WUC accuses China of genocide, forced labour and repression against Uyghurs at global forums

Swiss-Indian industrialist Pankaj Oswal has filed an urgent appeal with the United Nations seeking intervention for alleged illegal detention of his 26-year-old daughter in Uganda.

Oswal has claimed his daughter is denied basic rights and has been detained without trial in the East African country since October 1.

According to reports, Vasundhara Oswal was taken from Oswal's Extra-Neutral Alcohol (ENA) plant in Uganda by around 20 armed men, who did not show any identification or warrant. She was detained in a missing man’s case.&nbsp;

Oswal has reportedly&nbsp;filed an appeal with the United Nations Working Group on Arbitrary Detention (WGAD) on October 11. WGAD is an international human rights body appointed by the Human Rights Council to investigate and intervene in cases of misuse of police powers.

An Instagram post shared on Vasundhara’s handle described her “unlawful detainment and arrest.” The post showed an image of a toilet with blood and faeces on the floor. She was denied basic necessities including clean water and food and was not allowed to bathe or even change her clothes for nearly five days. She was forced to sit in a room full of shoes and given a small bench to sleep on.

According to the EU Reporter, Vasundhara was also denied vegetarian food and was not allowed to make contact with her family for days. Additionally, she was moved between multiple prisons to make it difficult for her family and lawyers to meet with her.

Several co-workers of Vasundhara have also been detained, including the company’s legal representative, Rita Ngabire.

Vasundhara’s brother described her as a “workaholic” who expanded the ENA plant in Uganda's Luwero from “a small tent on a bare land in 2021” to a $110 million factory. He claimed her detention was due to corporate jealousy of a 68-year-old man and accused him&nbsp;of extortion and ruining her reputation.

Despite a court order, Vasundhara was not released by the authorities, her brother said. According to reports, was taken to a lookalike court and charged with murder.

“This is every mother’s nightmare. My young daughter has been thrown into a foreign jail. She has been stripped of her basic human rights and her dignity. Vasundhara is an innocent bystander. All I want is her safety, and for her to be back in my arms,” Vasundhara’s mother said in an appeal to the Ugandan government.

However, there is a possibility of the draft being defeated even before it reaches the discussion table, as China has already mobilised its allies.

On Tuesday, the Chinese ambassador in Geneva issued a statement, backed by 30 countries, accusing the UN rights office of acting without a mandate and warning of the exaggeration of “an existing trend to western polarisation and politicisation of human rights”.

Chinese ambassador Chen Xu said that any resolution is condemned to defeat.

The HRC has 47 member states, and according to the Guardian, only eight of the 30 signatories to the Chinese missive are the voting members.

Experts believe that a call for an independent probe may not see the light of the day as around 14 would be backing the draft, while roughly 15 to 18 nations supporting China’s stance.

The latest maneuverer by the Western leaders follows a report published by the outgoing UN human rights commissioner, Michelle Bachelet, on her last day in office– 31 August – saying that there was clear evidence of crimes against humanity committed by China during its suppression of Uyghur Muslims in Xinjiang province.

This is for the first time that the UN came out with such a report making allegations against China.

The report claimed to have found evidence of systemic discrimination, mass arbitrary detention, torture, and sexual and gender-based violence.

Among other issues that were discussed in the meeting were the root causes of recruitment and forced conscription of children in conflicts in Africa and in Asia principally in the Sahel region, in the east of the Democratic Republic of the Congo, Central African Republic, Mali, Somalia, in Afghanistan, in Syria, in Iraq, in Yemen, and in Ukraine.

They requested the strengthening of monitoring mechanisms and encouraged the development of networks of civil society organizations in the area of advocacy for the cause of children.

A decision to submit a written communication at the 51st session of the Human Rights Council, in view of sensitizing the Member States of the Council to integrate the issue of the protection of children in the Council`s debates.&nbsp;

Explaining the move, announced on Monday, U.S. Ambassador to the United Nations Linda Thomas-Greenfield told Reuters: "It is important to say (to&nbsp;Russia) 'we're not going to allow you to continue to act with such impunity and pretend that you respect&nbsp;human&nbsp;rights'."

Blinken said the United States still recognised the rights council is a "flawed body, in need of reform to its agenda, membership, and focus, including its disproportionate focus on Israel."

But, he stressed, "our withdrawal in June 2018 did nothing to encourage meaningful change, but instead created a vacuum of US leadership, which countries with authoritarian agendas have used to their advantage."

