her airway. She was worried about undergoing a second procedure so soon after the first one, but we explained to her that the human body is designed in such a way that there's no place in it for a foreign object," Dr Jash said. The surgery went on for 30 minutes, and it proved to be challenging because the screw "had been in her lung for more than two weeks and tissues had already grown around it". "We had to be very careful because if, during extraction, the screw came in contact with the airway - which is very narrow - it could cause injury and lead to bleeding which could cause a catastrophe," the doctor added.