"To address the council's deficiencies and ensure it lives up to its mandate, the United States must be at the table using the full weight of our diplomatic leadership. It is our view that the best way to improve the council is to engage with it and its members in a principled fashion," he said.

"We strongly believe that when the United States engages constructively with the council, in concert with our allies and friends, positive change is within reach."

Calling Pakistan a "breeding ground" for terrorism, Secretary-General of Baloch Human Rights Council, Samad Baloch, on Wednesday said <a href="https://www.wionews.com/south-asia/pakistan-approaches-international-community-over-kashmir-but-commits-genocide-in-balochistan-baloch-leader-248933">Pakistan is committing "systematic genocide"</a> of the minorities.

He also termed Islamabad a "rogue state" with no law and justice.

This comes at the time when the Pakistan government has submitted a dossier in UNHRC over Kashmir.

"While a very comprehensive normative framework of human rights treaties and Covenants has evolved, the work of the Human Rights Council and its associated procedures and mandates is, regrettably, getting more contentious and difficult," Lal said at the UN General Assembly session on Report of the Human Rights Council Friday.

He said more broadly, the global situation today is a troubled one, with growing concerns about the multiple challenges posed to the spirit of multilateralism due to ineffectiveness of the global governance mechanisms to find commonly acceptable solutions.

"The reasons for many of the difficulties surrounding the discussions on the human rights agenda are not hard to find. They flow from the often very divergent priorities and concerns of member states in terms of their levels of development, social and cultural contexts and governance systems," he said.

Lal noted that while the global discourse on human rights continues to evolve, fundamental contradictions remain. The relative prioritisation of the individual versus State, national sovereignty versus international norms and universal versus culture-specific approach, all evoke differing opinions.

"Constraints on national capacities to implement certain rights, instances of politicisation of human rights as a foreign policy tool, and perceived intrusiveness beyond mandated activities remain areas of concern," he said.

He further said while the work of the Human Rights Council continues to expand with growing number of resolutions and decisions, greater frequency of meetings and special sessions, the effectiveness of its work is, however, not always clear.&nbsp;

"There is also a proliferation of special procedures both on thematic and country-specific situations. Their effectiveness is also constrained by lack of, and opacity of funding, lack of a balanced representation in staffing, mistrust on some of them clearly exceeding their mandates and politicising their approach. Country-specific procedures have largely been counter-productive," he said.

"Instances of such mechanisms and offices operating on their own without any mandate and producing clearly biased documents only further harm the credibility of United Nations??," Lal said.

In June this year, India had rejected then Human Rights High Commissioner Zeid Ra'ad Al Hussein's report on Kashmir in which he had called for an independent international probe into the human rights situation in Kashmir.&nbsp;

Lal had said then that the "so-called" report reflects the "clear bias of an official who was acting without any mandate whatsoever and relied on unverified sources of information."&nbsp;

Lal had said the report "was not even found fit to be considered by the membership of the forum where it was submitted."

At the Friday session, Lal pointed out that the palette of human rights ranges from individual to collective on one hand, and from civil and political, to economic and social and cultural rights to the right to development on the other.&nbsp;

"Agreement on not only the prioritisation and the interpretation of various rights but on the best way to promote and protect human rights, including in situations of possible gross and systematic violations, often remains elusive, especially if it clashes with the idea of sovereignty of nation states," he said.

Describing terrorism as one of the worst forms of violation of human rights, Lal said India has had to face repeated terrorist attacks on innocent people, emanating from beyond its borders, thinly veiled reference to Pakistan.&nbsp;

He said despite terrorism being acknowledged as one of the foremost global challenges, any meaningful collective response to address this menace continues to be thwarted by some.

He stressed that the human rights agenda must be pursued in a fair and equal manner with objectivity, respect for national sovereignty and territorial integrity, non-interference in the internal affairs of States, non-selectivity and transparency.

"For the success of our collective and common cause or promoting and protecting human rights, our emphasis at the Human Rights Council and Treaty bodies, and Special Procedures and the OHCHR ?should not be confrontational but instead focus on achieving the desired results from a more inclusive, participatory and positive approach through dialogue and capacity building," he said.

Aziz Baloch, a Free Balochistan movement activist in Canada, said that Pakistan army has been conducting an internal displacement throughout Balochistan for many years.

He further claimed that Islamabad has forcefully abducted 20,000 Baloch people till now.

"Even after seven decades of its forceful occupation, Pakistan has failed to provide even basic facilities such as primary education, healthcare and potable water to the people of the resource-rich province of Balochistan," he added.

Aziz further called the much-vouched China-Pakistan Economic Corridor (CPEC) as a 'satanic coalition'&nbsp;between the two countries."The China- Pakistan Economic Corridor (CPEC), which is constantly touted as the economic game changer by Islamabad administration has only added to the woes of the people of the region," said Aziz.

Further, President of the Canada-based World Baloch Women's Forum Professor Naela Quadri Baloch said, "Pakistan has sold Balochistan to China.

"The Chinese Navy and other forces are coming to Balochistan because Pakistan is no more able to keep us, slaves," Naela Quadri said.

The Baloch activists have been trying to voice their concerns at multiple international platforms, including the United Nations.

Recently, at the 37th session of the Human Rights Council, activists raised the issue of enforced disappearances, torture and killings of several Baloch activists and intellectuals.

A Pakistan journalist, named Taha Siddiqui, said that the Islamabad government has been neglecting the instances of abduction of the Baloch natives for many years.

"There is a camp for missing Baloch persons outside the Islamabad Press Club that is going on for many years now. And, it does not get any coverage in local media. There are women and children sitting with photos of their loved ones who have been missing for months, years and even at times for decades. And, there is no end to their misery," Siddiqui said.

Siddiqui, in a March 28 interview, had informed that March 27 is observed as 'Black Day'&nbsp;as on that day Pakistan attacked the province in 1948 and illegally occupied it with internationally recognised borders and a legal system of governance.

A large number of people in Balochistan are internally displaced whereas many have taken exile in other countries.

The situation is deteriorating as the Pakistan army and its intelligence agency are on a rampage to eliminate the identity of indigenous Baloch people.

European parliamentarian, experts lambast Pakistan for sheltering terrorists

It took a long time, but on Thursday Australia became the 26th country to achieve marriage equality.

The LGBTI community is euphoric and relieved with this hard-fought victory. But there is also trauma from the drawn-out postal survey campaign, which saw attacks on rainbow families and communities. It left many feeling vulnerable and distressed. In some cases, it brought back painful memories of the bullying and abuse they were subjected to in their adolescence.

But once the celebrations from Australia achieving marriage equality have subsided, the fight for LGBTI people to live lives free from discrimination will continue.

A long way to go

The focus recently has, understandably, been on achieving marriage equality. However, it&rsquo;s important to recognise that this accomplishment does not mean that LGBTI people enjoy all of the same human rights as heterosexual people.

Australian law has not yet caught up with the reality of modern families. Children in LGBTI families may have more than two parents: a lesbian couple may have a child with the assistance of a gay couple, for instance, and all four parents may be actively involved in raising the child.

In contrast to Canada, which allows birth certificates to record up to four parents, Australia allows only two parents to be recorded. This means that this pivotal identity document may not accurately reflect a child&rsquo;s family structure.

Another issue that can now receive greater attention is the ongoing use of conversion therapies to &ldquo;cure&rdquo; a person&rsquo;s same-sex attraction. These harmful practices appear to have gone underground but are actually more prevalent in Australia than ever before.

Conversion therapies have been condemned by the medical profession as harmful and ineffective, and by the UN as a breach of human rights. Nevertheless, they continue in Australia.

In 2016, the Victorian government established a commissioner to investigate and ban unregistered health practitioners who claim to be able to convert same-sex-attracted people. However, the Health Complaints Commissioner does not have the power to examine faith-based organisations engaging in such practices, which limits this initiative&rsquo;s effectiveness.

In the US, however, several states and cities have enacted legislation to ban conversion therapy &ndash; either for minors or, in the case of New York City, for adults as well.

Additionally, a case in the state of New Jersey against a Jewish counselling group culminated in a decision that the group had committed consumer fraud when it promised to change a person&rsquo;s same-sex attraction into opposite-sex attraction and was held liable to pay damages.

Given the attempts to embed discrimination against LGBTI people in the marriage equality legislation under the guise of religious freedom, and the government&rsquo;s review into whether Australian law adequately protects religious freedom, now may not be the best time to advocate for the removal of religious exemptions from federal, state and territory anti-discrimination legislation.

As it stands, religious bodies are allowed to discriminate against a person on the basis of their sexual orientation. The impact of such exemptions was recently illustrated when a teacher at a Baptist school in Western Australia was lawfully sacked for being gay.

Another issue that has received little attention is the ongoing practice of subjecting intersex infants to surgical or hormonal interventions to &ldquo;fix&rdquo; their sex to appear male or female. Advocates are calling for such medical interventions to be banned unless it is freely given and fully informed consent.

Advocacy on the world stage

Australia achieving marriage equality will also help improve our human rights reputation on the international stage &ndash; which is in desperate need of help.

At its UN Human Rights Council periodic review in 2016, several countries recommended that Australia amend its laws to allow same-sex couples to marry.

Australia should also lend its support to persecuted LGBTI people in other parts of the world. This includes in the Asia-Pacific region, where 19 countries criminalise homosexuality. As Martin Luther King said: Injustice anywhere is a threat to justice everywhere.

We should celebrate and enjoy the fact that Australia finally has marriage equality. But it is by no means the end of the road when it comes to the law reform necessary to enable LGBTI people to enjoy lives of dignity and equality.

Birth certificates that accurately reflect a child&rsquo;s family, ban on conversion therapies, removal of religious exemptions from anti-discrimination legislation, and prohibitions on surgeries to &ldquo;normalise&rdquo; an intersex infant&rsquo;s genitalia are just some of the issues that need to be fixed before Australia&rsquo;s LGBTI community can fully enjoy their human rights.

Australia legalising marriage equality does not necessarily mean LGBTI people enjoy all of the same human rights as heterosexual people

It took a long time, but on Thursday Australia became the 26th country to achieve marriage equality. The LGBTI community is euphoric and relieved with this hard-fought victory. But there is also trauma from the drawn-out postal survey campaign, which saw attacks on rainbow families and communities. It left many feeling vulnerable and distressed. In some cases, it brought back painful memories of the bullying and abuse they were subjected to in their adolescence. But once the celebrations from Australia achieving marriage equality have subsided, the fight for LGBTI people to live lives free from discrimination will continue. Watch: Marriage equality has passed, so what’s next? × A long way to go The focus recently has, understandably, been on achieving marriage equality. However, it’s important to recognise that this accomplishment does not mean that LGBTI people enjoy all of the same human rights as heterosexual people. Australian law has not yet caught up with the reality of modern families. Children in LGBTI families may have more than two parents: a lesbian couple may have a child with the assistance of a gay couple, for instance, and all four parents may be actively involved in raising the child. In contrast to Canada, which allows birth certificates to record up to four parents, Australia allows only two parents to be recorded. This means that this pivotal identity document may not accurately reflect a child’s family structure. Another issue that can now receive greater attention is the ongoing use of conversion therapies to “cure” a person’s same-sex attraction. These harmful practices appear to have gone underground but are actually more prevalent in Australia than ever before. Conversion therapies have been condemned by the medical profession as harmful and ineffective, and by the UN as a breach of human rights. Nevertheless, they continue in Australia. In 2016, the Victorian government established a commissioner to investigate and ban unregistered health practitioners who claim to be able to convert same-sex-attracted people. However, the Health Complaints Commissioner does not have the power to examine faith-based organisations engaging in such practices, which limits this initiative’s effectiveness. In the US, however, several states and cities have enacted legislation to ban conversion therapy – either for minors or, in the case of New York City, for adults as well. Additionally, a case in the state of New Jersey against a Jewish counselling group culminated in a decision that the group had committed consumer fraud when it promised to change a person’s same-sex attraction into opposite-sex attraction and was held liable to pay damages. Given the attempts to embed discrimination against LGBTI people in the marriage equality legislation under the guise of religious freedom, and the government’s review into whether Australian law adequately protects religious freedom, now may not be the best time to advocate for the removal of religious exemptions from federal, state and territory anti-discrimination legislation. As it stands, religious bodies are allowed to discriminate against a person on the basis of their sexual orientation. The impact of such exemptions was recently illustrated when a teacher at a Baptist school in Western Australia was lawfully sacked for being gay. Another issue that has received little attention is the ongoing practice of subjecting intersex infants to surgical or hormonal interventions to “fix” their sex to appear male or female. Advocates are calling for such medical interventions to be banned unless it is freely given and fully informed consent. Advocacy on the world stage Australia achieving marriage equality will also help improve our human rights reputation on the international stage – which is in desperate need of help. At its UN Human Rights Council periodic review in 2016, several countries recommended that Australia amend its laws to allow same-sex couples to marry. Australia should also lend its support to persecuted LGBTI people in other parts of the world. This includes in the Asia-Pacific region, where 19 countries criminalise homosexuality. As Martin Luther King said: Injustice anywhere is a threat to justice everywhere. We should celebrate and enjoy the fact that Australia finally has marriage equality.
